Terms Used In Kansas Statutes > Chapter 8 > Article 2 - Drivers' Licenses
- Academic degree: means any associate, bachelor's, first professional, master's, intermediate (specialist), or doctor's degree. See Kansas Statutes 74-3262
- Account holder: means a legal resident who is the owner of an individual development account. See Kansas Statutes 74-50,202
- Accredited independent institution: has the meaning ascribed thereto in Kan. See Kansas Statutes 74-32,241
- Accumulated contributions: means the sum of all contributions by a member to the system which shall be credited to such member's account, with interest allowed thereon, plus such member's contributions transferred from the school employees savings fund of the state school retirement system;
(2) "compensation" means the same as defined in subsection (9) of Kan. See Kansas Statutes 74-4932
- Acquittal:
- Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
- A verdict of "not guilty."
- Act: means the Kansas deferred retirement option program act;
(2) "board" means the board of trustees of the Kansas public employees retirement system;
(3) "DROP" means the deferred retirement option program established by Kan. See Kansas Statutes 74-4986l
- Act: means the provisions of Kan. See Kansas Statutes 74-50,211
- Act: means the Kansas development finance authority act. See Kansas Statutes 74-8902
- Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
- Adult basic education program: means a program of one or more courses in general education subjects taught at the grade school or high school level under the supervision of a board for eligible persons which is included in the state plan and for which federal funds are received pursuant to federal law. See Kansas Statutes 74-32,253
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- agency: shall mean any agency or instrumentality of the state of Kansas which stores, gathers or generates public information. See Kansas Statutes 74-9301
- Agricultural business enterprises: means facilities supporting or utilized in the operation of farms, ranches and other agricultural, aquacultural or silvicultural commodity producers and services provided in conjunction with the foregoing. See Kansas Statutes 74-8902
- Alcohol: means any substance containing any form of alcohol including, but not limited to, ethanol, methanol, propanol and isopropanol;
(b) "alcohol concentration" means:
(1) The number of grams of alcohol per 100 milliliters of blood; or
(2) the number of grams of alcohol per 210 liters of breath;
(c) "commercial driver's license" means a commercial license issued pursuant to Kan. See Kansas Statutes 8-2,128
- Allegation: something that someone says happened.
- Allocation: means the allocation of the state ceiling among governmental issuers as provided in this act. See Kansas Statutes 74-5059
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- American Indian: means a person having origins in the original peoples of North America and who maintains cultural identification through tribal affiliation or community recognition. See Kansas Statutes 74-32,113
- American Indian or Alaskan Native: means a person having origins in any of the original peoples of North America and who maintains cultural identification through tribal affiliation or community recognition. See Kansas Statutes 74-3284
- Amortization: Paying off a loan by regular installments.
- Ancillary lottery gaming facility operations: means additional non-lottery facility game products and services not owned and operated by the state that may be included in the overall development associated with the lottery gaming facility. See Kansas Statutes 74-8702
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Antiquities: means historic or prehistoric ruins and other archeological sites, including evidence of such features as constructions or inscriptions by human agency or other evidence of human activity having antiquity but not including any unmarked burial site subject to the provisions of the Kansas unmarked burial sites preservation act. See Kansas Statutes 74-5401
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- Applied research: means those research activities occurring at educational institutions and in private enterprises, which have potential commercial application;
(b) "basic research" means research that has long range generic value to an industry classification or group of companies. See Kansas Statutes 74-8103
- Appraisal: A determination of property value.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Arrest: Taking physical custody of a person by lawful authority.
- Asian or Pacific Islander: means a person having origins in any of the original peoples of the far east, southeast Asia, the Indian subcontinent, or pacific islands. See Kansas Statutes 74-3284
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Assistant provost: means the assistant provost of the division of continuing education of Kansas state university. See Kansas Statutes 74-5023
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.
- Authority: means the Kansas development finance authority created by Kan. See Kansas Statutes 74-8902
- Auto racetrack facility: means the same as defined in Kan. See Kansas Statutes 74-8702
- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Banking industry: means banks, savings and loan associations and credit unions;
(b) "contribution" means and includes the donation of cash or property other than used clothing in an amount or value of $250 or more. See Kansas Statutes 74-99c02
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
- Base eligibility period: means the three taxable years immediately preceding the date of application for benefits under this act. See Kansas Statutes 74-50,136
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- benefits: shall mean all moneys payable by the United States through the bureau. See Kansas Statutes 73-501
- Bequest: Property gifted by will.
- bet: means a bargain in which the parties agree that, dependent upon chance, one stands to win or lose something of value specified in the agreement. See Kansas Statutes 74-8702
- bioscience business: means a business engaged in bioscience as defined in Kan. See Kansas Statutes 74-8132
- Blighted area: has the meaning ascribed to it in Kan. See Kansas Statutes 74-5093
- Board: means the board of education of any school district or the board of trustees of any community college. See Kansas Statutes 74-32,253
- board: means the Kansas board of examiners in fitting and dispensing of hearing instruments. See Kansas Statutes 74-5807
- Board: means the natural and scientific areas advisory board created by Kan. See Kansas Statutes 74-6603
- Board: means the crime victims compensation board established under Kan. See Kansas Statutes 74-7301
- board: means the Kansas technology enterprise advisory board;
(d) "department" means the department of commerce;
(e) "educational institutions" means public and private community colleges, colleges and universities in the state;
(f) "enterprise" means a firm with its principal place of business in Kansas which is engaged or proposes to be engaged in this state in agricultural, natural resource-based or other manufacturing, research and development, or the provision of technology-based services;
(g) "new technology" means the development through science or research of methods, processes and procedures, including but not limited to those involving the utilization of agricultural products and by-products and oil and gas and other mineral resources for practical application in industrial and service situations;
(h) "person" means any individual, partnership, corporation or joint venture carrying on business or proposing to carry on business within the state;
(i) "product" means any product, device, technique or process, which is or may be developed or marketed commercially; however, "product" does not refer to basic research but shall apply to such products, devices, techniques or processes which have advanced beyond the theoretical stage and are in a prototype or practice stage;
(j) "qualified security" means any public or private financial arrangement, involving any note, security, debenture, evidence of indebtedness, certificate of interest or participation in any profit-sharing agreement, preorganization certificate or subscription, transferable security, investment contract, certificate of deposit for a security, certificate of interest or participation in a patent or application therefor, or in royalty or other payments under such a patent or application, or, in general, any interest or instrument commonly known as a "security" or any certificate for, receipt for, guarantee of, or option, warrant or right to subscribe to or purchase any of the foregoing to the extent allowed by law;
(k) "secretary" means the secretary of commerce; and
(l) "seed capital" means financing that is provided for the development, refinement and commercialization of a product, process or innovation, whether for the startup of a new firm, the expansion or the restructuring of a small firm. See Kansas Statutes 74-8103
- Board: means the board of trustees of Kansas City Kansas community college;
(2) "foundation" means the Kansas multi-sport and recreation foundation;
(3) "increment" means that amount of state and local sales tax revenue imposed pursuant to Kan. See Kansas Statutes 74-8936
- Board of directors: means the board of directors of the authority created by Kan. See Kansas Statutes 74-8902
- Board of regents: means the state board of regents provided for in the constitution of this state and described in article 32 of chapter 74 of Kansas Statutes Annotated. See Kansas Statutes 74-3278
- Board of regents: means the state board of regents created by Kan. See Kansas Statutes 74-5023
- Bonds: means any bonds, notes, debentures, interim certificates, grant and revenue anticipation notes, interest in a lease, lease certificate of participation or other evidences of indebtedness, whether or not the interest on which is subject to federal income taxation, issued by the authority pursuant to this act. See Kansas Statutes 74-8902
- Breakage: means the odd cents by which the amount payable on each dollar wagered exceeds:
(1) A multiple of $. See Kansas Statutes 74-8802
- bureau: means the United States veterans' bureau or its successor. See Kansas Statutes 73-501
- Business support services: means business counseling, technical assistance and business planning services provided to existing or prospective small businesses or entrepreneurs;
(2) "contributions" means and includes the donation of cash or property other than used clothing in an amount or value of $250 or more. See Kansas Statutes 74-50,154
- Capital improvements: means any physical public betterment or improvement or any preliminary plans, studies or surveys relative thereto; land or rights in land, including, without limitations, leases, air rights, easements, rights-of-way or licenses; and any furnishings, machinery, vehicles, apparatus or equipment for any public betterment or improvement. See Kansas Statutes 74-8902
- Capital offense: A crime punishable by death.
- Career technical education: means organized educational programs offering a sequence of courses which are directly related to the preparation of individuals in paid or unpaid employment in current or emerging occupations requiring other than a baccalaureate or advanced degree. See Kansas Statutes 74-32,407
- Career technical education capital outlay aid: means state financial aid distributed under this act by the state board to an eligible institution for the purpose of construction, reconstruction, repair, remodeling, additions to, furnishing and equipping of buildings, architectural expenses incidental thereto, the acquisition of buildings and building sites and the acquisition of equipment. See Kansas Statutes 74-32,413
- Career technical education institution: means any technical college, community college, municipal university, or any state educational institution that operates one or more career technical education programs. See Kansas Statutes 74-32,417
- Career technical education program: means a program of vocational or technical training or retraining that is operated at the postsecondary level and is designed to prepare persons for gainful employment. See Kansas Statutes 74-32,417
- Career technical workforce grant: means the award of a financial grant-in-aid by this state under this act to an eligible student. See Kansas Statutes 74-32,423
- cash investment: means money or money equivalent in consideration for qualified securities;
(d) "department" means the department of commerce;
(e) "Kansas business" means any business owned by an individual, any partnership, association or corporation domiciled in Kansas, or any corporation, even if a wholly owned subsidiary of a foreign corporation, that does business primarily in Kansas or does substantially all of such businesses' production in Kansas;
(f) "owner" means any natural person who is, directly or indirectly, a partner, stockholder or member in a permitted entity investor;
(g) "permitted entity investor" means: (A) Any general partnership, limited partnership, corporation that has in effect a valid election to be taxed as an S corporation under the United States internal revenue code, or a limited liability company that has elected to be taxed as a partnership under the United States internal revenue code; and (B) that was established and is operated for the sole purpose of making investments in other entities;
(h) "qualified Kansas business" means the Kansas businesses that are approved and certified as qualified Kansas businesses as provided in Kan. See Kansas Statutes 74-8132
- center: means the Kansas center for entrepreneurship;
(d) "department" means the department of commerce;
(e) "distressed community" means an area in which 20% or more of the population of all ages for each census tract located within the area has an income below poverty level as reported in the most recently completed decennial census published by the United States bureau of the census;
(f) "fund" means the Kansas community entrepreneurship fund;
(g) "contributor" means a person or entity making a contribution to the Kansas center for entrepreneurship;
(h) "Kansas business" means any business owned by an individual, any partnership, association or corporation domiciled in Kansas, or any corporation, even if a wholly owned subsidiary of a foreign corporation, that does business primarily in Kansas or does substantially all of its production in Kansas;
(i) "member" means a member of the board of directors;
(j) "qualified entrepreneur" means an entrepreneur who has exhibited a financial commitment to the business or who has proven business experience or who possesses either a bachelor or master of business administration degree or who has completed course work as directed by the Kansas center for entrepreneurship that certifies the individual as a qualified entrepreneur;
(k) "regional and community organization" means a not-for-profit organization properly organized under Kansas statutes to provide funds to start-up entrepreneurs through loans, grants or agreements with financial institutions;
(l) "rural community" means any city having a population of fewer than 50,000 or except as otherwise provided, any unincorporated area. See Kansas Statutes 74-99c02
- Chambers: A judge's office.
- Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
- Claimant: means any of the following persons claiming compensation under this act:
(1) A victim;
(2) a dependent of a deceased victim;
(3) a third person other than a collateral source; or
(4) an authorized person acting on behalf of any of them. See Kansas Statutes 74-7301
- Code: means the internal revenue code of 1986. See Kansas Statutes 74-5059
- Collateral source: means the net financial benefit, after deduction of taxes, legal fees, costs, expenses of litigation, liens, offsets, credits or other deductions, from a source of benefits or advantages for economic loss otherwise reparable under this act which the victim or claimant has received, or which is readily available to the victim or claimant, from:
(1) The offender;
(2) the government of the United States or any agency thereof, a state or any of its political subdivisions or an instrumentality or two or more states, unless the law providing for the benefits or advantages makes them excess or secondary to benefits under this act;
(3) social security, medicare and medicaid;
(4) state-required temporary nonoccupational disability insurance;
(5) workers' compensation;
(6) wage continuation programs of any employer;
(7) proceeds of a contract of insurance payable to the victim for loss which the victim sustained because of the criminally injurious conduct;
(8) a contract providing prepaid hospital and other health care services or benefits for disability; or
(9) damages awarded in a tort action. See Kansas Statutes 74-7301
- commercial motor vehicle: means a motor vehicle designed or used to transport passengers or property, if:
(1) The vehicle has a gross vehicle weight rating of 26,001 or more pounds or such lesser rating, as determined by rules and regulations adopted by the secretary, but shall not be more restrictive than the federal regulation;
(2) the vehicle is designed to transport 16 or more passengers, including the driver; or
(3) the vehicle is transporting hazardous materials and is required to be placarded in accordance with 49 C. See Kansas Statutes 8-2,128
- Commission: means the antiquities commission created by this act. See Kansas Statutes 74-5401
- Commission: means the Kansas lottery commission. See Kansas Statutes 74-8702
- Commission: means the Kansas racing and gaming commission created by this act. See Kansas Statutes 74-8802
- committee: means the Kansas criminal justice information system committee. See Kansas Statutes 74-5701
- Committee: means the nursing service scholarship review committee established under Kan. See Kansas Statutes 74-3292
- Committee: means the committee on surety bonds and insurance. See Kansas Statutes 74-4717
- committee: means the community strategic planning grant committee established by Kan. See Kansas Statutes 74-5093
- Community college: means any community college organized and operating under the laws of this state. See Kansas Statutes 74-32,241
- Community resource program: means a program designed and established in response to the educational, recreational, social and cultural needs of a community and which is operated by residents of the community who volunteer their talent, skills and knowledge in offering courses and activities for all the residents of the community. See Kansas Statutes 74-5023
- Community-based organization: means any religious or charitable association or tribal entity that is approved by the department to implement the individual development account reserve fund. See Kansas Statutes 74-50,202
- compensation: means the same as such term is defined in Kan. See Kansas Statutes 74-49,202
- Competent: means a good faith determination that the person is likely to successfully meet the performance standards of the position based on what a reasonable person knowledgeable in the operation of the position would conclude from all information available at the time the decision is made. See Kansas Statutes 73-201
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Concessionaire licensee: means a person, partnership, corporation or association licensed by the commission to utilize a space or privilege within a racetrack facility to sell goods or services. See Kansas Statutes 74-8802
- Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
- Conservator: means an individual or corporation appointed by the court to act on behalf of a conservatee and possessed of some or all of the powers and duties set out in Kan. See Kansas Statutes 77-201
- Construct: means to acquire or build, in whole or in part, in such manner and by such method as the authority shall determine to be in the public interest and necessary to accomplish the purposes of and authority set forth in this act. See Kansas Statutes 74-8902
- Contingent beneficiary: Receiver of property or benefits if the first named beneficiary fails to receive any or all of the property or benefits in question before his (her) death.
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Contract: means an agreement, written or oral, between two or more persons, partnerships, corporations or associations, or any combination thereof that creates an obligation between the parties. See Kansas Statutes 74-8802
- controlled substance: means any substance so classified under Kan. See Kansas Statutes 8-2,128
- Conviction: A judgement of guilt against a criminal defendant.
- conviction: means an unvacated adjudication of guilt or a determination that a person has violated or failed to comply with the law and in a court of original jurisdiction or an administrative proceeding, an unvacated forfeiture of bail or collateral deposited to secure the person's appearance in court, a plea of guilty or nolo contendere accepted by the court, the payment of a fine or court cost, or violation of a condition of release without bail, regardless of whether the penalty is rebated, suspended or probated;
(i) "disqualification" means any of the following:
(1) The suspension, revocation, or cancellation of a commercial driver's license by the state or jurisdiction of issuance;
(2) any withdrawal of a person's privileges to drive a commercial motor vehicle by a state or other jurisdiction as the result of a violation of state or local law relating to motor vehicle traffic control, other than parking, vehicle weight or vehicle defect violations;
(3) a determination by the federal motor carrier safety administration that a person is not qualified to operate a commercial motor vehicle under 49 C. See Kansas Statutes 8-2,128
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- County median wage: means the median wage paid to employees located in the county where the qualified company intends to employ new employees as reported by the department of labor in its annual report for the previous year. See Kansas Statutes 74-50,211
- Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
- covered position: means a position with an affiliated employer that is eligible for membership in the Kansas public employees retirement system pursuant to the provisions of Kan. See Kansas Statutes 74-49,202
- Crime scene cleanup: means removal of blood, stains, odors or other debris caused by the crime or the processing of the crime scene and may include replacement of materials that were removed because such materials were biohazardous or were damaged as part of evidence collection. See Kansas Statutes 74-7301
- Criminally injurious conduct: means conduct that: (1) (A) Occurs or is attempted in this state or occurs to a person whose domicile is in Kansas who is the victim of a violent crime which occurs in another state, possession, or territory of the United States of America may make an application for compensation if:
(i) The crimes would be compensable had it occurred in the state of Kansas; and
(ii) the places the crimes occurred are states, possessions or territories of the United States of America not having eligible crime victim compensation programs;
(B) poses a substantial threat or personal injury or death; and
(C) either is punishable by fine, imprisonment or death or would be so punishable but for the fact that the person engaging in the conduct lacked capacity to commit the crime under the laws of this state; or
(2) is an act of terrorism, as defined in 18 U. See Kansas Statutes 74-7301
- Crossover employment: means a situation in which an occupational licensee is concurrently employed at the same racing facility by an organization licensee and a facility owner licensee or facility manager licensee. See Kansas Statutes 74-8802
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Decedent: A deceased person.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Deed: is a pplied to an instrument conveying lands but does not imply a sealed instrument. See Kansas Statutes 77-201
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Defunct institution of postsecondary education: means any institution of postsecondary education which has made a determination that it should be dissolved or disorganized, or which has been dissolved or disorganized prior to the effective date of this act, or which ceases to award academic degrees or has ceased awarding academic degrees prior to the effective date of this act. See Kansas Statutes 74-3262
- Department: means the department of revenue acting directly or through its duly authorized officers and agents. See Kansas Statutes 8-273
- Department: means the department of administration. See Kansas Statutes 74-4717
- department: means the department of commerce;
(4) "entrepreneur" means an individual creating a new business, service or product;
(5) "region" means multi-county areas as defined by the secretary of commerce;
(6) "regional business development fund" means an authorized and audited fund that is created by taxpayer contributions, interest income and investment income and is managed by the regional foundation board of directors for the purposes of economic and leadership development in the region;
(7) "regional foundation" means any organization in Kansas that demonstrates capacity to provide economic development services to regions as defined by this act, and: (A) Has obtained a ruling from the internal revenue service of the United States department of treasury that such organization is exempt from income taxation under the provisions of section 501(c)(3) or 501(c)(6) of the federal internal revenue code;
(B) has been designated as a certified development company by the United States small business administration;
(C) has been designated as an economic development district by the United States department of commerce's economic development administration;
(D) has been organized as a regional planning commission under Kan. See Kansas Statutes 74-50,154
- Dependent: A person dependent for support upon another.
- Dependent: shall mean any child born before or during the period of time such child's father served as a prisoner of war or was declared to be a person missing in action, or any child legally adopted or in the legal custody of any person prior to and during the time such person served as a prisoner of war or was declared to be a person missing in action. See Kansas Statutes 73-1216
- Dependent: means a natural person wholly or partially dependent upon the victim for care or support, and includes a child of the victim born after the victim's death. See Kansas Statutes 74-7301
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- Designated educational institution: means an educational institution that: (1) Has been identified by the Kansas board of regents, working in conjunction with the Kansas department of commerce, as delivering programs that are high cost, high demand or in a critical industry field; (2) is eligible to receive federal title IV funding; and (3) has its main campus or principal place of operation located in Kansas. See Kansas Statutes 74-32,423
- Devise: To gift property by will.
