- ABLE account: refers to an achieving a better life experience (ABLE) account established by an eligible individual that:

- Abstract of judgment: In a federal criminal proceeding, A certification from a U.S. District Court clerk that a judgment of restitution was entered against the defendant owing to the victim. If the defendant inherits, owns, or sells real property or holdings, these assets can then be attached at the state and local levels as well.
- accident response service fee: means a fee imposed for any of the following:

- Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
- administrator: means a natural person who administers, manages, supervises, or is in general administrative charge of a housing with services establishment. See Indiana Code 12-10-15-1.5
- adult protective services unit: refers to the entity with whom the division contracts to carry out the duties listed in section 8 of this chapter. See Indiana Code 12-10-3-1
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- advisory committee: refers to the 211 advisory committee established by section 9 of this chapter. See Indiana Code 12-13-16-3
- affected agency: means any of the following:

- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- agency: means a department, a commission, a council, a board, a bureau, a division, a service, an office, or an administration that is responsible for providing services to infants and toddlers with disabilities and their families, including the following:

- agent: refers to a person who is charged with the responsibility of navigating and operating a personal delivery device. See Indiana Code 9-21-11.5-1
- aggregate: has the meaning set forth in Indiana Code 9-20-4-0.5
- alcoholic beverage: has the meaning set forth in Indiana Code 9-30-15-1
- Allegation: something that someone says happened.
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.

- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
- Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
- authority: refers to the Indiana finance authority. See Indiana Code 9-21-3.5-1
- authority: refers to the achieving a better life experience (ABLE) authority created by section 9 of this chapter. See Indiana Code 12-11-14-2
- autism: means an autism spectrum disorder that is described in the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders of the American Psychiatric Association. See Indiana Code 12-11-8-1
- Autism: means a neurological condition as described in the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders of the American Psychiatric Association. See Indiana Code 1-1-4-5
- automated traffic law enforcement system: means a device that:

- backfill employee: means an employee of a political subdivision who performs the duties of a mobile support unit member during the deployment of the mobile support unit member to assist another state under the Emergency Management Assistance Compact. See Indiana Code 10-14-3-0.5

- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Balanced budget: A budget in which receipts equal outlays.
- Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Bequest: Property gifted by will.
- bias crime: means an offense in which the person who commits the offense knowingly or intentionally:

- center for independent living: means a consumer controlled, community based, cross-disability, nonresidential private nonprofit agency that:

- certificated employee: has the meaning set forth in IC 20-29-2-4. See Indiana Code 10-13-3-3
- Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
- citation: means any summons, ticket, or other official document issued by a police officer for a traffic violation containing an order that requires the motorist to respond. See Indiana Code 9-28-2-1
- Civil penalty: means any monetary penalty levied on a licensee or registrant because of violations of statutes, regulations, licenses, or registration certificates, but does not include criminal penalties. See Indiana Code 10-19-12-4
- class I child care home: means a child care home that serves any combination of full-time and part-time children, not to exceed at any one (1) time twelve (12) children plus three (3) children who are enrolled in at least full-day kindergarten. See Indiana Code 12-7-2-33.7
- class II child care home: means a child care home that serves more than twelve (12) children but not more than any combination of sixteen (16) full-time and part-time children at any one (1) time. See Indiana Code 12-7-2-33.8
- clean claim: means a claim submitted by a provider for payment under the Medicaid program that can be processed without obtaining additional information from:

- Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
- Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
- collateral: means any cash or other security deposited to secure an appearance for trial following the issuance by a police officer of a citation for a traffic violation. See Indiana Code 9-28-2-2

- Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.

- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.

- council: means the security and privacy council established by section 34 of this chapter. See Indiana Code 10-13-3-4
- council: refers to the division of disability and rehabilitative services advisory council established by this chapter. See Indiana Code 12-9-4-1
- council: means the statewide independent living council established by section 6 of this chapter. See Indiana Code 12-12-8-2.5
- council: refers to the interagency coordinating council established by section 7 of this chapter. See Indiana Code 12-12.7-2-2

- counseling: means the activities conducted by a pharmacist to inform Medicaid recipients about the proper use of drugs as required by the board under this chapter. See Indiana Code 12-15-35-4

- court: means a tribunal with jurisdiction to hear and determine traffic violation cases and the judge or other presiding officer sitting as a court. See Indiana Code 9-30-3-2

- covered medical services: refers to medical services that meet the following qualifications:

