Terms Used In Utah Code > Title 20A > Chapter 3a > Part 4 - Disposition of Ballots

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Ammunition: means a bullet, a cartridge case, primer, propellant powder, or other ammunition designed for use in any firearm, either as an individual component part or in a completely assembled cartridge. See Utah Code 53-5d-102
  • Arrest: Taking physical custody of a person by lawful authority.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Ballot: means the storage medium, including a paper, mechanical, or electronic storage medium, that records an individual voter's vote. See Utah Code 20A-1-102
  • Board of canvassers: means the entities established by Sections 20A-4-301 and 20A-4-306 to canvass election returns. See Utah Code 20A-1-102
  • Bureau: means the Bureau of Criminal Identification created in Section 53-10-201. See Utah Code 53-5c-102
  • Canvass: means the review of election returns and the official declaration of election results by the board of canvassers. See Utah Code 20A-1-102
  • Cohabitant: means an individual who:
         (2)(a) is 18 years old or older;
         (2)(b) resides in the same home with another individual; and
         (2)(c)
              (2)(c)(i) is living as if a spouse of the individual;
              (2)(c)(ii) is related by blood or marriage to the individual;
              (2)(c)(iii) has one or more children in common with the individual; or
              (2)(c)(iv) has an interest in the safety and well-being of the individual. See Utah Code 53-5c-102
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Counting center: means one or more locations selected by the election officer in charge of the election for the automatic counting of ballots. See Utah Code 20A-1-102
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the Department of Public Safety created in Section 53-1-103. See Utah Code 53-1-102
  • Domestic violence: means the same as that term is defined in Section 77-36-1. See Utah Code 53-5c-102
  • Election: means a regular general election, a municipal general election, a statewide special election, a local special election, a regular primary election, a municipal primary election, and a special district election. See Utah Code 20A-1-102
  • Election officer: means :
         (23)(a) the lieutenant governor, for all statewide ballots and elections;
         (23)(b) the county clerk for:
              (23)(b)(i) a county ballot and election; and
              (23)(b)(ii) a ballot and election as a provider election officer as provided in Section Utah Code 20A-1-102
  • Election official: means any election officer, election judge, or poll worker. See Utah Code 20A-1-102
  • Firearm: means a device from which is expelled a projectile by action of an explosive. See Utah Code 53-5b-103
  • Firearm: means a pistol, revolver, shotgun, short barrel shotgun, rifle or short barrel rifle, or a device that could be used as a dangerous weapon from which is expelled a projectile by action of an explosive. See Utah Code 53-5c-102
  • Firearm accessory: means an item that is used in conjunction with or mounted upon a firearm, firearm action, or firearm receiver but is not essential to the basic function of a firearm, including:
         (2)(a) a telescopic or laser sight;
         (2)(b) a magazine;
         (2)(c) a flash or sound suppressor;
         (2)(d) a folding or aftermarket stock or grip;
         (2)(e) a speed-loader;
         (2)(f) an ammunition carrier; and
         (2)(g) a light for target illumination. See Utah Code 53-5b-103
  • Health care provider: means a person:
         (5)(a) who provides health care or professional services related to health care; and
         (5)(b) is acting within the scope of the person's license, certification, practice, education, or training. See Utah Code 53-5c-102
  • Illegal firearm: means a firearm the ownership or possession of which is prohibited under state or federal law. See Utah Code 53-5c-102
  • Jail release agreement: means the same as that term is defined in Section 78B-7-801. See Utah Code 53-5c-102
  • Jail release court order: means the same as that term is defined in Section 78B-7-801. See Utah Code 53-5c-102
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Law enforcement agency: means a municipal or county police agency or an officer of that agency. See Utah Code 53-5c-102
  • Law enforcement officer: means the same as that term is defined in Section 53-13-103. See Utah Code 53-1-102
  • Manual ballot: means a paper document produced by an election officer on which an individual records an individual's vote by directly placing a mark on the paper document using a pen or other marking instrument. See Utah Code 20A-1-102
  • Manufactured: means creating a firearm, a firearm action or receiver, a firearm accessory, or ammunition from basic materials for functional usefulness, including:
         (4)(a) forging;
         (4)(b) casting;
         (4)(c) machining; and
         (4)(d) another process for working materials. See Utah Code 53-5b-103
  • Manufacturer: means , with respect to a qualified product, a person who is engaged in the business of manufacturing a qualified product and who is licensed to engage in business as a manufacturer under 18 U. See Utah Code 53-5d-102