- director: means the director of the United States veterans' bureau or his successor. See Kansas Statutes 73-501
- Disabled veteran: means a person who has served on active duty in the armed forces, has been separated therefrom under honorable conditions, and has established the present existence of a service-connected disability or is receiving compensation, disability retirement benefits, or pension because of a public statute administered by the department of veterans affairs or a military department. See Kansas Statutes 73-201
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
- Docket: A log containing brief entries of court proceedings.
- Donor: The person who makes a gift.
- drive: includes operation or physical control of a motor vehicle anywhere in the state;
(k) "driver" means any person who drives, operates or is in physical control of a commercial motor vehicle, in any place open to the general public for purposes of vehicular traffic, or who is required to hold a commercial driver's license;
(l) "driver's license" means any driver's license or any other license or permit to operate a motor vehicle issued under, or granted by, the laws of this state, including:
(1) Any temporary license or instruction;
(2) the privilege of any person to drive a motor vehicle whether or not such person holds a valid license; or
(3) any nonresident's operating privilege;
(m) "employer" means any person, including the United States, a state or a political subdivision of a state, who owns or leases a commercial motor vehicle or assigns a person to drive a commercial motor vehicle;
(n) "endorsement" means an authorization to an individual's commercial driver's license required to permit the individual to operate certain types of commercial motor vehicles;
(o) "felony" means any offense under state or federal law that is punishable by death or imprisonment for a term exceeding one year;
(p) "gross vehicle weight rating" means the value specified by the manufacturer as the maximum loaded weight of a single or a combination (articulated) vehicle. See Kansas Statutes 8-2,128
- driver: means any person who drives, operates or is in physical control of a commercial motor vehicle, in any place open to the general public for purposes of vehicular traffic, or who is required to hold a commercial driver's license;
(l) "driver's license" means any driver's license or any other license or permit to operate a motor vehicle issued under, or granted by, the laws of this state, including:
(1) Any temporary license or instruction;
(2) the privilege of any person to drive a motor vehicle whether or not such person holds a valid license; or
(3) any nonresident's operating privilege;
(m) "employer" means any person, including the United States, a state or a political subdivision of a state, who owns or leases a commercial motor vehicle or assigns a person to drive a commercial motor vehicle;
(n) "endorsement" means an authorization to an individual's commercial driver's license required to permit the individual to operate certain types of commercial motor vehicles;
(o) "felony" means any offense under state or federal law that is punishable by death or imprisonment for a term exceeding one year;
(p) "gross vehicle weight rating" means the value specified by the manufacturer as the maximum loaded weight of a single or a combination (articulated) vehicle. See Kansas Statutes 8-2,128
- DROP account: means the notional account to which is credited the monthly DROP accrual;
(5) "DROP period" means the period of time that a member elects to participate in the DROP pursuant to Kan. See Kansas Statutes 74-4986l
- Dual racetrack facility: means a racetrack facility for the racing of both horses and greyhounds or two immediately adjacent racetrack facilities, owned by the same licensee, one for racing horses and one for racing greyhounds. See Kansas Statutes 74-8802
- Economic loss: means economic detriment consisting only of allowable expense, work loss, replacement services loss and, if injury causes death, dependent's economic loss and dependent's replacement service loss. See Kansas Statutes 74-7301
- Educational and training program for advanced practice registered nurses: means a post-basic nursing education program a graduate of which meets the education requirements of the board of nursing for licensure as an advanced practice registered nurse. See Kansas Statutes 74-32,132
- Educational facilities: means real, personal and mixed property of any and every kind intended by an educational institution in furtherance of its educational program. See Kansas Statutes 74-8902
- Educational institution: means any state educational institution under the control and supervision of the state board of regents; and
(b) "university police officer" means university police officers employed by the chief executive officer of any educational institution. See Kansas Statutes 74-4986f
- elected state official: means any member of the legislature, or a former member of the legislature, the governor, the lieutenant governor, the secretary of state, the attorney general, the commissioner of insurance and the state treasurer; and any person who formerly served in any such capacity who has 10 or more years of credited service and who has not yet retired or withdrawn such person's accumulated contributions. See Kansas Statutes 74-4998b
- Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
- Electronic gaming machine: means any electronic, electromechanical, video or computerized device, contrivance or machine authorized by the Kansas lottery that, upon insertion of cash, tokens, electronic cards or any consideration, is available to play, operate or simulate the play of a game authorized by the Kansas lottery pursuant to the Kansas expanded lottery act, including, but not limited to, bingo, poker, blackjack, keno and slot machines, and that may deliver or entitle the player operating the machine to receive cash, tokens, merchandise or credits that may be redeemed for cash. See Kansas Statutes 74-8702
- Eligible aviation business: means a person, corporation, partnership or other entity engaged in the aviation manufacturing or service industry and doing business in Kansas that satisfies conditions imposed by the secretary, which may include, among other conditions, that the person, corporation, partnership or other entity:
(A) Paid at least $150,000,000 in average annual gross Kansas compensation, according to reports filed with the secretary of labor, during the base eligibility period;
(B) paid at least $50,000 of average annual gross compensation per Kansas employee during the base eligibility period;
(C) has invested at least $500,000,000 in real and tangible personal property located within and currently used in the operation of a business in Kansas; and
(D) is described by the north American industrial classification system as being in the manufacturing or service sector. See Kansas Statutes 74-50,136
- Eligible aviation project: means a research, development, engineering or manufacturing project (A) undertaken by an eligible aviation business relating to the development of a new or improved business component or product and may include, but not be limited to, product development and design, applied research, manufacturing, improvement, replacement or acquisition of real or personal property and modernization and retooling of existing property in Kansas, (B) for which the eligible aviation business proposes to invest not less than $500,000,000 in Kansas in direct connection with the eligible aviation project of not less than $500,000,000 in Kansas and (C) for which the eligible aviation business proposes to employ up to 4,000 full-time employees in Kansas, as defined in Kan. See Kansas Statutes 74-50,136
- Eligible business: means a person, corporation, partnership or other entity doing business in Kansas that satisfies conditions imposed by the secretary, which may include, among other conditions, that the person, corporation, partnership or other entity:
(A) Paid at least $600,000,000 in average annual gross Kansas compensation, according to reports filed with the secretary of labor, during the base eligibility period; and
(B) paid at least $50,000 of average annual gross compensation per Kansas employee during the base eligibility period; and
(C) has invested at least $1,000,000,000 in real and tangible personal property located within and currently used in the operation of a business in Kansas; and
(D) is described by North American industrial classification system as being in the manufacturing sector. See Kansas Statutes 74-50,136
- Eligible career technical education program: means a designated career technical education program operated at the postsecondary level by a designated educational institution. See Kansas Statutes 74-32,423
- Eligible educational institution: means : (1) Any state educational institution under the control and supervision of the state board; and (2) any municipal university established and operating under the provisions of article 13a of chapter 13 of Kansas Statutes Annotated. See Kansas Statutes 74-3275
- Eligible institution: means an institution of postsecondary education which maintains open enrollment, the main campus or principal place of operation of which is located in Kansas, and which qualifies as an eligible institution under the higher education act of 1965 (P. See Kansas Statutes 74-3284
- Eligible persons: means persons who (1) have attained the age of 16, (2) have not graduated from high school and have not been recognized as having achieved an equivalent level of education, and (3) are not now regularly enrolled in school. See Kansas Statutes 74-32,253
- Eligible project: means a research, development, engineering or manufacturing project (A) undertaken by an eligible business relating to the development of a new or improved business component or product and may include, but not be limited to, product development and design, applied research, manufacturing, improvement, replacement or acquisition of real or personal property and modernization and retooling of existing property in Kansas, (B) for which the eligible business proposes to invest not less than $500,000,000 in Kansas in direct connection with the eligible project of not less than $500,000,000 in Kansas and (C) for which the eligible business proposes to employ up to 4,000 full-time employees in Kansas, as defined in Kan. See Kansas Statutes 74-50,136
- Eligible student: means a person who is: (1) A resident of Kansas, (2) initially acceptable for enrolling at an ROTC institution or who has so enrolled and is in good standing, and (3) qualified for participation in the reserve officers' training corps program at such ROTC institution or who is participating in the program. See Kansas Statutes 74-3255
- Eligible wind or solar energy business: means a person, corporation, partnership or other entity engaged in the wind or solar energy manufacturing industry and doing business in Kansas that satisfies conditions imposed by the secretary, which may include among other conditions, that the person, corporation, partnership or other entity:
(A) Pay at least $32,500 of average annual compensation per Kansas employee; and
(B) is described by the North American industrial classification system as being in the manufacturing sector. See Kansas Statutes 74-50,136
- Eligible wind or solar energy project: means a research, development, engineering or manufacturing project (A) undertaken by an eligible wind or solar energy business relating to the production of a business component or product and may include, but not be limited to, product development and design, applied research, manufacturing, improvement, replacement or acquisition of real or personal property and modernization and retooling of existing property in Kansas, (B) for which the eligible wind or solar energy business proposes to invest not less than $30,000,000 in Kansas in direct connection with the eligible wind or solar energy project of not less than $30,000,000 in Kansas and (C) for which the eligible wind or solar energy business proposes to employ at least 200 full-time employees in Kansas within five years, as defined in Kan. See Kansas Statutes 74-50,136
- Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
- employee: means the same as such term is defined in Kan. See Kansas Statutes 74-49,202
- Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
- entry date: means the entry date as of which an eligible employer joins the system. See Kansas Statutes 74-49,202
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Escrow: Money given to a third party to be held for payment until certain conditions are met.
- Ethnic minority group: means a group of persons categorized as: (1) American Indian or Alaskan Native; (2) Asian or Pacific Islander; (3) Black, non-Hispanic; or (4) Hispanic. See Kansas Statutes 74-3284
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Ex officio: Literally, by virtue of one's office.
