As used in this chapter:

(1) “Boycott action” means refusing to deal, terminating business activities, or limiting commercial relations.

Terms Used In Utah Code 63G-27-102

  • Boycott action: means refusing to deal, terminating business activities, or limiting commercial relations. See Utah Code 63G-27-102
  • Boycotted company: means a company that:
         (3)(a) engages in the exploration, production, utilization, transportation, sale, or manufacture of fossil fuel-based energy, timber, mining, or agriculture;
         (3)(b) engages in, facilitates, or supports the manufacture, distribution, sale, or use of firearms;
         (3)(c) does not meet or commit to meet environmental standards, including standards for eliminating, reducing, offsetting, or disclosing greenhouse gas-emissions, beyond applicable state and federal law requirements; or
         (3)(d) does not facilitate or commit to facilitate access to abortion or sex characteristic surgical procedures. See Utah Code 63G-27-102
  • Company: includes any wholly-owned subsidiary, majority-owned subsidiary, parent company, or affiliate of an entity described in Subsection (4)(a). See Utah Code 63G-27-102
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Ordinary business purpose: means a purpose that is related to business operations. See Utah Code 63G-27-102
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Sex: means , in relation to an individual, the individual's biological sex, either male or female, at birth, according to distinct reproductive roles as manifested by:
         (34)(a) sex and reproductive organ anatomy;
         (34)(b) chromosomal makeup; and
         (34)(c) endogenous hormone profiles. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) “Boycott of the State of Israel” means engaging in a boycott action targeting:

     (2)(a) the State of Israel; and
     (2)(b)

          (2)(b)(i) companies or individuals doing business in or with the State of Israel; or
          (2)(b)(ii) companies authorized by, licensed by, or organized under the laws of the State of Israel to do business.
(3) “Boycotted company” means a company that:

     (3)(a) engages in the exploration, production, utilization, transportation, sale, or manufacture of fossil fuel-based energy, timber, mining, or agriculture;
     (3)(b) engages in, facilitates, or supports the manufacture, distribution, sale, or use of firearms;
     (3)(c) does not meet or commit to meet environmental standards, including standards for eliminating, reducing, offsetting, or disclosing greenhouse gas-emissions, beyond applicable state and federal law requirements; or
     (3)(d) does not facilitate or commit to facilitate access to abortion or sex characteristic surgical procedures.
(4)

     (4)(a) “Company” means a corporation, partnership, limited liability company, or similar entity.
     (4)(b) “Company” includes any wholly-owned subsidiary, majority-owned subsidiary, parent company, or affiliate of an entity described in Subsection (4)(a).
(5) “Economic boycott” means, without an ordinary business purpose:

     (5)(a) engaging in a boycott action targeting:

          (5)(a)(i) a boycotted company; or
          (5)(a)(ii) another company because the company does business with a boycotted company; or
     (5)(b) taking an action intended to penalize, inflict economic harm to, or change or limit the activities of:

          (5)(b)(i) a boycotted company; or
          (5)(b)(ii) another company because the company does business with a boycotted company.
(6)

     (6)(a) “Ordinary business purpose” means a purpose that is related to business operations.
     (6)(b) “Ordinary business purpose” does not include a purpose that is solely related to furthering social, political, or ideological interests.
(7) “Public entity” means the state or a political subdivision of the state, including each department, division, office, board, commission, council, authority, or institution of the state or a political subdivision of the state.
