- Abandonment: means any knowing or intentional action or failure to act, including desertion, by a person acting as a caretaker for a vulnerable adult that leaves the vulnerable adult without the means or ability to obtain necessary food, clothing, shelter, or medical or other health care. See Utah Code 26B-6-201
- Abortion clinic: means a type I abortion clinic or a type II abortion clinic. See Utah Code 26B-2-201
- Abuse: means the same as that term is defined in Section
80-1-102 . See Utah Code 30-3-10.1 - Abuse: means the same as that term is defined in Section
80-1-102 . See Utah Code 26B-1-501 - Abuse: means :(2)(a) knowingly or intentionally:(2)(a)(i) attempting to cause harm;(2)(a)(ii) causing harm; or(2)(a)(iii) placing another in fear of harm;(2)(b) unreasonable or inappropriate use of physical restraint, medication, or isolation that causes or is likely to cause harm to a vulnerable adult;(2)(c) emotional or psychological abuse;(2)(d) a sexual offense as described in Title 76, Chapter 5, Offenses Against the Individual; or(2)(e) deprivation of life sustaining treatment, or medical or mental health treatment, except:(2)(e)(i) as provided in Title 75, Chapter 2a, Advance Health Care Directive Act; or(2)(e)(ii) when informed consent, as defined in Section 76-5-111, has been obtained. See Utah Code 26B-6-201
- Access line: means a circuit-switched connection, or the functional equivalent of a circuit-switched connection, from an end-user to the public switched network. See Utah Code 54-8b-2
- Accommodation: means :
(1)(a) a hotel or motel room;(1)(b) a condominium or cooperative unit;(1)(c) a cabin;(1)(d) a lodge;(1)(e) an apartment; or(1)(f) a private or commercial structure designed for overnight occupancy by one or more individuals. See Utah Code 57-19-2- Account: means a demand deposit account, checking or negotiable withdrawal order account, savings account, time deposit account, or money-market mutual fund account. See Utah Code 26B-9-101
- Accredited clinical education program: means a clinical education program for a health care profession that is accredited by the Accreditation Council on Graduate Medical Education. See Utah Code 26B-4-701
- Accredited clinical training program: means a clinical training program that is accredited by an entity recognized within medical education circles as an accrediting body for medical education, advanced practice nursing education, physician assistant education, doctor of pharmacy education, dental education, or registered nursing education. See Utah Code 26B-4-701
- Acknowledged before me: means :
(1)(a) that the person acknowledging appeared before the person taking the acknowledgment;(1)(b) that he acknowledged he executed the document;(1)(c) that, in the case of:(1)(c)(i) a natural person, he executed the document for the purposes stated in it;(1)(c)(ii) a corporation, the officer or agent acknowledged he held the position or title set forth in the document or certificate, he signed the document on behalf of the corporation by proper authority, and the document was the act of the corporation for the purpose stated in it;(1)(c)(iii) a partnership, the partner or agent acknowledged he signed the document on behalf of the partnership by proper authority, and he executed the document as the act of the partnership for the purposes stated in it;(1)(c)(iv) a person acknowledging as principal by an attorney in fact, he executed the document by proper authority as the act of the principal for the purposes stated in it; or(1)(c)(v) a person acknowledging as a public officer, trustee, administrator, guardian, or other representative, he signed the document by proper authority, and he executed the document in the capacity and for the purposes stated in it; and(1)(d) that the person taking the acknowledgment:(1)(d)(i) either knew or had satisfactory evidence that the person acknowledging was the person named in the document or certificate; and(1)(d)(ii) in the case of a person executing a document in a representative capacity, either had satisfactory evidence or received the sworn statement or affirmation of the person acknowledging that the person had the proper authority to execute the document. - Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
- A verdict of "not guilty."
- ACT team: means a mobile team of medical and mental health professionals that provides assertive community outreach treatment and, based on the individual circumstances of each case, coordinates with other medical providers and appropriate community resources. See Utah Code 26B-5-601
- ACT team personnel: means a licensed psychiatrist or mental health therapist, or another individual, as determined by the division, who is part of an ACT team. See Utah Code 26B-5-601
- Active tetrahydrocannabinol: means THC, any THC analog, and tetrahydrocannabinolic acid. See Utah Code 26B-4-201
- Activities of daily living: means essential activities including:
(2)(a) dressing;(2)(b) eating;(2)(c) grooming;(2)(d) bathing;(2)(e) toileting;(2)(f) ambulation;(2)(g) transferring; and(2)(h) self-administration of medication. See Utah Code 26B-2-201- Activity and use limitations: means restrictions or obligations created under this chapter with respect to real property. See Utah Code 57-25-102
- Activity regulated under this title: means an act, attempted act, or activity prohibited or regulated under this title or the rules and proclamations promulgated under this title pertaining to protected wildlife including:
(1)(a) fishing;(1)(b) hunting;(1)(c) trapping;(1)(d) taking;(1)(e) permitting a dog, falcon, or other domesticated animal to take;(1)(f) transporting;(1)(g) possessing;(1)(h) selling;(1)(i) wasting;(1)(j) importing;(1)(k) exporting;(1)(l) rearing;(1)(m) keeping;(1)(n) using as a commercial venture; and(1)(o) releasing to the wild. See Utah Code 23A-1-101- Address: includes :
(1)(b)(i) a post office box number;(1)(b)(ii) a rural free delivery route number; and(1)(b)(iii) a street name and number. See Utah Code 16-10a-102- Adjudicative proceeding: means an action or proceeding of the office conducted in accordance with Title 63G, Chapter 4, Administrative Procedures Act. See Utah Code 26B-9-201
- Adjudicative proceeding: means :
(2)(a) an action by a board, commission, department, officer, or other administrative unit of the state that determines the legal rights, duties, privileges, immunities, or other legal interests of one or more identifiable persons, including an action to grant, deny, revoke, suspend, modify, annul, withdraw, or amend an authority, right, or license; and(2)(b) judicial review of an action described in Subsection (2)(a). See Utah Code 68-3-12.5- Administer: means the direct application of a controlled substance, whether by injection, inhalation, ingestion, or any other means, to the body of a patient or research subject by:
(1)(a)(i) a practitioner or, in the practitioner's presence, by the practitioner's authorized agent; or(1)(a)(ii) the patient or research subject at the direction and in the presence of the practitioner. See Utah Code 58-37-2- Administration of criminal justice: means the performance of detection, apprehension, detention, pretrial release, post-trial release, prosecution, and adjudication. See Utah Code 26B-4-201
- Administrative order: means an order that has been issued by the office, the department, or an administrative agency of another state or other comparable jurisdiction with similar authority to that of the office. See Utah Code 26B-9-201
- Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
- Adoption document: means an adoption-related document filed with the office, a petition for adoption, a decree of adoption, an original birth certificate, or evidence submitted in support of a supplementary birth certificate. See Utah Code 26B-8-101
- Adoption services: means the same as that term is defined in Section
80-2-801 . See Utah Code 26B-2-101- Adult: means an individual 18 years old or older. See Utah Code 26B-5-301
- Adult: means an individual who is 18 years old or older. See Utah Code 26B-6-201
- Adult: means an individual who is at least 18 years old. See Utah Code 26B-8-301
- Adult Autism Treatment Account: means the Adult Autism Treatment Account created in Section 26B-1-322. See Utah Code 26B-4-601
- Adult day care: means nonresidential care and supervision:
(2)(a) for three or more adults for at least four but less than 24 hours a day; and(2)(b) that meets the needs of functionally impaired adults through a comprehensive program that provides a variety of health, social, recreational, and related support services in a protective setting. See Utah Code 26B-2-101- Adult protection case file: means a record, stored in any format, contained in a case file maintained by Adult Protective Services. See Utah Code 26B-6-201
- Adult Protective Services: means the unit within the division responsible to investigate abuse, neglect, and exploitation of vulnerable adults and provide appropriate protective services. See Utah Code 26B-6-201
- Advertise: means information provided by a person in any medium:
(3)(a) to the public; and(3)(b) that is not age restricted to an individual who is at least 21 years old. See Utah Code 26B-4-201- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Advisory board: means the Medical Cannabis Policy Advisory Board created in Section
26B-1-435 . See Utah Code 26B-4-201- Advisory committee: means the Adult Autism Treatment Program Advisory Committee created in Section 26B-1-424. See Utah Code 26B-4-601
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Affiliate: means the same as that term is defined in Section 16-6a-102. See Utah Code 57-21-2
- Affiliate: means :
(1)(a) a person that directly or indirectly owns, controls, or holds with power to vote, 20% or more of the outstanding voting securities of the debtor, other than a person that holds the securities:(1)(a)(i) as a fiduciary or agent without sole discretionary power to vote the securities; or(1)(a)(ii) solely to secure a debt, if the person has not exercised the power to vote;(1)(b) a corporation 20% or more of whose outstanding voting securities are directly or indirectly owned, controlled, or held with power to vote, by the debtor or a person that directly or indirectly owns, controls, or holds, with power to vote, 20% or more of the outstanding voting securities of the debtor, other than a person that holds the securities:(1)(b)(i) as a fiduciary or agent without sole discretionary power to vote the securities; or(1)(b)(ii) solely to secure a debt, if the person has not exercised the power to vote;(1)(c) a person whose business is operated by the debtor under a lease or other agreement, or a person substantially all of whose assets are controlled by the debtor; or(1)(d) a person that operates the debtor's business under a lease or other agreement or controls substantially all of the debtor's assets. See Utah Code 25-6-102- Affiliate: means the same as that term is defined in Section 16-10a-102. See Utah Code 16-10a-1802
- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- aged: means a person 60 years old or older. See Utah Code 26B-6-101
- Agency: means :
(1)(a) a department, division, agency, commission, board, council, committee, authority, political subdivision, or other instrumentality of the state or of a political subdivision of the state whether one or more; and(1)(b) any other person whose use of the power of eminent domain results in a person becoming a displaced person. See Utah Code 57-12-3- Agency: means the Utah Department of Environmental Quality or other state or federal agency that determines or approves the environmental response project under which the environmental covenant is created. See Utah Code 57-25-102
- Agent: means an authorized person who acts on behalf of or at the direction of a manufacturer, distributor, or practitioner but does not include a motor carrier, public warehouseman, or employee of any of them. See Utah Code 58-37-2
- Agent: means a coach, teacher, employee, representative, or volunteer. See Utah Code 26B-4-401
- Agent: means an individual:
(2)(a) authorized to make health care decisions on the principal's behalf by a power of attorney for health care; or(2)(b) expressly authorized to make an anatomical gift on the principal's behalf by any other record signed by the principal. See Utah Code 26B-8-301- Aggregator: means any person or entity that:
(2)(a)(i) is not a telecommunications corporation;(2)(a)(ii) in the ordinary course of its business makes operator assisted services available to the public or to customers and transient users of its business or property through an operator service provider; and(2)(a)(iii) receives from an operator service provider by contract, tariff, or otherwise, commissions or compensation for calls delivered from the aggregator's location to the operator service provider. See Utah Code 54-8b-2- Aggrieved person: includes a person who:
(2)(a) claims to have been injured by a discriminatory housing practice; or(2)(b) believes that the person will be injured by a discriminatory housing practice that is about to occur. See Utah Code 57-21-2- Agritourism: means the same as that term is defined in Section
78B-4-512 . See Utah Code 26B-7-401- Agritourism food establishment: means a non-commercial kitchen facility where food is handled, stored, or prepared to be offered for sale on a farm in connection with an agritourism activity. See Utah Code 26B-7-401
- Agritourism food establishment permit: means a permit issued by a local health department to the operator for the purpose of operating an agritourism food establishment. See Utah Code 26B-7-401
- Allegation: something that someone says happened.
