20.455
20.455 Justice, department of. There is appropriated to the department of justice for the following programs:
20.455(1)
(1) Legal services.
20.455(2)
(2) Law enforcement services.
20.455(2)(b)
(b) Investigations and operations. The amounts in the schedule for conducting undercover investigations and operations.
20.455(1)(b)
(b) Special counsel. A sum sufficient, subject to the procedures established in ss. 5.05 (2m) (c) and 14.11 (2) (c), for the compensation of special counsel appointed as provided in ss. 5.05 (2m) (c), 14.11 (2), and 321.42.
20.455(1)(gh)
(gh) Investigation and prosecution. Moneys received under ss. 23.22 (9) (c), 49.49 (6), 100.263, 133.16, 281.98 (2), 283.91 (5), 289.96 (3) (b), 291.97 (3), 292.99 (2), 293.87 (4) (b), 295.19 (3) (b) 2., and 299.97 (2), for the expenses of investigation and prosecution of violations, including attorney fees.
20.455(1)(hm)
(hm) Restitution. All moneys received by the department to provide restitution to victims when ordered by the court as the result of prosecutions under § 49.49 and chs. 100, 133, 281 to 285 and 289 to 299 and under a federal antitrust law for the purpose of providing restitution to victims of the violation when ordered by the court.

(a) General program operations. The amounts in the schedule for general program operations, including § 165.065.
20.455(1)(d)
(d) Legal expenses. Biennially, the amounts in the schedule for the payment of expenses, except staff salaries and fringe benefits, incurred by the department of justice in the prosecution or defense of any action or proceeding in which the state may be a party or may have an interest, for any abstract of title, clerk of court’s fees, sheriff’s fees or any other expense actually necessary to the prosecution or defense of those cases, for the payment of expenses incurred where the department of justice is not involved, and where the statutes provide that those expenses shall be paid from this appropriation, unless the cost or expenses are charged to some other appropriation.

(gs) Delinquent obligation collection. From the moneys received under § 165.30 (3)(b), the amounts in the schedule for expenses related to the collection of delinquent obligations under § 165.30.
20.455(1)(k)
(k) Environment litigation project. All moneys received from the department of natural resources for materials or services provided by the department of justice regarding a project involving the use of environmental litigation to protect air, land and water resources to be used to pay for costs and expenses associated with those materials and services.
20.455(1)(km)
(km) Interagency and intra-agency assistance. The amounts in the schedule to provide legal services to state agencies. All moneys received from the department or any other state agency for legal services shall be credited to this appropriation.
20.455(1)(m)
(m) Federal aid. All moneys received as federal aid as authorized by the governor under § 16.54.
20.455(2)(a)
(a) General program operations. The amounts in the schedule for general program operations, including operating the state crime laboratories, performing criminal investigations, providing law enforcement services and providing independent crime laboratory services for defendants in a felony case upon authorization by the presiding judge.
20.455(2)(am)
(am) Officer training reimbursement. A sum sufficient to make payments under § 165.85 (5x). The amount appropriated under this paragraph may not exceed $150,000 in any fiscal year.
20.455(2)(c)
(c) Crime laboratory equipment. Biennially, the amounts in the schedule for the acquisition, maintenance, repair and replacement costs of the laboratory equipment in the state and regional crime laboratories.
20.455(2)(dg)
(dg) Weed and seed and law enforcement technology. The amounts in the schedule to provide grants for weed and seed projects under § 165.982 and for law enforcement technology under § 165.983.
20.455(2)(dq)
(dq) Law enforcement community policing grants. Biennially, the amounts in the schedule to provide law enforcement community policing grants under § 165.984.
20.455(2)(gm)
(gm) Criminal history searches; fingerprint identification. All moneys received as fee payments under § 165.82 (1) for the provision of services under § 165.82 (1) and the provision of an automated fingerprint identification system.
20.455(2)(gp)
(gp) Crime information alerts. All moneys received as fee payments under § 165.785 (2) and all moneys received as gifts, grants, or donations for the provision of services under § 165.785 (1) and the provision of a crime alert network.
20.455(2)(g)
(g) Gaming law enforcement; racing revenues. From all moneys received under ss. 562.02 (2) (f), 562.04 (1) (b) 4. and (2) (d), 562.05 (2), 562.065 (3) (cm) and (d), (3m) (c) 2., and (4), 562.09 (2) (e), and 562.124 (2), the amounts in the schedule for the performance of the department’s gaming law enforcement responsibilities under chs. 562 to 569 and 945. Notwithstanding § 20.001 (3)(a), the unencumbered balance of this appropriation account at the end of each fiscal year shall be transferred to the lottery fund.

