  • Adjudicative proceeding: means :
         (2)(a) an action by a board, commission, department, officer, or other administrative unit of the state that determines the legal rights, duties, privileges, immunities, or other legal interests of one or more identifiable persons, including an action to grant, deny, revoke, suspend, modify, annul, withdraw, or amend an authority, right, or license; and
         (2)(b) judicial review of an action described in Subsection (2)(a). See Utah Code 68-3-12.5
  • Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
  • Ambulance: means a ground, air, or water vehicle that:
         (2)(a) transports patients and is used to provide emergency medical services; and
         (2)(b) is required to obtain a permit under Section 53-2d-404 to operate in the state. See Utah Code 53-2d-101
  • Ambulance provider: means an emergency medical service provider that:
         (3)(a) transports and provides emergency medical care to patients; and
         (3)(b) is required to obtain a license under Part 5, Ambulance and Paramedic Providers. See Utah Code 53-2d-101
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Annual maintenance utility: means a tool within the system that:
         (1)(a) is designed to comply with Section 20A-2-504;
         (1)(b) a county clerk is required to run on an annual basis; and
         (1)(c) identifies each inactive voter and each voter to be removed from the voter registration database. See Utah Code 20A-2-501
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Armed forces: means the United States Army, Navy, Air Force, Marine Corps, Space Force, and Coast Guard. See Utah Code 68-3-12.5
  • Arrest: Taking physical custody of a person by lawful authority.
  • Ballot: means the storage medium, including a paper, mechanical, or electronic storage medium, that records an individual voter's vote. See Utah Code 20A-1-102
  • Behavioral emergency services: means delivering a behavioral health intervention to a patient in an emergency context within a scope and in accordance with guidelines established by the department. See Utah Code 53-2d-101
  • Bureau: means the Bureau of Emergency Medical Services created in Section 53-2d-102. See Utah Code 53-2d-101
  • Canvass: means the review of election returns and the official declaration of election results by the board of canvassers. See Utah Code 20A-1-102
  • City: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Committee: means the Trauma System and Emergency Medical Services Committee created by Section 53-2d-104. See Utah Code 53-2d-101
  • Community paramedicine: means medical care:
         (9)(a) provided by emergency medical service personnel; and
         (9)(b) provided to a patient who is not:
              (9)(b)(i) in need of ambulance transportation; or
              (9)(b)(ii) located in a health care facility as defined in Section 26B-2-201. See Utah Code 53-2d-101
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • CPR: means artificial ventilation or external chest compression applied to a person who is unresponsive and not breathing. See Utah Code 53-2d-101
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Database: means the statewide voter registration database, described in Subsection 20A-2-502(1)(a) that:
         (2)(a) is maintained and updated via the system; and
         (2)(b) uses information relative to voter registration and voting, including information that is obtained from a voter, a governmental entity, as defined in Section 63G-2-103, or another state. See Utah Code 20A-2-501
  • Decedent: A deceased person.
  • Department: means the Department of Public Safety created in Section 53-1-103. See Utah Code 53-1-102
  • Dependent: A person dependent for support upon another.