- Amateur sports organization: means , except as provided in Subsection (2)(b):
(2)(a)(i) a sports team;(2)(a)(ii) a public or private school;(2)(a)(iii) a public or private sports league;(2)(a)(iv) a public or private sports camp; or(2)(a)(v) any other public or private organization that organizes, manages, or sponsors a sporting event for its members, enrollees, or attendees. See Utah Code 26B-4-401- Ambulance service provider: means :
(1)(a) an ambulance provider as defined in Section 26B-4-101; or(1)(b) a non-911 service provider as defined in Section 26B-4-101. See Utah Code 26B-3-801- Ambulatory surgical facility: means a freestanding facility, which provides surgical services to patients not requiring hospitalization. See Utah Code 26B-2-201
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Amendment: means a change to an approved registration that is required under Section 57-19-9 or by a division rule made under this chapter. See Utah Code 57-19-2
- Amenities: means the following physical, recreational or social facilities located at a mobile home park:
(1)(a) a club house;(1)(b) a park;(1)(c) a playground;(1)(d) a swimming pool;(1)(e) a hot tub;(1)(f) a tennis court; or(1)(g) a basketball court. See Utah Code 57-16-3- Amortization: Paying off a loan by regular installments.
- Anaphylaxis: means a potentially life-threatening hypersensitivity to a substance. See Utah Code 26B-4-401
- Anatomical gift: means a donation of all or part of a human body to take effect after the donor's death for the purpose of transplantation, therapy, research, or education. See Utah Code 26B-8-301
- Announcement date: when used in reference to a business combination, means the date of the first public announcement of the final, definitive proposal for the business combination. See Utah Code 16-10a-1802
- Annualized billing period: means :
(1)(a) a 12-month billing cycle beginning on April 1 of one year and ending on March 31 of the following year; or(1)(b) an additional 12-month billing cycle as defined by an electrical corporation's net metering tariff or rate schedule. See Utah Code 54-15-102- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Applicant: means any person who requests assistance under the medical programs of the state. See Utah Code 26B-3-101
- Applicant: means a person that applies for an initial license or a license renewal under this part. See Utah Code 26B-2-101
- Applied behavior analysis: means the same as that term is defined in Section 31A-22-642. See Utah Code 26B-4-601
- Appraisal: A determination of property value.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Approved treatment facility or program: means a mental health or substance use treatment provider that meets the goals and measurements described in Subsection 26B-5-102(2)(j). See Utah Code 26B-5-301
- Appurtenant easement: means an easement tied to, or dependent on, ownership or occupancy of a unit or a parcel of real property. See Utah Code 57-13c-101
- Aquaculture facility: means the same as that term is defined in Section
4-37-103 . See Utah Code 23A-1-101- Aquatic wildlife: means species of fish, mollusks, crustaceans, aquatic insects, or amphibians. See Utah Code 23A-1-101
- Area agency: means an area agency that provides services to the aged, high risk adults, or both within a planning and service area. See Utah Code 26B-6-101
- Area agency on aging: means a public or private nonprofit agency or office designated by the division to:
(4)(a) operate within a planning and service area of the state; and(4)(b) develop and implement a broad range of services for the aged in the area described in Subsection (4)(a). See Utah Code 26B-6-101- Area agency on high risk adults: means a public or private nonprofit agency or office designated by the division to:
(5)(a) operate within a planning and service area of the state; and(5)(b) develop and implement services for high risk adults in the area described in Subsection (5)(a). See Utah Code 26B-6-101- Armed forces: means the United States Army, Navy, Air Force, Marine Corps, Space Force, and Coast Guard. See Utah Code 68-3-12.5
- Arrears: means the same as support debt. See Utah Code 26B-9-201
- Arrest: Taking physical custody of a person by lawful authority.
- Articles of incorporation: include :
(4)(a) amended and restated articles of incorporation;(4)(b) articles of merger; and(4)(c) a document of a similar import to those described in Subsections (4)(a) and (b). See Utah Code 16-10a-102- ASHA: means the American Speech-Language-Hearing Association. See Utah Code 58-41-2
- Assertive community treatment: includes the provision of assessment and treatment plans, rehabilitation, support services, and referrals to other community resources. See Utah Code 26B-5-601
- Assessment: means for the purpose of taxation wherever appropriate. See Utah Code 54-8-3
- Assessment: means any charge imposed by the association, including:
(1)(a) common expenses on or against a unit owner pursuant to the provisions of the declaration, bylaws, or this chapter; and(1)(b) an amount that an association of unit owners assesses to a unit owner under Subsection57-8-43 (9)(g). See Utah Code 57-8-3- Assessment: means the inpatient hospital assessment established by this part. See Utah Code 26B-3-501
- Assessment: means the Medicaid expansion hospital assessment established by this part. See Utah Code 26B-3-601
- Assessment: means the Medicaid ambulance service provider assessment established by this part. See Utah Code 26B-3-801
- Asset: means property of a debtor, but does not include:
(2)(a) property to the extent it is encumbered by a valid lien;(2)(b) property to the extent it is generally exempt under nonbankruptcy law; or(2)(c) an interest in property held in tenancy by the entireties to the extent it is not subject to process by a creditor holding a claim against only one tenant. See Utah Code 25-6-102- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Assignee: means a person entitled to enforce an assignment of rents. See Utah Code 57-26-102
- Assignment of rents: means a transfer of an interest in rents in connection with an obligation secured by real property located in this state and from which the rents arise. See Utah Code 57-26-102
- Assignor: means a person that makes an assignment of rents or the successor owner of the real property from which the rents arise. See Utah Code 57-26-102
- Assistance: means public assistance. See Utah Code 26B-9-101
- Assistance: means public assistance as defined in Section 26B-9-101. See Utah Code 26B-9-201
- Assistance with activities of daily living: means providing of or arranging for the provision of assistance with activities of daily living. See Utah Code 26B-2-201
- Assisted living facility: means :
(5)(a)(i) a type I assisted living facility, which is a residential facility that provides assistance with activities of daily living and social care to two or more residents who:(5)(a)(i)(A) require protected living arrangements; and(5)(a)(i)(B) are capable of achieving mobility sufficient to exit the facility without the assistance of another person; and(5)(a)(ii) a type II assisted living facility, which is a residential facility with a home-like setting that provides an array of coordinated supportive personal and health care services available 24 hours per day to residents who have been assessed under department rule to need any of these services. See Utah Code 26B-2-201- Assisted living facility: means the same as that term is defined in Section 26B-2-201. See Utah Code 26B-2-301
- Assisted outpatient treatment: means involuntary outpatient mental health treatment ordered under Section 26B-5-351. See Utah Code 26B-5-301
- Associate: when used to indicate a relationship with a person, means:
(3)(a) a corporation or organization of which the person is an officer or partner or is, directly or indirectly, the beneficial owner of 10% or more of any class of voting stock;(3)(b) a trust or other estate in which the person has a substantial beneficial interest or as to which the person serves as trustee or in a similar fiduciary capacity; and(3)(c) a relative or spouse of the person, or any relative of the spouse, who has the same home as the person. See Utah Code 16-10a-1802- Associated with the licensee: means that an individual is:
(4)(a)(i) affiliated with a licensee as an owner, director, member of the governing body, employee, agent, provider of care, department contractor, or volunteer; or(4)(a)(ii) applying to become affiliated with a licensee in a capacity described in Subsection (4)(a)(i). See Utah Code 26B-2-101- Association: means two or more operators organized to receive notification of excavation activities in the state, as provided by Section
54-8a-9 . See Utah Code 54-8a-2- association: means all of the unit owners:
(2)(a) acting as a group in accordance with the declaration and bylaws; or(2)(b) organized as a legal entity in accordance with the declaration. See Utah Code 57-8-3- Association: means an organized body consisting solely of owners of timeshare interests in a timeshare development, including developers or purchasers. See Utah Code 57-19-2
- Association: means the Utah Speech-Language-Hearing Association. See Utah Code 58-41-2
- Assumed corporate name: means a name assumed for use in this state by a foreign corporation pursuant to Section 16-10a-1506 because its corporate name is not available for use in this state. See Utah Code 16-10a-102
- Asthma action plan: means a written plan:
(4)(a) developed with a school nurse, a student's parent or guardian, and the student's health care provider to help control the student's asthma; and(4)(b) signed by the student's:(4)(b)(i) parent or guardian; and(4)(b)(ii) health care provider. See Utah Code 26B-4-401- Asthma emergency: means an episode of respiratory distress that may include symptoms such as wheezing, shortness of breath, coughing, chest tightness, or breathing difficulty. See Utah Code 26B-4-401
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Attending physician: means a physician licensed to practice medicine in this state who has primary responsibility for the care and treatment of the declarant. See Utah Code 26B-5-301
- Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
- Attorney-in-fact: means an adult properly appointed under this part to make mental health treatment decisions for a declarant under a declaration for mental health treatment. See Utah Code 26B-5-301
- Audiologist: means a person who practices audiology or who holds himself out to the public directly or indirectly by any means, act, title, identification, performance, method, or procedure as one who nonmedically examines, measures, tests, interprets, evaluates, assesses, diagnoses, directs, instructs, treats, counsels, prescribes, and recommends for persons affected by or suspected of having disorders of or conditions of hearing loss, or assists persons in achieving the reception, communication, and perception of sound and determines the range, nature, and degree of hearing function related to communication needs, or provides audiology services and uses audio electronic equipment and provides audiology services and consultation regarding noise control and hearing conservation, conducts tests and interpretation of vestibular function and nystagmus, prepares ear impressions and provides ear molds, aids, accessories, prescriptions, and prostheses for hearing, evaluates sound environment and equipment, and calibrates instruments used in testing and supplementing auditory function. See Utah Code 58-41-2
- Audiology: means the application of principles, methods, and procedures, and measuring, testing, examining, interpreting, diagnosing, predicting, evaluating, prescribing, consulting, treating, instructing, and researching, which is related to hearing, vestibular function, and the disorders of hearing, to related language and speech disorders and to aberrant behavior related to hearing loss or vestibular function, for the purpose of preventing and modifying disorders related to hearing loss or vestibular function, and planning, directing, managing, conducting, and participating in hearing conservation, evoked potentials evaluation, nonmedical tinnitus evaluation or treatment, noise control, habilitation, and rehabilitation programs, including hearing aid evaluation, assistive listening device evaluation, prescription, preparation, and dispensing, and auditory training and lip reading. See Utah Code 58-41-2
- Audiology aide: means an individual who:
(5)(a) meets the minimum qualifications established by the board for audiology aides. See Utah Code 58-41-2- Authority: means the Point of the Mountain State Land Authority, created in Section
11-59-201 . See Utah Code 11-59-102- Authorized person: means an employee or agent:
(1)(a) of a public utility that:(1)(a)(i) generates, transmits, or delivers electricity; or(1)(a)(ii) provides and whose work relates to communication services;(1)(b) of an industrial plant whose work relates to the electrical system of the industrial plant;(1)(c) of a cable television or communication services company, or of a contractor of cable television or communication services company, if specifically and expressly authorized by the owner of the poles to make cable television or communication services attachments; or(1)(d) of a state, county, or municipal agency which has or whose work relates to:(1)(d)(i) overhead electrical lines;(1)(d)(ii) overhead lighting systems;(1)(d)(iii) authorized overhead circuit construction;(1)(d)(iv) conductors on poles; or(1)(d)(v) structures of any type. See Utah Code 54-8c-1- Authorized shares: means the shares of all classes a domestic or foreign corporation is authorized to issue. See Utah Code 16-10a-102
- Autism spectrum disorder: means the same as that term is defined in Section 31A-22-642. See Utah Code 26B-4-601
- Auxiliary aids and services: means items, equipment, or services that assist in effective communication between an individual who has a mental, hearing, vision, or speech disability and another individual. See Utah Code 26B-2-301
- Avoided costs: means the incremental costs to an electrical corporation of electric energy or capacity or both that, due to the purchase of electric energy or capacity or both from small power production or cogeneration facilities, the electrical corporation would not have to generate itself or purchase from another electrical corporation. See Utah Code 54-2-1
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
- Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
- Basic residential service: means a local exchange service for a residential customer consisting of:
(3)(a) a single line with access to the public switched network;(3)(b) touch-tone or the functional equivalent;(3)(c) local flat-rate unlimited usage, exclusive of extended area service;(3)(d) single-party service;(3)(e) a free phone number listing in directories received for free;(3)(f) access to operator services;(3)(g) access to directory assistance;(3)(h) access to lifeline and telephone relay assistance;(3)(i) access to 911 and E911 emergency services;(3)(j) access to long-distance carriers;(3)(k) access to toll limitations services;(3)(l) other services as may be determined by the commission; and(3)(m) no feature. See Utah Code 54-8b-2- Beneficial owner: when used with respect to stock, means a person:
(4)(a) that, individually or with or through any of its affiliates or associates, beneficially owns the stock, directly or indirectly;(4)(b) that, individually or with or through any of its affiliates or associates, has:(4)(b)(i) the right to acquire the stock:(4)(b)(i)(A) whether the right is exercisable immediately or only after the passage of time, pursuant to an agreement, arrangement, or understanding, whether or not in writing; or(4)(b)(i)(B) upon the exercise of conversion rights, exchange rights, warrants, or options, or otherwise, except that a person may not be considered the beneficial owner of stock tendered pursuant to a tender or exchange offer made by the person or an affiliate or associate of the person until the tendered stock is accepted for purchase or exchange; or(4)(b)(ii) the right to vote the stock pursuant to an agreement, arrangement, or understanding, whether or not in writing, except that a person may not be considered the beneficial owner of any stock under this Subsection (4)(b)(ii) if the agreement, arrangement, or understanding to vote the stock arises solely from a revocable proxy or consent given in response to a proxy or consent solicitation made in accordance with the applicable regulations under the Exchange Act and is not then reportable on a Schedule 13D under the Exchange Act, or any comparable or successor report; or(4)(c) that has an agreement, arrangement, or understanding, whether or not in writing, for the purpose of acquiring, holding, voting, except voting pursuant to a revocable proxy or consent as described in Subsection (4)(b)(ii), or disposing of the stock with any other person that beneficially owns, or whose affiliates or associates beneficially own, directly or indirectly, the stock. See Utah Code 16-10a-1802- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Benefit: means the receipt of money, goods, or any other thing of pecuniary value. See Utah Code 26B-3-1101
- Bequest: Property gifted by will.
