As used in this chapter:

(1) “Common interest community” means the same as that term is defined in Section 57-25-102.

Terms Used In Utah Code 57-30-101

  • Common interest community: means the same as that term is defined in Section 57-25-102. See Utah Code 57-30-101
  • Contract: A legal written agreement that becomes binding when signed.
  • Document: means every instrument in writing, including every conveyance, affecting, purporting to affect, describing, or otherwise concerning any right, title, or interest in real property, except wills and leases for a term not exceeding one year. See Utah Code 57-1-1
  • Land: includes :
         (18)(a) land;
         (18)(b) a tenement;
         (18)(c) a hereditament;
         (18)(d) a water right;
         (18)(e) a possessory right; and
         (18)(f) a claim. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • real property: includes :
         (31)(a) land;
         (31)(b) a tenement;
         (31)(c) a hereditament;
         (31)(d) a water right;
         (31)(e) a possessory right; and
         (31)(f) a claim. See Utah Code 68-3-12.5
  • Record: means to submit a document to a county recorder for official placement in a public land record. See Utah Code 57-30-101
  • Residential real estate: means real property located in the state that is:
         (5)(a) used primarily for a personal, family, or household purpose; and
         (5)(b) contains fewer than five dwelling units. See Utah Code 57-30-101
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) “Home warranty service contract” means the same as that term is defined in Section 31A-6a-101.
(3) “Record” means to submit a document to a county recorder for official placement in a public land record.
(4)

     (4)(a) “Residential property service agreement” means, except as provided in Subsection (4)(b), an agreement to provide services in connection with:

          (4)(a)(i) the purchase or sale of residential real estate; or
          (4)(a)(ii) the maintenance of residential real estate in preparation for purchase or sale.
     (4)(b) “Residential property service agreement” does not include:

          (4)(b)(i) a home warranty service agreement;
          (4)(b)(ii) an insurance contract;
          (4)(b)(iii) an agreement for an option to purchase or right of refusal;
          (4)(b)(iv) a maintenance or repair agreement between an owner of real property within a common interest community and a homeowners’ association or other similar organization; or
          (4)(b)(v) an agreement to provide Internet or utility equipment or services.
(5) “Residential real estate” means real property located in the state that is:

     (5)(a) used primarily for a personal, family, or household purpose; and
     (5)(b) contains fewer than five dwelling units.