- examiner: means a drivers' license examiner of the division of vehicles or any person whom the director of vehicles has authorized, pursuant to the authority granted by this act, to accept applications for drivers' licenses and administer the examinations required for the issuance or renewal of drivers' licenses. See Kansas Statutes 8-234a
- executive director: means the managing officer of the system as defined in subsection (16) of Kan. See Kansas Statutes 74-4932
- Executive director: means the executive director of the Kansas lottery. See Kansas Statutes 74-8702
- Executive director: means the executive director of the commission. See Kansas Statutes 74-8802
- Executive officer: means the chief executive officer of the state board of regents appointed under Kan. See Kansas Statutes 74-3292
- Executive session: A portion of the Senate's daily session in which it considers executive business.
- Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
- Facilities: means any real property, personal property or mixed property of any and every kind. See Kansas Statutes 74-8902
- Facility manager licensee: means a person, partnership, corporation or association licensed by the commission and having a contract with an organization licensee to manage a racetrack facility located in Sedgwick county. See Kansas Statutes 74-8802
- Facility owner licensee: means a person, partnership, corporation or association, or the state of Kansas or any political subdivision thereof, licensed by the commission to construct or own a racetrack facility located in Sedgwick county. See Kansas Statutes 74-8802
- Fair association: means an association organized pursuant to Kan. See Kansas Statutes 74-8802
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- fatality: means the death of a person as a result of a motor vehicle accident;
(ff) "noncommercial motor vehicle" means a motor vehicle or combination of motor vehicles not defined by the term commercial motor vehicle in subsection (f);
(gg) "school bus" means a commercial motor vehicle used to transport preprimary, primary or secondary school students from home to school, from school to home or to and from school-sponsored events. See Kansas Statutes 8-2,128
- Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
- Federal entity: means the government of the United States of America or any bureau, department, instrumentality or other agency of the federal government. See Kansas Statutes 74-8902
- Federal law: means the adult education act of 1966 (title III, P. See Kansas Statutes 74-32,253
- Federal poverty level: means the most recent poverty income guidelines published in the calendar year by the United States department of health and human services. See Kansas Statutes 74-50,202
- Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
- Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
- Fiduciary: A trustee, executor, or administrator.
- final average salary: means the average highest annual salary, as defined in Kan. See Kansas Statutes 74-49,202
- Financial institution: means any bank, trust company, savings bank, credit union or savings and loan association or any other financial institution regulated by the state of Kansas, any agency of the United States or other state with an office in Kansas which is approved by the secretary to create and maintain the necessary financial instruments setting up individual development accounts for eligible families or individuals to implement this program. See Kansas Statutes 74-50,202
- Financial interest: means an interest that could result directly or indirectly in receiving a pecuniary gain or sustaining a pecuniary loss as a result of ownership or interest in a business entity or activity or as a result of a salary, gratuity or other compensation or remuneration from any person. See Kansas Statutes 74-8802
- Financial need: means the difference between the available financial resources of a Kansas ethnic minority scholar and the scholar's total anticipated expenses to attend an eligible institution. See Kansas Statutes 74-3284
- first employed: means an employee has not been an employee in a covered position of any participating employer prior to July 1, 2009, and is employed by a participating employer in a covered position on or after July 1, 2009; an employee who is a former member of the system who withdrew contribution accounts before July 1, 2009, and who is again employed by a participating employer in a covered position on or after July 1, 2009; or an employee who was an inactive non-vested member and who is again employed by a participating employer in a covered position on or after July 1, 2009;
(8) "inactive, non-vested member" means a member who has terminated employment with a participating employer and who does not have a vested retirement benefit in the system on July 1, 2009;
(9) "normal retirement date" means the date on or after which a member may retire with all retirement benefits pursuant to Kan. See Kansas Statutes 74-49,202
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
- Fraud: Intentional deception resulting in injury to another.
- Gaming equipment: means any electric, electronic, computerized or electromechanical machine, mechanism, supply or device or any other equipment, that is: (1) Unique to the Kansas lottery and used pursuant to the Kansas lottery act; (2) integral to the operation of an electronic gaming machine or lottery facility game; and (3) affects the results of an electronic gaming machine or lottery facility game by determining win or loss. See Kansas Statutes 74-8702
- Gaming zone: means : (1) The northeast Kansas gaming zone, which consists of Wyandotte county; (2) the southeast Kansas gaming zone, which consists of Crawford and Cherokee counties; (3) the south central Kansas gaming zone, which consists of Sedgwick and Sumner counties; and (4) the southwest Kansas gaming zone, which consists of Ford county. See Kansas Statutes 74-8702
- Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
- gateway: shall mean any centralized electronic information system by which public information shall be provided via dial-in modem or continuous link to the public through subscription or through public libraries. See Kansas Statutes 74-9301
- General election: refers to the election required to be held on the Tuesday following the first Monday in November of each even-numbered year. See Kansas Statutes 77-201
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Governmental issuer: means the state and any instrumentality or political subdivision thereof which is authorized to issue private activity bonds. See Kansas Statutes 74-5059
- Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
- Grantor: The person who establishes a trust and places property into it.
- Gray machine: means any mechanical, electro-mechanical or electronic device, capable of being used for gambling, that is: (1) Not authorized by the Kansas lottery; (2) not linked to a lottery central computer system; (3) available to the public for play; or (4) capable of simulating a game played on an electronic gaming machine or any similar gambling game authorized pursuant to the Kansas expanded lottery act. See Kansas Statutes 74-8702
- Greyhound: means any greyhound breed of dog properly registered with the national greyhound association of Abilene, Kansas. See Kansas Statutes 74-8802
- Gross compensation: means gross wages and benefits paid to or on behalf of employees receiving wages. See Kansas Statutes 74-50,136
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Guardian: means an individual or a nonprofit corporation certified in accordance with Kan. See Kansas Statutes 77-201
- habitual violator: means any resident or nonresident person who, within the immediately preceding five years, has been convicted in this or any other state:
(a) Three or more times of:
(1) Vehicular homicide, as defined by Kan. See Kansas Statutes 8-285
- hazardous materials: means any material that has been designated as hazardous under 49 U. See Kansas Statutes 8-2,128
- Health care facilities: means facilities for furnishing physical or mental health care. See Kansas Statutes 74-8902
- Hearing instrument: means any instrument, aid or device designed for or represented as aiding or improving impaired human hearing and any parts of such an instrument, aid or device. See Kansas Statutes 74-5807
- High-impact project: means a business development project for which the qualified company shall meet the requirements of subsection (c) of Kan. See Kansas Statutes 74-50,211
- Higher education loan program: means a program which is provided for the purpose of making loans available to students and to parents of students and which is operated under applicable federal loan programs established pursuant to the provisions of the Higher Education Act of 1965, as amended; and
(2) "qualified nonprofit corporation" means a nonprofit corporation organized under the laws of the state of Kansas which is approved as the single nonprofit corporation providing a statewide higher education loan program and which is authorized to issue obligations which are exempt from federal income taxation. - Hispanic: means a person of Mexican, Puerto Rican, Cuban, Central or South American or other Spanish culture or origin, regardless of race. See Kansas Statutes 74-3284
- Historical horse race machine: means any electronic, electromechanical, video or computerized device, contrivance or machine authorized by the commission that, upon insertion of cash, tokens, electronic cards or any consideration, is available to accept wagers on and simulate the running of historical horse races, and that may deliver or entitle the patron operating the machine to receive cash, tokens, merchandise or credits that may be redeemed for cash. See Kansas Statutes 74-8802
- Honors or gifted program: means an educational program designed and operated by an institution of postsecondary education for the purpose of providing Kansas honor students with intellectually stimulating and challenging courses of instruction for college credit and thereby to achieve the purpose and intention of this act. See Kansas Statutes 74-32,241
- Host facility: means the racetrack at which the race is run or, if the race is run in a jurisdiction that is not participating in the interstate combined wagering pool, the racetrack or other facility that is designated as the host facility. See Kansas Statutes 74-8802
- Host jurisdiction: means the jurisdiction where the host facility is located. See Kansas Statutes 74-8802
- Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
- income: shall include only moneys received by the curator from the bureau and all earnings, interest and profits derived therefrom. See Kansas Statutes 73-501
- incoming governor: means the person who is the apparent successful candidate for the office of governor, as ascertained by the secretary of state following the general election for such office. See Kansas Statutes 75-132
- Incompetent person: includes disabled persons and incapacitated persons as defined herein. See Kansas Statutes 77-201
- Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
- Individual development account: means a financial instrument established in Kan. See Kansas Statutes 74-50,202
- Individual development account reserve fund: means the fund created by an approved community-based organization for the purposes of funding the costs incurred in the administration of the program by the financial institutions and the community-based organizations and for providing matching funds for moneys in individual development accounts. See Kansas Statutes 74-50,202
- Industrial enterprise: means facilities for manufacturing, producing, processing, assembling, repairing, extracting, warehousing, distributing, communications, computer services, transportation, corporate and management offices and services provided in connection with any of the foregoing, in isolation or in any combination, that involve the creation of new or additional employment or the retention of existing employment. See Kansas Statutes 74-8902
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- INK: shall mean the information network of Kansas, Inc. See Kansas Statutes 74-9301
- Instant bingo vending machine: means a machine or electronic device that is purchased or leased by a licensee, as defined by Kan. See Kansas Statutes 74-8702
- Institution: means the university of Kansas, university of Kansas medical center, Kansas state university of agriculture and applied science, Wichita state university, Emporia state university, Pittsburg state university, Fort Hays state university and Kansas state university polytechnic campus;
(b) "governing authority" means the state board of regents or the chief executive officer of an institution if such officer has been designated by the state board to act on its behalf in exercising the authority of the board to care for, control, maintain and supervise all roads, streets, driveways and parking facilities for vehicles on the grounds of the institution; and
(c) "vehicle" means motor vehicle, motorized bicycle and bicycle. See Kansas Statutes 74-3209
- Institution of postsecondary education: means any college, university, community college, junior college, technical institute, or the equivalent thereof, which is or was chartered, incorporated or otherwise organized in this state and the main campus of which is or was located in this state. See Kansas Statutes 74-3262