  • Negligent entrustment: means the supplying of a qualified product by a seller for use by another person when the seller knows, or reasonably should know, the person to whom the product is supplied is likely to, and does, use the product in a manner involving unreasonable risk of physical injury to the person or others. See Utah Code 53-5d-102
  • Owner cohabitant: means a cohabitant who:
         (10)(a) is 18 years old or older; and
         (10)(b) owns a firearm. See Utah Code 53-5c-102
  • Person: means the same as that term is defined in Section Utah Code 53-5d-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Poll worker: includes election judges. See Utah Code 20A-1-102
  • Polling place: means a building where voting is conducted. See Utah Code 20A-1-102
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Qualified civil liability action: means a civil action or proceeding or an administrative proceeding brought by any person against a manufacturer or seller of a qualified product, or a trade association, for damages, punitive damages, injunctive or declaratory relief, abatement, restitution, fines, or penalties, or other relief, resulting from the criminal or unlawful misuse of a qualified product by the person or a third party. See Utah Code 53-5d-102
  • Qualified product: means a firearm or antique firearm, as defined in Section 76-10-501, ammunition, or a component part of a firearm or ammunition. See Utah Code 53-5d-102
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Return envelope: means the envelope, described in Subsection 20A-3a-202(4), provided to a voter with a manual ballot:
         (65)(a) into which the voter places the manual ballot after the voter has voted the manual ballot in order to preserve the secrecy of the voter's vote; and
         (65)(b) that includes the voter affidavit and a place for the voter's signature. See Utah Code 20A-1-102
  • Seller: means , with respect to a qualified product, a federal firearms licensee, as defined in Section 76-10-501. See Utah Code 53-5d-102
  • Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Statute: A law passed by a legislature.
  • Trade association: means :
         (8)(a) any corporation, unincorporated association, federation, business league, or professional or business organization not organized or operated for profit and no part of the net earnings of which inures to the benefit of any private shareholder or individual;
         (8)(b) an organization described in Utah Code 53-5d-102
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
  • Unlawful misuse: means conduct that violates a statute, ordinance, or regulation as it relates to the use of a qualified product. See Utah Code 53-5d-102
  • Valid voter identification: means :
         (76)(a) a form of identification that bears the name and photograph of the voter which may include:
              (76)(a)(i) a currently valid Utah driver license;
              (76)(a)(ii) a currently valid identification card that is issued by:
                   (76)(a)(ii)(A) the state; or
                   (76)(a)(ii)(B) a branch, department, or agency of the United States;
              (76)(a)(iii) a currently valid Utah permit to carry a concealed weapon;
              (76)(a)(iv) a currently valid United States passport; or
              (76)(a)(v) a currently valid United States military identification card;
         (76)(b) one of the following identification cards, whether or not the card includes a photograph of the voter:
              (76)(b)(i) a valid tribal identification card;
              (76)(b)(ii) a Bureau of Indian Affairs card; or
              (76)(b)(iii) a tribal treaty card; or
         (76)(c) two forms of identification not listed under Subsection (76)(a) or (b) but that bear the name of the voter and provide evidence that the voter resides in the voting precinct, which may include:
              (76)(c)(i) a current utility bill or a legible copy thereof, dated within the 90 days before the election;
              (76)(c)(ii) a bank or other financial account statement, or a legible copy thereof;
              (76)(c)(iii) a certified birth certificate;
              (76)(c)(iv) a valid social security card;
              (76)(c)(v) a check issued by the state or the federal government or a legible copy thereof;
              (76)(c)(vi) a paycheck from the voter's employer, or a legible copy thereof;
              (76)(c)(vii) a currently valid Utah hunting or fishing license;
              (76)(c)(viii) certified naturalization documentation;
              (76)(c)(ix) a currently valid license issued by an authorized agency of the United States;
              (76)(c)(x) a certified copy of court records showing the voter's adoption or name change;
              (76)(c)(xi) a valid Medicaid card, Medicare card, or Electronic Benefits Transfer Card;
              (76)(c)(xii) a currently valid identification card issued by:
                   (76)(c)(xii)(A) a local government within the state;
                   (76)(c)(xii)(B) an employer for an employee; or
                   (76)(c)(xii)(C) a college, university, technical school, or professional school located within the state; or
              (76)(c)(xiii) a current Utah vehicle registration. See Utah Code 20A-1-102
  • Voter: means an individual who:
         (79)(a) meets the requirements for voting in an election;
         (79)(b) meets the requirements of election registration;
         (79)(c) is registered to vote; and
         (79)(d) is listed in the official register book. See Utah Code 20A-1-102
