- Accident: shall mean any event that results in injury or property damage attributable directly or indirectly to the motion of a motor vehicle or its load. See New Hampshire Revised Statutes 259:1-a
- Active duty: means full-time duty as an enlisted member, or as a commissioned or warrant officer, in any branch of the armed forces. See New Hampshire Revised Statutes 21:50
- ADS: means the hardware and software that are collectively capable of performing all aspects of the dynamic driving task within its operational design domain, if any, including achieving a minimal risk condition, without any intervention or supervision by a conventional human driver. See New Hampshire Revised Statutes 242:1
- ADS-equipped vehicle: means a vehicle equipped with an automated driving system. See New Hampshire Revised Statutes 242:1
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Airboat: means any shallow-draft boat propelled by an airplane propeller and steered by an airplane rudder or any boat, including a hovercraft, which is designed to travel on a cushion of air on or within 2 feet of the water, not including any mechanical device which also functions as an airplane. See New Hampshire Revised Statutes 270:2
- Alcohol: shall mean any substance containing any form of alcohol, including but not limited to, ethanol, methanol, propanol and isopropanol. See New Hampshire Revised Statutes 259:3-a
- Alcohol concentration: shall mean either grams of alcohol per 100 milliliters of blood, grams of alcohol per 67 milliliters of urine, or grams of alcohol per 210 liters of breath. See New Hampshire Revised Statutes 259:3-b
- Allegation: something that someone says happened.
- Alternative fuel: means any source of fuel, other than motor fuel and electricity, used to propel a motor vehicle over the ways of the state. See New Hampshire Revised Statutes 259:3-d
- Alternative fuel dealer: means any person who sells, produces, or refines alternative fuel for use in a motor vehicle as defined in N. See New Hampshire Revised Statutes 259:3-e
- Alternative fuel dispenser: shall mean a machine specifically used at an alternative fuel dealer that is used to pump compressed natural gas, liquid natural gas, propane, or other types of alternative fuel directly into a motor vehicle for use on the ways of the state. See New Hampshire Revised Statutes 259:3-f
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Armed forces: means the United States Army, Army Reserve, Navy, Naval Reserve, Marine Corps, Marine Corps Reserve, Air Force, Air Force Reserve, Space Force, Coast Guard, Coast Guard Reserve, Army National Guard, and the Air National Guard. See New Hampshire Revised Statutes 21:50
- Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
- Arrest: Taking physical custody of a person by lawful authority.
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Auto wholesale dealer: shall mean any person with an established place of business, who is exclusively engaged in the business of purchasing vehicles requiring registration for use upon a way, for resale to a retail or wholesale dealer. See New Hampshire Revised Statutes 259:5-a
- Autocycle: means a 3-wheeled motor vehicle that has a steering wheel and seating that does not require the operator to straddle or sit astride, is equipped with safety belts for all occupants and is manufactured to comply with federal safety requirements for motorcycles. See New Hampshire Revised Statutes 259:4-d
- Automobile transporter: means any vehicle combination designed and used specifically for the transport of assembled vehicles capable of being driven on the highway. See New Hampshire Revised Statutes 259:4-b
- Automobile utility trailer: shall mean any trailer suitable for towing by a passenger automobile or pick-up truck, and which is being towed by such vehicle for the purpose of hauling personal property intrastate or interstate; excepting such trailers when hauling livestock. See New Hampshire Revised Statutes 259:5
- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
- Bequest: Property gifted by will.
