(1) Failure to register any aircraft required to be registered with the state subjects the owners of the aircraft to the same penalties provided for motor vehicles under Sections 41-1a-1101, 41-1a-1301, and 41-1a-1307.

Terms Used In Utah Code 72-10-112

  • Aircraft: means any contrivance now known or in the future invented, used, or designed for navigation of or flight in the air. See Utah Code 72-10-102
  • Airport: means any area of land, water, or both, that:
         (8)(a) is used or is made available for landing and takeoff;
         (8)(b) provides facilities for the shelter, supply, and repair of aircraft, and handling of passengers and cargo;
         (8)(c) meets the minimum requirements established by the department as to size and design, surface, marking, equipment, and operation; and
         (8)(d) includes all areas shown as part of the airport in the current airport layout plan as approved by the Federal Aviation Administration. See Utah Code 72-10-102
  • Department: means the Department of Transportation created in Section 72-1-201. See Utah Code 72-1-102
  • Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5

     (2)(a) The department shall conduct compliance audits and inspections as needed to enforce state laws related to the registration of aircraft.
     (2)(b) The department shall coordinate with airport operators to determine and verify accurate reporting of aircraft that are based within the state for the purpose of administering and enforcing state aircraft registration laws.

     (3)(a) In addition to the penalties described in Subsection (1), the department may impose a fine of 10% of the registration fee for the first month and 5% of the registration fee for each subsequent month an aircraft is operated in violation of Section 72-10-109.
     (3)(b) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the department shall makes rules establishing procedures for the enforcement of state aircraft registration laws and the administration of penalties described in this section.
     (3)(c) The department shall comply with the procedures and requirements of Title 63G, Chapter 4, Administrative Procedures Act, in all adjudicative proceedings conducted for the enforcement of penalties under this section.
