  • Agricultural products: include floricultural, horticultural, viticultural, forestry, nut, dairy, livestock, poultry, bee and any farm products. See Maine Revised Statutes Title 13 Sec. 1774
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Antibody to HIV: means the specific immunoglobulin produced by the body's immune system in response to HIV. See Maine Revised Statutes Title 5 Sec. 19201
  • Any election: means primary and general elections and referenda, whether regular or special. See Maine Revised Statutes Title 21-A Sec. 1
  • Appraisal: A determination of property value.
  • Articles: means the articles of incorporation. See Maine Revised Statutes Title 13 Sec. 1774
  • Association: means a corporation organized under this subchapter, or a similar domestic corporation, or a foreign association or corporation if authorized to do business in this State, organized under any general or special Act as a cooperative association for the mutual benefit of its members, as agricultural producers, and which confines its operations to purposes authorized by this subchapter and restricts the return on the stock or membership capital and the amount of its business with nonmembers to the limits placed thereon by this subchapter for associations organized hereunder.   • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Automatic tabulating equipment: means any apparatus that automatically examines and counts votes recorded on paper ballots and tabulates the results. See Maine Revised Statutes Title 21-A Sec. 808
  • Automobile graveyard: includes an area used for automobile dismantling, salvage and recycling operations. See Maine Revised Statutes Title 30-A Sec. 3752

  • Ballot labels: means the pages, cards or other material containing the names of offices and candidates and the referendum questions to be voted on that are placed on the voting device to conform with the voting system in use. See Maine Revised Statutes Title 21-A Sec. 808
  • Ballot question committee: means a person that receives contributions or makes expenditures aggregating in excess of $5,000 for the purpose of initiating or influencing a campaign, other than a campaign for the nomination or election of a candidate.   • Bank: includes savings banks, savings and loan associations, credit unions and trust companies. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Beneficiary: means a person or persons designated by a member to receive a benefit under this Part or a person otherwise entitled to receive a benefit under this Part. See Maine Revised Statutes Title 5 Sec. 17001
  • Benefit: means any payment made, or required to be made, to a beneficiary under chapter 423, subchapter V or chapter 425, subchapter V. See Maine Revised Statutes Title 5 Sec. 17001
  • Beverage container: means a can, bottle, jar or other container made of aluminum or metal that is sealed by a manufacturer and contained, at the time of sale, a beverage, as defined by Title 38, section 3102, subsection 1, but does not include a beer keg.   • Board: means the board of trustees, established under section 12004?F, subsection 9, to administer the Maine Public Employees Retirement System. See Maine Revised Statutes Title 5 Sec. 17001
  • Board: means the board of directors. See Maine Revised Statutes Title 13 Sec. 1774
  • Bona fide occupational exposure: means skin, eye, mucous membrane or parenteral contact of a person with the potentially infectious blood or other body fluids of another person that results from the performance of duties by the exposed person in the course of employment.   • Bureau: means the Department of the Secretary of State, Bureau of Motor Vehicles. See Maine Revised Statutes Title 21-A Sec. 231

  • Campaign: means any course of activities to influence the nomination or election of a candidate or to initiate or influence any of the following ballot measures:

  • Candidate: means any person who has filed a petition under either sections 335 and 336 or sections 354 and 355 and has qualified as a candidate by either procedure, or any person who has received contributions or made expenditures or has given consent for any other person to receive contributions or make expenditures with the intent of qualifying as a candidate.   • Cash proceeds: means proceeds that are money, checks, deposit accounts or the like. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • Caucus: means a meeting of a political party or committee. See Maine Revised Statutes Title 21-A Sec. 1
  • Caucus political action committee: means a political action committee designated under section 1053?C to promote the election of nominees of a political party to the Senate or the House of Representatives. See Maine Revised Statutes Title 21-A Sec. 1001
  • Central voter registration system: means a single electronic information system and database for voter registration information maintained by the Secretary of State and used by all municipal jurisdictions in the State. See Maine Revised Statutes Title 21-A Sec. 1
  • Certificate of title: includes another record maintained as an alternative to a certificate of title by the governmental unit that issues certificate of title if a statute permits the security interest in question to be indicated on the record as a condition or result of the security interest's obtaining priority over the rights of a lien creditor with respect to the collateral.   • Charitable trust: has the meaning set forth in Title 5, section 194?A, subsection 1, paragraph C. See Maine Revised Statutes Title 24 Sec. 2301
  • Charitable trust plan: means the plan submitted to the Attorney General pursuant to Title 5, section 194?A, subsection 5. See Maine Revised Statutes Title 24 Sec. 2301
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Chattel paper: means a record or records that evidence both a monetary obligation and a security interest in specific goods, a security interest in specific goods and license of software used in the goods, a lease of specific goods or a lease of specific goods and license of software used in the goods.   • Chief executive officer: means the Chief Executive Officer of the Maine Public Employees Retirement System. See Maine Revised Statutes Title 5 Sec. 17001
  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Child: means any natural or legally adopted, born or unborn, progeny of a member. See Maine Revised Statutes Title 5 Sec. 17001
  • Child or children: means a person who has not attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72
  • Clearing corporation: means :
    (i) A person that is registered as a "clearing agency" under the federal securities laws;
    (ii) A federal reserve bank; or
    (iii) Any other person that provides clearance or settlement services with respect to financial assets that would require it to register as a clearing agency under the federal securities laws but for an exclusion or exemption from the registration requirement, if its activities as a clearing corporation, including adoption of rules, are subject to regulation by a federal or state governmental authority.   • Consignee: means a merchant to which goods are delivered in a consignment. See Maine Revised Statutes Title 11 Sec. 9-1102