  • Direct medical observation: means in-person observation of a patient by a physician, registered nurse, physician's assistant, or individual licensed under Section 26B-4-116. See Utah Code 53-2d-101
  • Duplicate voter utility: means a tool within the system that runs a set of queries to identify potential duplicate voter records. See Utah Code 20A-2-501
  • Election: means a regular general election, a municipal general election, a statewide special election, a local special election, a regular primary election, a municipal primary election, and a special district election. See Utah Code 20A-1-102
  • Emergency medical condition: means :
         (11)(a) a medical condition that manifests itself by symptoms of sufficient severity, including severe pain, that a prudent layperson, who possesses an average knowledge of health and medicine, could reasonably expect the absence of immediate medical attention to result in:
              (11)(a)(i) placing the individual's health in serious jeopardy;
              (11)(a)(ii) serious impairment to bodily functions; or
              (11)(a)(iii) serious dysfunction of any bodily organ or part; or
         (11)(b) a medical condition that in the opinion of a physician or the physician's designee requires direct medical observation during transport or may require the intervention of an individual licensed under Section 53-2d-402 during transport. See Utah Code 53-2d-101
  • Emergency medical dispatch center: means a public safety answering point, as defined in Section 63H-7a-103, that is designated as an emergency medical dispatch center by the bureau. See Utah Code 53-2d-101
  • Emergency medical service personnel: includes a paramedic, medical director of a licensed emergency medical service provider, emergency medical service instructor, behavioral emergency services technician, other categories established by the committee, and a certified emergency medical dispatcher. See Utah Code 53-2d-101
  • Emergency medical service providers: means :
         (14)(a) licensed ambulance providers and paramedic providers;
         (14)(b) a facility or provider that is required to be designated under Subsection 53-2d-403(1)(a); and
         (14)(c) emergency medical service personnel. See Utah Code 53-2d-101
  • Emergency medical services: means :
         (15)(a) medical services;
         (15)(b) transportation services;
         (15)(c) behavioral emergency services; or
         (15)(d) any combination of the services described in Subsections (15)(a) through (c). See Utah Code 53-2d-101
  • Equal: means , with respect to biological sex, of the same value. See Utah Code 68-3-12.5
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Inactive voter: means a registered voter who is listed as inactive by a county clerk under Subsection 20A-2-505(4)(c)(i) or (ii). See Utah Code 20A-1-102
  • Interested party: means :
         (18)(a) a licensed or designated emergency medical services provider that provides emergency medical services within or in an area that abuts an exclusive geographic service area that is the subject of an application submitted pursuant to Part 5, Ambulance and Paramedic Providers;
         (18)(b) any municipality, county, or fire district that lies within or abuts a geographic service area that is the subject of an application submitted pursuant to Part 5, Ambulance and Paramedic Providers; or
         (18)(c) the department when acting in the interest of the public. See Utah Code 53-2d-101
  • Intestate: Dying without leaving a will.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Land: includes :
         (18)(a) land;
         (18)(b) a tenement;
         (18)(c) a hereditament;
         (18)(d) a water right;
         (18)(e) a possessory right; and
         (18)(f) a claim. See Utah Code 68-3-12.5
  • Law enforcement agency: means an entity or division of:
              (1)(e)(i)
                   (1)(e)(i)(A) the federal government, a state, or a political subdivision of a state;
                   (1)(e)(i)(B) a state institution of higher education; or
                   (1)(e)(i)(C) a private institution of higher education, if the entity or division is certified by the commissioner under Title 53, Chapter 19, Certification of Private Law Enforcement Agency; and
              (1)(e)(ii) that exists primarily to prevent and detect crime and enforce criminal laws, statutes, and ordinances. See Utah Code 53-1-102
  • Law enforcement officer: means the same as that term is defined in Section 53-13-103. See Utah Code 53-1-102
  • Level of service: means the level at which an ambulance provider type of service is licensed as:
         (19)(a) emergency medical technician;
         (19)(b) advanced emergency medical technician; or
         (19)(c) paramedic. See Utah Code 53-2d-101
  • Medical control: means a person who provides medical supervision to an emergency medical service provider. See Utah Code 53-2d-101
  • Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
  • Nonemergency secured behavioral health transport: means an entity that:
         (22)(a) provides nonemergency secure transportation services for an individual who:
              (22)(a)(i) is not required to be transported by an ambulance under Section 53-2d-405; and
              (22)(a)(ii) requires behavioral health observation during transport between any of the following facilities:
                   (22)(a)(ii)(A) a licensed acute care hospital;
                   (22)(a)(ii)(B) an emergency patient receiving facility;
                   (22)(a)(ii)(C) a licensed mental health facility; and
                   (22)(a)(ii)(D) the office of a licensed health care provider; and
         (22)(b) is required to be designated under Section 53-2d-403. See Utah Code 53-2d-101
  • Official register: means the official record furnished to election officials by the election officer that contains the information required by Section 20A-5-401. See Utah Code 20A-1-102
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Paramedic provider: means an entity that:
         (23)(a) employs emergency medical service personnel; and
         (23)(b) is required to obtain a license under Part 5, Ambulance and Paramedic Providers. See Utah Code 53-2d-101
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Patient: means an individual who, as the result of illness, injury, or a behavioral emergency condition, meets any of the criteria in Section 26B-4-119. See Utah Code 53-2d-101
  • Peace officer: means any officer certified in accordance with Title 53, Chapter 13, Peace Officer Classifications. See Utah Code 53-1-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Political subdivision: means :
         (25)(a) a city or town;
         (25)(b) a county;
         (25)(c) a special service district created under Title 17D, Chapter 1, Special Service District Act, for the purpose of providing fire protection services under Subsection 17D-1-201(9);
         (25)(d) a special district created under Title 17B, Limited Purpose Local Government Entities - Special Districts, for the purpose of providing fire protection, paramedic, and emergency services;
         (25)(e) areas coming together as described in Subsection Utah Code 53-2d-101
  • Poll worker: includes election judges. See Utah Code 20A-1-102
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Public figure: means an individual who, due to the individual being considered for, holding, or having held a position of prominence in a public or private capacity, or due to the individual's celebrity status, has an increased risk to the individual's safety. See Utah Code 20A-1-102
  • Quorum: The number of legislators that must be present to do business.
