Any former member of the state Teachers Retirement System who was employed as a regular full-time employee in a nonteaching capacity by a Board of Education, school principal or school administrator, prior to the time he became eligible for membership in the state Teachers Retirement System, shall be eligible for prior service credit for such service. Upon making application to the retirement board and providing satisfactory evidence, prior service credit shall be granted and his retirement allowance shall be recomputed and adjusted to include such prior service credit. Any increased retirement allowance resulting from the provisions of this section shall not be retroactive.
Terms Used In West Virginia Code 18-7A-35a
- board: means a county board of education. See West Virginia Code 18-1-1
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Member: means any person who has accumulated contributions standing to his or her credit in the State Teachers Retirement System. See West Virginia Code 18-7A-3
- Prior service: means all service as a teacher completed prior to July 1, 1941, and all service of a present member who was employed as a teacher and did not contribute to a retirement account because he or she was legally ineligible for membership during the service. See West Virginia Code 18-7A-3
- Regular full-time employee: means any person employed by a county board who has a regular position or job throughout his or her employment term, without regard to hours or method of pay. See West Virginia Code 18-1-1
- Retirement system: means the State Teachers Retirement System established by this article. See West Virginia Code 18-7A-3
- School: means the students and teachers assembled in one or more buildings, organized as a unit. See West Virginia Code 18-1-1
- State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