  • Mark-sense voting system: means a system in which votes are recorded on paper ballots by making marks in special voting response locations using a marking device. See Maine Revised Statutes Title 21-A Sec. 808
  • Marketing contract: includes a contract related to the marketing of agricultural products and a contract by an independent agricultural contractor for furnishing services and facilities in raising or growing agricultural products. See Maine Revised Statutes Title 13 Sec. 1774
  • Marking device: means any special marking implements or fluorescent or opaque inks that are required for marking paper ballots, depending on the type of system in use. See Maine Revised Statutes Title 21-A Sec. 808
  • may: when used in this Title, is used in a permissive sense to grant authority or permission, but not to create duty, to act in the manner specified by the context. See Maine Revised Statutes Title 21-A Sec. 7
  • Mechanical lever voting machine: means a machine that directly records a voter's choices via mechanical lever-actuated controls into a counting mechanism that tallies the votes without using a physical ballot. See Maine Revised Statutes Title 21-A Sec. 808
  • Medical review service provider: means an entity with whom the chief executive officer has contracted for the review of medical records and the provision of recommendations, opinions and certifications under this Part by health care providers employed by the entity. See Maine Revised Statutes Title 5 Sec. 17001
  • medical utilization review services: means a program or process by which a person, partnership or corporation, on behalf of an insurer, nonprofit service organization, 3rd-party administrator, or health maintenance organization, preferred provider organization or employer that is a payor for or that arranges for payment of medical services, seeks to review the utilization, appropriateness or quality of medical services provided to a person whose medical services are paid for, partially or entirely, by that insurer, nonprofit service organization, 3rd-party administrator, health maintenance organization, preferred provider organization or employer.   • Member: means a member of the organization entitled to vote under the articles or bylaws of the organization. See Maine Revised Statutes Title 24 Sec. 2301
  • Member: means any person included in the membership of a retirement program of the retirement system, as provided in chapter 423, subchapter 2, or chapter 425, subchapter 2. See Maine Revised Statutes Title 5 Sec. 17001

  • municipal clerk: means the clerk, deputy clerk or assistant clerk, where directed by the clerk to carry out duties under this Title, of a municipality. See Maine Revised Statutes Title 21-A Sec. 1
  • Municipal committee: means a city, town or ward committee of a political party. See Maine Revised Statutes Title 21-A Sec. 1
  • Municipal officers: means the mayor and aldermen or councillors of a city, the members of the select board or councillors of a town and the assessors of a plantation. See Maine Revised Statutes Title 21-A Sec. 1
  • Municipality: means a city, town or plantation. See Maine Revised Statutes Title 21-A Sec. 1
  • New debtor: means a person that becomes bound as debtor under section 9?1203, subsection (4) by a security agreement previously entered into by another person. See Maine Revised Statutes Title 11 Sec. 9-1102
  • New value: means :

  • Oath: A promise to tell the truth.

