(1) There is created the Board of Nursing that consists of the following 11 members:

- Adjudicative proceeding: means :(2)(a) an action by a board, commission, department, officer, or other administrative unit of the state that determines the legal rights, duties, privileges, immunities, or other legal interests of one or more identifiable persons, including an action to grant, deny, revoke, suspend, modify, annul, withdraw, or amend an authority, right, or license; and(2)(b) judicial review of an action described in Subsection (2)(a). See Utah Code 68-3-12.5
- Board: means the Board of Nursing created in Section 58-31b-201. See Utah Code 58-31b-102
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Division: means the Division of Professional Licensing created in Section
58-1-103 . See Utah Code 58-1-102- Licensee: means an individual who is licensed or certified under this chapter. See Utah Code 58-31b-102
- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
- Unprofessional conduct: means the same as that term is defined in Sections 58-1-501 and 58-31b-502 and as may be further defined by division rule made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act. See Utah Code 58-31b-102
(1)(a) nine nurses in a manner as may be further defined in division rule; and(1)(b) two members of the public.(2) The board shall be appointed and serve in accordance with Section 58-1-201.(3) The board shall carry out the duties and responsibilities in Sections 58-1-202 and 58-1-203 and shall:(3)(a)(3)(a)(i) recommend to the division minimum standards for educational programs qualifying a person for licensure or certification under this chapter;(3)(a)(ii) recommend to the division denial, approval, or withdrawal of approval regarding educational programs that meet or fail to meet the established minimum standards; and(3)(a)(iii) designate one of its members on a permanent or rotating basis to:(3)(a)(iii)(A) assist the division in reviewing complaints concerning the unlawful or unprofessional conduct of a licensee; and(3)(a)(iii)(B) advise the division in its investigation of these complaints.(3)(b) A board member who has, under Subsection (3)(a)(iii), reviewed a complaint or advised in its investigation may be disqualified from participating with the board when the board serves as a presiding officer in an adjudicative proceeding concerning the complaint.