(gc) Gaming law enforcement; Indian gaming. From the moneys received under § 569.06, the amounts in the schedule for investigative services for Indian gaming under ch. 569.
20.455(2)(gj)
(gj) General operations; child pornography surcharge. All moneys received as part B of any child pornography surcharge imposed under § 973.042 for investigating offenses under § 948.05 or 948.12.

(3) Administrative services.
20.455(3)(a)
(a) General program operations. The amounts in the schedule for the general administration of the department of justice.
20.455(2)(gr)
(gr) Handgun purchaser record check. All moneys received as fee payments under § 175.35 (2i) to provide services under § 175.35.
20.455(2)(gs)
(gs) Background check for licenses to carry concealed weapons. The amounts in the schedule to provide services under § 175.60. All moneys received as fee payments under § 175.60 (7)(c) and (d), (13), and (15) (b) 4. a. and b. shall be credited to this appropriation.
20.455(2)(gu)
(gu) Certification cards for carrying concealed weapons. All moneys received as fees under § 175.49 (5m) to verify eligibility of, and to issue certification cards to, former officers seeking to carry concealed weapons.
20.455(2)(h)
(h) Terminal charges. The amounts in the schedule for the transaction information for management of enforcement system. All moneys collected under § 165.827 from law enforcement agencies for rentals, terminal fees and related charges associated with the transaction information for management of enforcement system shall be credited to this appropriation.
20.455(2)(i)1.
1. The amount transferred to para. (kc) shall be the amount in the schedule under para. (kc).
20.455(2)(i)3.
3. The amount transferred to para. (kp) shall be the amount in the schedule under para. (kp).
20.455(2)(i)
(i) Penalty surcharge, receipts. The amounts in the schedule for the purposes of § 165.85 (5)(b) and for crime laboratory equipment. All moneys received from the penalty surcharge on court fines and forfeitures under § 757.05 (2) and all moneys transferred to this appropriation account from the appropriation accounts specified in subds. 1. to 15. shall be credited to this appropriation account. Moneys may be transferred from this paragraph to pars. (j), (ja), and (jb) by the secretary of administration for expenditures based upon determinations by the department of justice. The following amounts shall be transferred to the following appropriation accounts:

4. The amount transferred to § 20.255 (1)(kd) shall be the amount in the schedule under § 20.255 (1)(kd).
20.455(2)(i)5.
5. The amount transferred to § 20.255 (2)(kd) shall be the amount in the schedule under § 20.255 (2)(kd).
20.455(2)(i)5m.
5m. The amount transferred to § 20.410 (1)(kh) shall be the amount in the schedule under § 20.410 (1)(kh).
20.455(2)(i)6.
6. The amount transferred to § 20.410 (1)(kp) shall be the amount in the schedule under § 20.410 (1)(kp).
20.455(2)(i)8.
8. The amount transferred to § 20.505 (6)(kj) shall be the amount in the schedule under § 20.505 (6)(kj).
20.455(2)(i)9.
9. The amount transferred to para. (ke) shall be of the amount in the schedule under para. (ke).
20.455(2)(i)11.
11. The amount transferred to sub. (kp) shall be the amount in the schedule under sub. (kp).
20.455(2)(i)12.
12. The amount transferred to § 20.505 (1)(kq) shall be the amount in the schedule under § 20.505 (1)(kq).
20.455(2)(i)13.
13. The amount transferred to § 20.505 (6)(k) shall be the amount in the schedule under § 20.505 (6)(k).
20.455(2)(i)15.
15. The amount transferred to § 20.550 (1)(kj) shall be the amount in the schedule under § 20.550 (1)(kj).
20.455(2)(k)
(k) Interagency and intra-agency assistance. All moneys received from the department or any other state agency regarding law enforcement assistance to carry out the purposes for which received.
20.455(2)(ke)
(ke) Drug enforcement intelligence operations. The amounts in the schedule for drug enforcement tactical and strategic intelligence units. All moneys transferred from the appropriation account under par. (i) 9. shall be credited to this appropriation account. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall be transferred to the appropriation account under para. (i).
20.455(2)(j)
(j) Law enforcement training fund, local assistance. The amounts in the schedule to finance local law enforcement training as provided in § 165.85 (5)(b). All moneys transferred from para. (i) for the purpose of this appropriation shall be credited to this appropriation. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall be transferred to the appropriation account under para. (i).
20.455(2)(ja)
(ja) Law enforcement training fund, state operations. The amounts in the schedule to finance state operations associated with the administration of the law enforcement training fund and to finance training for state law enforcement personnel, as provided in § 165.85 (5)(b). All moneys transferred from para. (i) for the purpose of this appropriation shall be credited to this appropriation. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall be transferred to the appropriation account under para. (i).
20.455(2)(jb)
(jb) Crime laboratory equipment and supplies. The amounts in the schedule for the maintenance, repair, upgrading, and replacement costs of the laboratory equipment, and for supplies used to maintain, repair, upgrade, and replace that equipment, in the state and regional crime laboratories. All moneys transferred from para. (i) for the purpose of this appropriation shall be credited to this appropriation. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall be transferred to the appropriation account under para. (i).
20.455(2)(kg)
(kg) Interagency and intra-agency assistance; fingerprint identification. The amounts in the schedule for the purchase of an automated fingerprint system. All moneys received from the department or any other state agency for the purchase of an automated fingerprint identification system shall be credited to this appropriation.
20.455(2)(km)
(km) Lottery background investigations. The amounts in the schedule for the purpose of providing lottery-related background investigations. All moneys received from the department of revenue or any state agency as payments for services provided and costs incurred by the department of justice for lottery background investigations under § 565.25 (4) shall be credited to this appropriation account.
20.455(2)(kc)
(kc) Transaction information management of enforcement system. The amounts in the schedule for payments for a lease with option to purchase regarding computers for the transaction information for the management of enforcement system. All moneys transferred from the appropriation account under par. (i) 1. shall be credited to this appropriation account. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall be transferred to the appropriation account under para. (i).
20.455(2)(kd)
(kd) Drug law enforcement, crime laboratories, and genetic evidence activities. The amounts in the schedule for activities relating to drug law enforcement, drug law violation prosecution assistance, activities of the state and regional crime laboratories, and for transferring to the appropriation account under § 20.475 (1)(km) the amounts in the schedule under § 20.475 (1)(km). All moneys transferred to this appropriation from the appropriation account under para. (Lm) shall be credited to this appropriation account.
20.455(2)(kp)
(kp) Drug crimes enforcement; local grants. The amounts in the schedule for grants to local multijurisdictional groups to enforce prohibitions related to controlled substances, and to fund prosecutor positions serving multijurisdictional enforcement groups. All moneys transferred from the appropriation account under par. (i) 3. shall be credited to this appropriation account. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall be transferred to the appropriation account under para. (i).
20.455(2)(m)
(m) Federal aid, state operations. All moneys received as federal aid, as authorized by the governor under § 16.54, for state operations.
20.455(2)(n)
(n) Federal aid, local assistance. All moneys received as federal aid, as authorized by the governor under § 16.54, for local assistance.
20.455(2)(r)
(r) Gaming law enforcement; lottery revenues. From the lottery fund, the amounts in the schedule for the performance of the department’s gaming law enforcement responsibilities under chs. 562 to 569 and 945.
20.455(2)(kq)
(kq) County law enforcement services. The amounts in the schedule to provide grants to counties under § 165.89. All moneys transferred from the appropriation account under s. 20.505 (8) (hm) 15d. shall be credited to this appropriation account. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall revert to the appropriation account under § 20.505 (8)(hm).
20.455(2)(Lm)
(Lm) Crime laboratories; deoxyribonucleic acid analysis. All moneys received from crime laboratories and drug law enforcement surcharges authorized under § 165.755 and deoxyribonucleic acid analysis surcharges authorized under § 973.046 to provide deoxyribonucleic acid analysis, to administer § 165.77, to pay for the costs of mailing and materials under § 165.76 for the submission of biological specimens by the departments of corrections and health services and by county sheriffs, and to transfer to the appropriation account under para. (kd) the amounts in the schedule under para. (kd).

