Terms Used In Utah Code > Title 53 > Chapter 2a - Emergency Management Act
- Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Agent of the state: means any representative of a state agency, local agency, or non-profit entity that agrees to provide support to a requesting intrastate or interstate government entity that has declared an emergency or disaster and has requested assistance through the division. See Utah Code 53-2a-602
- Alerting authority: means a political subdivision that has received access to send alerts through the Integrated Public Alert and Warning System. See Utah Code 53-2a-102
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Armed forces: means the United States Army, Navy, Air Force, Marine Corps, Space Force, and Coast Guard. See Utah Code 68-3-12.5
- Arrest: Taking physical custody of a person by lawful authority.
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Attack: means a nuclear, cyber, conventional, biological, act of terrorism, or chemical warfare action against the United States of America or this state. See Utah Code 53-2a-102
- Ballot: means the storage medium, including a paper, mechanical, or electronic storage medium, that records an individual voter's vote. See Utah Code 20A-1-102
- Canvass: means the review of election returns and the official declaration of election results by the board of canvassers. See Utah Code 20A-1-102
- Chief executive officer: means :(1)(a) for a municipality:(1)(a)(i) the mayor for a municipality operating under all forms of municipal government except the council-manager form of government; or(1)(a)(ii) the city manager for a municipality operating under the council-manager form of government;(1)(b) for a county:(1)(b)(i) the chair of the county commission for a county operating under the county commission or expanded county commission form of government;(1)(b)(ii) the county executive officer for a county operating under the county-executive council form of government; or(1)(b)(iii) the county manager for a county operating under the council-manager form of government;(1)(c) for a special service district:(1)(c)(i) the chief executive officer of the county or municipality that created the special service district if authority has not been delegated to an administrative control board as provided in Section 17D-1-301;(1)(c)(ii) the chair of the administrative control board to which authority has been delegated as provided in Section 17D-1-301; or(1)(c)(iii) the general manager or other officer or employee to whom authority has been delegated by the governing body of the special service district as provided in Section 17D-1-301; or(1)(d) for a special district:(1)(d)(i) the chair of the board of trustees selected as provided in Section 17B-1-309; or(1)(d)(ii) the general manager or other officer or employee to whom authority has been delegated by the board of trustees. - City: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5- Commissioner: means the commissioner of the Department of Public Safety or the commissioner's designee. See Utah Code 53-2a-102
- Committee: means the Grid Resilience Committee created in Section 53-2a-1503. See Utah Code 53-2a-1501
- Committee membership: Legislators are assigned to specific committees by their party. Seniority, regional balance, and political philosophy are the most prominent factors in the committee assignment process.
- Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- County executive: means :
(7)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;(7)(b) the county executive, in the county executive-council optional form of government authorized by Section17-52a-203 ; or(7)(c) the county manager, in the council-manager optional form of government authorized by Section17-52a-204 . See Utah Code 68-3-12.5- County legislative body: means :
(8)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;(8)(b) the county council, in the county executive-council optional form of government authorized by Section17-52a-203 ; and(8)(c) the county council, in the council-manager optional form of government authorized by Section17-52a-204 . See Utah Code 68-3-12.5- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Declared disaster: means one or more events:
(2)(b)(i) within the state;(2)(b)(ii) that occur within a limited period of time;(2)(b)(iii) that involve:(2)(b)(iii)(A) a significant number of persons being at risk of bodily harm, sickness, or death; or(2)(b)(iii)(B) a significant portion of real property at risk of loss;(2)(b)(iv) that are sudden in nature and generally occur less frequently than every three years; and(2)(b)(v) that results in:(2)(b)(v)(A) the president of the United States declaring an emergency or major disaster in the state;(2)(b)(v)(B) the governor declaring a state of emergency under Part 2 Disaster Response and Recovery Act; or(2)(b)(v)(C) the chief executive officer of a local government declaring a local emergency under Part 2, Disaster Response and Recovery Act. See Utah Code 53-2a-602- Declared state disaster or emergency: means a declared disaster as defined in Section 53-2a-602. See Utah Code 53-2a-1202
- Department: means the Department of Public Safety created in Section
53-1-103 . See Utah Code 53-1-102- Dependent: A person dependent for support upon another.
