Terms Used In Utah Code 53F-5-503

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Review committee: means the committee established under Section 53F-5-502. See Utah Code 53F-5-501
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) The state board shall, subject to legislative appropriations, award a planning grant to an LEA:

          (1)(a)(i) that submits a planning grant application that meets the requirements established by the state board, subject to Subsection (2);
          (1)(a)(ii) if an LEA designee has attended the technical assistance training described in Section 53F-5-502; and
          (1)(a)(iii) if the LEA planning grant application has been recommended by the review committee.
     (1)(b) An LEA that receives a grant under Subsection (1)(a) shall expend the grant funds no later than one calendar year after receiving the funds.

     (2)(a) A planning grant application shall include evidence that the LEA:

          (2)(a)(i) can provide a general description of the program the LEA would like to plan;
          (2)(a)(ii) is intending to plan for:

               (2)(a)(ii)(A) schoolwide implementation; or
               (2)(a)(ii)(B) if the LEA intends to implement initially with a population smaller than schoolwide, phasing the plan in schoolwide or districtwide over a specified period of time;
          (2)(a)(iii) can describe the types of partners that will help with the plan and, eventually, implement the program;
          (2)(a)(iv) planning activities and program will focus on:

               (2)(a)(iv)(A) implementation of the core principles described in Section 53F-5-502;
               (2)(a)(iv)(B) use of the methods, as applicable, described in Section 53F-5-502; and
               (2)(a)(iv)(C) the outcome-based measures adopted by the state board under Section 53F-5-502;
          (2)(a)(v) has:

               (2)(a)(v)(A) the capacity, qualifications, local governing body support, and time to successfully plan the program; and
               (2)(a)(v)(B) an intentional and feasible planning process;
          (2)(a)(vi) will align the LEA’s budget as necessary with the planning process; and
          (2)(a)(vii) will communicate and promote the plan with parents, teachers, and members of the community.
     (2)(b) The state board may adopt other requirements in addition to the requirements in Subsection (2)(a).