(kt) County-tribal programs, local assistance. The amounts in the schedule for distribution to county-tribal law enforcement programs under § 165.90. All moneys transferred from the appropriation account under s. 20.505 (8) (hm) 15g. shall be credited to this appropriation account. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall revert to the appropriation account under § 20.505 (8)(hm).
20.455(2)(ku)
(ku) County-tribal programs, state operations. The amounts in the schedule to finance the activities of the department of justice associated with county-tribal law enforcement programs under § 165.90. All moneys transferred from the appropriation account under s. 20.505 (8) (hm) 15h. shall be credited to this appropriation account. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall revert to the appropriation account under § 20.505 (8)(hm).
20.455(2)(kw)
(kw) Tribal law enforcement assistance. The amounts in the schedule to provide grants for tribal law enforcement under § 165.91. All moneys transferred from the appropriation account under s. 20.505 (8) (hm) 15. shall be credited to this appropriation account. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall revert to the appropriation account under § 20.505 (8)(hm).
20.455(3)(g)
(g) Gifts, grants and proceeds. All moneys received from gifts and grants and all proceeds from services, conferences, and sales of publications and promotional materials to carry out the purposes for which made or collected, except as provided in sub. (gm) and (gp) and to transfer to § 20.505 (1)(kg), at the discretion of the attorney general, an amount not to exceed $98,300 annually.

(k) Interagency and intra-agency assistance. The amounts in the schedule to provide administrative services to state agencies. All moneys received from the department or any other state agency for administrative services shall be credited to this appropriation.
20.455(3)(m)
(m) Federal aid, state operations. All moneys received as federal aid as authorized by the governor under § 16.54, for state operations relating to administrative services.
20.455(3)(pz)
(pz) Indirect cost reimbursements. All moneys received from the federal government as reimbursement of indirect costs of grants and contracts for the purposes authorized in § 16.54 (9)(b).