- Insurance: means and includes every type of insurance on property. See Kansas Statutes 74-4701
- Insured disability benefit recipient: means any person receiving an insured disability benefit under Kan. See Kansas Statutes 74-49,109
- Interactive sports wagering platform: means an integrated system of hardware, software and applications, including, but not limited to, mobile applications and servers, through which sports wagering may be made available to persons physically located within the state of Kansas at the time of submitting the wager to a sports wagering manager over the internet or wireless services as defined in Kan. See Kansas Statutes 74-8702
- Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
- Interstate combined wagering pool: means a parimutuel pool established in one jurisdiction that is combined with comparable parimutuel pools from one or more racing jurisdictions for the purpose of establishing the amount of money returned on a successful wager in the participating jurisdictions. See Kansas Statutes 74-8802
- Intertrack wagering: means wagering on a simulcast race at a licensed racetrack facility or at a facility that is licensed in its racing jurisdiction to conduct live races. See Kansas Statutes 74-8802
- Intrastate combined wagering pool: means a parimutuel pool that is combined with comparable parimutuel pools from one or more racetrack facilities for the purpose of establishing the amount of money returned on a successful wager at the participating racetrack facilities. See Kansas Statutes 74-8802
- Job training agency: means any public or private educational or job training institution and any other public or private entity which is qualified to provide the training or retraining required under the KIT and KIR programs, including apprenticeship programs that are registered through the Kansas apprenticeship council and recognized by the United States department of labor, bureau of apprenticeship training. See Kansas Statutes 74-5065
- Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
- Joint resolution: A legislative measure which requires the approval of both chambers.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- jurisdiction: means a governmental authority that is responsible for the regulation of live or simulcast racing in its jurisdiction. See Kansas Statutes 74-8802
- Kansas comprehensive grant: means an award of financial assistance under the Kansas comprehensive grant program to an eligible Kansas student. See Kansas Statutes 74-32,120
- Kansas comprehensive grant program: means a program under which the state, in recognition that the provision of higher education for all residents of the state who have the desire and ability to obtain such education is an important public purpose and in response to the concern that many residents of the state are deterred by financial considerations from attending institutions of higher education, provides assistance to students with financial need through the award of grants. See Kansas Statutes 74-32,120
- Kansas distinguished scholarship: means an award under this act by this state to a distinguished Kansas scholar. See Kansas Statutes 74-3278
- Kansas educational institution: means a state educational institution under the control and supervision of the board of regents, a municipal university, or a not-for-profit independent institution of higher education which is accredited by the north central association of colleges and secondary schools accrediting agency based on its requirements as of April 1, 1985, or by the higher learning commission of the north central association of colleges and schools based on its requirements as of January 1, 2006, is operated independently and not controlled or administered by the state or any agency or subdivision thereof, maintains open enrollment, and the main campus or principal place of operation of which is located in Kansas. See Kansas Statutes 74-32,120
- Kansas ethnic minority fellowship program: means a program under which grants of financial assistance in the form of fellowships are awarded to qualified ethnic minority graduate students. See Kansas Statutes 74-32,113
- Kansas ethnic minority scholar: means a person who: (1) Is a resident of Kansas; (2) is a member of an ethnic minority group; (3) has been accepted for admission to or is enrolled full time in an educational program at an eligible institution; (4) has established financial need; and (5) has qualified for the award of a Kansas ethnic minority scholarship on the basis of having demonstrated educational ability, or who has previously so qualified and remains qualified for the renewal of a Kansas ethnic minority scholarship on the basis of maintaining full-time enrollment in an educational program at an eligible institution, remaining in good standing, and making satisfactory progress toward completion of the requirements for the award of a degree or certificate of completion. - Kansas ethnic minority scholarship: means a financial award by this state under this act to a Kansas ethnic minority scholar. See Kansas Statutes 74-3284
- Kansas ethnic minority scholarship program: means a program under which the state, in response to growing concerns over loss of talented ethnic minority students to institutions of postsecondary education in other states, the need to enhance the diversity of the student population at Kansas institutions of postsecondary education, and the barriers to ethnic minority student enrollment at Kansas institutions of postsecondary education and for the purpose of enabling and encouraging talented ethnic minority students to remain in Kansas for the attainment of educational goals and fulfillment of career aspirations, provides financial assistance through the award of Kansas ethnic minority scholarships to Kansas ethnic minority scholars. See Kansas Statutes 74-3284
- Kansas export transaction: means a transaction for the export of products substantially manufactured or processed within Kansas or services which result in additional employment within Kansas from Kansas to a destination outside the 50 states of the United States of America;
(b) "preexport" means the period of time between the formation of a Kansas export transaction and the actual shipment of the products or performance of the services; and
(c) "postexport" means the period of time between a shipment of products or performance of services for a Kansas export transaction and the receipt of final payment therefor. See Kansas Statutes 74-5070
- Kansas honor student: means a person who is a resident of Kansas, has not been graduated from high school, is intellectually talented, has demonstrated outstanding scholastic ability and achievement, and is enrolled or has been accepted for enrollment in an honors or gifted program. See Kansas Statutes 74-32,241
- Kansas honors scholarship: means an award under this act by this state to a Kansas honor student who has established financial need. See Kansas Statutes 74-32,241
- Kansas lottery: means the state agency created by this act to operate a lottery or lotteries pursuant to this act. See Kansas Statutes 74-8702
- Kansas student: means a full-time, in-state student who has established financial need and who is initially acceptable for entering a Kansas educational institution or who has so entered and is in good standing and making satisfactory progress toward graduation. See Kansas Statutes 74-32,120
- Kansas-whelped greyhound: means a greyhound whelped and raised in Kansas for the first six months of its life. See Kansas Statutes 74-8802
- KIR program: means a program under which the secretary provides for retraining, customized to meet the specifications of a restructuring industry, of employees of the industry. See Kansas Statutes 74-5065
- KIT program: means a program under which the secretary provides for training, customized to meet the specifications of a new or expanding industry, of new employees or prospective employees, or both, of the industry. See Kansas Statutes 74-5065
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Legacy: A gift of property made by will.
- Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
- Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- License: means an authorization to practice the fitting and dispensing of hearing instruments pursuant to this act and includes a temporary license and any certificate of endorsement issued prior to July 1, 2005. See Kansas Statutes 74-5807
- Lien: A claim against real or personal property in satisfaction of a debt.
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Loans: means loans made for the purposes of financing any of the activities authorized within this act, including loans made to financial institutions for funding or as security for loans made for accomplishing any of the purposes of this act and reserves and expenses appropriate or incidental thereto. See Kansas Statutes 74-8902
- Local organization: means nonprofit organizations which are organized under public or private auspices especially for the purpose of establishing and operating community resource programs, free universities, community education programs or other community programs or services, or for purposes primarily concerning the general welfare of the community. See Kansas Statutes 74-5023
- Local school annuitant: means (1) any person who is an annuitant with 10 or more years of service who is receiving an annuity from a school district maintaining a separate retirement system and whose annuity is not included, in whole or in part, in payments made to such school district under Kan. See Kansas Statutes 74-49,109
- Lottery facility games: means any electronic gaming machines and any other games that are authorized to be conducted or operated at any licensed gaming facilities in the United States. See Kansas Statutes 74-8702
- Lottery gaming enterprise: means an entertainment enterprise that includes a lottery gaming facility authorized pursuant to the Kansas expanded lottery act and ancillary lottery gaming facility operations that have a coordinated business or marketing strategy. See Kansas Statutes 74-8702
- Lottery gaming facility: means that portion of a building used for the purposes of operating, managing and maintaining lottery facility games. See Kansas Statutes 74-8702
- Lottery gaming facility expenses: means normal business expenses, as defined in the lottery gaming facility management contract, associated with the ownership and operation of a lottery gaming facility. See Kansas Statutes 74-8702
- Lottery gaming facility management contract: means a contract, subcontract or collateral agreement between the state and a lottery gaming facility manager for the management of a lottery gaming facility, the business of which is owned and operated by the Kansas lottery, negotiated and signed by the executive director on behalf of the state. See Kansas Statutes 74-8702
- Lottery gaming facility manager: means a corporation, limited liability company, resident Kansas American Indian tribe or other business entity authorized to construct and manage, or manage alone, pursuant to a lottery gaming facility management contract with the Kansas lottery, and on behalf of the state, a lottery gaming enterprise and lottery gaming facility. See Kansas Statutes 74-8702
- Lottery gaming facility revenues: means the total revenues from lottery facility games at a lottery gaming facility after all related prizes are paid. See Kansas Statutes 74-8702
- Lottery retailer: means any person with whom the Kansas lottery has contracted to sell lottery tickets or shares, or both, to the public. See Kansas Statutes 74-8702
- Lottery ticket vending machine: means a machine or similar electronic device owned or leased by the Kansas lottery, the sole purposes of which are to:
(A) Dispense a printed physical ticket, such as a lottery ticket, a keno ticket, a pull tab ticket or a coupon, the coupon of which must be redeemed through something other than a lottery ticket vending machine, after a purchaser inserts cash or other form of consideration into the machine;
(B) allow purchasers to manually check the winning status of a Kansas lottery ticket; and
(C) display advertising, promotions and other information pertaining to the Kansas lottery. See Kansas Statutes 74-8702
- Major procurement: means any gaming product or service, including, but not limited to, facilities, advertising and promotional services, annuity contracts, prize payment agreements, consulting services, equipment, tickets and other products and services unique to the Kansas lottery, but not including materials, supplies, equipment and services common to the ordinary operations of state agencies. See Kansas Statutes 74-8702
- Majority leader: see Floor Leaders
- Marketing agreement: means an agreement entered into between a professional sports team or other marketing entity and a lottery gaming facility manager for the purposes described in Kan. See Kansas Statutes 74-8702
- Marketing entity: means :
(1) A corporation, limited liability company, partnership or other business entity registered to do business in this state; or
(2) a nonprofit fraternal or veterans organization. See Kansas Statutes 74-8702
- Match-fixing: means to arrange or determine any action that occurs during a sporting event, including, but not limited to, any action resulting in the final outcome of such sporting event, for financial gain. See Kansas Statutes 74-8702
- Medically underserved area: means a practice location designated medically underserved by the secretary of health and environment. See Kansas Statutes 74-32,132