- Big game: means species of hoofed protected wildlife. See Utah Code 23A-1-101
- Big game: includes deer, elk, big horn sheep, moose, mountain goats, pronghorn. See Utah Code 23A-11-101
- Big game byproduct: means those parts of the carcass of a lawfully taken big game animal that are listed in Subsections (2)(a)(i) through (ix):
(2)(a)(i) bones with less than 1/2 inch of attached muscle tissue;(2)(a)(ii) fat, tendons, ligaments, cartilage, and silverskin with less than 1/2 inch attached muscle tissue;(2)(a)(iii) muscle tissue damaged by wound channels and within one inch of damaged tissue;(2)(a)(iv) head;(2)(a)(v) rib and neck meat on deer, pronghorn, mountain goat, and bighorn sheep;(2)(a)(vi) antlers and horns;(2)(a)(vii) legs below the knee and hock;(2)(a)(viii) internal organs; and(2)(a)(ix) hide. See Utah Code 23A-11-101- Biological sex at birth: means an individual's sex, as being male or female,
according to distinct reproductive roles as manifested by sex and reproductive organ anatomy, chromosomal makeup, and endogenous hormone profiles. See Utah Code 26B-8-101
- Bioterrorism: means :
(1)(a) the intentional use of any microorganism, virus, infectious substance, or biological product to cause death, disease, or other biological malfunction in a human, an animal, a plant, or another living organism in order to influence, intimidate, or coerce the conduct of government or a civilian population; and(1)(b) includes anthrax, botulism, small pox, plague, tularemia, and viral hemorrhagic fevers. See Utah Code 26B-7-301- Birthing center: means a facility that:
(6)(a) receives maternal clients and provides care during pregnancy, delivery, and immediately after delivery; and(6)(b)(6)(b)(i) is freestanding; or(6)(b)(ii) is not freestanding, but meets the requirements for an alongside midwifery unit described in Subsection26B-2-228 (7). See Utah Code 26B-2-201- Blind: means an individual, or class of individuals, whose central acuity does not exceed 20/200 in the better eye with correcting lenses or whose visual acuity, if better than 20/200, is accompanied by a limit to the field of vision in the better eye to such a degree that its widest diameter subtends an angle of no greater than 20 degrees. - Board: means the Underground Facilities Damage Dispute Board created in Section

(5)(a)(i) uses a regionally accredited education program;(5)(a)(ii) provides a residence to the school's students:(5)(a)(ii)(A) for the purpose of enabling the school's students to attend classes at the school; and(5)(a)(ii)(B) as an ancillary service to educating the students at the school;(5)(a)(iii) has the primary purpose of providing the school's students with an education, as defined in Subsection (5)(b)(i); and(5)(a)(iv)(5)(a)(iv)(A) does not provide the treatment or services described in Subsection (40)(a); or(5)(a)(iv)(B) provides the treatment or services described in Subsection (40)(a) on a limited basis, as described in Subsection (5)(b)(ii). See Utah Code 26B-2-101- Body art facility: means a facility where an individual practices or instructs:
(6)(a) body piercing;(6)(b) branding;(6)(c) permanent cosmetics;(6)(d) scarification; or(6)(e) tattooing. See Utah Code 26B-7-401- Body piercing: means any method of piercing the skin or mucosa to place jewelry through the skin or mucosa. See Utah Code 26B-7-401
- Booby trap: includes guns, ammunition, or explosive devices attached to trip wires or other triggering mechanisms, sharpened stakes, nails, spikes, electrical devices, lines or wires with hooks attached, and devices for the production of toxic fumes or gases. See Utah Code 58-37d-3
- Brain injury: means an acquired injury to the brain that is neurological in nature, including a cerebral vascular accident. See Utah Code 26B-6-401
- Branding: means the process in which a mark is burned, with or without heated metal, into human tissue with the intention of leaving a permanent mark. See Utah Code 26B-7-401
- Broken or defective: means any defects in the wheels, trucks, draft gears, couplers, brakes, draft and center sills, of any car, coach, locomotive, or other rolling stock of a railroad company and every other defect in any car, coach, locomotive or other rolling stock which would be dangerous to the public or to any employee of a railroad company while said car is being moved, hauled or transported. See Utah Code 56-2-1
- Building: means a building, containing units, and comprising a part of the property. See Utah Code 57-8-3
- Business: means any lawful activity, excepting a farm operation, conducted primarily:
(2)(a) for the purchase, sale, lease, or rental of personal or real property, and for the manufacture, processing, or marketing of products, commodities, or any other personal property;(2)(b) for the sale of services to the public;(2)(c) by a nonprofit organization; or(2)(d) for assisting in the purchase, sale, resale, manufacture, processing, or marketing of products, commodities, personal property, or services by the erection and maintenance of an outdoor advertising display or displays, whether or not such display or displays are located on the premises on which any of the above activities are conducted. See Utah Code 57-12-3- Business combination: when used in reference to any domestic corporation and an interested shareholder of the corporation, means:
(5)(a) a merger or consolidation of the corporation or any subsidiary of the corporation with:(5)(a)(i) the interested shareholder; or(5)(a)(ii) any other corporation, whether or not that corporation is an interested shareholder of the corporation, that is, or after the merger or consolidation would be, an affiliate or associate of the interested shareholder;(5)(b) any sale, lease, exchange, mortgage, pledge, transfer, or other disposition, in one transaction or a series of transactions, to or with the interested shareholder or any affiliate or associate of the interested shareholder of assets of the corporation or any subsidiary of the corporation:(5)(b)(i) having an aggregate market value equal to 10% or more of the aggregate market value of all the assets, determined on a consolidated basis, of the corporation;(5)(b)(ii) having an aggregate market value equal to 10% or more of the aggregate market value of all the outstanding stock of the corporation; or(5)(b)(iii) representing 10% or more of the earning power or net income, determined on a consolidated basis, of the corporation;(5)(c) the issuance or transfer by the corporation or any subsidiary of the corporation, in one transaction or a series of transactions, of any stock of the corporation or any subsidiary of the corporation that has an aggregate market value equal to 5% or more of the aggregate market value of all the outstanding stock of the corporation to the interested shareholder or any affiliate or associate of the interested shareholder except pursuant to the exercise of warrants or rights to purchase stock offered, or a dividend or distribution paid or made, pro rata to all shareholders of the corporation;(5)(d) the adoption of any plan or proposal for the liquidation or dissolution of the corporation proposed by, or pursuant to any agreement, arrangement, or understanding, whether or not in writing, with, the interested shareholder or any affiliate or associate of the interested shareholder;(5)(e) any reclassification of securities, including a stock split, stock dividend, or other distribution of stock in respect of stock, or any reverse stock split, or recapitalization of the corporation, or any merger or consolidation of the corporation with any subsidiary of the corporation, or any other transaction, whether or not with, into, or otherwise involving the interested shareholder:(5)(e)(i) proposed by, or pursuant to any agreement, arrangement, or understanding, whether or not in writing, with, the interested shareholder or any affiliate or associate of the interested shareholder; and(5)(e)(ii) that has the effect, directly or indirectly, of increasing the proportionate share of the outstanding shares of any class or series of voting stock or securities convertible into voting stock of the corporation or any subsidiary of the corporation that is directly or indirectly owned by the interested shareholder or any affiliate or associate of the interested shareholder, except as a result of immaterial changes due to fractional share adjustments; or(5)(f) a receipt by the interested shareholder or an affiliate or associate of the interested shareholder of the benefit, directly or indirectly, except proportionately as a shareholder of the corporation, of a loan, advance, guarantee, pledge, or other financial assistance or any tax credit or other tax advantage provided by or through the corporation. See Utah Code 16-10a-1802- Business day: means a day other than a Saturday, Sunday, or state or federal holiday. See Utah Code 57-19-2
- Business entity: means a claimant that is a:
(1)(a) C corporation;(1)(b) S corporation;(1)(c) general partnership;(1)(d) limited liability company;(1)(e) limited liability partnership;(1)(f) limited partnership; or(1)(g) business entity similar to Subsections(1)(c) through(f) :(1)(g)(i) with respect to which the business entity's income or losses are divided among and passed through to taxpayers; and(1)(g)(ii) as defined by the commission by rule made in accordance withTitle 63G, Chapter 3, Utah Administrative Rulemaking Act . See Utah Code 59-6-101- Business hours: means the hours between 8:00 a. See Utah Code 54-8a-2
- Bylaws: includes amended bylaws and restated bylaws. See Utah Code 16-10a-102
- Camp resort: means an enterprise that has as its primary purpose the offering of a camp resort interest. See Utah Code 57-19-2
- Camping site: means a space designed or promoted for the purpose of locating a trailer, tent, tent trailer, recreational vehicle, pickup camper, motor home, or other similar device used for land-based portable housing. See Utah Code 57-19-2
- Cannabis: means marijuana. See Utah Code 26B-4-201
- Cannabis processing facility: means the same as that term is defined in Section
4-41a-102 . See Utah Code 26B-4-201- Cannabis product: means a product that:
(8)(a) is intended for human use; and(8)(b) contains cannabis or any tetrahydrocannabinol or THC analog in a total concentration of 0. See Utah Code 26B-4-201- Cannabis production establishment: means the same as that term is defined in Section
4-41a-102 . See Utah Code 26B-4-201- Cannabis Research Review Board: means the Cannabis Research Review Board created in Section
26B-1-420 . See Utah Code 26B-4-201- Capacity building: means strengthening an individual's or a community's ability to participate in shared decision making. See Utah Code 26B-2-501
- Capacity limit: means the maximum number of qualifying children that a regulated provider may care for at any given time, in accordance with rules made by the department. See Utah Code 26B-2-401
- Capacity to consent: means the ability of an individual to understand and communicate regarding the nature and consequences of decisions relating to the individual, and relating to the individual's property and lifestyle, including a decision to accept or refuse services. See Utah Code 26B-6-201
- Carcass: means the dead body of an animal or the animal's parts. See Utah Code 23A-1-101
- Care facility: means :
(2)(a) a nursing facility;(2)(b) an intermediate care facility for an individual with an intellectual disability; or(2)(c) any other medical institution. See Utah Code 26B-3-1001- Caretaker: means a person or public institution that is entrusted with or assumes the responsibility to provide a vulnerable adult with care, food, shelter, clothing, supervision, medical or other health care, resource management, or other necessities for pecuniary gain, by contract, or as a result of friendship, or who is otherwise in a position of trust and confidence with a vulnerable adult, including a relative, a household member, an attorney-in-fact, a neighbor, a person who is employed or who provides volunteer work, a court-appointed or voluntary guardian, or a person who contracts or is under court order to provide care. See Utah Code 26B-6-201
- Carrier: means an infected individual or animal who harbors a specific infectious agent in the absence of discernible clinical disease and serves as a potential source of infection for man. See Utah Code 26B-7-201
- Case law: The law as laid down in cases that have been decided in the decisions of the courts.