(5) Victims and witnesses.
20.455(5)(a)
(a) General program operations. The amounts in the schedule for general program operations under chs. 949 and 950.
20.455(5)(b)
(b) Awards for victims of crimes. The amounts in the schedule for the payment of compensation and funeral and burial expenses awards to the victims of crimes under subch. I of ch. 949.
20.455(5)(c)
(c) Reimbursement for victim and witness services. The amounts in the schedule to provide reimbursement to counties under § 950.06 (2).
20.455(5)(d)
(d) Reimbursement for forensic examinations. A sum sufficient for the payments of awards under § 949.26.
20.455(5)(gc)
(gc) Crime victim and witness surcharge, sexual assault victim services. All moneys received from any crime victim and witness assistance surcharge authorized under § 973.045 (1) that are allocated to this appropriation account under § 973.045 (2m)(a), to provide grants for sexual assault victim services under § 165.93 and to administer the grant program.
20.455(5)(g)
(g) Crime victim and witness assistance surcharge, general services. The amounts in the schedule for purposes of ch. 950. All moneys received from any crime victim and witness assistance surcharge authorized under § 973.045 (1) that are allocated to this appropriation account under § 973.045 (2m)(b), all moneys received from any crime victim and witness assistance surcharge authorized under § 973.045 (1m), and all moneys received from any delinquency victim and witness assistance surcharge authorized under § 938.34 (8d)(a) shall be credited to this appropriation account. The department of justice shall transfer from this appropriation account to the appropriation account under para. (kj) the amounts in the schedule under para. (kj).
20.455(5)(h)
(h) Crime victim compensation services. The amounts in the schedule to provide crime victim compensation services. All moneys transferred from the appropriation account under § 20.435 (5)(hx) shall be credited to this appropriation account, except that the unencumbered balance on June 30 of each year shall revert to the appropriation account under § 20.435 (5)(hx).
20.455(5)(hh)
(hh) Crime victim restitution. All moneys received by the department under § 973.20 (9)(b) to provide crime victim restitution.
20.455(5)(i)
(i) Victim compensation, inmate payments. All moneys received under § 303.06 (2) and (3) for the administration of subch. I of ch. 949 and for crime victim compensation payments or services.
20.455(5)(k)
(k) Interagency and intra-agency assistance; reimbursement to counties. The amounts in the schedule to provide services relating to victims and witnesses and to provide reimbursement to counties under § 950.06 (2). All moneys received from the department or any other state agency for services relating to victims and witnesses shall be credited to this appropriation.
20.455(5)(kj)
(kj) Victim payments, victim surcharge. The amounts in the schedule for the payment of compensation and funeral and burial expenses awards to the victims of crimes under subch. I of ch. 949. All moneys transferred from the appropriation account under para. (g) shall be credited to this appropriation account. If the department of justice determines that the total of the amounts in this appropriation account and the amounts for compensation and awards to victims of crime under subch. I of ch. 949 in the appropriation accounts under pars. (b), (h), (i) and (m) exceeds the amount needed to fully fund compensation and awards to victims of crimes under subch. I of ch. 949, the department of justice may transfer moneys from this appropriation account to the appropriation account under para. (kk). The amount transferred to the appropriation account under para. (kk) may not exceed the amount by which the total amounts appropriated under this paragraph and pars. (b), (h), (i) and (m) for compensation and awards to victims of crimes under subch. I of ch. 949 exceed the amount needed to fully fund compensation and awards to victims of crimes under subch. I of ch. 949.
20.455(5)(kk)
(kk) Reimbursement to counties for providing victim and witness services. All moneys transferred from the appropriation account under para. (kj) for the purpose of reimbursing counties under § 950.06 (2) for costs incurred in providing services to victims and witnesses.
20.455(5)(kp)
(kp) Reimbursement to counties for victim-witness services. The amounts in the schedule for the purpose of reimbursing counties under § 950.06 (2) for costs incurred in providing services to victims and witnesses of crime. All moneys transferred from the appropriation account under sub. (2) (i) 11. shall be credited to this appropriation account. Notwithstanding § 20.001 (3)(a), the unencumbered balance on June 30 of each year shall be transferred to the appropriation account under sub. (i).

(m) Federal aid; victim compensation. All moneys received from the federal government for crime victim compensation, as authorized by the governor under § 16.54, to carry out the purposes for which made and received.
20.455(5)(ma)
(ma) Federal aid; state operations relating to crime victim services. All moneys received as federal aid for the administration of crime victim services, as authorized by the governor under § 16.54, to carry out the purposes for which made and received.
20.455(5)(mh)
(mh) Federal aid; victim assistance. All moneys received from the federal government for crime victim assistance, as authorized by the governor under § 16.54, to carry out the purposes for which made and received.