- Director: means the division director appointed under Section 53-2a-103 or the director's designee. See Utah Code 53-2a-102
- Disaster: means an event that:
(5)(a) causes, or threatens to cause, loss of life, human suffering, public or private property damage, or economic or social disruption resulting from attack, internal disturbance, natural phenomena, or technological hazard; and(5)(b) requires resources that are beyond the scope of local agencies in routine responses to emergencies and accidents and may be of a magnitude or involve unusual circumstances that require response by government, not-for-profit, or private entities. See Utah Code 53-2a-102- Disaster period: means a period that begins within 10 days after the first day of a declared state disaster or emergency and that extends for a period of 60 calendar days after the end of the declared state disaster or emergency. - Disaster recovery account: means the State Disaster Recovery Restricted Account created in Section 53-2a-603. See Utah Code 53-2a-602
- Disaster- or emergency-related work: means repairing, renovating, installing, building, rendering services, or other business activities that relate to infrastructure that has been damaged, impaired, or destroyed by a declared state disaster or emergency. See Utah Code 53-2a-1202
- Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
- Division: means the Division of Emergency Management created in Section 53-2a-103. See Utah Code 53-2a-102
- Division: means the Utah Division of Emergency Management created in Section 53-21-103. See Utah Code 53-2a-1501
- Election: means a regular general election, a municipal general election, a statewide special election, a local special election, a regular primary election, a municipal primary election, and a special district election. See Utah Code 20A-1-102
- Election judge: means a poll worker that is assigned to:
(22)(a) preside over other poll workers at a polling place;(22)(b) act as the presiding election judge; or(22)(c) serve as a canvassing judge, counting judge, or receiving judge. See Utah Code 20A-1-102- Election officer: means :
(23)(a) the lieutenant governor, for all statewide ballots and elections;(23)(b) the county clerk for:(23)(b)(i) a county ballot and election; and(23)(b)(ii) a ballot and election as a provider election officer as provided in SectionUtah Code 20A-1-102 - Election official: means any election officer, election judge, or poll worker. See Utah Code 20A-1-102
- Emergency disaster services: means :
(2)(d)(i)(A) evacuation;(2)(d)(i)(B) shelter;(2)(d)(i)(C) medical triage;(2)(d)(i)(D) emergency transportation;(2)(d)(i)(E) repair of infrastructure;(2)(d)(i)(F) safety services, including fencing or roadblocks;(2)(d)(i)(G) sandbagging;(2)(d)(i)(H) debris removal;(2)(d)(i)(I) temporary bridges;(2)(d)(i)(J) procurement and distribution of food, water, or ice;(2)(d)(i)(K) procurement and deployment of generators;(2)(d)(i)(L) rescue or recovery;(2)(d)(i)(M) emergency protective measures; or(2)(d)(i)(N) services similar to those described in Subsections (2)(d)(i)(A) through (M), as defined by the division by rule, that are generally required in response to a declared disaster. See Utah Code 53-2a-602- Emergency manager: means an individual designated as the emergency manager for a political subdivision as described in Section 53-2a-1402. See Utah Code 53-2a-102
- Emergency preparedness: means the following done for the purpose of being prepared for an emergency as defined by the division by rule made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act:
(2)(e)(i) the purchase of equipment;(2)(e)(ii) the training of personnel; or(2)(e)(iii) the obtaining of a certification. See Utah Code 53-2a-602- Emergency responder: includes :
(3)(b)(i) law enforcement officers, fire fighters, search and rescue personnel, emergency medical technicians, ambulance personnel, Department of Natural Resources employees, park rangers, public utilities workers, and volunteers participating in search and rescue and other emergency management operations; and(3)(b)(ii) persons and parties identified in the interstate mutual aid agreement. See Utah Code 53-2a-502- Emergency responder: includes a:
(1)(a) firefighter;(1)(b) structural engineer;(1)(c) physician;(1)(d) physician assistant;(1)(e) paramedic; or(1)(f) technical rescue specialist. See Utah Code 53-2a-1601- Emergency response team: means a group of emergency responders placed at the direction, control, and funding of the Division of Emergency Management, in accordance with an agreement between the Division of Emergency Management and a sponsoring agency and the provisions of this part, to assist in urban search and rescue:
(2)(a) in response to a disaster, emergency, or important event; or(2)(b) in anticipation of a forecasted severe weather event, a flood, or a planned important event. See Utah Code 53-2a-1601- Emergency response team member: means an individual who is:
(3)(a) an emergency responder;(3)(b) a member of an emergency response team; and(3)(c) acting within the scope of the individual's duties for an emergency response team. See Utah Code 53-2a-1601- Energy: includes the energy resources defined in this chapter. See Utah Code 53-2a-102
- energy resources: includes electricity, natural gas, gasoline and middle distillates, coal, wood fuels, geothermal sources, radioactive materials, and any other resource yielding energy. See Utah Code 53-2a-1003
- Equal: means , with respect to biological sex, of the same value. See Utah Code 68-3-12.5
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Executive action: means any of the following actions by the governor during a state of emergency:
(2)(a) an order, a rule, or a regulation made by the governor as described in Section 53-2a-209;(2)(b) an action by the governor to suspend or modify a statute as described in Subsection 53-2a-204(1)(j); or(2)(c) an action by the governor to suspend the enforcement of a statute as described in Subsection 53-2a-209(4). See Utah Code 53-2a-203- Exigent circumstances: means a significant change in circumstances following the expiration of a state of emergency declared in accordance with this chapter that:
(3)(a) substantially increases the threat to public safety or health relative to the circumstances in existence when the state of emergency expired;(3)(b) poses an imminent threat to public safety or health; and(3)(c) was not known or foreseen and could not have been known or foreseen at the time the state of emergency expired. See Utah Code 53-2a-203- Expenses: means actual labor costs of government and volunteer personnel, and materials. See Utah Code 53-2a-102
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Fraud: Intentional deception resulting in injury to another.
