As used in Sections 78B-3-106 and 78B-3-107, “heirs” means the following surviving persons:
(1) the decedent‘s spouse;

- Decedent: A deceased person.
- Intestate: Dying without leaving a will.
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5(2) the decedent’s children as provided in Section 75-2-114;(3)(3)(a) the decedent’s natural parents; or(3)(b) if the decedent was adopted, the decedent’s adoptive parents;(4) the decedent’s stepchildren who:(4)(a) are younger than 18 years old at the time of decedent’s death; and(4)(b)(4)(b)(i) received financial support from the decedent at the time of decedent’s death; or(4)(b)(ii) resided with the decedent on at least a part-time basis at the time of the decedent’s death; or(5) any blood relative as provided by the law of intestate succession if the decedent is not survived by a person under Subsection (1), (2), or (3).
