(1) Notwithstanding any other provision of law, the governing board or the executive director of any state department, instrumentality, or agency that is not a state agency, or the legislative body of any city, county, school district, or other political subdivision may by order or resolution give any officer or employee the authority to:

Terms Used In Utah Code 63A-2-408

  • Agency: means a board, commission, institution, department, division, officer, council, office, committee, bureau, or other administrative unit of the state, including the agency head, agency employees, or other persons acting on behalf of or under the authority of the agency head, the Legislature, the courts, or the governor, but does not mean a political subdivision of the state, or any administrative unit of a political subdivision of the state. See Utah Code 63A-1-103
  • City: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Department: means the Department of Government Operations. See Utah Code 63A-1-103
  • Division: means the Division of Purchasing and General Services created under Section 63A-2-101. See Utah Code 63A-2-101.5
  • Executive director: means the executive director of the Department of Government Operations. See Utah Code 63A-1-103
  • Federal surplus property: means surplus property of the federal government of the United States. See Utah Code 63A-2-101.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Property act: means the Federal Property and Administrative Services Act of 1949, Utah Code 63A-2-101.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • State agency: means any executive branch department, division, or other agency of the state. See Utah Code 63A-2-101.5
     (1)(a) secure the transfer of state surplus property or federal surplus property through the division under the property act; and
     (1)(b) obligate the state or political subdivision and its funds to the extent necessary to comply with the terms and conditions of those transfers.
(2) The authority conferred upon any officer or employee by an order or resolution remains in effect until:

     (2)(a) the order or resolution is revoked; and
     (2)(b) the division has received written notice of the revocation.