- Bicycle: shall mean every pedalled vehicle propelled by human power upon which any person may ride, except child's tricycles and similar devices. See New Hampshire Revised Statutes 259:6
- biennially: when applied to meetings and elections in towns, shall mean the biennial meetings and elections required by law to be holden in the month of November biennially, dating from the commencement of biennial elections in 1878; and the word "annual" when applied to meetings and elections in towns, shall mean the annual meetings and elections required by law to be holden in the month of March. See New Hampshire Revised Statutes 21:7
- Biodiesel: means a renewable special fuel that is composed of mono-alkyl esters of long chain fatty acids, is derived from vegetable oils or animal fats, and meets the American Society for Testing and Materials (ASTM) specifications D6751. See New Hampshire Revised Statutes 259:6-a
- Bus: shall mean every motor vehicle designed for carrying more than 10 passengers and used for transportation of persons; and every motor vehicle, other than a taxicab, designed and used for the transportation of persons for compensation. See New Hampshire Revised Statutes 259:7
- Business district: shall mean the territory contiguous to a highway when 50 percent or more of the frontage thereon for a distance of 300 feet or more is mainly occupied by dwellings or by dwellings and buildings in use for business. See New Hampshire Revised Statutes 259:8
- bylaw: when used in reference to legislative action taken by a city, town, county or village district shall have the same meaning as an ordinance and shall be subject to the same procedures for enactment. See New Hampshire Revised Statutes 21:45
- Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
- CDL: shall mean a license issued by the department in accordance with the requirements of N. See New Hampshire Revised Statutes 259:12-c
- Certificate: shall mean :

- Citation: shall mean any citation, summons, ticket or other document issued by an arresting officer for violation of a law, ordinance or rule, pertaining to motor vehicle traffic, ordering the arrested motorist to appear. See New Hampshire Revised Statutes 259:10
- Combination vehicle: shall mean a combination of truck-tractor and semi-trailer, or a combination of truck-tractor, semi-trailer, and full trailer, being driven together as an articulated unit. See New Hampshire Revised Statutes 259:11-a
- Commerce: shall mean :
I. See New Hampshire Revised Statutes 259:12-a - commercial boat: shall mean :
(a) Any boat used as a common carrier of passengers or property operating on a regular schedule; or
(b) Any boat propelled by electric or mechanical power carrying passengers for hire; or
(c) Any such boat or outboard motor when rented either separately or in connection with camps, cottages or other real estate; provided, however, any applicant applying for a commercial boat registration pursuant to this subparagraph shall certify that said application is bona fide and that the applicant does in fact rent the boat or outboard motor on a regular commercial basis either separately or in connection with the camp, cottage or other real estate under penalty of perjury. See New Hampshire Revised Statutes 270:2 - Commercial driver: shall mean a person who drives a commercial motor vehicle as defined in N. See New Hampshire Revised Statutes 259:12
- Commercial driver learner permit: shall mean a permit issued pursuant to N. See New Hampshire Revised Statutes 259:12-b
- Commercial motor vehicle: shall mean a motor vehicle or a combination of motor vehicles, used in commerce, to transport passengers or property if:
(a) The vehicle has a gross vehicle weight rating of 26,001 pounds or more;
(b) The vehicle has a gross combination weight rating or actual weight of 26,001 or more pounds, inclusive of any towed unit with gross vehicle weight rating or actual weight of more than 10,000 pounds;
(c) The vehicle is designed or used to transport 16 or more passengers, including the driver; or
(d) The vehicle is of any size and is used in the transportation of hazardous materials required to be placarded under 49 C. See New Hampshire Revised Statutes 259:12-e - Commissioner: shall mean the commissioner of safety. See New Hampshire Revised Statutes 259:13
- common carrier: means any person who undertakes, directly, or by his agent or under a lease or any other arrangement, to transport passengers or property on the public waters of the state operating on a regular schedule, for compensation. See New Hampshire Revised Statutes 270:2
- Compact utility tractor: shall mean any self-propelled 4-wheel vehicle utilizing diesel fuel, with a rated horsepower not to exceed 28 horsepower, that is capable of carrying not more than one occupant, is equipped by the manufacturer with at least one PTO (power take-off) in addition to any PTO installed for the purpose of an under-tractor mower deck, and has no provision for carrying a load other than attached implements such as snowplows, tool boxes, or bucket loaders. See New Hampshire Revised Statutes 259:13-a
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Construction equipment: shall mean all bulldozers, rollers, scrapers, graders, spreaders, pavers, bituminous mixers, retreading machines, compressors, power shovels, excavators, backhoes, wagons, concrete mixers, generators, message boards, wood chippers, bucket loaders, snow loaders, rooters, scarifiers and construction tractors, and such other items of equipment which in the opinion of the director should be classified as construction equipment. See New Hampshire Revised Statutes 259:42
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Controlled substance: shall mean any substance so classified under section 102(6) of the Controlled Substances Act (21 USC section 802(6)), and includes all substances listed on schedules I through V of 21 C. See New Hampshire Revised Statutes 259:13-b
- Conventional human driver: means a natural person who manually engages in-vehicle braking, accelerating, steering, and transmission gear selection input devices in order to operate a vehicle. See New Hampshire Revised Statutes 242:1
- Conviction: A judgement of guilt against a criminal defendant.
- Conviction: shall mean an adjudication of guilt which has not been annulled or vacated, a determination that a person has violated or failed to comply with the law in a court of original jurisdiction or an administrative proceeding, an unvacated forfeiture of bail or collateral deposited to secure the person's appearance in court, a plea of guilty or nolo contendere accepted by the court, the payment of a fine or court costs, or the violation of a condition of release without bail, regardless of whether the penalty is rebated, suspended or otherwise affected by probation. See New Hampshire Revised Statutes 259:14
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Crosswalk: shall mean that part of a highway at an intersection included within the connections of the lateral lines on opposite sides of the highway measured from the curbs, or in the absence of curbs from the edges of the traversable highway or any portion of a highway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface. See New Hampshire Revised Statutes 259:17
- Custom vehicle: shall mean any motor vehicle that is at least 30 model years old and has been altered from the manufacturer's original design or has a body constructed from non-original materials, but which is not a street rod and does not weigh more than 6,000 pounds. See New Hampshire Revised Statutes 259:17-a
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Dealer: shall mean a retail vehicle dealer or an auto wholesale dealer. See New Hampshire Revised Statutes 259:18
- Decedent: A deceased person.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Defense attorney: Represent defendants in criminal matters.
