(1) “Claimant” means a person who files a notice.

Terms Used In Utah Code 78B-6-1302

  • Claimant: means a person who files a notice. See Utah Code 78B-6-1302
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Notice: means a notice of the pendency of an action filed under Section 78B-6-1303. See Utah Code 78B-6-1302
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
(2) “Guarantee” means an agreement by a claimant to pay an amount of damages:

     (2)(a) specified by the court;
     (2)(b) suffered as a result of the maintenance of a notice;
     (2)(c) to a person with an interest in the real property that is the subject of the notice; and
     (2)(d) if the requirements of Subsection 78B-6-1304(5) are met.
(3) “Notice” means a notice of the pendency of an action filed under Section 78B-6-1303.