- Governing body: means :
(2)(f)(i) for a county, city, or town, the legislative body of the county, city, or town;(2)(f)(ii) for a special district, the board of trustees of the special district; and(2)(f)(iii) for a special service district:(2)(f)(iii)(A) the legislative body of the county, city, or town that established the special service district, if no administrative control board has been appointed under Section 17D-1-301; or(2)(f)(iii)(B) the administrative control board of the special service district, if an administrative control board has been appointed under Section 17D-1-301. See Utah Code 53-2a-602- Grid resilience: means efforts to provide greater resilience to the state's infrastructure with respect to:
(3)(a) weather events;(3)(b) wildfire;(3)(c) acts of terrorism; or(3)(d) other potentially damaging events. See Utah Code 53-2a-1501- Hazardous materials emergency: means a sudden and unexpected release of any substance that because of its quantity, concentration, or physical, chemical, or infectious characteristics presents a direct and immediate threat to public safety or the environment and requires immediate action to mitigate the threat. - Highway: includes :
(15)(a) a public bridge;(15)(b) a county way;(15)(c) a county road;(15)(d) a common road; and(15)(e) a state road. See Utah Code 68-3-12.5- Important event: includes an event attended by one or more officials of the United States or one or more foreign dignitaries and where a large crowd has or is anticipated to gather. See Utah Code 53-2a-1601
- Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
- Infrastructure: means property and equipment owned or used by communications networks, electric generation systems, transmission and distribution systems, gas distribution systems, water pipelines, and related support facilities that serve multiple customers or citizens, including real and personal property, such as buildings, offices, power and communication lines and poles, pipes, structures, and equipment. See Utah Code 53-2a-1202
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
- Internal disturbance: means a riot, prison break, terrorism, or strike. See Utah Code 53-2a-102
- Interstate mutual aid agreement: means an agreement that establishes procedures for claims against an out-of-state emergency responder, and that:
(4)(a) is established reciprocally between the Utah Highway Patrol and the Idaho State Police;(4)(b) is on file with the Utah Highway Patrol; and(4)(c) has a duration of one year from the time the agreement is entered into by Utah and Idaho. See Utah Code 53-2a-502- IPAWS: means the Integrated Public Alert and Warning System administered by the Federal Emergency Management Agency. See Utah Code 53-2a-102
- Joint resolution: A legislative measure which requires the approval of both chambers.
