Terms Used In Utah Code 81-2-306

  • County clerk: means :
         (1)(a) the county clerk of the county; or
         (1)(b) an employee or designee of the county clerk who is authorized to issue marriage licenses or solemnize marriages. See Utah Code 81-2-301
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
     (1)(a) The county clerk shall:

          (1)(a)(i) file and preserve the marriage license returned by an individual under Subsection 81-2-305(5) with the certificate of the marriage; and
          (1)(a)(ii) record the marriage license and certificate in a book kept for that purpose or by electronic means.
     (1)(b) The record shall be properly indexed in the names of the parties so married.
(2) An individual may use a diacritical mark, as defined in Section 26B-8-103, on a marriage license.
(3) A transcript shall be promptly certified and transmitted by the clerk to the state registrar of vital statistics.
(4) The marriage license and the certificate of the individual officiating at the marriage are:

     (4)(a) vital records as defined in Section 26B-8-101; and
     (4)(b) subject to the inspection requirements described in Section 26B-8-125.