- criminal history data: means information collected by criminal justice agencies, the United States Department of Justice for the department's information system, or individuals. See Indiana Code 10-13-3-5
- criminal justice agency: means any agency or department of any level of government whose principal function is:

- criteria: means the predetermined and explicitly accepted elements that are used to measure drug use on an ongoing basis to determine if the use is appropriate, medically necessary, and not likely to result in adverse medical outcomes. See Indiana Code 12-15-35-5
- cross-disability: means , with respect to a center for independent living, that a center provides independent living services to individuals representing a range of significant disabilities and does not require the presence of one (1) or more specific significant disabilities before determining that an individual is eligible for independent living services. - cross-indicated drug: means a drug that is used for a purpose generally held to be reasonable, appropriate, and within the community standards of practice even though the use is not included in the federal Food and Drug Administration's approved labeled indications for the drug. - current year inflation adjustment factor: means the total gross domestic product deflator, as determined by the United States Department of Commerce's Bureau of Economic Analysis, in the current year divided by the total gross domestic product deflator in federal fiscal year 2010. - Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Decedent: A deceased person.
- Decommissioning: means final operational activities at a facility to dismantle site structures, to decontaminate site surfaces and remaining structures, to stabilize and contain residual radioactive material, and to carry out any other activities to prepare the site for postoperational care. - Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

- disposition: means information disclosing that criminal proceedings have been concluded or indefinitely postponed. See Indiana Code 10-13-3-7

- Donee: The recipient of a gift.
- Donor: The person who makes a gift.
- DUR: means the program designed to measure and assess on a retrospective and a prospective basis the proper use of outpatient drugs in the Medicaid program. See Indiana Code 12-15-35-8
- early intervention services: means developmental services that meet the following conditions:

- energy emergency: means an existing or projected shortfall of at least eight percent (8%) of motor fuel or of other energy sources that threatens to seriously disrupt or diminish energy supplies to the extent that life, health, or property may be jeopardized. See Indiana Code 10-14-3-5
- Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
- entity: means a person other than an individual. See Indiana Code 10-14-3.5-5
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. - Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. - region: means a service provision region established by the division by rule adopted under IC 4-22-2. See Indiana Code 12-10-7-4
- register: means to report in person to a local law enforcement authority and provide the information required under section 8 of this chapter. See Indiana Code 11-8-8-4
- Registration: means registration with the department in accordance with rules and regulations adopted pursuant to this chapter. See Indiana Code 10-19-12-4
- rehabilitation technology: means the provision of physical devices or the adaptation of the physical environment to enable persons with physical disabilities to perform everyday activities in a workplace, in an educational setting, or in a home or other place of residence. See Indiana Code 12-12-6-1
- release: means furnishing a copy or an edited copy of criminal history data. See Indiana Code 10-13-3-17
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Remand: When an appellate court sends a case back to a lower court for further proceedings.
- reportable offenses: means all felonies and those misdemeanors the superintendent designates. See Indiana Code 10-13-3-18
- Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
- request: means asking for release or inspection of a limited criminal history by noncriminal justice organizations or individuals in a manner that:

- Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
- resident: means an individual who has a contract to reside in a housing with services establishment. See Indiana Code 12-10-15-5
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- retrospective DUR: means the part of the drug utilization review program that assesses or measures drug use based on an historical review of drug use data against predetermined and explicit criteria and standards that are developed on an ongoing basis with professional input. - rider coach trainer: means a licensed motorcycle operator who meets standards established by the bureau for instructors in motorcycle safety and education. See Indiana Code 9-27-7-2
- Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
- school age child care program: means a program operated by a school corporation or a nonprofit organization that offers care to children who are at least five (5) years of age but less than fifteen (15) years of age for the following periods of time:

- school corporation: has the meaning set forth in IC 20-18-2-16. See Indiana Code 10-13-3-20
- school property: means any property owned, rented, leased, or operated by:

- scope of practice: means the extent of the authorization to provide health or veterinary services granted to a health practitioner by a license issued to the practitioner in the state in which the principal part of the practitioner's services are rendered, including conditions imposed by the licensing authority. - serum PFAS levels: means the level of PFAS chemicals in an individual's blood. See Indiana Code 10-19-13-4
- Service of process: The service of writs or summonses to the appropriate party.
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- sex offender: means a person convicted of any of the following offenses:

- sexually violent predator: has the meaning set forth in Indiana Code 11-8-8-6
- Sheriff: means the sheriff of the county or another person authorized to perform sheriff's duties. See Indiana Code 1-1-4-5
- site closure: means all activities performed at a waste disposal site, such as stabilization and contouring, to assure that the site is in a stable condition so that only minor custodial care, surveillance, and monitoring are necessary at the site following termination of a licensed operation. - SNAP: refers to the federal Supplemental Nutrition Assistance Program under Indiana Code 12-14-30-1
- social networking web site username: means an identifier or profile that allows a person to create, use, or modify a social networking web site, as defined in Indiana Code 11-8-8-1.8
- Source material: means uranium or thorium, or any combination thereof, in any physical or chemical form, or ores which contain by weight one-twentieth of one percent (0. See Indiana Code 10-19-12-4
- Source material mill tailings: means the tailings or wastes produced by the extraction or concentration of uranium or thorium from any ore processed primarily for its source material content, including discrete surface wastes resulting from underground solution extraction processes, but not including underground ore bodies depleted by such solution extraction processes. - Sources of radiation: means collectively, radioactive material and radiation generating equipment. See Indiana Code 10-19-12-4
- special education cooperative: has the meaning set forth in IC 20-35-5-1(8). See Indiana Code 10-13-3-21
- special needs: means any of the following:

- Specific license: means a license, issued to a named person upon application filed under the regulations promulgated under this chapter, to use, manufacture, produce, transfer, receive, acquire, or possess quantities of, or devices or equipment utilizing, radioactive material. - Spent nuclear fuel: means irradiated nuclear fuel that has undergone at least one (1) year's decay since being used as a source of energy in a power reactor. See Indiana Code 10-19-12-4
- standards: means the acceptable range of deviation from the criteria that reflects local medical practice and that is tested on the Medicaid recipient database. See Indiana Code 12-15-35-15
- state: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or a territory or an insular possession subject to the jurisdiction of the United States. See Indiana Code 10-14-3.5-13
- state ombudsman: refers to the individual appointed by the secretary or the secretary's designee to run the state long term care ombudsman program and office under Indiana Code 12-10-13-6
- state plan: means the materials jointly developed and submitted by the council and the division to the commissioner containing the state's proposals for the following:

- Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
- Subpoena: A command to a witness to appear and give testimony.
- Subpoena duces tecum: A command to a witness to produce documents.
- Summons: Another word for subpoena used by the criminal justice system.
- supportive services: means help with personal laundry, handling or assisting with personal funds of the residents, or arranging for medical services, health related services, or social services. See Indiana Code 12-10-15-6
- SURS: refers to the surveillance utilization review system of the Medicaid program. See Indiana Code 12-15-35-16
- TANF assistance group: means persons whose income, resources, or needs are considered in determining one (1) or both of the following:

- Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
- Testify: Answer questions in court.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- therapeutic category: means a group of pharmacologic agents primarily characterized by a significant similarity of the biochemical or physiological mechanism by which these agents result in the intended clinical outcome. See Indiana Code 12-15-35-17.5
- third party: means a person having possession of a certificate of title for a vehicle because the person has a lien or an encumbrance indicated on the certificate of title. See Indiana Code 9-32-4-0.5
- toll road: has the meaning set forth for "toll road project" in IC 8-15-2-4(4). See Indiana Code 9-21-3.5-7
- toll violation: refers to the failure to pay a toll or user fee required under section 9 or 9. See Indiana Code 9-21-3.5-7.5
- tollway: has the meaning set forth in IC 8-15-3-7. See Indiana Code 9-21-3.5-8
- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
- Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
- Transuranic waste: means radioactive waste containing alpha emitting transuranic elements, with radioactive half-lives greater than five (5) years, in excess of ten (10) nanocuries per gram. See Indiana Code 10-19-12-4
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC

- unidentified person: means a deceased or mentally incapacitated person whose identity is unknown. See Indiana Code 10-13-3-22

- United States flag: refers to a United States flag flown on property owned or controlled by the state. See Indiana Code 10-18-9-7
- unrestricted access: means the ability of a recipient to obtain a prescribed drug without being subject to limits or preferences imposed by the office or the board for the purpose of cost savings except as provided under section 7 of this chapter. See Indiana Code 12-15-35.5-2.5
- User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
- vehicular substance offense: means any misdemeanor or felony in which operation of a vehicle while intoxicated, operation of a vehicle in excess of the statutory limit for alcohol, or operation of a vehicle with a controlled substance or its metabolite in the person's body, is a material element. See Indiana Code 9-30-15.5-1
- Venue: The geographical location in which a case is tried.
- Verified: when applied to pleadings, means supported by oath or affirmation in writing. See Indiana Code 1-1-4-5
