Terms Used In Ohio Code > Chapter 5107 - Ohio Works First Program

  • Adult: means an individual who is not a minor child. See Ohio Code 5107.02
  • Allegation: something that someone says happened.
  • Another: when used to designate the owner of property which is the subject of an offense, includes not only natural persons but also every other owner of property. See Ohio Code 1.02
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appraisal: A determination of property value.
  • Assistance group: means a group of individuals treated as a unit for purposes of determining eligibility for and the amount of assistance provided under Ohio works first. See Ohio Code 5107.02
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Child: includes child by adoption. See Ohio Code 1.59
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Contract: A legal written agreement that becomes binding when signed.
  • Custodian: means an individual who has legal custody, as defined in section 2151. See Ohio Code 5107.02
  • Dependent: A person dependent for support upon another.
  • Domestic violence: means being subjected to any of the following:

    (1) Physical acts that resulted in, or threatened to result in, physical injury to the individual;

    (2) Sexual abuse;

    (3) Sexual activity involving a dependent child;

    (4) Being forced as the caretaker relative of a dependent child to engage in nonconsensual sexual acts or activities;

    (5) Threats of, or attempts at, physical or sexual abuse;

    (6) Mental abuse;

    (7) Neglect or deprivation of medical care. See Ohio Code 5107.02

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fraud: Intentional deception resulting in injury to another.
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guardian: means an individual that is granted authority by a probate court pursuant to Chapter 2111 of the Revised Code, or a court of competent jurisdiction in another state, to exercise parental rights over a minor child to the extent provided in the court's order and subject to residual parental rights of the minor child's parents. See Ohio Code 5107.02
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • LEAP program: means the learning, earning, and parenting program conducted under section 5107. See Ohio Code 5107.02
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Minor child: means either of the following:

    (1) An individual who has not attained age eighteen;

    (2) An individual who has not attained age nineteen and is a full-time student in a secondary school or in the equivalent level of vocational or technical training. See Ohio Code 5107.02

  • Minor head of household: means a minor child who is either of the following:

    (1) Is married, pregnant, and a member of an assistance group that does not include an adult;

    (2) Is married and is a parent of a child included in the same assistance group that does not include an adult. See Ohio Code 5107.02

  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Ohio works first: means the program established by this chapter known as temporary assistance for needy families in Title IV-A. See Ohio Code 5107.02
  • Payment standard: means the amount specified in rules adopted under section 5107. See Ohio Code 5107.02
  • Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Specified relative: means the following individuals who are age eighteen or older:

    (1) The following individuals related by blood or adoption:

    (a) Grandparents, including grandparents with the prefix "great" "great-great" or "great-great-great";

    (b) Siblings;

    (c) Aunts, uncles, nephews, and nieces, including such relatives with the prefix "great" "great-great" "grand" or "great-grand";

    (d) First cousins and first cousins once removed. See Ohio Code 5107.02

  • state: means the state of Ohio. See Ohio Code 1.59
  • Title IV-D: means Title IV-A or Title IV-D of the "Social Security Act" 49 Stat. See Ohio Code 5107.02
  • United States: includes all the states. See Ohio Code 1.59