  • organization: means a corporation or other entity authorized by the superintendent or organized pursuant to this chapter for the purpose of providing nonprofit hospital service plans within the meaning of subsection 1, nonprofit medical service plans within the meaning of subsection 2 and any organization that provides only nonprofit health care plans within the meaning of subsection 3.   • Overseas voter: means :

  • Participating local district: means a local district that has approved the participation of its employees in the Participating Local District Retirement Program of the retirement system under section 18201. See Maine Revised Statutes Title 5 Sec. 17001
  • Party: means a political organization which has qualified to participate in a primary or general election under chapter 5. See Maine Revised Statutes Title 21-A Sec. 1
  • Party candidate listing: means any communication that meets the following criteria. See Maine Revised Statutes Title 21-A Sec. 1012
  • Payment intangible: means a general intangible under which the account debtor's principal obligation is a monetary obligation. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Pending voter registration record: means the electronic record created by a source agency that contains the personal identification information, including name, age, citizenship and legal residence, and other information required by section 152 of a person who is in the process of being considered for voter registration. See Maine Revised Statutes Title 21-A Sec. 231
  • Person: means any natural person, firm, corporation, partnership or other organization, association or group, however organized. See Maine Revised Statutes Title 5 Sec. 19201
  • Person: means an individual, committee, firm, partnership, corporation, association or organization. See Maine Revised Statutes Title 21-A Sec. 1001
  • Person: means any person regardless of sex, race, sexual orientation, gender identity, number of children, marital status, motive and citizenship. See Maine Revised Statutes Title 22 Sec. 1902
  • Person: includes an individual, a partnership, a corporation and an association. See Maine Revised Statutes Title 13 Sec. 1774
  • Pick-up contributions: means member contributions to the retirement system which are assumed and paid by the employer through a reduction of members' salaries for services rendered, in accordance with the United States Internal Revenue Code, Section 414(h), in lieu of employee contributions. See Maine Revised Statutes Title 5 Sec. 17001
  • Political committee: means 2 or more persons associated for the purpose of promoting or defeating a candidate, party or principle. See Maine Revised Statutes Title 21-A Sec. 1
  • Population: means the population determined by the last Decennial Census of the United States. See Maine Revised Statutes Title 21-A Sec. 1
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Primary election: means the regular election for the election of nominees of a party for the general election. See Maine Revised Statutes Title 21-A Sec. 1
  • Primary System: means that portion of the state highway system which the Department of Transportation has by official designation incorporated into the Federal-Aid Primary System. See Maine Revised Statutes Title 30-A Sec. 3752
  • Proceeds: means the following property:
  • (a). See Maine Revised Statutes Title 11 Sec. 9-1102
  • Producers: includes independent agricultural contractors. See Maine Revised Statutes Title 13 Sec. 1774
  • Production money crops: means crops that secure a production-money obligation incurred with respect to the production of those crops. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Production-money obligation: means an obligation of an obligor incurred for new value given to enable the debtor to produce crops if the value is in fact used for the production of the crops. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Promissory note: means an instrument that evidences a promise to pay a monetary obligation, does not evidence an order to pay and does not contain an acknowledgment by a bank that the bank has received for deposit a sum of money or funds. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Proof of voter eligibility: means reliable evidence of a person's eligibility to vote and must include proof of age, citizenship and residence. See Maine Revised Statutes Title 21-A Sec. 231
  • Proposal: means a record authenticated by a secured party that includes the terms on which the secured party is willing to accept collateral in full or partial satisfaction of the obligation it secures pursuant to sections 9?1620, 9?1621 and 9?1622. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Public organic record: means a record that is available to the public for inspection and is:

  • Public school: includes :
    (1) Any public school conducted within the State under the authority and supervision of a duly elected board of education, superintending school committee or school directors; and

  • Public-finance transaction: means a secured transaction in connection with which:

  • Qualifying member: means a member in service or a former member who is receiving a disability retirement benefit. See Maine Revised Statutes Title 5 Sec. 17951

