- Affected county: means a county in which any land of the district or agency is situated. See California Elections Code 10500
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- Age: refers to the chronological age of any individual who has reached a 40th birthday. See California Government Code 12926
- agency: means any district or agency of the type designated by and formed pursuant to the provisions of any principal act that incorporates this part. See California Elections Code 10500
- Agency: means the Labor and Workforce Development Agency. See California Labor Code 18.5
- Aggrieved person: includes any person who claims to have been injured by a discriminatory housing practice or believes that the person will be injured by a discriminatory housing practice that is about to occur. See California Government Code 12927
- Allegation: something that someone says happened.
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeals board: means the California Unemployment Insurance Appeals Board. See California Education Code 89529.15
- Appraisal: A determination of property value.
- Archival value: means the ongoing usefulness or significance of a record based on the administrative, legal, fiscal, evidential, or historical information it contains, justifying its permanent preservation. See California Government Code 12271
- Arrest: Taking physical custody of a person by lawful authority.
- Bag limit: means the maximum limit, in number or amount, of birds, mammals, fish, reptiles, or amphibians that may lawfully be taken by any one person during a specified period of time. See California Fish and Game Code 18
- Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Board: means the California Victim Compensation Board. See California Government Code 13951
- board: means any entity listed in Section 101, the entities referred to in Sections 1000 and 3600, the State Bar, the Department of Real Estate, and any other state agency that issues a license, certificate, or registration authorizing a person to engage in a business or profession. See California Business and Professions Code 31
- candidate: includes any officeholder who is subject to a recall election. See California Elections Code 305
- City: includes city and county. See California Business and Professions Code 18
- Commission: means the Fish and Game Commission, and "commissioner" means a member of the Fish and Game Commission. See California Fish and Game Code 30
- Commissioner: means the Labor Commissioner. See California Labor Code 2100
- Common disaster: A sudden and extraordinary misfortune that brings about the simultaneous or near-simultaneous deaths of two or more associated persons, such as husband and wife.
- Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
- Conduit: includes pipe, millrace, ditch, flume, siphon, tunnel, canal, and any other conduit or diversion used for the purpose of taking or receiving water from any river, creek, stream, or lake. See California Fish and Game Code 5900
- contestant: means any person initiating an election contest. See California Elections Code 16002
- Conviction: A judgement of guilt against a criminal defendant.
- County: includes city and county. See California Business and Professions Code 17
- County: includes "city and county. See California Code of Civil Procedure 17
- creed: include all aspects of religious belief, observance, and practice, including religious dress and grooming practices. See California Government Code 12926
- Crime: includes an act of terrorism, as defined in Section 2331 of Title 18 of the United States Code, committed against a resident of the state, whether or not the act occurs within the state. See California Government Code 13951
- Dam: includes all artificial obstructions. See California Fish and Game Code 5900
- Day: means calendar day, and "week" means calendar week. See California Fish and Game Code 35
- Decedent: A deceased person.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defined time period: means any unit of time measurement equal to or less than the duration of an employee's shift, and includes hours, minutes, and seconds and any fraction thereof. See California Labor Code 2100
- Delta: means the Sacramento-San Joaquin River Delta. See California Public Resources Code 75005
- Department: means the Civil Rights Department. See California Government Code 12925
- Department: means the Department of Human Resources. See California Government Code 19815
- Department: means the Department of Food and Agriculture. See California Food and Agricultural Code 32
- Department: means Department of Industrial Relations. See California Labor Code 19
- Department: means the Department of Fish and Wildlife. See California Fish and Game Code 37
- Derivative victim: means an individual who sustains pecuniary loss as a result of injury or death to a victim. See California Government Code 13951
- Director: means a member of the governing body. See California Elections Code 10500
- Director: means the Director of Civil Rights. See California Government Code 12925
- Director: means Director of Industrial Relations. See California Labor Code 20
- Director: means the Director of Fish and Wildlife. See California Fish and Game Code 39
- disabled: includes mental or physical illness and mental or physical injury including any illness or injury resulting from pregnancy, childbirth, or related medical condition. See California Education Code 89529.15
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Discrimination: includes refusal to sell, rent, or lease housing accommodations. See California Government Code 12927
- Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
- Dismissal: means dismissal for cause. See California Education Code 89530
- District: means fish and game district. See California Fish and Game Code 41
- Division: means the Division of Occupational Safety and Health. See California Labor Code 2100
- Division: means the Division of Labor Relations. See California Government Code 19815
- Docket: A log containing brief entries of court proceedings.
- Election: means any election including a primary that is provided for under this code. See California Elections Code 318
- Elections official: means any of the following:

- Elective office: means any office that may, under the principal act of the district or agency, be filled by way of an election. See California Elections Code 10500
- Elective officer: means "elective officer" as defined by the principal act of each district or agency or if not defined, any officer of a district or agency holding an office that can be filled by election. See California Elections Code 10500
- Elector: means a person who is a United States citizen 18 years of age or older and, except as specified in subdivision (b), is a resident of an election precinct in this state on or before the day of an election. See California Elections Code 321
- Employee: means a nonexempt employee who works at a warehouse distribution center. See California Labor Code 2100
- Employee: means any of the following:

- Employee work speed data: means information an employer collects, stores, analyzes, or interprets relating to an individual employee's performance of a quota, including, but not limited to, quantities of tasks performed, quantities of items or materials handled or produced, rates or speeds of tasks performed, measurements or metrics of employee performance in relation to a quota, and time categorized as performing tasks or not performing tasks. See California Labor Code 2100
- Employer: means a person who directly or indirectly, or through an agent or any other person, including through the services of a third-party employer, temporary service, or staffing agency or similar entity, employs or exercises control over the wages, hours, or working conditions of 100 or more employees at a single warehouse distribution center or 1,000 or more employees at one or more warehouse distribution centers in the state. See California Labor Code 2100
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Fiduciary: A trustee, executor, or administrator.
- Fish: means a wild fish, mollusk, crustacean, invertebrate, amphibian, or part, spawn, or ovum of any of those animals. See California Fish and Game Code 45
- Fishery: means both of the following:

- Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
- Full pay: means the gross base pay earnable by the employee and subject to retirement contribution if he or she had not vacated his or her position. See California Education Code 89529.02
- Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
- Gender: means sex, and includes a person's gender identity and gender expression. See California Government Code 12926
- Gender expression: means a person's gender-related appearance and behavior whether or not stereotypically associated with the person's assigned sex at birth. See California Government Code 12926
- General district election: means an election held pursuant to the provisions of this part. See California Elections Code 10500
- General election: means either of the following:

- Genetic information: includes any request for, or receipt of, genetic services, or participation in clinical research that includes genetic services, by an individual or any family member of the individual. See California Government Code 12926
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Governing body: means the board of directors of a district or agency or the board or body which governs the activities of the district or agency. See California Elections Code 10500
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
- Industrial disability leave: means temporary disability as defined in Divisions 4 (commencing with Section 3200) and 4. See California Education Code 89529.02
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
- item: includes , but is not limited to, any paper, document, book, map, artifact, or other type of record. See California Government Code 12220
- Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
- Labor Commissioner: means Chief of the Division of Labor Standards Enforcement. See California Labor Code 21
- Landowner voting district: means a district whose principal act requires an elector to be an owner of land located within the district. See California Elections Code 10500
- Law enforcement: means every district attorney, municipal police department, sheriff's department, district attorney's office, county probation department, and social services agency, the Department of Justice, the Department of Corrections, the Department of the Youth Authority, the Department of the California Highway Patrol, the police department of any campus of the University of California, California State University, or community college, and every agency of the State of California expressly authorized by statute to investigate or prosecute law violators. - Layoff: means separation from a position for lack of funds or lack of work. See California Education Code 89530
- license: means license, certificate, registration, or other means to engage in a business or profession regulated by this code or referred to in Section 1000 or 3600. See California Business and Professions Code 23.7
- Licensee: means any person authorized by a license, certificate, registration, or other means to engage in a business or profession regulated by this code or referred to in Sections 1000 and 3600. See California Business and Professions Code 23.8
- Local election: is a municipal, county, or district election. See California Elections Code 328
- Measure: means any constitutional amendment or other proposition submitted to a popular vote at any election. See California Elections Code 329
- Medical condition: means either of the following:

- Mental disability: includes , but is not limited to, all of the following:

- Mile: means either a statute mile (5,280 feet) or a nautical mile (6,077 feet) depending on the application. See California Fish and Game Code 55
- Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
- Municipal election: means elections in general law cities and where applicable in chartered cities. See California Elections Code 330
- Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Nomination documents: means declaration of candidacy and nomination papers. See California Elections Code 333
- Oath: A promise to tell the truth.
- Oath: includes affirmation. See California Elections Code 335
- On the bases enumerated in this part: means or refers to discrimination on the basis of one or more of the following: race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, genetic information, marital status, sex, age, sexual orientation, reproductive health decisionmaking, or veteran or military status. - Oral argument: An opportunity for lawyers to summarize their position before the court and also to answer the judges' questions.
- Overfishing: means a rate or level of taking that the best available scientific information, and other relevant information that the commission or department possesses or receives, indicates is not sustainable or that jeopardizes the capacity of a marine fishery to produce the maximum sustainable yield on a continuing basis. See California Fish and Game Code 98
- Oversight: Committee review of the activities of a Federal agency or program.
- Owner: includes the United States (except that for the purpose of Sections 5901, 5931, 5933, and 5938, "owner" does not include the United States as to any dam in the condition the dam existed on September 15, 1945), the State, a person, political subdivision, or district (other than a fish and game district) owning, controlling or operating a dam or pipe. See California Fish and Game Code 5900
- Permanent: means that the employee has a right to continued employment unless dismissed or laid off. See California Education Code 89530
- Person: means an individual, corporation, partnership, limited partnership, limited liability partnership, limited liability company, business trust, estate, trust, association, joint venture, agency, instrumentality, or any other legal or commercial entity, whether domestic or foreign. See California Labor Code 2100
- Person: includes one or more individuals, partnerships, associations, corporations, limited liability companies, legal representatives, trustees, trustees in bankruptcy, and receivers or other fiduciaries. See California Government Code 12925
- Person: includes a corporation as well as a natural person. See California Code of Civil Procedure 17
- Person: means any individual, partnership, association, corporation, limited liability company, or any organized group of persons whether incorporated or not. See California Food and Agricultural Code 38
- Person: means any person, association, organization, partnership, business trust, limited liability company, or corporation. See California Labor Code 18
- Person: means any natural person or any partnership, corporation, limited liability company, trust, or other type of association. See California Fish and Game Code 67
- Physical disability: includes , but is not limited to, all of the following:

- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
- Precinct: means a geographical area within a county that is made up of voters and is formed pursuant to Chapter 3 (commencing with Section 12200) of Division 12. See California Elections Code 338.6
- precinct board: means the board appointed by the elections official to serve at a vote center. See California Elections Code 339
- Primary election: includes all primary nominating elections provided for by this code. See California Elections Code 341
- Principal act: means the law providing for the creation of a particular district or agency or type of district or agency. See California Elections Code 10500
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Probate: Proving a will
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Process: signifies a writ or summons issued in the course of a judicial proceeding. See California Code of Civil Procedure 17
- Process: includes a writ or summons issued in the course of judicial proceedings of either a civil or criminal nature. See California Government Code 22
- Property: includes both personal and real property. See California Code of Civil Procedure 17
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Protection: means those actions necessary to prevent harm or damage to persons, property or natural resources or those actions necessary to allow the continued use and enjoyment of property or natural resources and includes acquisition, development, restoration, preservation and interpretation. See California Public Resources Code 75005
- Public defender: Represent defendants who can't afford an attorney in criminal matters.
- Purchase: means "buy" as defined in Section 24. See California Fish and Game Code 68
- Quota: means a work standard under which an employee is assigned or required to perform at a specified productivity speed, or perform a quantified number of tasks, or to handle or produce a quantified amount of material, within a defined time period and under which the employee may suffer an adverse employment action if they fail to complete the performance standard. See California Labor Code 2100
- Regular election: is a n election, the specific time for the holding of which is prescribed by law. See California Elections Code 348
- Reproductive health decisionmaking: includes , but is not limited to, a decision to use or access a particular drug, device, product, or medical service for reproductive health. See California Government Code 12926
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- Secretary: means the secretary of the governing body or a person designated by him or her to perform a duty of the secretary. See California Elections Code 10500
- Sell: includes offer or possess for sale, barter, exchange, or trade. See California Fish and Game Code 75
- Sequester: To separate. Sometimes juries are sequestered from outside influences during their deliberations.
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- Sex: includes , but is not limited to, the following:

- Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
- Subdivision: means a subdivision of the section in which that term occurs, unless some other section is expressly mentioned. See California Business and Professions Code 15
- Subdivision: means a subdivision of the section in which that term occurs unless some other section is expressly mentioned. See California Food and Agricultural Code 49
- Subdivision: means a subdivision of the section in which that term occurs unless some other section is expressly mentioned. See California Fish and Game Code 73
- Subpoena: A command to a witness to appear and give testimony.
- Summons: Another word for subpoena used by the criminal justice system.
- Take: means hunt, pursue, catch, capture, or kill, or attempt to hunt, pursue, catch, capture, or kill. See California Fish and Game Code 86
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
- trustees: means the Trustees of the California State University, created under Section 66600. See California Education Code 89000
- United States: means the United States of America, and in relation to any particular matter includes the officers, agents, employees, agencies, or instrumentalities authorized to act in relation thereto. See California Fish and Game Code 5900
- Uphold: The decision of an appellate court not to reverse a lower court decision.
- Venue: The geographical location in which a case is tried.
- Verdict: The decision of a petit jury or a judge.
- veteran: means any person who has served in the United States Army, Navy, Air Force, Marine Corps, Coast Guard, Space Force, or as an active nurse in the service of the American Red Cross, or in the Army and Navy Nurse Corps in time of war, or in any expedition of the Armed Forces of the United States, or who served in one of these services during the period September 16, 1940, to December 7, 1941, and received a discharge under conditions other than dishonorable. - Veteran or military status: means a member or veteran of the United States Armed Forces, United States Armed Forces Reserve, the United States National Guard, and the California National Guard. See California Government Code 12926
- Victim: means an individual who sustains injury or death as a direct result of a crime as specified in subdivision (e) of Section 13955. See California Government Code 13951
- Victim center: means a victim and witness assistance center that receives funds pursuant to §. See California Government Code 13951
- Violation: includes a failure to comply with any requirement of the code. See California Labor Code 22
- Voter: means a voter or elector as respectively defined in the principal act of each district or agency. See California Elections Code 10500
- Voter: means any elector who is registered under this code. See California Elections Code 359
- Warehouse distribution center: means an establishment as defined by any of the following North American Industry Classification System (NAICS) Codes, however that establishment is denominated:

- Writ: A formal written command, issued from the court, requiring the performance of a specific act.