- member: means any member of the Kansas police and firemen's retirement system who is eligible to participate in the DROP and who elects to participate in the DROP as provided in this act;
(7) "monthly DROP accrual" means the amount equal to the monthly retirement benefit that would have been payable to the member had the member terminated service and retired on the day the member elected; and
(8) "system" means the Kansas police and firemen's retirement system. See Kansas Statutes 74-4986l
- Mental health or treatment facility: means :
(1) Any private treatment facility as such term is defined in Kan. See Kansas Statutes 74-3292
- Mentally ill person: means a mentally ill person as defined in Kan. See Kansas Statutes 77-201
- metropolitan county: means the county of Douglas, Johnson, Leavenworth, Sedgwick, Shawnee or Wyandotte;
(d) "neighborhood revitalization organization" means any group organized for the purpose of encouraging economic development in a blighted area of a metropolitan county; and
(e) "nonmetropolitan county" means any county which is not a metropolitan county. See Kansas Statutes 74-5093
- military service: means the same as defined in subsection (22) of Kan. See Kansas Statutes 74-4932
- Minor: means any person defined by Kan. See Kansas Statutes 77-201
- Minority leader: See Floor Leaders
- Month: means a calendar month, unless otherwise expressed. See Kansas Statutes 77-201
- Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
- Motor vehicle: means every vehicle that is self-propelled upon or by which any person or property is or may be transported or drawn upon a public highway except devices used exclusively upon stationary rails or tracks. See Kansas Statutes 8-273
- Municipal university: means the municipal university established and operating under the provisions of article 13a of chapter 13 of Kansas Statutes Annotated. See Kansas Statutes 74-3255
- NAICS: means the North American industry classification system. See Kansas Statutes 74-50,211
- National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
- Natural and scientific preserve: means a natural or scientific area which is formally dedicated under the provisions of this act to be maintained as nearly as possible in its natural condition and to be used in a manner and under limitations consistent with its continued preservation, without impairment, disturbance, or artificial development except that deemed necessary for scientific research, education, or public interpretation of the area. See Kansas Statutes 74-6603
- Net electronic gaming machine income: means all cash or other consideration utilized to play an electronic gaming machine operated at a racetrack gaming facility, less all cash or other consideration paid out to winning players as prizes. See Kansas Statutes 74-8702
- network manager: shall mean the entity or person engaged to manage and run the gateway or network on behalf of INK. See Kansas Statutes 74-9301
- New business: means a facility, plant, division, office, department, production line, production shift or other business operations of a company that was not doing business in Kansas prior to the submission of an application for benefits under this act and that provides documentation of such to the satisfaction of the secretary. See Kansas Statutes 74-50,211
- New employee: means a person newly employed by the qualified company in the qualified company's business operating in Kansas during the taxable year for which benefits are sought under Kan. See Kansas Statutes 74-50,211
- New or expanding industry: means an industry which is locating or is newly located in Kansas or an existing industry which is located in Kansas and is expanding its work force. See Kansas Statutes 74-5065
- Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Non-metropolitan county: means any county that is not a metropolitan county. See Kansas Statutes 74-50,211
- Noneconomic detriment: means pain, suffering, inconvenience, physical impairment and nonpecuniary damage. See Kansas Statutes 74-7301
- Nonprofit fraternal organization: means any organization within this state that exists for the common benefit, brotherhood or other interests of its members and is authorized by its written constitution, charter, articles of incorporation or bylaws to engage in a fraternal, civic or service purpose within this state and has been determined by the executive director to be organized and operated as a bona fide fraternal organization and that has been exempted from the payment of federal income taxes as provided by section 501(c)(8) or section 501(c)(10) of the federal internal revenue code of 1986, as amended, or determined to be organized and operated as a bona fide nonprofit fraternal organization by the executive director. See Kansas Statutes 74-8702
- Nonprofit organization: means :
(1) A corporation that is incorporated in Kansas as a not-for-profit corporation pursuant to the Kansas general corporation code and the net earnings of which do not inure to the benefit of any shareholder, individual member or person; or
(2) a fair association. See Kansas Statutes 74-8802
- nonresident: means every person who is not a resident of this state. See Kansas Statutes 8-234a
- normal retirement age: means the attainment of age 65 with completion of five years of credited service, or 60 with the completion of 30 years of credited service;
(10) "plan" means the plan established within the Kansas public employees retirement system by Kan. See Kansas Statutes 74-49,302
- normal retirement date: means the same as defined in subsection (23) of Kan. See Kansas Statutes 74-4932
- Oath: A promise to tell the truth.
- Oath: includes an affirmation in all cases where an affirmation may be substituted for an oath, and in similar cases "swear" includes affirm. See Kansas Statutes 77-201
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Occupation licensee: means a person licensed by the commission to perform an occupation or provide services that the commission has identified as requiring a license pursuant to this act. See Kansas Statutes 74-8802
- Off-track wagering: means wagering on a simulcast race at a facility that is not licensed in its jurisdiction to conduct live races. See Kansas Statutes 74-8802
- Open enrollment: means the policy of an institution of postsecondary education which provides the opportunity of enrollment for any student who meets its academic and other reasonable enrollment requirements, without regard for race, gender, religion, creed, ethnicity or national origin. See Kansas Statutes 74-3284
- Organization licensee: means a nonprofit organization licensed by the commission to conduct races pursuant to this act and, if the license so provides, to construct or own a racetrack facility. See Kansas Statutes 74-8802
- Oversight: Committee review of the activities of a Federal agency or program.
- Parimutuel licensee: means a facility owner licensee or facility manager licensee under the Kansas parimutuel racing act. See Kansas Statutes 74-8702
- Parimutuel licensee location: means a racetrack facility, as defined in Kan. See Kansas Statutes 74-8702
- Parimutuel pool: means the total money wagered by individuals on one or more horses or greyhounds in a particular horse or greyhound race to win, place or show, or combinations thereof, as established by the commission, and, except in the case of an interstate or intrastate combined wagering pool, held by the organization licensee pursuant to the parimutuel system of wagering. See Kansas Statutes 74-8802
- Parimutuel wagering: means a form of wagering on the outcome of horse and greyhound races, including historical horse races conducted by an historical horse race machine, in which those who wager purchase tickets of various denominations on one or more horses or greyhounds and all wagers for each race are pooled and the winning ticket holders are paid prizes from such pool in amounts proportional to the total receipts in the pool. See Kansas Statutes 74-8802
- participating employer: means an eligible employer who has agreed to make contributions to the system on behalf of its employees first hired on or after July 1, 2009. See Kansas Statutes 74-49,202
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- patrol: means the state highway patrol;
(4) "address of principal residence" means: (A) The place where a person makes his or her permanent principal home; (B) place where a person resides, has an intention to remain and where they intend to return following an absence; or (C) place of habitation to which, whenever the person is absent, the person intends to return. See Kansas Statutes 8-234a
- pensioner: means a beneficiary of the bureau. See Kansas Statutes 73-501
- Person: means every natural person, firm, copartnership, association, corporation or school. See Kansas Statutes 8-273
- person: includes a partnership, corporation or an association. See Kansas Statutes 73-501
- Person: means any natural person, association, limited liability company, corporation or partnership. See Kansas Statutes 74-8702
- person missing in action: shall mean any person who was a resident of the state of Kansas at the time he entered service of the United States armed forces and who, while serving in said U. See Kansas Statutes 73-1216
- Personal property: All property that is not real property.
- Personal property: includes money, goods, chattels, evidences of debt and things in action, and digital assets as defined in the revised uniform fiduciary access to digital assets act, Kan. See Kansas Statutes 77-201
- Plaintiff: The person who files the complaint in a civil lawsuit.
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Political subdivision: means political or taxing subdivisions of the state, including municipal and quasi-municipal corporations, boards, commissions, authorities, councils, committees, subcommittees and other subordinate groups or administrative units thereof, receiving or expending and supported, in whole or in part, by public funds and any municipality as defined in Kan. See Kansas Statutes 74-8902
- Pooled bonds: means bonds of the authority, the interest on which is subject to federal income taxation, which are issued for the purpose of acquiring bonds issued by two or more political subdivisions. See Kansas Statutes 74-8902
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Practice of fitting and dispensing hearing instruments: means the evaluation or measurement of the powers or range of human hearing by means of an audiometer or by any other means as established by rules and regulations of the board and the consequent selection or adaptation or sale of hearing instruments intended to compensate for hearing loss, including the making of an impression of the ear. See Kansas Statutes 74-5807
- Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
- Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
- Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
- Primary facility: means the stadium or arena where a professional sports team hosts competitive games in accordance with such team's league rules. See Kansas Statutes 74-8702
- Private activity bond: has the meaning ascribed thereto in the code. See Kansas Statutes 74-5059
- Prize: means any prize paid directly by the Kansas lottery pursuant to the Kansas lottery act or the Kansas expanded lottery act or any rules and regulations adopted pursuant to either act. See Kansas Statutes 74-8702
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Probate: Proving a will
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Professional sports team: means an athletic team, whose primary facility is located in Kansas, that operates at the major league level in the sport of baseball, basketball, football, ice hockey or soccer. See Kansas Statutes 74-8702
- Program: means the Kansas work-study program established by this act. See Kansas Statutes 74-3275
- Program: means the Kansas individual development account program established in Kan. See Kansas Statutes 74-50,202
- Program contributor: means a person or entity who makes a contribution to an individual development account reserve fund. See Kansas Statutes 74-50,202
- Program period: means the duration of the period of time, or any division thereof, required for completion of a vocational or technical education program which is given in an eligible institution. See Kansas Statutes 74-3284
- project: means the construction of a multi-sport athletic complex and the improvement of facilities within the project area; and
(5) "project area" means the boundaries of the area in which the project will be undertaken as described by the board, but shall not include the boundaries of any redevelopment district in a major tourism area which includes an auto race track facility located in Wyandotte county as follows: Beginning at the intersection of Interstate 70 and Interstate 435; west along Interstate 70 to 118th Street; north along 118th Street to State Avenue; northeasterly along proposed relocated State Avenue to 110th Street; north along 110th Street to Parallel Parkway; east along Parallel Parkway to Interstate 435; South along Interstate 435 to Interstate 70. See Kansas Statutes 74-8936
- Property: includes personal and real property. See Kansas Statutes 77-201
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Public defender: Represent defendants who can't afford an attorney in criminal matters.
