- activities of daily living: refers to an activity described in the long term care services eligibility screen. See Indiana Code 12-10-10-1.5
- adult protective services unit: refers to the entity with whom the division contracts to carry out the duties listed in section 8 of this chapter. See Indiana Code 12-10-3-1
- Allegation: something that someone says happened.
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- area agency: means an area agency on aging designated by the bureau under IC 12-10-1-4. See Indiana Code 12-10-5.7-1
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- assisted living services: refers to services covered under a waiver and provided in any of the following entities:

- Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
- Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
- Bequest: Property gifted by will.
- case management: means a service conducted locally by an area agency on aging that includes the following:

- Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
- commission: refers to the Indiana state commission on aging established by this chapter. See Indiana Code 12-10-2-1
- community and home care services: means services provided within the limits of available funding to an eligible individual. See Indiana Code 12-10-10-2
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Contract: A legal written agreement that becomes binding when signed.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- council: refers to the division of disability and rehabilitative services advisory council established by this chapter. See Indiana Code 12-9-4-1
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Dependent: A person dependent for support upon another.
- eligible individual: means an individual who meets the following criteria:

- endangered adult: means an individual who is:

- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Fraud: Intentional deception resulting in injury to another.
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- governmental entity: means an office or a department that is under the direct supervision of a local elected official or a county office. See Indiana Code 12-10-3-3
- Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- health facility: means a facility that is licensed under or subject to IC 16-28. See Indiana Code 12-10-5.5-2
- housing with services establishment: has the meaning set forth in IC 12-10-15-3. See Indiana Code 12-10-5.5-2.5
- in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
- incapacitated individual: means an individual who:

- individual with a disability: refers to an individual with a severe chronic disability that is attributable to a mental or physical impairment or combination of mental and physical impairments that is likely to continue indefinitely. See Indiana Code 12-10-10-3
- institution: means any of the following:

- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
- legal assistance developer: has the meaning set forth in Indiana Code 12-10-13-3.2
- legal representative: means :

- level of services: means a determination of the type of services an individual may receive under a Medicaid waiver based on the individual's impairment and dependence and the corresponding reimbursement rate for the determined level of care. See Indiana Code 12-10-11.5-8

- long term care facility: means any of the following:

- long term care services eligibility screen: refers to the long term care services eligibility screen used by the division in making eligibility determinations under this chapter. See Indiana Code 12-10-10-4.5
- minor: means a person less than eighteen (18) years of age. See Indiana Code 1-1-4-5
- Month: means a calendar month, unless otherwise expressed. See Indiana Code 1-1-4-5
- Oath: A promise to tell the truth.
- Oath: includes "affirmation" and "to swear" includes to "affirm". See Indiana Code 1-1-4-5
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- office: refers to the long term care ombudsman office established by this chapter. See Indiana Code 12-10-13-4
- office: includes the following:

- ombudsman: means an individual or entity designated by the state ombudsman to investigate and resolve local complaints and concerns regarding the health, safety, welfare, or rights of residents. See Indiana Code 12-10-13-4.5
- Population: has the meaning set forth in Indiana Code 1-1-4-5
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
- program: means a dementia care specialist program established by an area agency under this chapter. See Indiana Code 12-10-5.7-2
- program: refers to the community and home options to institutional care for the elderly and disabled program established by this chapter. See Indiana Code 12-10-10-5
- Property: includes personal and real property. See Indiana Code 1-1-4-5
- protective services: refers to available medical, psychiatric, residential, and social services that are necessary to protect the health or safety of an endangered adult. See Indiana Code 12-10-3-5
- provider: refers to a regional guardianship services provider. See Indiana Code 12-10-7-3
- Quorum: The number of legislators that must be present to do business.
- region: means a service provision region established by the division by rule adopted under IC 4-22-2. See Indiana Code 12-10-7-4
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- Sheriff: means the sheriff of the county or another person authorized to perform sheriff's duties. See Indiana Code 1-1-4-5
- specialist: means a dementia care specialist designated by an area agency to administer a program under section 4 of this chapter. See Indiana Code 12-10-5.7-3
- state ombudsman: refers to the individual appointed by the secretary or the secretary's designee to run the state long term care ombudsman program and office under Indiana Code 12-10-13-6
- Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
- Testify: Answer questions in court.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
- Verified: when applied to pleadings, means supported by oath or affirmation in writing. See Indiana Code 1-1-4-5
- Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
