(1) As used in this chapter:
Terms Used In Utah Code 71A-2-101
- Armed forces: means the same as that term is defined in Section Utah Code 71A-1-101
- Department: means the Department of Veterans and Military Affairs. See Utah Code 71A-1-101
- Individual with a disability: means a veteran or service member who has established the existence of a service-connected disability or is receiving compensation, disability retirement benefits, or a pension because of a public statute administered by the VA or a military department. See Utah Code 71A-2-101
- Service member: means a currently serving member of the armed forces. See Utah Code 71A-1-101
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Statute: A law passed by a legislature.
- Veteran: means the same as that term is defined in Section Utah Code 71A-1-101
(1)(a) “Government entity” means the state, any county, municipality, special district, special service district, or any other political subdivision or administrative unit of the state, including state institutions of education.
(1)(b) “Individual with a disability” means a veteran or service member who has established the existence of a service-connected disability or is receiving compensation, disability retirement benefits, or a pension because of a public statute administered by the VA or a military department.
(1)(c) “Preference eligible” means:
(1)(c)(i) any individual who is a veteran or service member;
(1)(c)(ii) an individual with a disability, regardless of the percentage of disability;
(1)(c)(iii) the spouse or surviving spouse of a veteran or service member;
(1)(c)(iv) a purple heart recipient; or
(1)(c)(v) a retired member of the armed forces.
(2) Terms defined in Section 71A-1-101 apply to this chapter.
