- advertisement: means all representations disseminated in any manner or by any means, other than by labeling, for the purpose of inducing, or which are likely to induce, directly or indirectly, the purchase of food, drugs, devices, or cosmetics. See
- Ambulatory surgical center: means any distinct entity that operates primarily for the purpose of providing surgical services to patients not requiring hospitalization and for which the expected duration of services would not exceed 24 hours following an admission. See
- Applicant: means a person that applies for a license to operate a cannabis establishment pursuant to this chapter. See
- Board: means the Cannabis Control Board. See
- Cannabis establishment: means a cannabis cultivator, propagation cultivator, wholesaler, product manufacturer, retailer, testing laboratory, or integrated licensee licensed by the Board to engage in commercial cannabis activity in accordance with this chapter. See
- Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
- Check cashing: means receiving at least $500. See
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- corrosive: means any substance that in contact with living tissue will cause substantial destruction of tissue by chemical action, but shall not refer to action on inanimate surfaces. See

- cultivator: means a person licensed by the Board to engage in the cultivation of cannabis in accordance with this chapter. See
- Currency exchange: means receipt of revenues equal to or greater than five percent of total revenues from the exchange of money of one government for money of another government. See
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Department: means the Department of Liquor and Lottery. See

- Dispensary: means a business organization licensed pursuant to chapter 37 of this title. See

- hazardous substance: means any substance or mixture of substances that:

- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Integrated licensee: means a person licensed by the Board to engage in the activities of a cultivator, wholesaler, product manufacturer, retailer, and testing laboratory in accordance with this chapter. See
- irritant: means any substance, not corrosive within the meaning of subdivision (11) of this section, that on immediate, prolonged, or repeated contact with normal living tissue will induce a local inflammatory reaction. See
- label: means a display of written, printed, or graphic matter upon the immediate container of any article and a requirement made by or under authority of this chapter that any word, statement, or other information appearing on the label shall not be considered to be complied with unless such word, statement, or other information also appears on the outside container or wrapper, if any there be, of the retail package of the article, or is easily legible through the outside container or wrapper. - Lien: A claim against real or personal property in satisfaction of a debt.
- misbranded package: means any retailed package of a hazardous substance, intended for household use, that fails to bear a label:
- Monetary value: means a medium of exchange, whether or not redeemable in money. See
- Money: means a medium of exchange that is authorized or adopted by the United States or a foreign government. See
- Money transmission: means to engage in the business of selling or issuing payment instruments, selling or issuing prepaid access, or receiving money or monetary value for transmission to a location within or outside the United States. See
- Municipality: means a town, city, or incorporated village. See
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Patient: means a person admitted to or receiving health care services from an ambulatory surgical center. See
- Payment instrument: means a check, draft, money order, traveler's check, or other instrument for the transmission or payment of money or monetary value, whether or not negotiable. See
- Permit: means any permit or license issued pursuant to this title. See
- Person: means any individual, company, corporation, association, partnership, the U. See
- Person: shall include any natural person; corporation; municipality; the State of Vermont or any department, agency, or subdivision of the State; and any partnership, unincorporated association, or other legal entity. See
- person: includes an individual, partnership, corporation, and association. See
- Plant canopy: means the square footage dedicated to live plant production and does not include areas such as office space or areas used for the storage of fertilizers, pesticides, or other products. See
- Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
- Prepaid access: means funds or monetary value represented in digital electronic format, including virtual currency, whether or not specially encrypted, that are stored or capable of storage on electronic media and are retrievable and transferable electronically. See
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- product manufacturer: means a person licensed by the Board to manufacture cannabis products in accordance with this chapter. See
- propagation cultivator: means a person licensed by the Board to cultivate cannabis clones, immature plants, and mature plants in accordance with this chapter. See
- retailer: means a person licensed by the Board to sell cannabis and cannabis products to adults 21 years of age and older for off-site consumption or cultivation in accordance with this chapter. See
- said: when used by way of reference to a person or thing shall apply to the same person or thing last mentioned. See
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- Small cultivator: means a cultivator with a plant canopy or space for cultivating plants for breeding stock of not more than 1,000 square feet. See
- testing laboratory: means a person licensed by the Board to test cannabis and cannabis products in accordance with this chapter. See
- Town: shall include city and wards or precincts therein; "selectboard members" and "board of civil authority" shall extend to and include the mayor and aldermen of cities; "trustees" shall extend to and include bailiffs of incorporated villages; and the laws applicable to the inhabitants and officers of towns shall be applicable to the inhabitants and similar officers of all municipal corporations.