- Cash proceeds: means proceeds that are money, checks, deposit accounts, or the like. See Utah Code 57-26-102
- Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
- CCC: means the certificate of clinical competence awarded by the American Speech-Language-Hearing Association. See Utah Code 58-41-2
- Center based child care: means child care provided in a facility or program that is not the home of the provider. See Utah Code 26B-2-401
- Centerfire rifle hunt: means a hunt for which a hunter may use a centerfire rifle, except as provided in Subsection (3)(b). See Utah Code 23A-11-101
- Centers for Medicare and Medicaid Services: means the Centers for Medicare and Medicaid Services within the United States Department of Health and Human Services. See Utah Code 26B-4-701
- Certificate: means a certificate of public convenience and necessity issued by the commission authorizing a telecommunications corporation to provide specified public telecommunications services within a defined geographic service territory in the state. See Utah Code 54-8b-2
- Certificate: means a residential child care certificate issued by the office. See Utah Code 26B-2-701
- Certificate of registration: means a paper-based or electronic document issued under this title, or a rule or proclamation of the Wildlife Board granting authority to engage in activities not covered by a license, permit, or tag. See Utah Code 23A-1-101
- Certification: means a less restrictive level of licensure issued by the department. See Utah Code 26B-2-101
- Certification: means an approval to operate in compliance with local or federal requirements or regulations, completed by the office or on behalf of the office for a local or federal agency. See Utah Code 26B-2-701
- Certified copy: means a copy of a document certified by its custodian to be a true and correct copy of the document or the copy of the document maintained by the custodian, where the document or copy is maintained under the authority of the United States, the state of Utah or any of its political subdivisions, another state, a court of record, a foreign government, or an Indian tribe. See Utah Code 57-1-1
- Certified dietitian: means a person who is certified by the division as meeting the certification requirements provided in this chapter. See Utah Code 58-49-2
- Certified food safety manager: means a manager of a food service establishment who:
(9)(a) passes successfully a department-approved examination;(9)(b) successfully completes, every three years, renewal requirements established by department rule consistent with original certification requirements; and(9)(c) submits to the appropriate local health department the documentation required by Section26B-7-412 . See Utah Code 26B-7-401- Certified nurse midwife: means an individual who:
(3)(a) is licensed to practice as a certified nurse midwife under Title 58, Chapter 44a, Nurse Midwife Practice Act; and(3)(b) has completed an education program regarding the completion of a certificate of death developed by the department by rule made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act. See Utah Code 26B-8-101- Certified program: means a nursing care facility program with Medicaid certification. See Utah Code 26B-3-301
- Certified provider: means a person who holds a certificate from the department under Section 26B-2-404. See Utah Code 26B-2-401
- Chambers: A judge's office.
- Change of use: means a change of the use of a mobile home park, or any part of it, for a purpose other than the rental of mobile home spaces. See Utah Code 57-16-3
- Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
- Child: means the same as that term is defined in Section
80-1-102 . See Utah Code 26B-1-501- Child: means an individual under 18 years old. See Utah Code 26B-2-101
- Child: means an individual who is younger than 19 years old. See Utah Code 26B-3-901
- Child: means an individual who is under the age of 18. See Utah Code 26B-4-401
- Child: means a person under 18 years old. See Utah Code 26B-5-401
- Child: means the same as that term is defined in Section
81-6-101 . See Utah Code 26B-9-101 v2- Child: means :
(6)(a) a son or daughter under the age of 18 years who is not otherwise emancipated, self-supporting, married, or a member of the armed forces of the United States;(6)(b) a son or daughter over the age of 18 years, while enrolled in high school during the normal and expected year of graduation and not otherwise emancipated, self-supporting, married, or a member of the armed forces of the United States; or(6)(c) a son or daughter of any age who is incapacitated from earning a living and is without sufficient means. - Child care: means continuous care and supervision of a qualifying child, that is:
(4)(a) in lieu of care ordinarily provided by a parent in the parent's home;(4)(b) for less than 24 hours a day; and(4)(c) for direct or indirect compensation. See Utah Code 26B-2-401- Child care program: means a child care facility or program operated by a regulated provider. See Utah Code 26B-2-401
- Child placing: means receiving, accepting, or providing custody or care for any child, temporarily or permanently, for the purpose of:
(8)(a) finding a person to adopt the child;(8)(b) placing the child in a home for adoption; or(8)(c) foster home placement. See Utah Code 26B-2-101- Child support: means the same as that term is defined in Section 26B-9-301. See Utah Code 26B-9-101
- Child support: means the same as that term is defined in Section 26B-9-301. See Utah Code 26B-9-201
- Child support: includes obligations ordered by a tribunal for the support of a spouse or former spouse with whom the child resides if the spousal support is collected with the child support. See Utah Code 26B-9-301

- Child support guidelines: means guidelines as defined in Section 78B-12-102. See Utah Code 26B-9-201

- Child support order: means a judgment, decree, or order, whether temporary, final, or subject to modification, issued by a tribunal for child support and related costs and fees, interest and penalties, income withholding, attorney fees, and other relief. See Utah Code 26B-9-301
- Child support services: means services provided pursuant to Part D of Title IV of the Social Security Act, Utah Code 26B-9-101
- Child support services: means the same as that term is defined in Section 26B-9-101. See Utah Code 26B-9-201
- Child-placing agency: means a person that engages in child placing. See Utah Code 26B-2-101
- City: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5- Claim: means :
(3)(a) a request or demand for payment; or(3)(b) a cause of action for money or damages arising under any law. See Utah Code 26B-3-1001- Claim: means any request or demand for money or property:
(2)(a) made to any:(2)(a)(i) employee, officer, or agent of the state;(2)(a)(ii) contractor with the state; or(2)(a)(iii) grantee or other recipient, whether or not under contract with the state; and(2)(b) if:(2)(b)(i) any portion of the money or property requested or demanded was issued from or provided by the state; or(2)(b)(ii) the state will reimburse the contractor, grantee, or other recipient for any portion of the money or property. - claimant: means a resident or nonresident person. See Utah Code 59-6-101
- Clandestine laboratory operation: means the:
(1)(b)(i) purchase or procurement of chemicals, supplies, equipment, or laboratory location for the illegal manufacture of specified controlled substances;(1)(b)(ii) transportation or arranging for the transportation of chemicals, supplies, or equipment for the illegal manufacture of specified controlled substances;(1)(b)(iii) setting up of equipment or supplies in preparation for the illegal manufacture of specified controlled substances;(1)(b)(iv) activity of compounding, synthesis, concentration, purification, separation, extraction, or other physical or chemical processing of a substance, including a controlled substance precursor, or the packaging, repackaging, labeling, or relabeling of a container holding a substance that is a product of any of these activities, when the substance is to be used for the illegal manufacture of specified controlled substances;(1)(b)(v) illegal manufacture of specified controlled substances; or(1)(b)(vi) distribution or disposal of chemicals, equipment, supplies, or products used in or produced by the illegal manufacture of specified controlled substances. See Utah Code 58-37d-3- Clean coal technology: means a technology that may be researched, developed, or used for reducing emissions or the rate of emissions from a thermal electric generation plant that uses coal as a fuel source. See Utah Code 54-2-1
- Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
- Client: means an individual who receives or has received services from a licensee. See Utah Code 26B-2-101
- Client: means an individual, resident, or patient who receives services from a provider. See Utah Code 26B-2-701
- CMS: means the Centers for Medicare and Medicaid Services within the United States Department of Health and Human Services. See Utah Code 26B-3-101
- CMS: means the Centers for Medicare and Medicaid Services within the United States Department of Health and Human Services. See Utah Code 26B-3-501
- CMS: means the Centers for Medicare and Medicaid Services within the United States Department of Health and Human Services. See Utah Code 26B-3-601
- Commercial condominium project: means a condominium project that has no residential units within the project. See Utah Code 57-8-3
- Commercial trampoline: means a device that:
(1)(a) incorporates a trampoline bed; and(1)(b) is used for recreational jumping, springing, bouncing, acrobatics, or gymnastics in a trampoline park. See Utah Code 11-63-102- Commission: means the Labor Commission. See Utah Code 57-21-2
- Commission: means the Public Service Commission. See Utah Code 54-2-1
- Commission: means the Utah Behavioral Health Commission created in Section

- Committee: means a fatality review committee that is formed under Section

26B-1-204 . See Utah Code 26B-2-201- Committee: means the Primary Care Grant Committee described in Section
26B-1-410 . See Utah Code 26B-4-301- committee: means the Utah Substance Use and Mental Health Advisory Committee created in this section. See Utah Code 26B-5-801
- Committee: means the Health Data Committee created in Section
26B-1-413 . See Utah Code 26B-8-501- Committee membership: Legislators are assigned to specific committees by their party. Seniority, regional balance, and political philosophy are the most prominent factors in the committee assignment process.