- Department: shall mean the department of safety of the state of New Hampshire. See New Hampshire Revised Statutes 259:19
- Dependent: A person dependent for support upon another.
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- Devise: To gift property by will.
- Director: shall mean the director of the division of motor vehicles of the department of safety. See New Hampshire Revised Statutes 259:20
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Disqualification: shall mean a prohibition against driving a commercial motor vehicle. See New Hampshire Revised Statutes 259:20-a
- Division: shall mean the division of motor vehicles in the department of safety. See New Hampshire Revised Statutes 259:22
- Domicile: shall mean a natural person taking up residence in a town or city within the state and includes but is not limited to occupying a primary place of habitation, placing children in a public school within the state, accepting gainful employment, or being a registered voter liable for a resident tax, provided, however, that no person shall be considered to be domiciled in this state who simultaneously claims residence in any other state for any of the purposes indicated above. See New Hampshire Revised Statutes 259:23
- Donor: The person who makes a gift.
- Dower: A widow
- Driver: shall mean a person who drives or is in actual physical control of a motor vehicle as defined in N. See New Hampshire Revised Statutes 259:25
- Driverless capable vehicle: means a vehicle equipped with an automated driving system capable of performing all aspects of the dynamic driving task within its operational design domain, if any, including achieving a minimal risk condition, without any intervention or supervision by a conventional human driver. See New Hampshire Revised Statutes 242:1
- Driverless operation: means a mode of ADS-equipped vehicle operation in which either no on-board user is present, or in which on-board users who are present are not conventional human drivers. See New Hampshire Revised Statutes 242:1
- Duplicate copy: when used in reference to a driver's license, shall mean an additional license so marked containing a new photograph made when the additional license is obtained. See New Hampshire Revised Statutes 259:27
- Dynamic driving task: means all of the real-time operational and tactical functions required to operate a vehicle in on-road traffic within its specific operational design domain, if any, excluding the strategic functions such as trip scheduling and selection of destinations and waypoints. See New Hampshire Revised Statutes 242:1
- Electric bicycle: shall mean a pedaled vehicle equipped with an electric motor of less than 750 watts that falls within one of the following 3 classes:
I. See New Hampshire Revised Statutes 259:27-a - Emergency vehicles: shall mean all vehicles of fire departments and police departments, the state department of corrections, and such ambulances and emergency vehicles of municipal departments or public service corporations as authorized by the director. See New Hampshire Revised Statutes 259:28
- Enhanced technology ignition interlock device: shall mean an ignition interlock device equipped with a camera and which will transmit data as events occur and is capable of capturing and encoding as events occur a digital or photographic image of the vehicle driver including the time, date, and breath alcohol level of all breath attempts. See New Hampshire Revised Statutes 259:28-b
- Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Established place of business: shall mean :

- exclusively engaged: shall mean the retail sale of less than 5 motor vehicles in any state in any 12-month period. See New Hampshire Revised Statutes 259:5-a
- Executor: A male person named in a will to carry out the decedent
- Explosives: shall mean any chemical compound or mechanical mixture as defined in the rules adopted by the director of state police pursuant to N. See New Hampshire Revised Statutes 259:31
- farm: means any land, buildings, or structures on or in which agriculture and farming activities are carried out or conducted and shall include the residence or residences of owners, occupants, or employees located on such land. See New Hampshire Revised Statutes 259:32
- Fiduciary: A trustee, executor, or administrator.
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Fiscal year: shall mean the year beginning July 1 and ending June 30. See New Hampshire Revised Statutes 259:33
- FMVSS: shall mean the federal motor vehicle safety standards as contained in the code of federal regulations (CFR). See New Hampshire Revised Statutes 259:35
- following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
- Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
- Foreign jurisdiction: shall mean any jurisdiction other than a state of the United States. See New Hampshire Revised Statutes 259:35-a
- Fraud: Intentional deception resulting in injury to another.