- Land: includes :
(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5- Law enforcement officer: means the same as that term is defined in Section
53-13-103 . See Utah Code 53-1-102- Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Legislative emergency response committee: means the Legislative Emergency Response Committee created in Section 53-2a-218. See Utah Code 53-2a-203
- Local emergency: means a condition in any municipality or county of the state which requires that emergency assistance be provided by the affected municipality or county or another political subdivision to save lives and protect property within its jurisdiction in response to a disaster, or to avoid or reduce the threat of a disaster. See Utah Code 53-2a-203
- Local fund: means a local government disaster fund created in accordance with Section 53-2a-605. See Utah Code 53-2a-602
- Local government: means :
(2)(h)(i) a county;(2)(h)(ii) a city or town; or(2)(h)(iii) a special district or special service district that:(2)(h)(iii)(A) operates a water system;(2)(h)(iii)(B) provides transportation service;(2)(h)(iii)(C) provides, operates, and maintains correctional and rehabilitative facilities and programs for municipal, state, and other detainees and prisoners;(2)(h)(iii)(D) provides consolidated 911 and emergency dispatch service;(2)(h)(iii)(E) operates an airport; or(2)(h)(iii)(F) operates a sewage system. See Utah Code 53-2a-602- Local special election: means a special election called by the governing body of a local political subdivision in which all registered voters of the local political subdivision may vote. See Utah Code 20A-1-102
- Man: means an adult human male. See Utah Code 68-3-12.5
- Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
- Motor vehicle: means every self-propelled vehicle and every vehicle propelled by electric power obtained from overhead trolley wires, but not operated upon rails, except motorized wheel chairs and vehicles moved solely by human power. See Utah Code 53-1-102
- Municipal general election: means the election held in municipalities and, as applicable, special districts on the first Tuesday after the first Monday in November of each odd-numbered year for the purposes established in Section
20A-1-202 . See Utah Code 20A-1-102- Municipality: means a city or town. See Utah Code 20A-1-102
- Municipality: means the same as that term is defined in Section 10-1-104. See Utah Code 53-2a-102
- Natural phenomena: means any earthquake, tornado, storm, flood, landslide, avalanche, forest or range fire, or drought. See Utah Code 53-2a-102
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Officer: means a person who is elected or appointed to an office or position within a political subdivision. See Utah Code 53-2a-102
- Out-of-state business: means a business entity that:
(5)(a) has no presence in the state, other than any prior disaster- or emergency-related work, and conducts no business in the state, and whose services are requested by a registered business or by a state or local government for purposes of performing disaster- or emergency-related work in the state; and(5)(b) has no registration or tax filings or presence sufficient to require the collection or payment of a tax in the state prior to the declared state disaster or emergency. See Utah Code 53-2a-1202- Out-of-state employee: means an employee who does not work in the state, except for disaster- or emergency-related work during the disaster period. See Utah Code 53-2a-1202
- Participating political subdivision: means each county, municipality, public safety district, and public safety interlocal entity that has not adopted a resolution under Section 53-2a-306 withdrawing itself from the statewide mutual aid system. See Utah Code 53-2a-302
- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- Political party: means an organization of registered voters that has qualified to participate in an election by meeting the requirements of Chapter 8, Political Party Formation and Procedures. See Utah Code 20A-1-102
- Political subdivision: means the same as that term is defined in Section 11-61-102. See Utah Code 53-2a-102
- Political subdivision: means a municipality, county, special service district, or special district. See Utah Code 53-2a-203
- Poll worker: includes election judges. See Utah Code 20A-1-102
- Polling place: means a building where voting is conducted. See Utah Code 20A-1-102
- Presidential Primary Election: means the election established in Chapter 9, Part 8, Presidential Primary Election. See Utah Code 20A-1-102
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Provisional ballot: means a ballot voted provisionally by a person:
(55)(a) whose name is not listed on the official register at the polling place;(55)(b) whose legal right to vote is challenged as provided in this title; or(55)(c) whose identity was not sufficiently established by a poll worker. See Utah Code 20A-1-102- Public figure: means an individual who, due to the individual being considered for, holding, or having held a position of prominence in a public or private capacity, or due to the individual's celebrity status, has an increased risk to the individual's safety. See Utah Code 20A-1-102
- Public safety district: means a special district under Title 17B, Limited Purpose Local Government Entities - Special Districts, or special service district under Title 17D, Chapter 1, Special Service District Act, that provides public safety service. See Utah Code 53-2a-302
- Public safety interlocal entity: means an interlocal entity under Title 11, Chapter 13, Interlocal Cooperation Act, that provides public safety service. See Utah Code 53-2a-302
- Public safety service: means a service provided to the public to protect life and property and includes fire protection, police protection, emergency medical service, and hazardous material response service. See Utah Code 53-2a-302
- qualified: means to take the oath of office and begin performing the duties of the position for which the individual was elected. See Utah Code 20A-1-102
- Quorum: The number of legislators that must be present to do business.
