As used in this chapter:

(1) “Interest holder” means the same as that term is defined in Section 77-11a-101.

Terms Used In Utah Code 77-11d-101

  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Interest holder: means the same as that term is defined in Section 77-11a-101. See Utah Code 77-11d-101
  • Owner: means the same as that term is defined in Section 77-11a-101. See Utah Code 77-11d-101
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5

     (2)(a) “Lost or mislaid property”:

          (2)(a)(i) means any property that comes into the possession of a peace officer or law enforcement agency:

               (2)(a)(i)(A) that is not claimed by anyone who is identified as the owner of the property; or
               (2)(a)(i)(B) for which no owner or interest holder can be found after a reasonable and diligent search;
          (2)(a)(ii) includes any property received by a peace officer or law enforcement agency from a person claiming to have found the property; and
          (2)(a)(iii) does not include property seized by a peace officer in accordance with Chapter 11a, Seizure of Property and Contraband.
     (2)(b) “Lost or mislaid property” includes a firearm or other dangerous weapon received by a law enforcement agency at an airport under Subsection 76-10-529(6).
(3) “Owner” means the same as that term is defined in Section 77-11a-101.
(4) “Public interest use” means:

     (4)(a) use by a governmental agency as determined by the agency’s legislative body; or
     (4)(b) donation to a nonprofit charity registered with the state.