- Fraudulent practices: when used in reference to drivers' schools, shall mean, but not be limited to:
I. See New Hampshire Revised Statutes 259:36 - Full trailer: shall mean any trailer being towed behind a semi-trailer as part of a combination vehicle also known as twin-trailers or "double bottoms. See New Hampshire Revised Statutes 259:37-a
- Garage: shall mean every place where 5 or more motor vehicles are stored or housed at any one time, except such places in which motor vehicles are kept by the owners thereof without payment for storage. See New Hampshire Revised Statutes 259:38
- Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
- Gasoline: shall mean all products commonly or commercially known or sold as gasoline, including casinghead and absorption of natural gasoline, regardless of their classification or uses, and any liquid prepared, advertised, offered for sale, or sold for use as or commonly and commercially used as a fuel in internal combustion engines, which when subjected to distillation in accordance with the standard method of test for distillation of gasoline, naphtha, kerosene, and similar petroleum products (ASTM Designation D-86) show not less than 10 percent distilled (recovered) below 347 degrees Fahrenheit (175 degrees Centigrade) and not less than 95 percent distilled (recovered) below 464 degrees Fahrenheit (240 degrees Centigrade); provided that the term gasoline shall not include commercial solvents or naphthas which distill by ASTM method D-86 not more than 9 percent at 176 degrees Fahrenheit and which have a distillation range of 150 degrees Fahrenheit or less, or liquified gases which would not exist as liquid at a temperature of 60 degrees Fahrenheit and a pressure of 14. - GCWR: shall mean the value specified by the manufacturer as the maximum loaded weight of a combination (articulated) vehicle. See New Hampshire Revised Statutes 259:38-a
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- governing body: shall mean the board of selectmen in a town, the board of aldermen or council in a city or town with a town council, the school board in a school district or the village district commissioners in a village district, or when used to refer to unincorporated towns or unorganized places, or both, the county commissioners. See New Hampshire Revised Statutes 21:48
- governor and council: shall mean the governor with the advice and consent of the council. See New Hampshire Revised Statutes 21:31-a
- Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Habitual offender: means any resident or nonresident person whose record, as maintained in the office of the division, shows that such person has accumulated convictions in the number provided in paragraph I, II or III of this section for those offenses listed therein and committed within a 5-year period, based on the date of the offense. See New Hampshire Revised Statutes 259:39
- Hazardous materials: shall mean hazardous materials as defined in N. See New Hampshire Revised Statutes 259:40
- Heavy duty recovery vehicle: shall mean a wrecker that:
I. See New Hampshire Revised Statutes 259:40-b - Ignition interlock device: shall mean breath alcohol ignition interlock device or enhanced technology ignition interlock device, which is a system or device that connects a breath analyzer to a motor vehicle's ignition system. See New Hampshire Revised Statutes 259:43-a
- Imminent hazard: shall mean the existence of a condition that presents a substantial likelihood that death, serious illness, severe personal injury, or a substantial endangerment to health, property, or the environment may occur before the reasonably foreseeable completion date of a formal proceeding begun to lessen the risk of that death, illness, injury, or endangerment. See New Hampshire Revised Statutes 259:43-c
- Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
- Intersecting way: shall mean any way which joins another at an angle, whether it crosses the other or not. See New Hampshire Revised Statutes 259:45
- Intestate: Dying without leaving a will.
- Judgment: shall mean any judgment which shall have become final, rendered by a court of competent jurisdiction of any state, or of the United States. See New Hampshire Revised Statutes 259:46
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- License: shall mean any driver's license or any other license or permit to drive a vehicle issued under the laws of this state or a reciprocating state including:

- Lienholder: shall mean a person holding a security interest in a vehicle. See New Hampshire Revised Statutes 259:49
- Light truck: shall mean any motor truck having no more than 2 axles. See New Hampshire Revised Statutes 259:50
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- maintained for use: shall mean a motor vehicle or motorcycle in its original condition or restored to original or better condition and not intended for daily use. See New Hampshire Revised Statutes 259:4
- Minimal risk condition: means a reasonably safe state to which an automated driving system brings an ADS-equipped vehicle upon experiencing a performance-relevant failure of the vehicle's automated driving system that renders the automated driving system unable to perform the entire dynamic driving task, such as bringing the vehicle to a complete stop and activating the hazard lamps. See New Hampshire Revised Statutes 242:1
- Mixed use school bus: shall mean a station wagon, suburban, sport utility vehicle, passenger van, panel body vehicle, or vehicle converted to a school bus, owned or leased by a public school or private school and driven by a school employee, which bears a valid state inspection sticker and is employed principally in transporting schoolchildren to and from school activities. See New Hampshire Revised Statutes 259:96-a
- Mobile carrier: means an electrically powered device that:

See New Hampshire Revised Statutes 259:56-b - modified: means , but is not limited to, a substantial and material alteration or replacement of the engine, drive-train, suspension or brake system or alteration of the body which may be chopped, channelled, sectioned, filled or otherwise changed dimensionally from the original manufactured body. - month: shall mean a calendar month, and the word "year" a calendar year, unless otherwise expressed; and the word "year" shall be equivalent to the expression "year of our Lord. See New Hampshire Revised Statutes 21:8
- Moped: shall mean a motor-driven cycle whose speed attainable in one mile is 30 miles per hour or less; if an internal combustion engine is used, the piston displacement shall not exceed 50 cubic centimeters and the power-drive system shall not require the operator to shift gears. See New Hampshire Revised Statutes 259:57
- Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
- Mortgagee: The person to whom property is mortgaged and who has loaned the money.
- Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
- Motor fuel: shall mean all products used in an internal combustion engine for the generation of power to propel motor vehicles or mechanical contrivances on or over the ways of this state. See New Hampshire Revised Statutes 259:58
- Motor home: shall mean a self-propelled, completely self-contained vehicle that includes the conveniences of a home, including cooking, sleeping, and permanent sanitary facilities, and a driver's seat that is accessible in a walking position from the living quarters. See New Hampshire Revised Statutes 259:58-a
- Motor truck: shall mean any truck of greater than 26,000 pounds manufacturer's gross vehicle weight rating, or any motor vehicle equipped with other than pneumatic tires. See New Hampshire Revised Statutes 259:59
- Motor vehicle: shall mean :
I. See New Hampshire Revised Statutes 259:60 - Motor vehicle business: shall mean a business which is principally engaged in one or more of the following activities: buying, selling, or exchanging motor vehicles requiring registration for use upon a way, motor vehicle mechanical service, motor vehicle collision repair service, the reconditioning and restoration of motor vehicles, and the sale of motor vehicle parts. See New Hampshire Revised Statutes 259:60-a
- Motor vehicle liability policy: shall mean a policy of liability insurance which provides:

- Motorcycle: shall mean every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than 3 wheels in contact with the ground, but excluding electric bicycles, tractors, and mopeds. See New Hampshire Revised Statutes 259:63
- Motorcycle driver: shall mean any person who drives a motorcycle. See New Hampshire Revised Statutes 259:64
- Muffler: shall mean a device consisting of a series of chambers or baffleplates or other mechanical design for the purpose of receiving exhaust gases and effectively reducing noise. See New Hampshire Revised Statutes 259:66
- Neighborhood electric vehicle: shall mean any 4-wheeled electric vehicle that has a maximum speed which is greater than 20 miles per hour but not greater than 25 miles per hour, and which complies with the federal safety standards established in 49 C. See New Hampshire Revised Statutes 259:66-b
- Next of kin: shall mean the spouse, child, parent, stepparent, sibling, or legal guardian of the individual in question. See New Hampshire Revised Statutes 259:66-a
- Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Nonresident: shall mean :

See New Hampshire Revised Statutes 259:67 - Number plate: shall mean the sign or marker furnished by the director, on which is displayed the registration number or mark of a vehicle assigned thereto by the director, which shall bear on the face thereof a permanent or changeable designation of the effective period. See New Hampshire Revised Statutes 259:68
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Off highway recreational vehicle: shall mean any mechanically propelled vehicle used for pleasure or recreational purposes running on rubber tires, tracks, or cushion of air and dependent on the ground or surface for travel, or other unimproved terrain whether covered by ice or snow or not, where the driver sits in or on the vehicle. See New Hampshire Revised Statutes 259:69
- OHRV: shall mean an off highway recreational vehicle. See New Hampshire Revised Statutes 259:70
- On-demand driverless capable vehicle network: means a transportation service network that uses a software application or other digital means to dispatch driverless capable vehicles for purposes of transporting persons or goods, including for-hire transportation, transportation for compensation, and public transportation. See New Hampshire Revised Statutes 242:1
- Open road tolling lane: shall mean any lane on a toll road so designated by a traffic control device or lane control system at which certain vehicles equipped with transponder devices for the payment of tolls are permitted to travel at highway speeds without reducing speed or stopping to pay a toll. See New Hampshire Revised Statutes 259:69-a
- Operational design domain: means a description of the specific operating domain in which an automated driving system is designed to properly operate, including but not limited to roadway types, speed range, environmental conditions such as weather or time of day, and other domain constraints. See New Hampshire Revised Statutes 242:1
- Oral argument: An opportunity for lawyers to summarize their position before the court and also to answer the judges' questions.
- Out-of-service order: shall mean a declaration by the Federal Highway Administration or an authorized local, state or federal enforcement officer, or an enforcement officer from the commonwealth of Puerto Rico, Canada, or Mexico, that a driver, or a commercial motor vehicle, or a motor carrier operation, is out of service. See New Hampshire Revised Statutes 259:71-a
- Oversight: Committee review of the activities of a Federal agency or program.