- Registered business: means a business entity that is currently registered to do business in the state prior to the declared state disaster or emergency. See Utah Code 53-2a-1202
- Registration form: means a form by which an individual may register to vote under this title. See Utah Code 20A-1-102
- Regular general election: means the election held throughout the state on the first Tuesday after the first Monday in November of each even-numbered year for the purposes established in Section
20A-1-201 . See Utah Code 20A-1-102- Regular primary election: means the election, held on the date specified in Section
Utah Code 20A-1-102 - Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Requesting political subdivision: means a participating political subdivision that requests emergency assistance under Section 53-2a-207 from one or more other participating political subdivisions. See Utah Code 53-2a-302
- Resident: means a person who resides within a specific voting precinct in Utah. See Utah Code 20A-1-102
- Responding political subdivision: means a participating political subdivision that responds to a request under Section 53-2a-307 from a requesting political subdivision. See Utah Code 53-2a-302
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
- Special district: means the same as that term is defined in Section 17B-1-102. See Utah Code 53-2a-602
- Special election: means an election held as authorized by Section
20A-1-203 . See Utah Code 20A-1-102- Special fund: means a fund other than a general fund of a local government that is created for a special purpose established under the uniform system of budgeting, accounting, and reporting. See Utah Code 53-2a-602
- Special service district: means the same as that term is defined in Section 17D-1-102. See Utah Code 53-2a-602
- Sponsoring agency: means an entity in the state that executes a written agreement to organize a National Urban Search and Rescue Response System task force as described in Utah Code 53-2a-1601
- State: means the state of Utah. See Utah Code 53-2a-302
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- State of emergency: means a condition in any part of this state that requires state government emergency assistance to supplement the local efforts of the affected political subdivision to save lives and to protect property, public health, welfare, or safety in the event of a disaster, or to avoid or reduce the threat of a disaster. See Utah Code 53-2a-102
- Statute: A law passed by a legislature.
- Subpoena: A command to a witness to appear and give testimony.
- Swear: includes "affirm. See Utah Code 68-3-12.5
- system: means the aggregate of all participating political subdivisions and the state. See Utah Code 53-2a-302
- Technological hazard: means any hazardous materials accident, mine accident, train derailment, air crash, radiation incident, pollution, structural fire, or explosion. See Utah Code 53-2a-102
- Terrorism: means activities or the threat of activities that:
(19)(a) involve acts dangerous to human life;(19)(b) are a violation of the criminal laws of the United States or of this state; and(19)(c) to a reasonable person, would appear to be intended to:(19)(c)(i) intimidate or coerce a civilian population;(19)(c)(ii) influence the policy of a government by intimidation or coercion; or(19)(c)(iii) affect the conduct of a government by mass destruction, assassination, or kidnapping. See Utah Code 53-2a-102- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.

- Urban search and rescue: means the location, extrication, and initial medical stabilization of victims trapped in a confined space as the result of a structural collapse, transportation accident, mining accident, or collapsed trench. See Utah Code 53-2a-102
- Utah Code: means the 1953 recodification of the Utah Code, as amended, unless the text expressly references a portion of the 1953 recodification of the Utah Code as it existed:
(42)(a) on the day on which the 1953 recodification of the Utah Code was enacted; or(42)(b)(42)(b)(i) after the day described in Subsection (42)(a); and(42)(b)(ii) before the most recent amendment to the referenced portion of the 1953 recodification of the Utah Code. (76)(a) a form of identification that bears the name and photograph of the voter which may include:(76)(a)(i) a currently valid Utah driver license;(76)(a)(ii) a currently valid identification card that is issued by:(76)(a)(ii)(A) the state; or(76)(a)(ii)(B) a branch, department, or agency of the United States;(76)(a)(iii) a currently valid Utah permit to carry a concealed weapon;(76)(a)(iv) a currently valid United States passport; or(76)(a)(v) a currently valid United States military identification card;(76)(b) one of the following identification cards, whether or not the card includes a photograph of the voter:(76)(b)(i) a valid tribal identification card;(76)(b)(ii) a Bureau of Indian Affairs card; or(76)(b)(iii) a tribal treaty card; or(76)(c) two forms of identification not listed under Subsection (76)(a) or (b) but that bear the name of the voter and provide evidence that the voter resides in the voting precinct, which may include:(76)(c)(i) a current utility bill or a legible copy thereof, dated within the 90 days before the election;(76)(c)(ii) a bank or other financial account statement, or a legible copy thereof;(76)(c)(iii) a certified birth certificate;(76)(c)(iv) a valid social security card;(76)(c)(v) a check issued by the state or the federal government or a legible copy thereof;(76)(c)(vi) a paycheck from the voter's employer, or a legible copy thereof;(76)(c)(vii) a currently valid Utah hunting or fishing license;(76)(c)(viii) certified naturalization documentation;(76)(c)(ix) a currently valid license issued by an authorized agency of the United States;(76)(c)(x) a certified copy of court records showing the voter's adoption or name change;(76)(c)(xi) a valid Medicaid card, Medicare card, or Electronic Benefits Transfer Card;(76)(c)(xii) a currently valid identification card issued by:(76)(c)(xii)(A) a local government within the state;(76)(c)(xii)(B) an employer for an employee; or(76)(c)(xii)(C) a college, university, technical school, or professional school located within the state; or(76)(c)(xiii) a current Utah vehicle registration. See Utah Code 20A-1-102- Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