  • record owner: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC

  • Registered organization: means an organization formed or organized solely under the law of a single state or of the United States by the filing of a public organic record with, the issuance of a public organic record by or the enactment of legislation by the state or the United States.   • Registrar: means the registrar or deputy registrar of voters of a municipality. See Maine Revised Statutes Title 21-A Sec. 1
  • Regular interest: means interest at the rate set from time to time by the board in accordance with section 17156. See Maine Revised Statutes Title 5 Sec. 17001
  • Residence: means that place where the person has established a fixed and principal home to which the person, whenever temporarily absent, intends to return. See Maine Revised Statutes Title 21-A Sec. 1
  • Residence address: means the street and number or other designation indicating the physical location of a person's residence. See Maine Revised Statutes Title 21-A Sec. 1
  • Retirement: means termination of membership with a retirement allowance granted under this chapter. See Maine Revised Statutes Title 5 Sec. 17001
  • Retirement allowance: means the retirement payments to which a member is or may be entitled as provided in this Part. See Maine Revised Statutes Title 5 Sec. 17001
  • Retirement benefit: means the same as retirement allowance. See Maine Revised Statutes Title 5 Sec. 17001
  • Retirement system: means the Maine Public Employees Retirement System. See Maine Revised Statutes Title 5 Sec. 17001
  • Scrap metal: means metal that can be recycled, including, but not limited to, bits and pieces of metal parts that may be combined together with bolts or soldering and can be recycled when worn or superfluous. See Maine Revised Statutes Title 30-A Sec. 3771
  • Scrap metal processor: means a person that purchases scrap metal for resale or recycling. See Maine Revised Statutes Title 30-A Sec. 3771
  • Secondary obligor: means an obligor to the extent that:
  • (a). See Maine Revised Statutes Title 11 Sec. 9-1102
  • Secured party: means :
  • (a). See Maine Revised Statutes Title 11 Sec. 9-1102
  • Securities intermediary: means :
    (i) A clearing corporation; or
    (ii) A person, including a bank or broker, that in the ordinary course of its business maintains securities accounts for others and is acting in that capacity. See Maine Revised Statutes Title 11 Sec. 8-1102
  • Security: except as otherwise provided in section 8?1103, means an obligation of an issuer or a share, participation or other interest in an issuer or in property or an enterprise of an issuer:
    (i) That is represented by a security certificate in bearer or registered form or the transfer of which may be registered upon books maintained for that purpose by or on behalf of the issuer;
    (ii) That is one of a class or series or by its terms is divisible into a class or series of shares, participations, interests or obligations; and
    (iii) That:
    (A) Is, or is of a type, dealt in or traded on securities exchanges or securities markets; or
    (B) Is a medium for investment and by its terms expressly provides that it is a security governed by this Article. See Maine Revised Statutes Title 11 Sec. 8-1102
  • Security agreement: means an agreement that creates or provides for a security interest. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Security entitlement: means the rights and property interest of an entitlement holder with respect to a financial asset specified in Part 5. See Maine Revised Statutes Title 11 Sec. 8-1102
  • Seller: means any person that receives in a transaction monetary consideration from a scrap metal processor in exchange for nonferrous metal, iron or steel, including stainless steel. See Maine Revised Statutes Title 30-A Sec. 3771
  • Seropositivity: means the presence of antibody to HIV as detected by appropriate laboratory tests. See Maine Revised Statutes Title 5 Sec. 19201
  • Service: means service as an employee for which compensation was paid. See Maine Revised Statutes Title 5 Sec. 17001
  • Service credit: means credit received for creditable service as defined under subsection 10. See Maine Revised Statutes Title 5 Sec. 17001
  • Signature: includes a signature stamp and a signature written by another registered voter on behalf of an individual in accordance with the procedure set forth in section 153?A and, for an individual who is unable to sign that individual's own name, a mark. See Maine Revised Statutes Title 21-A Sec. 1
  • Software: means a computer program and any supporting information provided in connection with a transaction relating to the program. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Source agency: means the bureau and a state agency or department or other entity designated as a source agency pursuant to section 233, subsection 1 that, as part of the normal course of business of that entity, collects documents that contain personal identification information that provides proof of voter eligibility. See Maine Revised Statutes Title 21-A Sec. 231
  • Special election: means an election other than a regular election. See Maine Revised Statutes Title 21-A Sec. 1
  • Spouse: means the person currently legally married to a member. See Maine Revised Statutes Title 5 Sec. 17001
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands or any territory or insular possession subject to the jurisdiction of the United States. See Maine Revised Statutes Title 11 Sec. 9-1102
  • State employee: means any regular classified or unclassified officer or employee in a department, any employee of the Maine Community College System except those who make the election provided under Title 20?A, section 12722, any employee of the Maine Educational Center for the Deaf and Hard of Hearing and the Governor Baxter School for the Deaf except as provided in Title 20?A, section 7407, subsection 3?A, any employee of the Maine Military Authority, any employee of the Northern New England Passenger Rail Authority, any employee of the Maine Port Authority, any employee of the Efficiency Maine Trust who on June 30, 2009 is an employee of the Public Utilities Commission energy efficiency or renewable energy programs who elects to remain a state employee, any employee of the Efficiency Maine Trust who accepts employment with the Efficiency Maine Trust prior to July 1, 2010 who was a state employee immediately prior to accepting such employment who elects to remain a state employee and any employee transferred from the Division of Higher Education Services to the Finance Authority of Maine who elects to be treated as a state employee, but does not include:

  • Statewide AIDS alliance: means a statewide coalition of community-based AIDS organizations having at least one representative from each member organization. See Maine Revised Statutes Title 5 Sec. 19251
  • Subscriber: means an individual who has subscribed to one or more of the hospital, medical or health care service plans or contracts offered or issued by the organization or health insurance affiliate as defined in section 2308?A through an individual or family policy or group policy.
