(1) The division or a peace officer acting in his official capacity may take possession of any certificate of title, registration card, decal, permit, license certificate, permit, registration plate, or any other article issued by the state:

Terms Used In Utah Code 53-3-226

  • Division: means the Driver License Division of the department created in Section 53-3-103. See Utah Code 53-3-102
  • License: means the privilege to drive a motor vehicle. See Utah Code 53-3-102
  • Peace officer: means any officer certified in accordance with Title 53, Chapter 13, Peace Officer Classifications. See Utah Code 53-1-102
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) that is fictitious or altered;
     (1)(b) that has been unlawfully or erroneously issued;
     (1)(c) that is unlawfully or erroneously displayed; or
     (1)(d) as required under Section 41-6a-520, 53-3-223, 53-3-231, or 53-3-418.
(2) A receipt shall be issued that describes each confiscated item.
