• Actual conflict of interest: means any action or any decision or recommendation by a person acting in a capacity as a public official, the effect of which would be to the private pecuniary benefit or detriment of the person or the person's relative or any business with which the person or a relative of the person is associated unless the pecuniary benefit or detriment arises out of circumstances described in subsection (13) of this section. See Oregon Statutes 244.020
• Any other state: includes any state and the District of Columbia. See Oregon Statutes 174.100
• Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
• Board: means the Workers' Compensation Board. See Oregon Statutes 705.010
• Board: means the Construction Contractors Board. See Oregon Statutes 701.005
• Business: means any corporation, partnership, proprietorship, firm, enterprise, franchise, association, organization, self-employed individual and any other legal entity operated for economic gain but excluding any income-producing not-for-profit corporation that is tax exempt under section 501(c) of the Internal Revenue Code with which a public official or a relative of the public official is associated only as a member or board director or in a nonremunerative capacity. See Oregon Statutes 244.020
• Candidate: means an individual for whom a declaration of candidacy, nominating petition or certificate of nomination to public office has been filed or whose name is printed on a ballot or is expected to be or has been presented, with the individual's consent, for nomination or election to public office. See Oregon Statutes 244.020
• Conservator: means a person appointed as a conservator under the provisions of this chapter. See Oregon Statutes 125.005
• Contractor: means any of the following:

  (a) A person that, for compensation or with the intent to sell, arranges or undertakes or offers to undertake or submits a bid to construct, alter, repair, add to, subtract from, improve, inspect, move, wreck or demolish, for another, a building, highway, road, railroad, excavation or other structure, project, development or improvement attached to real estate, or to do any part thereof. See Oregon Statutes 701.005

• Department: means the Department of Consumer and Business Services. See Oregon Statutes 705.010
• Dependent: A person dependent for support upon another.
• Development commission: means any entity that has the authority to purchase, develop, improve or lease land or the authority to operate or direct the use of land. See Oregon Statutes 244.020
• Director: means the Director of the Department of Consumer and Business Services. See Oregon Statutes 705.010
• district: means any one of the following:

  (1) A people's utility district organized under ORS Chapter 261. See Oregon Statutes 198.010

• Fiduciary: means a guardian or conservator appointed under the provisions of this chapter or any other person appointed by a court to assume duties with respect to a protected person under the provisions of this chapter. See Oregon Statutes 125.005
• Financially incapable: means a condition in which a person is unable to manage financial resources of the person effectively for reasons including, but not limited to, mental illness, mental retardation, physical illness or disability, chronic use of drugs or controlled substances, chronic intoxication, confinement, detention by a foreign power or disappearance. See Oregon Statutes 125.005
• First Partner: means the spouse or domestic partner of the Governor, or an individual who primarily has a personal relationship with the Governor as determined by the Oregon Government Ethics Commission by rule. See Oregon Statutes 244.020
• General contractor: means a contractor whose business operations require the use of more than two unrelated building trades or crafts that the contractor supervises or performs in whole or part, whenever the sum of all contracts on any single property, including materials and labor, exceeds an amount established by rule by the board. See Oregon Statutes 701.005
• Gift: means something of economic value given to a public official, a candidate or a relative or member of the household of the public official or candidate:

  (A) Without valuable consideration of equivalent value, including the full or partial forgiveness of indebtedness, which is not extended to others who are not public officials or candidates or the relatives or members of the household of public officials or candidates on the same terms and conditions; or

  (B) For valuable consideration less than that required from others who are not public officials or candidates. See Oregon Statutes 244.020

• Guardian: means a person appointed as a guardian under the provisions of this chapter. See Oregon Statutes 125.005
• Honorarium: means a payment or something of economic value given to a public official in exchange for services upon which custom or propriety prevents the setting of a price. See Oregon Statutes 244.020
• Incapacitated: means a condition in which a person's ability to receive and evaluate information effectively or to communicate decisions is impaired to such an extent that the person presently lacks the capacity to meet the essential requirements for the person's physical health or safety. See Oregon Statutes 125.005
• Income: means income of any nature derived from any source, including, but not limited to, any salary, wage, advance, payment, dividend, interest, rent, honorarium, return of capital, forgiveness of indebtedness, or anything of economic value. See Oregon Statutes 244.020
• Juror: means any juror or prospective juror. See Oregon Statutes 10.010
• Jury: means a body of persons temporarily selected from persons who live in a particular county or district, and invested with power to present or indict in respect to a crime or to try a question of fact. See Oregon Statutes 10.010
• Legislative or administrative interest: means an economic interest, distinct from that of the general public, in:

  (a) Any matter subject to the decision or vote of the public official acting in the public official's capacity as a public official; or

  (b) Any matter that would be subject to the decision or vote of the candidate who, if elected, would be acting in the capacity of a public official. See Oregon Statutes 244.020

• Member of the household: means any person who resides with the public official or candidate. See Oregon Statutes 244.020
• Minor: means any person who has not attained 18 years of age. See Oregon Statutes 125.005
• Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
• Planning commission: means a county planning commission created under ORS Chapter 215 or a city planning commission created under ORS Chapter 227. See Oregon Statutes 244.020
• Potential conflict of interest: means any action or any decision or recommendation by a person acting in a capacity as a public official, the effect of which could be to the private pecuniary benefit or detriment of the person or the person's relative, or a business with which the person or the person's relative is associated, unless the pecuniary benefit or detriment arises out of the following:

  (a) An interest or membership in a particular business, industry, occupation or other class required by law as a prerequisite to the holding by the person of the office or position. See Oregon Statutes 244.020

• Protected person: means a person for whom a protective order has been entered. See Oregon Statutes 125.005
• Protective order: means an order of a court appointing a fiduciary or any other order of the court entered for the purpose of protecting the person or estate of a respondent or protected person. See Oregon Statutes 125.005
• Protective proceeding: means a proceeding under this chapter. See Oregon Statutes 125.005
• Public office: has the meaning given that term in ORS § 260. See Oregon Statutes 244.020
• Public official: means the First Partner and any person who, when an alleged violation of this chapter occurs, is serving the State of Oregon or any of its political subdivisions or any other public body as defined in ORS § 174. See Oregon Statutes 244.020
• Respondent: means a person for whom entry of a protective order is sought in a petition filed under ORS § 125. See Oregon Statutes 125.005
• Responsible managing individual: means an individual who:

  (a) Is an owner described in ORS § 701. See Oregon Statutes 701.005

• Service of process: The service of writs or summonses to the appropriate party.
• special government body: means any of the following:

  (a) A public corporation created under a statute of this state and specifically designated as a public corporation. See Oregon Statutes 174.117

• Specialty contractor: includes a person who performs work regulated under ORS § 446. See Oregon Statutes 701.005
• Statement of economic interest: means a statement as described by ORS § 244. See Oregon Statutes 244.020
• Uphold: The decision of an appellate court not to reverse a lower court decision.
• Visitor: means a person appointed by the court under ORS § 125. See Oregon Statutes 125.005
• Vulnerable youth: means a person who:

  (a) Is at least 18 years of age but has not attained 21 years of age;

  (b) Is eligible for classification under 8 U. See Oregon Statutes 125.005