- Common expenses: means :
(6)(a) all sums lawfully assessed against the unit owners;(6)(b) expenses of administration, maintenance, repair, or replacement of the common areas and facilities;(6)(c) expenses agreed upon as common expenses by the association of unit owners; and(6)(d) expenses declared common expenses by this chapter, or by the declaration or the bylaws. See Utah Code 57-8-3- Common facilities: means all works and facilities:
(1)(a) owned or used by two or more public power entities or power utilities; and(1)(b) necessary to the generation, transmission, or distribution of electric power and energy. See Utah Code 54-9-102- Common interest community: means a condominium, cooperative, or other real property with respect to which a person, by virtue of the person's ownership of a parcel of real property, is obligated to pay property taxes or insurance premiums, or for maintenance, or improvement of other real property described in a recorded covenant that creates the common interest community. See Utah Code 57-25-102
- Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
- Common stock: means stock other than preferred stock. See Utah Code 16-10a-1802
- Common-interest community: means :
(2)(a) an association of unit owners, as defined in Section 57-8-3;(2)(b) an association, as defined in Section 57-8a-102; or(2)(c) a cooperative, as defined in Section 57-23-2. See Utah Code 57-13c-101- Communicable disease: means illness due to a specific infectious agent or its toxic products which arises through transmission of that agent or its products from a reservoir to a susceptible host, either directly, as from an infected individual or animal, or indirectly, through an intermediate plant or animal host, vector, or the inanimate environment. See Utah Code 26B-7-201
- Communication service: means the transmission of intelligence by electrical means, including telephone, telegraph, messenger-call, clock, police, fire alarm, and traffic control circuits or the transmission of standard television or radio signals. See Utah Code 54-8-3
- Community health worker: means an individual who:
(2)(a) works to improve a social determinant of health;(2)(b) acts as an intermediary between a community and health services or social services to:(2)(b)(i) facilitate access to services; or(2)(b)(ii) improve the quality and cultural competence of service delivery; and(2)(c) increases health knowledge and self-sufficiency of an individual or a community through outreach, capacity building, community education, informal counseling, social support, and other similar activities. See Utah Code 26B-2-501- Community location: means the same as that term is defined:
(1)(a) as it relates to a municipality, in Section Utah Code 26B-7-501- Community mental health center: means an entity that provides treatment and services to a resident of a designated geographical area, that operates by or under contract with a local mental health authority, and that complies with state standards for community mental health centers. See Utah Code 26B-5-301
- Compendia: means resources widely accepted by the medical profession in the efficacious use of drugs, including "American Hospital Formulary Service Drug Information" "U. See Utah Code 26B-3-301
- Complainant: means an aggrieved person, including the director, who has commenced a complaint with the division. See Utah Code 57-21-2
- Complainant: means a person who initiates a complaint. See Utah Code 26B-6-701
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Complaint: means a complaint initiated with the ombudsman identifying a person who has violated the rights and privileges of an individual with a disability. See Utah Code 26B-6-701
- Conciliation: means the attempted resolution of an issue raised in a complaint of discriminatory housing practices by the investigation of the complaint through informal negotiations involving the complainant, the respondent, and the division. See Utah Code 57-21-2
- Conciliation agreement: means a written agreement setting forth the resolution of the issues in conciliation. See Utah Code 57-21-2
- Conciliation conference: means the attempted resolution of an issue raised in a complaint or by the investigation of a complaint through informal negotiations involving the complainant, the respondent, and the division. See Utah Code 57-21-2
- Conditional medical cannabis card: means an electronic medical cannabis card that the department issues in accordance with Subsection
26B-4-213 (1)(b) to allow an applicant for a medical cannabis card to access medical cannabis during the department's review of the application. See Utah Code 26B-4-201- Condominium: means the ownership of a single unit in a multiunit project together with an undivided interest in common in the common areas and facilities of the property. See Utah Code 57-8-3
- Condominium plat: means a plat or plats of survey of land and units prepared in accordance with Section
57-8-13 . See Utah Code 57-8-3- Condominium project: means a real estate condominium project; a plan or project whereby two or more units, whether contained in existing or proposed apartments, commercial or industrial buildings or structures, or otherwise, are separately offered or proposed to be offered for sale. See Utah Code 57-8-3
- Condominium unit: means a unit together with the undivided interest in the common areas and facilities appertaining to that unit. See Utah Code 57-8-3
- Congregate care program: means any of the following that provide services to a child:
(11)(a)(i) an outdoor youth program;(11)(a)(ii) a residential support program;(11)(a)(iii) a residential treatment program; or(11)(a)(iv) a therapeutic school. See Utah Code 26B-2-101- Conservation easement: means a nonpossessory property interest created for one or more of the following conservation purposes:
(3)(a) retaining or protecting the natural, scenic, wildlife, wildlife-habitat, biological, ecological, or open-space values of real property;(3)(b) ensuring the availability of real property for agricultural, forest, outdoor-recreational, or open-space uses;(3)(c) protecting natural resources, including wetlands, grasslands, and riparian areas;(3)(d) maintaining or enhancing air or water quality;(3)(e) preserving the historical, architectural, archeological, paleontological, or cultural aspects of real property; or(3)(f) any other purpose under Chapter 18, Land Conservation Easement Act. See Utah Code 57-13c-101- conservation easement: means an easement, covenant, restriction, or condition in a deed, will, or other instrument signed by or on behalf of the record owner of the underlying real property for the purpose of preserving and maintaining land or water areas predominantly in a natural, scenic, or open condition, or for recreational, agricultural, cultural, wildlife habitat or other use or condition consistent with the protection of open land. See Utah Code 57-18-2
- Conservation officer: means a full-time, permanent employee of the division who is POST certified as a peace or a special function officer. See Utah Code 23A-1-101
- Conservator: is a s defined in Section 75-1-201. See Utah Code 26B-6-301
- Consolidation: means the registration of one or more additional sites or interests in a development after the division approves the development's registration. See Utah Code 57-19-2
- Consumer: means any person not primarily engaged in the provision of health care to individuals or in the administration of facilities or institutions in which such care is provided and who does not hold a fiduciary position, or have a fiduciary interest in any entity involved in the provision of health care, and does not receive, either directly or through his spouse, more than 1/10 of his gross income from any entity or activity relating to health care. See Utah Code 26B-2-201
- Consumer price index: means the Consumer Price Index for All Urban Consumers: All Items Less Food & Energy, as published by the Bureau of Labor Statistics of the United States Department of Labor. See Utah Code 54-23-102
- Consumption: means ingesting or having any measurable amount of a controlled substance in a person's body, but this Subsection (1)(c) does not include the metabolite of a controlled substance. See Utah Code 58-37-2
- Contact: means an individual or animal having had association with an infected individual, animal, or contaminated environment so as to have had an opportunity to acquire the infection. See Utah Code 26B-7-201
- Continuance: Putting off of a hearing ot trial until a later time.
- Continuing criminal enterprise: means any individual, sole proprietorship, partnership, corporation, business trust, association, or other legal entity, and any union or groups of individuals associated in fact although not a legal entity, and includes illicit as well as licit entities created or maintained for the purpose of engaging in conduct which constitutes the commission of episodes of activity made unlawful by Chapter 37, Utah Controlled Substances Act, Chapter 37a, Utah Drug Paraphernalia Act, Chapter 37b, Imitation Controlled Substances Act, Chapter 37c, Utah Controlled Substance Precursor Act, or Chapter 37d, Clandestine Drug Lab Act, which episodes are not isolated, but have the same or similar purposes, results, participants, victims, methods of commission, or otherwise are interrelated by distinguishing characteristics. See Utah Code 58-37-2
- Contract: A legal written agreement that becomes binding when signed.
- Contractible condominium: means a condominium project from which one or more portions of the land within the project may be withdrawn in accordance with provisions of the declaration and of this chapter. See Utah Code 57-8-3
- Control: means to add, remove, or change the placement of a drug, substance, or immediate precursor under Section
58-37-3 . See Utah Code 58-37-2- Control number: means a number or other identifier that:
(2)(a) is assigned by the department to an individual's health data;(2)(b) is consistent with the best practices of data privacy; and(2)(c) is used to ensure health data is not able to be readily associated with an individual when the health data is provided for research or statistical analysis. See Utah Code 26B-8-501- Controlled substance: means a drug or substance:
(1)(f)(i)(A) included in Schedules I, II, III, IV, or V of Section58-37-4 ;(1)(f)(i)(B) included in Schedules I, II, III, IV, or V of the federal Controlled Substances Act, Title II, P. See Utah Code 58-37-2- Controlled substance: means the same as that term is defined in Title 58, Chapter 37, Utah Controlled Substances Act. See Utah Code 26B-4-501
- Controlled substance analog: means :
(1)(g)(i)(A) a substance the chemical structure of which is substantially similar to the chemical structure of a controlled substance listed in Schedules I and II of Section58-37-4 , a substance listed in SectionUtah Code 58-37-2 - Controlled substance database: means the controlled substance database created in Section
58-37f-201 . See Utah Code 26B-4-201- Controlled substance precursor: includes a chemical reagent and means any of the following:

- controlling interest: means the direct or indirect possession of the power to direct or cause the direction of the management and policies of an entity, whether through the ownership of voting shares, by contract, or otherwise. See Utah Code 16-10a-102
- conversion: means the removal of all or any part of any existing overhead electric or communications facilities and the replacement thereof with underground electric or communication facilities constructed at the same or different locations. See Utah Code 54-8-3
- Convertible land: means a building site which is a portion of the common areas and facilities, described by metes and bounds, within which additional units or limited common areas and facilities may be created in accordance with this chapter. See Utah Code 57-8-3
- Convertible space: means a portion of the structure within the condominium project, which portion may be converted into one or more units or common areas and facilities, including limited common areas and facilities in accordance with this chapter. See Utah Code 57-8-3
- Conveyance: includes a motor vehicle, a vessel, a motorboat, a sailboat, a personal watercraft, a container, a trailer, a live well, or a bilge area. See Utah Code 23A-10-101
- Conviction: A judgement of guilt against a criminal defendant.