- Owner: shall mean :
I. See New Hampshire Revised Statutes 259:72 - Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- person: means any individual, firm, co-partnership, corporation, company, association or joint-stock association, including any trustee, administrator, executor, receiver, assignee or other personal representative thereof. See New Hampshire Revised Statutes 270:2
- Person: shall mean the same as provided in N. See New Hampshire Revised Statutes 259:74
- person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
- Personal delivery device: means an electrically powered device that:

- petition: when used in connection with the equity jurisdiction of the superior court, and referring to a document filed with the court, shall mean complaint, and "petitioner" shall mean plaintiff. See New Hampshire Revised Statutes 21:51
- petitioner: shall mean plaintiff. See New Hampshire Revised Statutes 21:51
- Place of business: shall mean the site, location or building within this state at which a person conducts the business in which he is engaged. See New Hampshire Revised Statutes 259:76
- Plaintiff: The person who files the complaint in a civil lawsuit.
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Pneumatic tires: shall mean tires in which compressed air is designed to support the load. See New Hampshire Revised Statutes 259:77
- Pocket bike: includes , but is not limited to, motorized devices commonly known as "mini-cycles" "mini-choppers" and "pocket rockets" but does not include a moped as defined in N. See New Hampshire Revised Statutes 259:77-a
- Police officer: shall mean any constable, peace officer, or other officer authorized to make arrests or serve process. See New Hampshire Revised Statutes 259:78
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
- principally engaged: means that the business derives at least 51 percent of its annual gross income from the motor vehicle business or, if there was no income in the prior year, 51 percent of the assets of the business are directly related to the motor vehicle business. See New Hampshire Revised Statutes 259:60-a
- private boat: shall mean any boat, not a commercial boat, propelled by electric, human or mechanical power used exclusively for pleasure purposes by its owner, or others with his permission. See New Hampshire Revised Statutes 270:2
- Private passenger vehicle: shall mean a motor vehicle, except motorcycles, tractors, snowmobiles, OHRV's and mopeds, which is designed and used for the purpose of transporting 10 persons or less and used for the transportation of human beings with their necessary personal belongings, and not exceeding 8,000 pounds in gross vehicle weight. See New Hampshire Revised Statutes 259:81
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Probate: Proving a will
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Public defender: Represent defendants who can't afford an attorney in criminal matters.
- Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
- Public way: shall mean :

- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- Reciprocating state: shall mean a state having provisions of law to the same effect as the provisions of this title relative to reciprocal provisions as to arrest of nonresidents. See New Hampshire Revised Statutes 259:84
- Recreation vehicle: shall mean a self-propelled or towed vehicle that is equipped to serve as temporary living quarters for recreational, camping, or travel purposes and is used solely as a family or personal conveyance. See New Hampshire Revised Statutes 259:84-a
- registered mail: when used in connection with the requirement for notice by mail shall mean either registered mail or certified mail. See New Hampshire Revised Statutes 21:32-a
- Registration number: shall mean the number or mark assigned by the director to a vehicle. See New Hampshire Revised Statutes 259:85
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Remand: When an appellate court sends a case back to a lower court for further proceedings.
- Repairer: shall mean any person who is principally engaged in the motor vehicle business, but who is not a dealer and who has an established place of business. See New Hampshire Revised Statutes 259:87
- replica: means a body or frame manufactured after the year 1949 and which resembles that of the original vehicle and which retains the basic style and dimensions as originally manufactured and whose major components such as grill shell, hood, or doors are readily interchangeable with the original pre-1949 component. See New Hampshire Revised Statutes 259:106-a
- Repossess: shall mean the act of obtaining physical possession of a motor vehicle by a lienholder or any person acting on his behalf for any actual or claimed breach of any condition contained in a security agreement. See New Hampshire Revised Statutes 259:87-a
- Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
- Resident: shall mean a resident of the state as defined in N. See New Hampshire Revised Statutes 259:88
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- Retail vehicle dealer: shall mean a person engaged in the motor vehicle business who sells motor vehicles to the general public, or demonstrates for sale vehicles on consignment to the general public. See New Hampshire Revised Statutes 259:89-a
- Revocation: shall mean the termination by formal action of the department or of a court of competent jurisdiction of a person's driver's license or privilege to drive on the ways of this state, or of any other license, registration or permit issued by the department. See New Hampshire Revised Statutes 259:90
- Right-of-way: shall mean the right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed or proximity as to give rise to the danger of collision unless one grants precedence to the other. See New Hampshire Revised Statutes 259:91
- road: shall include all bridges thereon. See New Hampshire Revised Statutes 21:26
