(1) In accordance with rules adopted by the office under Section 63N-2-509 , the GOEO board shall establish a separate, independent review committee to provide recommendations to the office regarding the terms and conditions of an agreement and to consult with the office as provided in this part or in rule.
Terms Used In Utah Code 63N-2-504
- Agreement: means an agreement described in Section 63N-2-503. See Utah Code 63N-2-502
- Executive director: means the executive director of the office. See Utah Code 63N-1a-102
- GOEO: means the Governor's Office of Economic Opportunity. See Utah Code 63N-1a-102
- GOEO board: means the Board of Economic Opportunity created in Section
63N-1a-401 . See Utah Code 63N-1a-102 - Qualified hotel: means a full-service hotel development constructed in the state on or after July 1, 2014 that:(23)(a) requires a significant capital investment;(23)(b) includes at least 85 square feet of convention, exhibit, and meeting space per guest room; and(23)(c) is located within 1,000 feet of a convention center that contains at least 500,000 square feet of convention, exhibit, and meeting space. - Review committee: means the independent review committee established under Section 63N-2-504. See Utah Code 63N-2-502
(2) The review committee shall consist of:(2)(a) one member appointed by the executive director to represent the office;(2)(b) two members appointed by the mayor or chief executive of the county in which the qualified hotel is located or proposed to be located;(2)(c) two members appointed by:(2)(c)(i) the mayor of the municipality in which the qualified hotel is located or proposed to be located, if the qualified hotel is located or proposed to be located within the boundary of a municipality; or(2)(c)(ii) the mayor or chief executive of the county in which the qualified hotel is located or proposed to be located, in addition to the two members appointed under Subsection (2)(b), if the qualified hotel is located or proposed to be located outside the boundary of a municipality;(2)(d) an individual representing the hotel industry, appointed by the Utah Hotel and Lodging Association;(2)(e) an individual representing the commercial development and construction industry, appointed by the president or chief executive officer of the local chamber of commerce;(2)(f) an individual representing the convention and meeting planners industry, appointed by the president or chief executive officer of the local convention and visitors bureau; and(2)(g) one member appointed by the GOEO board.(3)(3)(a) A member serves an indeterminate term and may be removed from the review committee by the appointing authority at any time.(3)(b) A vacancy may be filled in the same manner as an appointment under Subsection (2).(4) A member of the review committee may not be paid for serving on the review committee and may not receive per diem or expense reimbursement.(5) The office shall provide any necessary staff support to the review committee.