- Conviction: means a determination of guilt by verdict, whether jury or bench, or plea, whether guilty or no contest, for any offense proscribed by:
(1)(h)(i)(A) Chapter 37, Utah Controlled Substances Act;(1)(h)(i)(B) Chapter 37a, Utah Drug Paraphernalia Act;(1)(h)(i)(C) Chapter 37b, Imitation Controlled Substances Act;(1)(h)(i)(D) Chapter 37c, Utah Controlled Substance Precursor Act; or(1)(h)(i)(E) Chapter 37d, Clandestine Drug Lab Act; or(1)(h)(ii) for any offense under the laws of the United States and any other state which, if committed in this state, would be an offense under:(1)(h)(ii)(A) Chapter 37, Utah Controlled Substances Act;(1)(h)(ii)(B) Chapter 37a, Utah Drug Paraphernalia Act;(1)(h)(ii)(C) Chapter 37b, Imitation Controlled Substances Act;(1)(h)(ii)(D) Chapter 37c, Utah Controlled Substance Precursor Act; or(1)(h)(ii)(E) Chapter 37d, Clandestine Drug Lab Act. See Utah Code 58-37-2- Cooperative: means a form of coownership of real estate in which:
(1)(a) the fee interest in the real estate is held by a corporation, partnership, trust, or other legal entity;(1)(b) an individual's interest in the cooperative is evidenced in a form such as stock, participation shares, membership certificates, or similar instrument; and(1)(c) the participating individual's right of occupancy is demonstrated by a proprietary lease or similar instrument. See Utah Code 57-23-2- Cooperative wildlife management unit: means a generally contiguous area of land that is:
(1)(a) open for hunting small game, waterfowl, turkey, or big game; and(1)(b) registered in accordance with this chapter and rules of the Wildlife Board. See Utah Code 23A-7-101- Cooperative wildlife management unit agent: means a person appointed by a landowner, landowner association, or landowner association operator to perform the functions described in Section 23A-7-207. See Utah Code 23A-7-101
- Cooperative wildlife management unit authorization: means a card, label, ticket, or other identifying document authorizing the possessor to hunt small game or waterfowl in a cooperative wildlife management unit. See Utah Code 23A-7-101
- Cooperative wildlife management unit permit: means a permit authorizing the possessor to hunt turkey, or big game in a cooperative wildlife management unit. See Utah Code 23A-7-101
- Core-skill training: means :
(4)(a) 90 hours of competency-based education; and(4)(b) 300 hours of community involvement as determined by the department through rule. See Utah Code 26B-2-501- Corporate name: means :
(10)(a) the name of a domestic corporation or a domestic nonprofit corporation as stated in its articles of incorporation; or(10)(b) the name of a foreign corporation or a foreign nonprofit corporation as stated in its articles of incorporation or document of similar import. See Utah Code 16-10a-102- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Corporation: includes an association and a joint stock company having any powers or privileges not possessed by individuals or partnerships. See Utah Code 54-2-1
- Counseling: means the activities conducted by a pharmacist to inform Medicaid recipients about the proper use of drugs, as required by the board under this part. See Utah Code 26B-3-301
- Counterclaim: A claim that a defendant makes against a plaintiff.
- Counterfeit opioid: means an opioid or container or labeling of an opioid that:
(1)(d)(i)(1)(d)(i)(A) without authorization bears the trademark, trade name, or other identifying mark, imprint, number, device, or any likeness of them, of a manufacturer, distributor, or dispenser other than the person or persons who in fact manufactured, distributed, or dispensed the substance which falsely purports to be an opioid distributed by another manufacturer, distributor, or dispenser; and(1)(d)(i)(B) a reasonable person would believe to be an opioid distributed by an authorized manufacturer, distributor, or dispenser based on the appearance of the substance as described under this Subsection (1)(d)(i) or the appearance of the container or labeling of the opioid; or(1)(d)(ii)(1)(d)(ii)(A) is falsely represented to be any legally or illegally manufactured opioid; and(1)(d)(ii)(B) a reasonable person would believe to be a legal or illegal opioid. See Utah Code 58-37d-3- Counterfeit substance: means :
(1)(i)(i) any controlled substance or container or labeling of any controlled substance that:(1)(i)(i)(A) without authorization bears the trademark, trade name, or other identifying mark, imprint, number, device, or any likeness of them, of a manufacturer, distributor, or dispenser other than the person or persons who in fact manufactured, distributed, or dispensed the substance which falsely purports to be a controlled substance distributed by any other manufacturer, distributor, or dispenser; and(1)(i)(i)(B) a reasonable person would believe to be a controlled substance distributed by an authorized manufacturer, distributor, or dispenser based on the appearance of the substance as described under Subsection (1)(i)(i)(A) or the appearance of the container of that controlled substance; or(1)(i)(ii) any substance other than under Subsection (1)(i)(i) that:(1)(i)(ii)(A) is falsely represented to be any legally or illegally manufactured controlled substance; and(1)(i)(ii)(B) a reasonable person would believe to be a legal or illegal controlled substance. See Utah Code 58-37-2- County executive: means :
(7)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;(7)(b) the county executive, in the county executive-council optional form of government authorized by Section17-52a-203 ; or(7)(c) the county manager, in the council-manager optional form of government authorized by Section17-52a-204 . See Utah Code 68-3-12.5- County governing body: means one of the types of county government provided for in Title 17, Chapter 52a, Part 2, Forms of County Government. See Utah Code 26A-1-102
- County health department: means a local health department that serves a county and municipalities located within that county. See Utah Code 26A-1-102
- County legislative body: means :
(8)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;(8)(b) the county council, in the county executive-council optional form of government authorized by Section17-52a-203 ; and(8)(c) the county council, in the council-manager optional form of government authorized by Section17-52a-204 . See Utah Code 68-3-12.5- Court: means the particular court that orders probation in a case. See Utah Code 58-50-2
- Court: is a s defined in Section 75-1-201. See Utah Code 26B-6-301
- Court order: means a judgment or order of a tribunal of appropriate jurisdiction of this state, another state, Native American tribe, the federal government, or any other comparable jurisdiction. See Utah Code 26B-9-201
- Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
- Covered multifamily dwelling: means :
(8)(a) a building consisting of four or more dwelling units if the building has one or more elevators; and(8)(b) the ground floor units in other buildings consisting of four or more dwelling units. See Utah Code 57-21-2- Credit bureau: An agency that collects individual credit information and sells it for a fee to creditors so they can make a decision on granting loans. Typical clients include banks, mortgage lenders, credit card companies, and other financing companies. (Also commonly referred to as consumer-reporting agency or credit-reporting agency.) Source: OCC
- Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
- Creditor: means a person that has a claim. See Utah Code 25-6-102
- Criminal risk factors: means a person's characteristics and behaviors that:
(1)(a) affect the person's risk of engaging in criminal behavior; and(1)(b) are diminished when addressed by effective treatment, supervision, and other support resources, resulting in reduced risk of criminal behavior. See Utah Code 26B-5-101- Criteria: means those predetermined and explicitly accepted elements used to measure drug use on an ongoing basis in order to determine if the use is appropriate, medically necessary, and not likely to result in adverse medical outcomes. See Utah Code 26B-3-301
- Critical access hospital: means a critical access hospital that meets the criteria of Utah Code 26B-4-501
- Cross examine: Questioning of a witness by the attorney for the other side.
- Crossing: means a telecommunications facility constructed under or across a railroad right-of-way:
(2)(a)(i) at an angle between 80 degrees and 100 degrees;(2)(a)(ii) with a minimum depth of:(2)(a)(ii)(A) 10 feet below rail level for nonhorizontal directional drilling; or(2)(a)(ii)(B) 15 feet below rail for horizontal directional drilling; and(2)(a)(iii) within a county that is not a county of the first class. See Utah Code 54-23-102- Cultivated crops: means :
(2)(a) annual or perennial crops harvested from or on cleared and planted land;(2)(b) perennial orchard trees on cleared and planted land;(2)(c) crop residues that have forage value for livestock; and(2)(d) pastures. See Utah Code 23A-8-101- Cultivated crops: means :
(4)(a) annual or perennial crops harvested from or on cleared and planted land;(4)(b) perennial orchard trees on cleared and planted land;(4)(c) crop residues that have forage value for livestock; and(4)(d) pastures. See Utah Code 23A-11-101- Custodial funeral service director: means a funeral service director who:
(4)(a) is employed by a licensed funeral establishment; and(4)(b) has custody of a dead body. See Utah Code 26B-8-101- Customer-generated electricity: means electricity that:
(2)(a) is generated by a customer generation system for a customer participating in a net metering program;(2)(b) exceeds the electricity the customer needs for the customer's own use; and(2)(c) is supplied to the electrical corporation administering the net metering program. See Utah Code 54-15-102- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Dangerous public health condition: means any of the following:
(2)(a) cholera;(2)(b) pneumonic plague;(2)(c) severe acute respiratory syndrome;(2)(d) smallpox;(2)(e) tuberculosis;(2)(f) any viral hemorrhagic fever;(2)(g) measles; or(2)(h) any infection:(2)(h)(i) that is new, drug resistant, or reemerging;(2)(h)(ii) that evidence suggests is likely to cause either high mortality or morbidity; and(2)(h)(iii) only if the relevant legislative body of the county where the infection is located approves as needing containment. See Utah Code 26B-7-301- Data supplier: means a health care facility, health care provider, self-funded employer, third-party payor, health maintenance organization, or government department which could reasonably be expected to provide health data under this part. See Utah Code 26B-8-501
- Database: means the statewide database maintained by the division under Section 26B-6-210. See Utah Code 26B-6-201
- Day: means calendar day. See Utah Code 57-26-102
- Day treatment: means specialized treatment that is provided to:
(12)(a) a client less than 24 hours a day; and(12)(b) four or more persons who:(12)(b)(i) are unrelated to the owner or provider; and(12)(b)(ii) have emotional, psychological, developmental, physical, or behavioral dysfunctions, impairments, or chemical dependencies. See Utah Code 26B-2-101- Dead body: means a human body or parts of a human body from the condition of which it reasonably may be concluded that death occurred. See Utah Code 26B-8-101
- Dead body: means the same as that term is defined in Section
26B-8-101 . See Utah Code 26B-8-201- Dead fetus: means a product of human conception, other than those circumstances described in Subsection 76-7-301(1):
(7)(a) of 20 weeks' gestation or more, calculated from the date the last normal menstrual period began to the date of delivery; and(7)(b) that was not born alive. See Utah Code 26B-8-101- Debt: means liability on a claim. See Utah Code 25-6-102
- Debtor: means a person that is liable on a claim. See Utah Code 25-6-102
- Decedent: A deceased person.
- Decedent: means the same as a dead body. See Utah Code 26B-8-101
- Decedent: means :
(4)(a) a deceased individual whose body or part is or may be the source of an anatomical gift; and(4)(b) includes:(4)(b)(i) a stillborn infant; and(4)(b)(ii) subject to restrictions imposed by law other than this part, a fetus. See Utah Code 26B-8-301- Declarant: means all persons who execute the declaration or on whose behalf the declaration is executed. See Utah Code 57-8-3
- Declarant father: means a male who claims to be the genetic father of a child, and, along with the biological mother, signs a voluntary declaration of paternity to establish the child's paternity. See Utah Code 26B-8-101
- Declaration: means the instrument by which the property is submitted to the provisions of this act, as it from time to time may be lawfully amended. See Utah Code 57-8-3
- Decontaminate: means to:
(2)(a) drain and dry non-treated water; and(2)(b) chemically or thermally treat in accordance with rule. See Utah Code 23A-10-101- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Defense attorney: Represent defendants in criminal matters.