- Roadable aircraft: shall mean any aircraft capable of taking off and landing from a suitable airfield which is also designed to be driven on public roadways as a conveyance. See New Hampshire Revised Statutes 259:91-a
- roadway: means that portion of a way improved, designed, or ordinarily used for vehicular travel, including the berm or shoulder where such berm or shoulder is used by persons riding bicycles or other human powered vehicles. See New Hampshire Revised Statutes 259:75-b
- Rural residence district: shall mean the territory contiguous to a way not comprising a business or urban residence district when the frontage on such way for a distance of
1/2 mile or more is mainly occupied by dwellings or by dwellings and buildings in use for business on any one side. See New Hampshire Revised Statutes 259:93 - Safety glass: shall mean glass so treated or combined with other materials as to reduce, in comparison with ordinary sheet glass or plate glass, the likelihood of injury to persons by objects from external sources or by glass when the glass is cracked or broken. See New Hampshire Revised Statutes 259:94
- School bus: shall mean a vehicle owned by a public or governmental agency, or a privately owned vehicle, including a station wagon, suburban, panel body vehicle and vehicles converted to a school bus, but excluding a passenger vehicle, employed solely in transporting school children to and from school or school activities by virtue of a contract with a municipality, municipal board or school board authorities. See New Hampshire Revised Statutes 259:96
- seal: shall include an impression of the official seal made upon the paper alone, as well as an impression thereof made by means of wax, or a wafer, affixed thereto. See New Hampshire Revised Statutes 21:11
- seaplane: means any aircraft on floats or an amphibian aircraft with a hull and sponson, which is capable of landing on land or water. See New Hampshire Revised Statutes 270:2
- Security agreement: shall mean an interest in a vehicle reserved or created by agreement and which secures payment or performance of an obligation. See New Hampshire Revised Statutes 259:97
- Semi-trailer: shall mean a vehicle of the trailer type so designed and used in conjunction with a self-propelled vehicle that a considerable part of its own weight or that of its load rests upon and is carried by the towing vehicle, and not including a pair or set of wheels commonly used as an implement for other purposes than transportation, provided, however, that the word "semi-trailer" shall not include any vehicle as described in this section if used exclusively for agricultural purposes unless said vehicle be of the type constructed specifically to be towed by a tractor-type truck. See New Hampshire Revised Statutes 259:98
- Serious injury: shall mean any harm to the body which causes severe, permanent or protracted loss of or impairment to the health or to the function of any part of the body. See New Hampshire Revised Statutes 259:98-b
- Serious traffic violation: shall mean :
I. See New Hampshire Revised Statutes 259:98-a - Service of process: The service of writs or summonses to the appropriate party.
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- Sidecar: shall mean a one-wheel attachment to a motorcycle. See New Hampshire Revised Statutes 259:99
- Single unit vehicle: shall mean a truck consisting of cab, chassis and body capable of carrying a load and not primarily designed for drawing other vehicles. See New Hampshire Revised Statutes 259:100-a
- Ski area vehicles: shall mean motor vehicles, except private passenger vehicles, whether wheeled or tracked, on-highway or off-highway, owned or leased by a ski area as defined in N. See New Hampshire Revised Statutes 259:101
- Snowmobile: shall mean any vehicle propelled by mechanical power that is designed to travel over ice or snow supported in part by skis, tracks, or cleats. See New Hampshire Revised Statutes 259:102
- Special fuel: shall mean all products, except gasoline, propane, natural gas, or liquified natural gas, used in an internal combustion engine for the generation of power to propel motor vehicles or mechanical contrivances on or over the ways. See New Hampshire Revised Statutes 259:103-a
- Special mileage commercial tire: shall mean a tire manufactured with an extra layer of rubber between the cord body and original tread design, which extra layer is designed for the purpose of recutting or regrooving, and which tire is specially labelled as a special mileage commercial tire. See New Hampshire Revised Statutes 259:104
- Special mobile equipment: shall mean a vehicle not designed for the transportation of persons or property upon a highway and only incidentally driven or moved over a way, including but not limited to ditch-digging apparatus, well-boring apparatus and road construction and maintenance machinery such as asphalt spreaders, bituminous mixers, bucket loaders, tractors other than truck tractors, ditchers, leveling graders, finishing machines, motor graders, road rollers, scarifiers, earth moving carryalls and scrapers, power shovels and drag lines, and self-propelled cranes and earth moving equipment. See New Hampshire Revised Statutes 259:105
- State: shall mean :
I. See New Hampshire Revised Statutes 259:106 - state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4
- Statute: A law passed by a legislature.
- Street rod: shall mean a vehicle, the body and frame of which were manufactured prior to the year 1949 and which has been modified for safe road use, or a replica thereof which has also been modified for safe road use. See New Hampshire Revised Statutes 259:106-a
- Subpoena: A command to a witness to appear and give testimony.
- Subpoena duces tecum: A command to a witness to produce documents.
- Summons: Another word for subpoena used by the criminal justice system.
