As used in this chapter:

(1) “County or municipality franchise fee” means a franchise fee that a county or municipality receives from a multi-channel video or audio service provider.

Terms Used In Utah Code 59-26-102

  • City: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Franchise fee: is a s defined in Utah Code 59-26-102
  • Multi-channel video or audio service provider: includes the following except as specifically exempted by state or federal law:
              (3)(b)(i) a cable operator;
              (3)(b)(ii) a CATV provider;
              (3)(b)(iii) a multi-point distribution provider;
              (3)(b)(iv) a MMDS provider;
              (3)(b)(v) a SMATV operator;
              (3)(b)(vi) a direct-to-home satellite service provider; or
              (3)(b)(vii) a DBS provider. See Utah Code 59-26-102
  • Municipality: means a city or town. See Utah Code 59-26-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Town: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
(2) “Franchise fee” is as defined in 47 U.S.C. § 542, except that the term “cable operator” or “cable subscriber” shall be interpreted to include a multi-channel video or audio service provider.

     (3)(a) “Multi-channel video or audio service provider” means any person or group of persons that:

          (3)(a)(i) provides multi-channel video or audio service and directly or indirectly owns a significant interest in the multi-channel video or audio service; or
          (3)(a)(ii) otherwise controls or is responsible through any arrangement, the management and operation of the multi-channel video or audio service.
     (3)(b) “Multi-channel video or audio service provider” includes the following except as specifically exempted by state or federal law:

          (3)(b)(i) a cable operator;
          (3)(b)(ii) a CATV provider;
          (3)(b)(iii) a multi-point distribution provider;
          (3)(b)(iv) a MMDS provider;
          (3)(b)(v) a SMATV operator;
          (3)(b)(vi) a direct-to-home satellite service provider; or
          (3)(b)(vii) a DBS provider.
(4) “Municipality” means a city or town.
