(1) There is created a restricted account within the General Fund known as the “Immigration Act Restricted Account.”

Terms Used In Utah Code 63G-12-103

  • Department: means the Department of Public Safety created in Section 53-1-103. See Utah Code 63G-12-102
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Restricted account: means the Immigration Act Restricted Account created in Section 63G-12-103. See Utah Code 63G-12-102
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5

     (2)(a) The restricted account shall consist of:

          (2)(a)(i) a fee collected under this chapter;
          (2)(a)(ii) a fine collected under Section 63G-12-207;
          (2)(a)(iii) civil penalties imposed under Section 63G-12-211 or 63G-12-306;
          (2)(a)(iv) money appropriated to the restricted account by the Legislature; and
          (2)(a)(v) interest earned on the restricted account.
     (2)(b) The restricted account shall earn interest.
(3) The Legislature may appropriate money from the restricted account to:

     (3)(a) the department and the Office of the Governor to pay the costs associated with the implementation of Section 63G-12-202;
     (3)(b) the department to administer this chapter;
     (3)(c) the State Tax Commission for costs associated with implementing Section 63G-12-203;
     (3)(d) the attorney general for costs associated with:

          (3)(d)(i) litigation related to this chapter;
          (3)(d)(ii) a multi-agency strike force created under Section 67-5-22.7; or
          (3)(d)(iii) a memorandum of understanding executed under Section 67-5-28; and
     (3)(e) the Identity Theft Restricted Account created in Section 67-5-22.7.