- Suspension: shall mean the temporary withdrawal by formal action of the department or of a court of competent jurisdiction of a person's driver's license or privilege to drive a vehicle on the ways of this state, or any other license, registration or permit issued by the department, which temporary withdrawal shall be for a period specifically designated by the department or court and until the reissuance of the license, registration, permit or privilege. See New Hampshire Revised Statutes 259:107
- Swim line: means a combination of ropes, cables, and floats which encompass an area abutting the shore line, for the use of swimmers. See New Hampshire Revised Statutes 270:2
- sworn: when applied to public officers required by the constitution to take oaths therein prescribed, shall refer to those oaths; when applied to other officers it shall mean sworn to the faithful discharge of the duties of their offices before a justice of the peace, or other person authorized to administer official oaths in such cases. See New Hampshire Revised Statutes 21:25
- Tandem axle: shall mean 2 consecutive axles whose centers may be included between parallel vertical planes spaced at least 4 feet and not more than 10 feet apart, extending across the full width of the vehicle, except that for vehicles being driven on the interstate and defense highway system with a gross weight in excess of 73,280 pounds a tandem axle shall be limited to 2 or more consecutive axles whose centers may be included between parallel vertical planes spaced not less than 40 nor more than 96 inches apart, extending across the full width of the vehicle. See New Hampshire Revised Statutes 259:107-a
- Test driver: means a trained employee, contractor, or other person who is acting as an agent of the testing entity while operating the testing entity's ADS-equipped vehicles that are part of the automated vehicle testing pilot program. See New Hampshire Revised Statutes 242:1
- Testate: To die leaving a will.
- Testify: Answer questions in court.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Testing entity: means an individual, company, college or university, nonprofit, or other organization involved with the design or testing of automated vehicle technologies. See New Hampshire Revised Statutes 242:1
- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
- Tractor: shall mean : any self-propelled vehicle designed or used for agricultural purposes or as a traveling power plant or for drawing other vehicles, but having no provision for carrying a load other than attached implements such as snowplows, tool boxes, or bucket loaders, but shall not include vehicles used for recreational purposes or agricultural/industrial utility vehicles as defined in N. See New Hampshire Revised Statutes 259:108
- Tractor-trailer: shall mean any truck-tractor and semi-trailer. See New Hampshire Revised Statutes 259:109
- Traffic: shall mean pedestrians, ridden or herded animals, vehicles, streetcars, and other conveyances either singly or together while using any way for purposes of travel. See New Hampshire Revised Statutes 259:110
- Traffic control signal: shall mean any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and permitted to proceed. See New Hampshire Revised Statutes 259:111
- Trailer: shall mean any vehicle without motive power designed for carrying property or passengers wholly on its own structure and for being drawn by a self-propelled vehicle, except those running exclusively on snow or on stationary tracks and vehicles used exclusively for agricultural purposes. See New Hampshire Revised Statutes 259:113
- Transporter: shall mean :
I. See New Hampshire Revised Statutes 259:114 - Tread depth: shall mean the amount of tread design on the tire. See New Hampshire Revised Statutes 259:115
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Tridem: shall mean 3 consecutive axles, the centers of which, when measured between the first and third axles, may be included between parallel vertical planes spaced more than 8 feet apart, and which tridem unit measures less than 12 feet overall between the centers of extreme axles, extending across the full width of the vehicles; except that for vehicles being driven on the interstate and defense highway system with a gross weight in excess of 73,280 pounds, a tridem shall measure not less than 40 inches nor more than 96 inches between the parallel vertical planes. See New Hampshire Revised Statutes 259:115-a
- Truck: shall mean every motor vehicle designed, used or maintained primarily for the transportation of property. See New Hampshire Revised Statutes 259:115-b
- Truck-tractor: shall mean any vehicle designed and intended primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the vehicle and load so drawn, except that a truck-tractor engaged in the transportation of automobiles may transport motor vehicles on a part of the power unit. See New Hampshire Revised Statutes 259:116
- Trustee: A person or institution holding and administering property in trust.
- United States: shall include said district and territories. See New Hampshire Revised Statutes 21:4
- Urban residence district: shall mean the territory contiguous to a highway not comprising a business district when the frontage on such highway for a distance of 300 feet or more is mainly occupied by dwellings or by dwellings and buildings in use for business. See New Hampshire Revised Statutes 259:118
- User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
- Vehicle: shall mean :
I. See New Hampshire Revised Statutes 259:122 - Vehicle identification number: shall mean a unique distinguishing number issued by a vehicle manufacturer to a particular vehicle and stamped or embossed on a permanent part of the vehicle or on a plate provided by the manufacturer for that purpose, or such unique distinguishing number issued by the motor vehicle titling authority of this or any other state in lieu of a manufacturer's number. See New Hampshire Revised Statutes 259:123
- Veteran: means any person who:
(1) Served in the United States armed forces for more than 4 years and continues to serve; or
(2) Has been discharged or released from duty in the United States armed forces with:
(A) An honorable discharge; or
(B) An uncharacterized discharge based on a service-connected injury, illness, or disability. See New Hampshire Revised Statutes 21:50 - Way: shall mean :

- Writ: A formal written command, issued from the court, requiring the performance of a specific act.