- delinquency: means that child support in an amount at least equal to current child support payable for one month is overdue. See Utah Code 26B-9-301
- Delinquent: means delinquency. See Utah Code 26B-9-301 v2
- Delinquent on a child support obligation: means that a person:
(2)(a)(2)(a)(i) made no payment for 60 days on a current child support obligation as set forth in an administrative or court order;(2)(a)(ii) after the 60-day period described in Subsection (2)(a)(i), failed to make a good faith effort under the circumstances to make payment on the child support obligation in accordance with the order; and(2)(a)(iii) has not obtained a judicial order staying enforcement of the person's child support obligation, or the amount in arrears; or(2)(b)(2)(b)(i) made no payment for 60 days on an arrearage obligation of child support as set forth in:(2)(b)(i)(A) a payment schedule;(2)(b)(i)(B) a written agreement with the office; or(2)(b)(i)(C) an administrative or judicial order;(2)(b)(ii) after the 60-day period described in Subsection (2)(b)(i), failed to make a good faith effort under the circumstances to make payment on the child support obligation in accordance with the payment schedule, agreement, or order; and(2)(b)(iii) has not obtained a judicial order staying enforcement of the person's child support obligation, or the amount in arrears. See Utah Code 26B-9-501- Deliver: includes delivery by mail or another means of transmission authorized by Section 16-10a-103, except that delivery to the division means actual receipt by the division. See Utah Code 16-10a-102
- delivery: means the actual, constructive, or attempted transfer of a controlled substance or a listed chemical, whether or not an agency relationship exists. See Utah Code 58-37-2
- Delivery address: means the same as that term is defined in Section
4-41a-102 . See Utah Code 26B-4-201- Department: means the Department of Commerce. See Utah Code 58-37-2
- Department: means the Department of Natural Resources. See Utah Code 23A-1-101
- Department: means the Department of Transportation created in Section 72-1-201. See Utah Code 54-2-1
- Department: means the Department of Commerce. See Utah Code 58-1-102
- Department: means the Department of Health and Human Services created in Section
26B-1-201 . See Utah Code 26A-1-102- Department: means the Department of Health and Human Services. See Utah Code 26B-4-201
- Department contractor: means an individual who:
(13)(a) provides services under a contract with the department; and(13)(b) due to the contract with the department, has or will likely have direct access to a child or vulnerable adult. See Utah Code 26B-2-101- Department of Transportation: means the Department of Transportation created in Section 72-1-201. See Utah Code 57-12-3
- Dependency: means the same as that term is defined in Section
80-1-102 . See Utah Code 26B-1-501- Dependent: A person dependent for support upon another.
- Depose: means to make a written statement made under oath or affirmation. See Utah Code 68-3-12.5
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- Depredation: means an act causing damage or death. See Utah Code 23A-8-101
- Depredation mitigation plan: means the plan described in Subsection 23A-8-402(2). See Utah Code 23A-8-101
- Designated caregiver: means :
(16)(a) an individual:(16)(a)(i) whom an individual with a medical cannabis patient card or a medical cannabis guardian card designates as the patient's caregiver; and(16)(a)(ii) who registers with the department under Section26B-4-214 ; or(16)(b)(16)(b)(i) a facility that an individual designates as a designated caregiver in accordance with Subsection26B-4-214 (1)(b); or(16)(b)(ii) an assigned employee of the facility described in Subsection26B-4-214 (1)(b)(ii). See Utah Code 26B-4-201- Designated examiner: means :
(8)(a) a licensed physician, preferably a psychiatrist, who is designated by the division as specially qualified by training or experience in the diagnosis of mental or related illness; or(8)(b) a licensed mental health professional designated by the division as specially qualified by training and who has at least five years' continual experience in the treatment of mental illness. See Utah Code 26B-5-301- Designated facility: means :
(3)(a) a freestanding urgent care center;(3)(b) a general acute hospital; or(3)(c) a critical access hospital. See Utah Code 26B-4-501- Designee: means a physician who has responsibility for medical functions including admission and discharge, an employee of a local mental health authority, or an employee of a person that has contracted with a local mental health authority to provide mental health services under Section 17-43-304. See Utah Code 26B-5-301
- Deteriorating disease: includes :
(5)(a) multiple sclerosis;(5)(b) muscular dystrophy;(5)(c) Huntington's chorea;(5)(d) Alzheimer's disease;(5)(e) ataxia; or(5)(f) cancer. See Utah Code 26B-6-401- Developer: means a person that:
(10)(a) establishes, owns, offers, sells, or operates a timeshare development or camp resort; or(10)(b) engages one or more other persons to establish, own, offer, sell, or operate a timeshare development or camp resort on the person's behalf. See Utah Code 57-19-2- Development: includes :
(11)(b)(i) a single-site development; or(11)(b)(ii) a multiple-site development. See Utah Code 57-19-2- Developmental center: means the Utah State Developmental Center, established in accordance with Part 5, Utah State Developmental Center. See Utah Code 26B-6-401
- Devise: To gift property by will.
- Diagnostic information: means a clinical facility's record of individuals who present for treatment, including the reason for the visit, chief complaint, presenting diagnosis, final diagnosis, and any pertinent lab results. See Utah Code 26B-7-301
- Diagnostic mammography: means mammography performed on a woman having suspected breast cancer. See Utah Code 26B-2-601
- Dietetics: includes :
(3)(a) the evaluation of a person's dietary status;(3)(b) the advising and education of persons on dietary needs; and(3)(c) the evaluation of needs, implementation of systems to support needs, and maintenance of appropriate standards of quality in food and dietary service for individuals, groups, or patients in licensed institutional facilities or in private office settings. See Utah Code 58-49-2- Direct access: means that an individual has, or likely will have:
(14)(a) contact with or access to a child or vulnerable adult that provides the individual with an opportunity for personal communication or touch; or(14)(b) an opportunity to view medical, financial, or other confidential personal identifying information of the child, the child's parents or legal guardians, or the vulnerable adult. See Utah Code 26B-2-101- Direct labor: means work required for preparation, processing and packing, other than supervision, administration, inspection, or shipping. See Utah Code 55-5a-2
- Direct sales presentation: means an in-person, telephonic, or Internet-based communication that presents an offer to purchase an interest in a development to one or more prospective purchasers. See Utah Code 57-19-2
- Direct service worker: means a person who provides services to a person with a disability:
(8)(a) when the services are rendered in:(8)(a)(i) the physical presence of the person with a disability; or(8)(a)(ii) a location where the person rendering the services has access to the physical presence of the person with a disability; and(8)(b)(8)(b)(i) under a contract with the division;(8)(b)(ii) under a grant agreement with the division; or(8)(b)(iii) as an employee of the division. See Utah Code 26B-6-401- Directions of use: means recommended routes of administration for a medical cannabis treatment and suggested usage guidelines. See Utah Code 26B-4-201
- Directly supervised: means that an individual is being supervised under the uninterrupted visual and auditory surveillance of another individual who has a current background check approval issued by the office. See Utah Code 26B-2-101
- Director: means the director of the division. See Utah Code 57-19-2
- Director: means the director of the division or a designee. See Utah Code 57-21-2
- Director: means the director of the division appointed under Section
23A-2-202 . See Utah Code 23A-1-101- Director: means the director of the Division of Professional Licensing. See Utah Code 58-1-102
- Director: means the director appointed under Section
26B-5-103 . See Utah Code 26B-5-101- Director: means the director of the division. See Utah Code 26B-6-101
- Director: means the director of the office. See Utah Code 26B-2-101
- Director: means the director of the Division of Services for People with Disabilities. See Utah Code 26B-6-401
- Director: means the director of the Office of Recovery Services. See Utah Code 26B-9-101
- Director: means the director of the Office of Recovery Services. See Utah Code 26B-9-201
- Disability: means a physical or mental impairment that substantially limits one or more of a person's major life activities, including a person having a record of such an impairment or being regarded as having such an impairment. See Utah Code 57-21-2
- Disability: means a severe, chronic disability that:
(9)(a)(i) is attributable to:(9)(a)(i)(A) an intellectual disability;(9)(a)(i)(B) a condition that qualifies a person as a person with a related condition, as defined in Utah Code 26B-6-401- Disaster relief organization: means an entity that:
(1)(a) provides emergency or disaster relief services that include health or veterinary services provided by volunteer health practitioners;(1)(b) is designated or recognized as a provider of the services described in Subsection (1)(a) under a disaster response and recovery plan adopted by:(1)(b)(i) an agency of the federal government;(1)(b)(ii) the department; or(1)(b)(iii) a local health department; and(1)(c) regularly plans and conducts its activities in coordination with:(1)(c)(i) an agency of the federal government;(1)(c)(ii) the department; or(1)(c)(iii) a local health department. See Utah Code 26B-4-801- Discharges: means the number of total hospital discharges reported on:
(3)(a) Worksheet S-3 Part I, column 15, lines 14, 16, and 17 of the 2552-10 Medicare cost report for the applicable assessment year; or(3)(b) a similar report adopted by the department by administrative rule, if the report under Subsection (3)(a) is no longer available. See Utah Code 26B-3-501- Discharges: means the number of total hospital discharges reported on:
(3)(a) Worksheet S-3 Part I, column 15, lines 14, 16, and 17 of the 2552-10 Medicare cost report for the applicable assessment year; or(3)(b) a similar report adopted by the department by administrative rule, if the report under Subsection (3)(a) is no longer available. See Utah Code 26B-3-601- disclose: means the communication of health care data to any individual or organization outside the department, its staff, and contracting agencies. See Utah Code 26B-8-501
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Discriminate: includes segregate or separate. See Utah Code 57-21-2
- Discriminatory housing practice: means an act that is unlawful under this chapter. See Utah Code 57-21-2
- Disinterested witness: means :
(5)(a)(i) a witness other than the spouse, child, parent, sibling, grandchild, grandparent, or guardian of the individual who makes, amends, revokes, or refuses to make an anatomical gift; or(5)(a)(ii) another adult who exhibited special care and concern for the individual. See Utah Code 26B-8-301- Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
- Disorder: means the condition of decreased, absent, or impaired auditory, speech, voice, or language function. See Utah Code 58-41-2
- Dispense: means the delivery of a controlled substance by a pharmacist to an ultimate user pursuant to the lawful order or prescription of a practitioner, and includes distributing to, leaving with, giving away, or disposing of that substance as well as the packaging, labeling, or compounding necessary to prepare the substance for delivery. See Utah Code 58-37-2
- Dispense: means the same as that term is defined in Section
58-17b-102 . See Utah Code 26B-4-501- Dispenser: means a pharmacist who dispenses a controlled substance. See Utah Code 58-37-2
- Displaced person: means any person who, after the effective date of this chapter, moves from real property, or who moves the person's personal property from real property, or moves or discontinues the person's business or moves the person's dwelling as a result of the acquisition of the real property, in whole or in part, or as a result of a written order of the acquiring agency to vacate real property for a program of purchase undertaken by an agency or as a direct result of code enforcement activities or a program of rehabilitation of buildings conducted pursuant to a federal or state assisted program. See Utah Code 57-12-3
- Disposable earnings: means the same as that term is defined in Section 26B-9-101. See Utah Code 26B-9-201
- Disposal: means the abandonment, discharge, deposit, injection, dumping, spilling, leaking, or placing of hazardous or dangerous material into or on property, land, or water so that the material may enter the environment, be emitted into the air, or discharged into any waters, including groundwater. See Utah Code 58-37d-3
- Disposition: includes sale, lease, assignment, award by lottery, or any other transaction concerning a subdivision, if undertaken for gain or profit. See Utah Code 57-11-2
- Dispositioner: means :
(9)(a) a person designated in a written instrument, under Subsection 58-9-602(1), as having the right and duty to control the disposition of the decedent, if the person voluntarily acts as the dispositioner; or(9)(b) the next of kin of the decedent, if:(9)(b)(i)(9)(b)(i)(A) a person has not been designated as described in Subsection (9)(a); or(9)(b)(i)(B) the person described in Subsection (9)(a) is unable or unwilling to exercise the right and duty described in Subsection (9)(a); and(9)(b)(ii) the next of kin voluntarily acts as the dispositioner. See Utah Code 26B-8-101- Distribute: means to deliver other than by administering or dispensing a controlled substance or a listed chemical. See Utah Code 58-37-2
- Distribute: means the actual, constructive, or attempted sale, transfer, delivery, or dispensing to another of an imitation controlled substance. See Utah Code 58-37b-2
- Distribution: means the following by a corporation to or for the benefit of its shareholders in respect of any of the corporation's shares:
(13)(a)(i) a direct or indirect transfer of money or other property, other than a corporation's own shares; or(13)(a)(ii) incurrence of indebtedness by the corporation. See Utah Code 16-10a-102- Distribution electrical cooperative: includes an electrical corporation that:
(8)(a) is a cooperative;(8)(b) conducts a business that includes the retail distribution of electricity the cooperative purchases or generates for the cooperative's members; and(8)(c) is required to allocate or distribute savings in excess of additions to reserves and surplus on the basis of patronage to the cooperative's:(8)(c)(i) members; or(8)(c)(ii) patrons. See Utah Code 54-2-1- Distributor: means a person who distributes controlled substances. See Utah Code 58-37-2
- Diversion agreement: means a written agreement entered into by a licensee and the division that describes the requirements of the licensee's monitoring regimen and that was entered into before May 12, 2020. See Utah Code 58-4a-102
- Division: means the Division of Public Utilities established in Section 54-4a-1. See Utah Code 54-8b-2
- Division: means the Division of Real Estate created in Section
61-2-201 . See Utah Code 57-11-2- Division: means the Division of Real Estate of the Department of Commerce. See Utah Code 57-19-2
- Division: means the Division of Antidiscrimination and Labor established under the commission. See Utah Code 57-21-2
- Division: means the Division of Real Estate of the Department of Commerce. See Utah Code 57-23-2
- Division: means the Division of Professional Licensing created in Section

- Document: means every instrument in writing, including every conveyance, affecting, purporting to affect, describing, or otherwise concerning any right, title, or interest in real property, except wills and leases for a term not exceeding one year. See Utah Code 57-1-1
- Document: means information that is inscribed on a tangible medium or that is stored on an electronic or other medium and is retrievable in perceivable form. See Utah Code 57-26-102
- Document of gift: means a donor card or other record used to make an anatomical gift. See Utah Code 26B-8-301
- domestic corporation: means a corporation for profit that:
(11)(a) is not a foreign corporation; and(11)(b) is incorporated under or subject to this chapter. See Utah Code 16-10a-102- Domestic violence: means the same as that term is defined in Section
77-36-1 . See Utah Code 26B-2-101- Dominant estate: means an estate or interest in real property benefitted by an appurtenant easement. See Utah Code 57-13c-101
- Donor: The person who makes a gift.