- public information: shall mean any information stored, gathered or generated in electronic or magnetic form by the state of Kansas, its agencies or instrumentalities, which is included within the information deemed to be public pursuant to the Kansas open records act, Kan. See Kansas Statutes 74-9301
- Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
- Public or private auspices: means counties, cities, townships, towns, villages, recreation commissions, councils or departments, or private and independent groups of community residents and volunteers. See Kansas Statutes 74-5023
- Qualified business: means any business that does not contravene any law or public policy, as determined by the secretary. See Kansas Statutes 74-50,202
- Qualified company: means any for-profit corporation, partnership or other entity making available to its full-time employees adequate health insurance coverage and paying at least 50% of the premium for such health insurance, which meets the requirements of Kan. See Kansas Statutes 74-50,211
- Qualified ethnic minority graduate student: means a person who: (1) Is a citizen of the United States; (2) is a member of an ethnic minority group; (3) has been accepted for admission to or is enrolled full time in a graduate program at a state educational institution; and (4) has qualified for the award of a fellowship under the Kansas ethnic minority fellowship program on the basis of having demonstrated scholastic ability, or who has previously so qualified and remains qualified for renewal of the fellowship on the basis of remaining in good standing and making satisfactory progress toward completion of the requirements of the graduate program in which enrolled. See Kansas Statutes 74-32,113
- Qualified firm: means a for-profit business establishment, subject to state income, sales or property taxes, identified under the North American industry classification system (NAICS) subsectors 221, 311 to 339, 423 to 425, 481 to 519, 521 to 721 and 811 to 928 or is identified as a corporate or regional headquarters or back-office operation of a national or multi-national corporation regardless of NAICS designation. See Kansas Statutes 74-50,131
- Qualified plan: means a business plan which:
(1) Is approved by a financial institution, or by a nonprofit loan fund having demonstrated fiduciary integrity;
(2) includes a description of services or goods to be sold, a marketing plan and projected financial statements; and
(3) may require the eligible individual to obtain the assistance of an experienced entrepreneurial advisor. See Kansas Statutes 74-50,202
- Qualified principal residence: means a principal residence, the qualified acquisition costs of which do not exceed 100% of the average area purchase price applicable to such residence. See Kansas Statutes 74-50,202
- qualified securities: means a cash investment through any form or combination of forms of financial assistance as provided in this subsection that have been approved in form and substance by the secretary. See Kansas Statutes 74-8132
- Quorum: The number of legislators that must be present to do business.
- Race meeting: means one or more periods of racing days during a calendar year designated by the commission for which an organization licensee has been approved by the commission to hold live horse or greyhound races or simulcast horse races at which parimutuel wagering is conducted, including such additional time as designated by the commission for the conduct of official business before and after the races. See Kansas Statutes 74-8802
- racetrack facility: includes a facility used for the display of and wagering on simulcast races and the operation of historical horse race machines without any live horse or greyhound races being conducted. See Kansas Statutes 74-8802
- Racetrack gaming facility: means that portion of a parimutuel licensee location where electronic gaming machines are operated, managed and maintained. See Kansas Statutes 74-8702
- Racetrack gaming facility management contract: means an agreement between the Kansas lottery and a racetrack gaming facility manager, negotiated and signed by the executive director on behalf of the state, for placement of electronic gaming machines owned and operated by the state at a racetrack gaming facility. See Kansas Statutes 74-8702
- Racetrack gaming facility manager: means a parimutuel licensee specifically certified by the Kansas lottery to become a certified racetrack gaming facility manager and offer electronic gaming machines for play at the racetrack gaming facility. See Kansas Statutes 74-8702
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- real property: include lands, tenements and hereditaments, and all rights to them and interest in them, equitable as well as legal. See Kansas Statutes 77-201
- Recess: A temporary interruption of the legislative business.
- regional leadership development: means training and education that enable a region to develop community leadership that strengthens the economic and social environment in that region;
(9) "rural community" means any city having a population of fewer than 50,000 or except as otherwise provided, any unincorporated area. See Kansas Statutes 74-50,154
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Replacement services loss: means expenses reasonably incurred in obtaining ordinary and necessary services in lieu of those the injured person would have performed, not for income, but for the benefit of self or family, if such person had not been injured. See Kansas Statutes 74-7301
- Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
- Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
- Research facilities: means facilities for use in research and development activities, whether conducted for profit or not for profit, of an agricultural business enterprise, industrial enterprise or any other commercial enterprise or educational institution or health care institution. See Kansas Statutes 74-8902
- residence: means the place which is adopted by a person as the person's place of habitation and to which, whenever the person is absent, the person has the intention of returning. See Kansas Statutes 8-2,128
- Residence: means the place which is adopted by a person as the person's place of habitation and to which, whenever the person is absent, the person has the intention of returning. See Kansas Statutes 77-201
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- Restructuring industry: means an existing industry which is located in Kansas and is restructuring its operations through incorporation of existing technology, development and incorporation of new technology, diversification of production or development and implementation of new production. See Kansas Statutes 74-5065
- Retained job: means an existing job which will be lost without participation by the employer under the provisions of the promoting employment across Kansas act. See Kansas Statutes 74-50,211
- Retirant: means (1) any person who is a member of a retirement system and who has retired prior to July 2, 1987, (2) any person who is a special member of a retirement system and who has retired prior to July 2, 1987, (3) any person who is a joint annuitant or beneficiary of any member described in clause (1) or of any special member described in clause (2), (4) any local school annuitant, and (5) any insured disability benefit recipient. See Kansas Statutes 74-49,109
- retirement annuity account: means the account established for employer credits of members under Kan. See Kansas Statutes 74-49,302
- Retirement system: means the Kansas public employees retirement system, the Kansas police and firemen's retirement system, the state school retirement system, the Kansas highway patrol pension fund, the Kansas bureau of investigation pension fund, the Kansas retirement fund for judges, or the Kansas retirement fund for official court reporters. See Kansas Statutes 74-49,109
- Retraining: means retraining of employees of a restructuring industry who are likely to be displaced because of obsolete or inadequate job skills and knowledge. See Kansas Statutes 74-5065
- road: include public bridges and may be construed to be equivalent to "county way" "county road" "common road" "state road" and "territorial road. See Kansas Statutes 77-201
- ROTC institution: means a state educational institution or municipal university that provides a reserve officers' training corps program. See Kansas Statutes 74-3255
- Rural area: means any county of this state other than Douglas, Johnson, Sedgwick, Shawnee and Wyandotte counties. See Kansas Statutes 74-3292
- salary: means the same as such term is defined in Kan. See Kansas Statutes 74-49,202
- Satisfactory performance: means retaining admission in and meeting the standards established by the Kansas educational institution being attended by the eligible student. See Kansas Statutes 74-32,423
- School district: means any school district organized under the laws of this state. See Kansas Statutes 74-32,407
- school employment: means the employment of a member when employed by an eligible employer as specified in any of subsection (1), (2) or (3) of Kan. See Kansas Statutes 74-4932
- School of nursing: means a school within the state of Kansas which is approved by the state board of nursing to grant an associate degree or a baccalaureate degree in professional nursing or a certificate of completion in practical nursing and is:
(1) Under the control and supervision of the state board of regents;
(2) a municipal university; or
(3) a not-for-profit independent institution of higher education that has its main campus or principal place of operation in Kansas, maintains open enrollment as such term is defined in Kan. See Kansas Statutes 74-3292
- School year: means the 12-month period ending on June 30. See Kansas Statutes 74-32,407
- school year: means the twelve-month period beginning September 1 and ending August 31;
(4) "employee" means any employee of a participating employer which is an eligible employer, as specified in Kan. See Kansas Statutes 74-4932
- seal: includes an impression of the seal upon the paper alone, as well as upon wax or a wafer affixed to the paper. See Kansas Statutes 77-201
- secretary: means the secretary of the Kansas department of revenue;
(v) "serious traffic violation" means:
(1) Excessive speeding, is defined as 15 miles per hour or more over the posted speed limit;
(2) reckless driving, as defined under Kan. See Kansas Statutes 8-2,128
- Secretary: means the secretary of administration. See Kansas Statutes 74-4717
- Secretary: means the secretary of commerce. See Kansas Statutes 74-5059
- secretary: means the secretary of commerce. See Kansas Statutes 74-8132
- secretary: means the secretary of the department of commerce; and
(n) "seed capital" means financing that is provided for the development, refinement and commercialization of a product, process or innovation whether for the startup of a new firm, the expansion or the restructuring of a small firm. See Kansas Statutes 74-99c02
- Selection committee: means a committee established at each ROTC institution by the chief executive officer of each such institution. See Kansas Statutes 74-3255
- Semester: means one of two principal terms, when there are only two principal terms in the academic year, whether or not there are other shorter terms during the same academic year. See Kansas Statutes 74-3278
- Sentencing guidelines: A set of rules and principles established by the United States Sentencing Commission that trial judges use to determine the sentence for a convicted defendant. Source: U.S. Courts
- Service of process: The service of writs or summonses to the appropriate party.
