(1) As used in this section:
Terms Used In Utah Code 76-2-106
- Actor: means a person whose criminal responsibility is in issue in a criminal action. See Utah Code 76-1-101.5
- Offense: means a violation of any penal statute of this state. See Utah Code 76-1-101.5
(1)(a) “Unmanned aircraft” means the same as that term is defined in Section 72-10-102.
(1)(b) “Unmanned aircraft system” means the same as that term is defined in Section 72-10-102.
(2) An actor may be found guilty of an offense if:
(2)(a) the actor commits the offense with the aid of an unmanned aircraft; and
(2)(b) the unmanned aircraft system for the unmanned aircraft is under the actor’s control at the time of the offense.