- Donor: means an individual whose body or part is the subject of an anatomical gift. See Utah Code 26B-8-301
- Donor registry: means a database that contains records of anatomical gifts and amendments to or revocations of anatomical gifts. See Utah Code 26B-8-301
- Dosing guidelines: means a quantity range and frequency of administration for a recommended treatment of medical cannabis. See Utah Code 26B-4-201
- Down syndrome: means a genetic condition associated with an extra chromosome 21, in whole or in part, or an effective trisomy for chromosome 21. See Utah Code 26B-7-101
- Dreissena mussel: means a mussel of the genus Dreissena at any life stage, including a zebra mussel, a quagga mussel, and Conrad's false mussel. See Utah Code 23A-10-101
- Driver license: means a license or permit issued by the Driver License Division of the Department of Public Safety, to operate a vehicle, whether or not conditions are attached to the license or permit. See Utah Code 26B-8-301
- Driver license: means a license, as defined in Section 53-3-102. See Utah Code 26B-9-501
- Driver License Division: means the Driver License Division of the Department of Public Safety created in Section 53-3-103. See Utah Code 26B-9-501
- Drug: means :
(1)(r)(i)(A) a substance recognized in the official United States Pharmacopoeia, Official Homeopathic Pharmacopoeia of the United States, or Official National Formulary, or any supplement to any of them, intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in humans or animals;(1)(r)(i)(B) a substance that is required by any applicable federal or state law or rule to be dispensed by prescription only or is restricted to administration by practitioners only;(1)(r)(i)(C) a substance other than food intended to affect the structure or any function of the body of humans or other animals; and(1)(r)(i)(D) substances intended for use as a component of any substance specified in Subsections (1)(r)(i)(A), (B), and (C). See Utah Code 58-37-2- Drug paraphernalia: includes :
(2)(a) kits used, or intended for use, in planting, propagating, cultivating, growing, or harvesting any species of plant which is a controlled substance or from which a controlled substance can be derived;(2)(b) kits used, or intended for use, in manufacturing, compounding, converting, producing, processing, or preparing a controlled substance;(2)(c) isomerization devices used, or intended for use, to increase the potency of any species of plant which is a controlled substance;(2)(d) except as provided in Subsection (3), testing equipment used, or intended for use, to identify or to analyze the strength, effectiveness, or purity of a controlled substance;(2)(e) scales and balances used, or intended for use, in weighing or measuring a controlled substance;(2)(f) diluents and adulterants, such as quinine hydrochloride, mannitol, mannited, dextrose and lactose, used, or intended for use to cut a controlled substance;(2)(g) separation gins and sifters used, or intended for use to remove twigs, seeds, or other impurities from marihuana;(2)(h) blenders, bowls, containers, spoons and mixing devices used, or intended for use to compound a controlled substance;(2)(i) capsules, balloons, envelopes, and other containers used, or intended for use to package small quantities of a controlled substance;(2)(j) containers and other objects used, or intended for use to store or conceal a controlled substance;(2)(k) hypodermic syringes, needles, and other objects used, or intended for use to parenterally inject a controlled substance into the human body, except as provided in Section 58-37a-5; and(2)(l) objects used, or intended for use to ingest, inhale, or otherwise introduce a controlled substance into the human body, including but not limited to:(2)(l)(i) metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes with or without screens, permanent screens, hashish heads, or punctured metal bowls;(2)(l)(ii) water pipes;(2)(l)(iii) carburetion tubes and devices;(2)(l)(iv) smoking and carburetion masks;(2)(l)(v) roach clips: meaning objects used to hold burning material, such as a marihuana cigarette, that has become too small or too short to be held in the hand;(2)(l)(vi) miniature cocaine spoons and cocaine vials;(2)(l)(vii) chamber pipes;(2)(l)(viii) carburetor pipes;(2)(l)(ix) electric pipes;(2)(l)(x) air-driven pipes;(2)(l)(xi) chillums;(2)(l)(xii) bongs; and(2)(l)(xiii) ice pipes or chillers. See Utah Code 58-37a-3- Drug-disease contraindications: means that the therapeutic effect of a drug is adversely altered by the presence of another disease condition. See Utah Code 26B-3-301
- DUR: means the program designed to measure and assess, on a retrospective and prospective basis, the proper use of outpatient drugs in the Medicaid program. See Utah Code 26B-3-301
- Dwelling: means :
(14)(a) a building or structure, or a portion of a building or structure, occupied as, designed as, or intended for occupancy as a residence of one or more families; or(14)(b) vacant land that is offered for sale or lease for the construction or location of a dwelling as described in Subsection (14)(a). See Utah Code 57-21-2- Ear piercing: means the puncturing of the lobe of the ear with piercing equipment to insert stud-and-clasp jewelry according to the directions provided by the piercing equipment's manufacturer. See Utah Code 26B-7-401
- Easement: means a nonpossessory property interest that:
(5)(a) provides a right to enter, use, or enjoy real property owned by or in the possession of another; and(5)(b) imposes on the owner or possessor a duty not to interfere with the entry, use, or enjoyment permitted by the instrument creating the easement or, in the case of an easement not established by express grant or reservation, the entry, use, or enjoyment authorized by law. See Utah Code 57-13c-101- Easement holder: means :
(6)(a) in the case of an appurtenant easement, the dominant estate owner; or(6)(b) in the case of an easement in gross, a public-entity easement, a public-utility easement, a conservation easement, or a negative easement, the grantee of the easement or a successor. See Utah Code 57-13c-101- Easement in gross: means an easement not tied to, or dependent on, ownership or occupancy of a unit or a parcel of real property. See Utah Code 57-13c-101
- education: means a course of study for one or more grades from kindergarten through grade 12. See Utah Code 26B-2-101
- Elder adult: means a person 65 years old or older. See Utah Code 26B-2-101
- Elder adult: means an individual 65 years old or older. See Utah Code 26B-6-201
- Electric or communication facilities: means any works or improvements used or useful in providing electric or communication service, including poles, supports, tunnels, manholes, vaults, conduits, pipes, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers, insulators, cut-outs, switches, capacitors, meters, communication circuits, appliances, attachments and appurtenances. See Utah Code 54-8-3
- Electric plant: includes all real estate, fixtures, and personal property owned, controlled, operated, or managed in connection with or to facilitate the production, generation, transmission, delivery, or furnishing of electricity for light, heat, or power, and all conduits, ducts, or other devices, materials, apparatus, or property for containing, holding, or carrying conductors used or to be used for the transmission of electricity for light, heat, or power. See Utah Code 54-2-1
- Electrical corporation: means the same as that term is defined in Section
54-2-1 . See Utah Code 57-8-3- Electronic: means relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic, or similar capabilities. See Utah Code 25-6-102
- Electronic cigarette: means the same as that term is defined in Section 76-10-101. See Utah Code 26B-7-501
- Electronic cigarette product: means the same as that term is defined in Section 76-10-101. See Utah Code 26B-7-501
- Electronic cigarette substance: means the same as that term is defined in Section 76-10-101. See Utah Code 26B-7-501
- Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
- Electronic positive response system: means an automated information system, operated by the association, that allows excavators, locators, operators, and others to communicate the status of an excavation notice. See Utah Code 54-8a-2
- electronically transmitted: means a process of communication not directly involving the physical transfer of paper that is suitable for the receipt, retention, retrieval, and reproduction of information by the recipient, whether by e-mail, facsimile, or otherwise. See Utah Code 16-10a-102
- eligibility: means qualification, based on criteria established by the division, to receive services that are administered by the division. See Utah Code 26B-6-401
- Eligible customer: means a person who:
(11)(a) on December 31, 2013:(11)(a)(i) was a customer of a public utility that, on December 31, 2013, had more than 200,000 retail customers in this state; and(11)(a)(ii) owned an electric plant that is an electric generation plant that, on December 31, 2013, had a generation name plate capacity of greater than 150 megawatts; and(11)(b) produces electricity:(11)(b)(i) from a qualifying power production facility for sale to a public utility in this state;(11)(b)(ii) primarily for the eligible customer's own use; or(11)(b)(iii) for the use of the eligible customer's tenant or affiliate. See Utah Code 54-2-1- Eligible facility: means a facility that uses energy derived from one of the following to generate electricity:
(4)(a) solar photovoltaic and solar thermal energy;(4)(b) wind energy;(4)(c) hydrogen;(4)(d) organic waste;(4)(e) hydroelectric energy;(4)(f) waste gas and waste heat capture or recovery;(4)(g) biomass and biomass byproducts, except for the combustion of:(4)(g)(i) wood that has been treated with chemical preservatives such as creosote, pentachlorophenol, or chromated copper arsenate; or(4)(g)(ii) municipal waste in a solid form;(4)(h) forest or rangeland woody debris from harvesting or thinning conducted to improve forest or rangeland ecological health and to reduce wildfire risk;(4)(i) agricultural residues;(4)(j) dedicated energy crops;(4)(k) landfill gas or biogas produced from organic matter, wastewater, anaerobic digesters, or municipal solid waste; or(4)(l) geothermal energy. - Emergency: means an occurrence or suspected natural gas leak necessitating immediate action to prevent or mitigate loss of, or damage to, life, health, property, or essential public services. See Utah Code 54-8a-2
- Emergency: means :
(2)(a) a state of emergency declared by:(2)(a)(i) the president of the United States;(2)(a)(ii) the governor in accordance with