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- Share: means any intangible manifestation authorized by the Kansas lottery to prove participation in a lottery game, except as provided by the Kansas expanded lottery act. See Kansas Statutes 74-8702
- Simulcast: means a live audio-visual broadcast of an actual horse race at the time it is run. See Kansas Statutes 74-8802
- Sponsor: means any adult care home licensed under the adult care home licensure act, any medical care facility licensed under Kan. See Kansas Statutes 74-3292
- Sporting event: means any professional or collegiate sport or athletic event, motor race event or any other special event authorized by the commission that has not occurred at the time wagers are placed on such event. See Kansas Statutes 74-8702
- Sports governing body: means the organization that prescribes the final rules and enforces codes of conduct with respect to a sporting event and the participants in such event. See Kansas Statutes 74-8702
- Sports wagering: includes , but is not limited to, single game wagers, teaser wagers, parlays, over-under wagers, moneyline wagers, pools, exchange wagering, in-game wagers, in-play wagers, proposition wagers, straight wagers and such other wagers approved by the commission. See Kansas Statutes 74-8702
- Sports wagering revenues: means wagering revenue generated from sports wagering that is an amount equal to the total wagers less any voided wagers, federal excise taxes, free plays or other promotional credits and any amounts paid as prizes. See Kansas Statutes 74-8702
- Sports wagering supplier: means a person providing goods, services, software or any other components necessary for the determination of the odds or the outcomes of any wager on a sporting event, directly or indirectly, to a lottery gaming facility manager, including data feeds and odds services, that is licensed under Kan. See Kansas Statutes 74-8702
- state: means a state of the United States, the District of Columbia, Puerto Rico, the Virgin Islands, Guam, American Samoa and the Commonwealth of Northern Mariana Islands;
(6) "wireless communication device" means any wireless electronic communication device that provides for voice or data communication between two or more parties, including, but not limited to, a mobile or cellular telephone, a text messaging device, a personal digital assistant that sends or receives messages, an audio-video player that sends or receives messages or a laptop computer; and
(7) "religious organization" means any organization, church, body of communicants, or group, gathered in common membership for mutual support and edification in piety, worship and religious observances, or a society of individuals united for religious purposes at a definite place and which religious organization maintains an established place of worship within this state and has a regular schedule of services or meetings at least on a weekly basis and has been determined to be organized and created as a bona fide religious organization. See Kansas Statutes 8-234a
- state: means a state, territory or possession of the United States, the District of Columbia, the Commonwealth of Puerto Rico, a foreign country and a state or province of a foreign country and shall have the same meaning in other statutes of this state relating to interstate relations for licensing of vehicles. See Kansas Statutes 74-4305
- State: means the state of Kansas. See Kansas Statutes 74-5059
- State: means the state of Kansas. See Kansas Statutes 74-8902
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Kansas Statutes 77-201
- State agency: means any state office or officer, department, board, commission, institution, bureau or any agency, division or unit within any office, department, board, or other state authority. See Kansas Statutes 74-4701
- state agency: means any officer, department, bureau, division, board, authority, agency, commission or institution of this state. See Kansas Statutes 74-5039
- State agency: means any office, department, board, commission, bureau, division, public corporation, agency or instrumentality of this state. See Kansas Statutes 74-8902
- State board: means the state board of education. See Kansas Statutes 8-273
- State board: means the state board of regents. See Kansas Statutes 74-3275
- State board of education: means the state board of education provided for in the constitution of this state. See Kansas Statutes 74-32,423
- State ceiling: means the ceiling applicable under the code to the aggregate face amount of qualified private activity bonds, the interest on which is exempt from federal income taxation, which may be issued within this state during any calendar year. See Kansas Statutes 74-5059
- State educational institution: has the meaning ascribed thereto in Kan. See Kansas Statutes 74-3255
- state lottery: means the lottery or lotteries operated pursuant to this act. See Kansas Statutes 74-8702
- State plan: means the plan for adult basic education programs prepared and adopted by the state board in accordance with state and federal law. See Kansas Statutes 74-32,253
- State scholar: means a full-time, in-state student who has exhibited scholastic ability and who is initially acceptable for entering an eligible institution or who has so entered and is in good standing and making satisfactory progress. See Kansas Statutes 74-32,233
- State scholarship: means an award under this act by this state to a state scholar who has established financial need. See Kansas Statutes 74-32,233
- Statute: A law passed by a legislature.
- Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
- Student records: means the records, files and data of all students who are in attendance at a defunct institution of postsecondary education at the time of dissolution or disorganization or cessation of the awarding of academic degrees, or who have attended a defunct institution of postsecondary education. See Kansas Statutes 74-3262
- Subpoena: A command to a witness to appear and give testimony.
- Subpoena duces tecum: A command to a witness to produce documents.
- Successor institution: means an institution of postsecondary education which has custody of all property, records, files and data of a defunct institution of postsecondary education. See Kansas Statutes 74-3262
- Summons: Another word for subpoena used by the criminal justice system.
- system: means the Kansas public employees retirement system. See Kansas Statutes 74-49,302
- Takeout: means the total amount of money withheld from each parimutuel pool for the payment of purses, taxes and the share to be kept by the organization licensee. See Kansas Statutes 74-8802
- Technical college: means an educational institution that formerly was an area vocational school or an area vocational-technical school and that has been converted to, established as, and officially designated a technical college under authority of this act. See Kansas Statutes 74-32,407
- Technology education: means an applied discipline designed to promote technological literacy which provides knowledge and understanding of the impacts of technology including its organizations, techniques, tools and skills to solve practical problems and extend human capabilities in technological areas. See Kansas Statutes 74-32,407
- technology improvements: means a project that results in the ability of the region to enhance service in areas, including broadband access, web site creation, wireless internet services, computer programming, computer servers, computer networks, computer databases, electronic training modules, electronic media and any other technological areas deemed eligible by the secretary. See Kansas Statutes 74-50,154
- Term: means one of two or more substantially equivalent divisions of the academic year of an eligible institution. See Kansas Statutes 74-3284
- Testator: A male person who leaves a will at death.
- Testify: Answer questions in court.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Ticket: means any tangible evidence issued by the Kansas lottery to prove participation in a lottery game, including a sports wager, other than a lottery facility game. See Kansas Statutes 74-8702
- Token: means a representative of value, of metal or other material, that is not legal tender, redeemable for cash only by the issuing lottery gaming facility manager or racetrack gaming facility manager and that is issued and sold by a lottery gaming facility manager or racetrack gaming facility manager for the sole purpose of playing an electronic gaming machine or lottery facility game. See Kansas Statutes 74-8702
- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
- Training: means training of employees or preemployment training of prospective employees for jobs newly created by a new or expanding industry. See Kansas Statutes 74-5065
- Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Trustee: A person or institution holding and administering property in trust.
- Undertaking: means a promise or security in any form where required by law. See Kansas Statutes 77-201
- United States: means the 50 states and the District of Columbia;
(aa) "division" means the division of vehicles of the Kansas department of revenue;
(bb) "director" means the director of the division of vehicles of the Kansas department of revenue;
(cc) "foreign country" means any jurisdiction other than the United States;
(dd) "nonresident commercial driver's license" means a license issued pursuant to Kan. See Kansas Statutes 8-2,128
- user association: shall mean an association:
(1) Whose membership is identifiable by regular payment of association dues and regularly maintained membership lists;
(2) which is registered with the state or is a Kansas corporation;
(3) which exists for the purpose of advancing the common occupation or profession of its membership; and
(4) which, after the appointment of the initial board of INK, regularly promotes and encourages the subscription of its members to the gateway service provided by INK. See Kansas Statutes 74-9301
- USERRA: means the same as defined in subsection (34) of Kan. See Kansas Statutes 74-4932
- vehicle: shall include motor vehicles, vehicles and mobile equipment. See Kansas Statutes 74-4707
- Vendor: means any person who has entered into a major procurement contract with the Kansas lottery. See Kansas Statutes 74-8702
- Venue: The geographical location in which a case is tried.
- Verdict: The decision of a petit jury or a judge.
- Veteran: means :
(A) Any person who entered the armed forces before October 15, 1976, and separated from the armed forces under honorable conditions, if such person served: (i) On active duty during any war (the official dates for war service are April 6, 1917 through July 2, 1921, and December 7, 1941 through April 28, 1952); (ii) during the period April 28, 1952 through July 1, 1955; (iii) in any campaign or expedition for which a campaign badge or service medal has been authorized; or (iv) for more than 180 consecutive days since January 31, 1955, but before October 15, 1976, excluding an initial period of active duty for training under the "six-month" reserve or national guard program;
(B) any person who entered the armed forces on or after October 15, 1976, and separated from the armed forces under honorable conditions, if such person was awarded a service medal or campaign badge;
(C) any person who separated from the armed forces under honorable conditions and has a disability certified by the United States department of veterans affairs as being service connected, has been issued the purple heart by the United States government or has been released from active service with a service-connected disability;
(D) the spouse of a veteran who has a 100% service connected disability as determined by the United States department of veteran affairs;
(E) the unremarried spouse of a veteran who died while, and as a result of, serving in armed forces; and
(F) the spouse of a prisoner of war, as defined by Kan. See Kansas Statutes 73-201
- Victim: means a person who suffers personal injury or death as a result of:
(1) Criminally injurious conduct;
(2) the good faith effort of any person to prevent criminally injurious conduct;
(3) the good faith effort of any person to apprehend a person suspected of engaging in criminally injurious conduct; or
(4) witnessing a violent crime when the person was 16 years of age or younger at the time the crime was committed. See Kansas Statutes 74-7301
- Video lottery machine: means any electronic video game machine that, upon insertion of cash, is available to play or simulate the play of a video game authorized by the commission, including, but not limited to, bingo, poker, black jack and keno, and which uses a video display and microprocessors and in which, by chance, the player may receive free games or credits that can be redeemed for cash. See Kansas Statutes 74-8702
- Ward: means a person who has a guardian. See Kansas Statutes 77-201
- Washburn institute of technology: means the institute of technology at Washburn university. See Kansas Statutes 74-32,407
- Work loss: means loss of income from work the injured person would have performed if such person had not been injured, and expenses reasonably incurred by such person in obtaining services in lieu of those the person would have performed for income, reduced by any income from substitute work actually performed by such person or by income such person would have earned in available appropriate substitute work that the person was capable of performing but unreasonably failed to undertake. See Kansas Statutes 74-7301
- Writ: A formal written command, issued from the court, requiring the performance of a specific act.
- YES: means services performed by eligible students for the purpose of assisting school districts in the maintenance of special education services for exceptional children, alternative school programs, at risk pupil assistance plans, educational system enhancement plans, bilingual education programs for limited English proficient pupils, vocational education programs, or school programs in general. See Kansas Statutes 74-3275