  • Registration form: means a form by which an individual may register to vote under this title. See Utah Code 20A-1-102
  • Regular general election: means the election held throughout the state on the first Tuesday after the first Monday in November of each even-numbered year for the purposes established in Section 20A-1-201. See Utah Code 20A-1-102
  • Regular primary election: means the election, held on the date specified in Section Utah Code 20A-1-102
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Sex: means , in relation to an individual, the individual's biological sex, either male or female, at birth, according to distinct reproductive roles as manifested by:
         (34)(a) sex and reproductive organ anatomy;
         (34)(b) chromosomal makeup; and
         (34)(c) endogenous hormone profiles. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Statute: A law passed by a legislature.
  • System: means the statewide voter registration system described in Subsection 20A-2-502(1)(a), including the database and all information within the system or database. See Utah Code 20A-2-501
  • Testator: A male person who leaves a will at death.
  • Town: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Trauma: means an injury requiring immediate medical or surgical intervention. See Utah Code 53-2d-101
  • Trauma system: means a single, statewide system that:
         (28)(a) organizes and coordinates the delivery of trauma care within defined geographic areas from the time of injury through transport and rehabilitative care; and
         (28)(b) is inclusive of all prehospital providers, hospitals, and rehabilitative facilities in delivering care for trauma patients, regardless of severity. See Utah Code 53-2d-101
  • Triage: means the sorting of patients in terms of disposition, destination, or priority. See Utah Code 53-2d-101
  • Trustor: The person who makes or creates a trust. Also known as the grantor or settlor.
  • Type of service: means the category at which an ambulance provider is licensed as:
         (31)(a) ground ambulance transport;
         (31)(b) ground ambulance interfacility transport; or
         (31)(c) both ground ambulance transport and ground ambulance interfacility transport. See Utah Code 53-2d-101
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
  • Vehicle: means every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, excepting devices used exclusively upon stationary rails or tracks. See Utah Code 53-1-102
  • Venue: The geographical location in which a case is tried.
  • Veteran: means an individual who:
              (44)(a)(i) has served in the United States Armed Forces for at least 180 days:
                   (44)(a)(i)(A) on active duty; or
                   (44)(a)(i)(B) in a reserve component, to include the National Guard; or
              (44)(a)(ii) has incurred an actual service-related injury or disability while in the United States Armed Forces regardless of whether the individual completed 180 days; and
              (44)(a)(iii) was separated or retired under conditions characterized as honorable or general. See Utah Code 68-3-12.5
  • Voter: means an individual who:
         (79)(a) meets the requirements for voting in an election;
         (79)(b) meets the requirements of election registration;
         (79)(c) is registered to vote; and
         (79)(d) is listed in the official register book. See Utah Code 20A-1-102
  • Voter identification verification tool: means a tool within the system that compares data in a voter registration record to Driver License Division data and Social Security Administration data to verify voter identification. See Utah Code 20A-2-501
  • Voter registration deadline: means the registration deadline provided in Section Utah Code 20A-1-102
  • Writing: includes :
         (48)(a) printing;
         (48)(b) handwriting; and
         (48)(c) information stored in an electronic or other medium if the information is retrievable in a perceivable format. See Utah Code 68-3-12.5
