(1) The sentencing commission shall establish and maintain:

Terms Used In Utah Code 63M-7-404.1

  • Adult sentencing and supervision length guidelines: means the guidelines established in Section Utah Code 63M-7-401.1
  • Commission: means the State Commission on Criminal and Juvenile Justice created in Section 63M-7-201. See Utah Code 63M-7-101.5
  • Juvenile: means a minor as that term is defined in Section 80-1-102. See Utah Code 63M-7-401.1
  • Juvenile disposition guidelines: means the guidelines established in Section Utah Code 63M-7-401.1
  • Master offense list: means a document that contains all offenses that exist in statute and each offense's associated penalty. See Utah Code 63M-7-401.1
  • Offense: means a felony, a misdemeanor, an infraction, or an adjudication under the laws of this state, another state, or the United States. See Utah Code 63M-7-401.1
  • Sentencing commission: means the sentencing commission created in Section Utah Code 63M-7-401.1
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) the adult sentencing and supervision length guidelines described in Section 63M-7-404.3;
     (1)(b) the juvenile disposition guidelines described in Section 63M-7-404.5;
     (1)(c) a master offense list described in Section 63M-7-405; and
     (1)(d) a collateral consequences guide described in Section 63M-7-405.
(2) The sentencing commission may make recommendations to the Legislature, the governor, and the Judicial Council regarding:

     (2)(a) the adult sentencing and supervision length guidelines described in Section 63M-7-404.3;
     (2)(b) the juvenile disposition guidelines described in Section 63M-7-404.5;
     (2)(c) a master offense list described in Section 63M-7-405; and
     (2)(d) a collateral consequences guide described in Section 63M-7-405.
(3) The sentencing commission shall use existing data and resources from state criminal justice agencies in carrying out the duties of the sentencing commission.
(4) The sentencing commission shall:

     (4)(a) provide training and recommendations regarding the adult sentencing and supervision length guidelines, the juvenile disposition guidelines, and other documents maintained by the sentencing commission to the three branches of government, in coordination with the commission; and
     (4)(b) assist and respond to questions from all three branches of government.
(5)

     (5)(a) The sentencing commission may provide analysis and recommendations to the commission regarding proposed legislation or other policy changes that may impact sentencing, release, or supervision of individuals convicted of crimes.
     (5)(b) The sentencing commission may not take public positions on proposed legislation or other proposed policy changes by the Legislature.
(6) The sentencing commission may employ professional assistance and other staff members that the sentencing commission considers necessary to comply with this part.
(7) The sentencing commission shall coordinate with the commission on criminal and juvenile justice issues, budget, and administrative support.
