(1) As used in this section, “institution of higher education” means an institution listed in Section 53B-1-102.
Terms Used In Utah Code 13-34-303
- Division: means the Division of Consumer Protection. See Utah Code 13-34-101
- Reciprocity agreement: means an agreement the division enters into with another state in accordance with Section 13-34-303. See Utah Code 13-34-101
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) The division may execute an interstate reciprocity agreement that is:
(2)(b) for the benefit of:
(2)(b)(i) postsecondary schools in the state; or
(2)(b)(ii)
(2)(b)(ii)(A) postsecondary schools in the state; and
(2)(b)(ii)(B) institutions of higher education.
(3) If the division executes an interstate reciprocity agreement described in Subsection (2) that includes institutions of higher education, the Utah Board of Higher Education may make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, that:
(3)(a) implement the reciprocity agreement; and
(3)(b) relate to institutions of higher education.
