As used in Sections 78B-3-106 and 78B-3-107, “heirs” means the following surviving persons:

(1) the decedent‘s spouse;

Terms Used In Utah Code 78B-3-105

  • Decedent: A deceased person.
  • Intestate: Dying without leaving a will.
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
(2) the decedent’s children as provided in Section 75-2-114;
(3)

     (3)(a) the decedent’s natural parents; or
     (3)(b) if the decedent was adopted, the decedent’s adoptive parents;
(4) the decedent’s stepchildren who:

     (4)(a) are younger than 18 years old at the time of decedent’s death; and
     (4)(b)

          (4)(b)(i) received financial support from the decedent at the time of decedent’s death; or
          (4)(b)(ii) resided with the decedent on at least a part-time basis at the time of the decedent’s death; or
(5) any blood relative as provided by the law of intestate succession if the decedent is not survived by a person under Subsection (1), (2), or (3).
