West Virginia Code 16-29B-5a – Executive Director of the authority; powers and duties
(a) The Secretary shall appoint an executive director of the authority to supervise and direct the fiscal and administrative matters of the authority. This person shall be qualified by training and experience to direct the operations of the authority. The executive director is ineligible for civil service coverage as provided in section four, article six, chapter twenty-nine of this code and serves at the will and pleasure of the Secretary.
Terms Used In West Virginia Code 16-29B-5a
- Authority: means the Health Care Authority created pursuant to the provisions of this article. See West Virginia Code 16-29B-3
- Director: means the administrative head of the Health Care Authority as set forth in section five-a of this article. See West Virginia Code 16-29B-3
- Person: means an individual, trust, estate, partnership, committee, corporation, association or other organization such as a joint stock company, a state or political subdivision or instrumentality thereof or any legal entity recognized by the state. See West Virginia Code 16-29B-3
- Secretary: means the Secretary of the Department of Health and Human Resources. See West Virginia Code 16-29B-3
- State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
(b) The executive director shall:
(1) Serve on a full-time basis and may not be engaged in any other profession or occupation;
(2) Not hold political office in the government of the state either by election or appointment while serving as executive director;
(3) Shall be a citizen of the United States and shall become a citizen of the state within ninety days of appointment; and
(4) Report to the Secretary.
