- Actively engaged in farming: means the designated person is personally involved in the production of crops and livestock on the eligible tract on a regular, continuous, and substantial basis. See Iowa Code 425A.2

- Aerobic structure: means an animal feeding operation structure other than an egg washwater storage structure which employs bacterial action which is maintained by the utilization of air or oxygen and which includes aeration equipment. See Iowa Code 459.102
- Affected area: means any real property affected, suspected of being affected, or modeled to be likely affected by a release occurring at an enrolled site. See Iowa Code 455H.103
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Affiliate: means a corporate parent, subsidiary, or predecessor of a participant, a co-owner or cooperator of a participant, a spouse, parent, or child of a participant, an affiliated corporation or enterprise of a participant, or any other person substantially involved in the legal affairs or management of a participant, as defined by the department. See Iowa Code 455H.103
- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- Agency: means the department of natural resources created by section 455A. See Iowa Code 455I.2

- Agricultural drainage well: means a vertical opening to an aquifer or permeable substratum which is constructed by any means including but not limited to drilling, driving, digging, boring, augering, jetting, washing, or coring, and which is capable of intercepting or receiving surface or subsurface drainage water from land directly or by a drainage system. See Iowa Code 460.101

- Agricultural land: means land in tracts of ten acres or more excluding any buildings or other structures located on the land, and not laid off into lots of less than ten acres or divided by streets and alleys into parcels of less than ten acres, lying within a school corporation and in good faith used for agricultural or horticultural purposes. - All-terrain vehicle: means a motorized vehicle with not less than three and not more than six nonhighway tires that is limited in engine displacement to less than one thousand cubic centimeters and in total dry weight to less than one thousand two hundred pounds and that has a seat or saddle designed to be straddled by the operator and handlebars for steering control. - All-terrain vehicle: means a motor vehicle designed to travel on three or more wheels and designed primarily for off-road recreational use but not including farm tractors or equipment, construction equipment, forestry vehicles, or lawn and grounds maintenance vehicles. See Iowa Code 322D.1
- Allegation: something that someone says happened.
- Alluvial aquifer area: means an area underlaid by sand or gravel aquifers situated beneath floodplains along stream valleys and includes alluvial deposits associated with stream terraces and benches, contiguous wind-blown sand deposits, and glacial outwash deposits. See Iowa Code 459B.102
- Alternative drainage system: means a drainage system constructed as part of a drainage district in order to drain surface or subsurface water from land due to the closing of an agricultural drainage well. See Iowa Code 460.101
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.

- Anaerobic lagoon: means an unformed manure storage structure, if the primary function of the structure is to store and stabilize manure, the structure is designed to receive manure on a regular basis, and the structure's design waste loading rates provide that the predominant biological activity is anaerobic. See Iowa Code 459.102

- Animal: means cattle, swine, horses, sheep, chickens, turkeys, or fish. See Iowa Code 459.102

- Animal feeding operation: means a lot, yard, corral, building, or other area in which animals are confined and fed and maintained for forty-five days or more in any twelve-month period, and all structures used for the storage of manure from animals in the operation. See Iowa Code 459.102
- Animal feeding operation structure: means a confinement building, manure storage structure, dry bedded confinement feeding operation structure as defined in section 459B. See Iowa Code 459.102
- Animal unit: means a unit of measurement based upon the product of multiplying the number of animals of each category by a special equivalency factor as follows:a. See Iowa Code 459.102

- Animal unit capacity: means a measurement used to determine the maximum number of animal units that may be maintained as part of an animal feeding operation at any one time, including as provided in sections 459. See Iowa Code 459.102
- Animal unit capacity: means the maximum number of animal units which the owner or operator confines in a dry bedded confinement feeding operation at any one time. See Iowa Code 459B.102
- Animal weight capacity: means the product of multiplying the maximum number of animals which the owner or operator confines in an animal feeding operation at any one time by the average weight during a production cycle. See Iowa Code 459.102
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- Applicant: means a person authorized to regularly lend moneys to be secured by a mortgage on real property in this state, a licensed real estate broker, a licensed attorney, a participating abstractor, or a licensed closing agent. See Iowa Code 16.92
- Appraisal: A determination of property value.
- Apprenticeship program: means a program registered and certified with the United States secretary of labor under section 1 of the National Apprenticeship Act, 29 U. See Iowa Code 422.7
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Aquaculture: means the controlled propagation, growth, and harvest of aquatic organisms, including, but not limited to fish, amphibians, reptiles, mollusks, crustaceans, gastropods, algae, and other aquatic plants, by an aquaculturist. See Iowa Code 481A.1
- Aquaculture unit: means all private waters for aquaculture with or without buildings, used for the purpose of propagating, raising, holding, or harvesting aquatic organisms for commercial purposes. See Iowa Code 481A.1
- Aquaculturist: means an individual involved in producing, transporting, or marketing aquatic products from private waters for commercial purposes. See Iowa Code 481A.1
- Aquatic invasive species: means a nonnative wildlife or plant species that has been determined by the department to pose a significant threat to the aquatic resources or water infrastructure of the state. See Iowa Code 456A.37
- Aquatic plant: means a submergent, emergent, floating, or floating-leaved plant, including algae, and includes any part of such a plant. See Iowa Code 456A.37
- Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
- Arrest: Taking physical custody of a person by lawful authority.
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- at retail: means to sell a towable recreational vehicle to a person who will devote it to a consumer use. See Iowa Code 322C.2

- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Audited partnership: means a partnership subject to a final federal partnership adjustment resulting from a partnership level audit. See Iowa Code 422.25A

- Background levels: means concentrations of hazardous substances naturally occurring and generally present in the environment in the vicinity of an enrolled site or an affected area and not the result of releases. See Iowa Code 455H.103
- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Bailiff: a court officer who enforces the rules of behavior in courtrooms.
- Bait: means the same as defined in section 481A. See Iowa Code 456A.37
- Bait: includes but is not limited to minnows, green sunfish, orange-spotted sunfish, gizzard shad, frogs, crayfish, and salamanders. See Iowa Code 481A.1
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
- Base year: means the calendar year last ending before the claim is filed. See Iowa Code 425.17
- Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
- Basic levy: means a levy authorized and limited by section 331. See Iowa Code 331.421
- Bedding: means crop, vegetation, or forage residue or similar materials placed in a dry bedded confinement building for the care of animals. See Iowa Code 459B.102
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Bequest: Property gifted by will.
- Biological balance: means that condition when the number of animals present over the long term is at or near the number of animals of a particular species that the available habitat is capable of supporting. See Iowa Code 481A.1
- Bird: means a member of the class Aves. See Iowa Code 481A.1
- Board: shall mean the state board of regents. See Iowa Code 262A.2

- Board: means the board of supervisors of a county. See Iowa Code 331.101

- Bonds: shall mean revenue bonds which are payable solely and only from student fees and charges and institutional income received by the institution at which the project is being undertaken. See Iowa Code 262A.2
- Bonds or notes: shall mean revenue bonds or revenue notes which are payable solely and only from hospital income. See Iowa Code 263A.1
- Borrower: means a student attending a covered institution in this state, or a parent or person in parental relation to such student, who obtains an educational loan from a lending institution to pay for or finance a student's higher education expenses. See Iowa Code 261F.1
- building: means a building used in conjunction with a confinement feeding operation to house animals and in which any manure from the animals is stored as dry bedded manure. See Iowa Code 459B.102
- Buildings and facilities: shall mean those academic buildings and other facilities used primarily for instructional and research purposes, including libraries, and such other administrative and service buildings and facilities as are deemed necessary by the board to provide supporting services to the instructional and research programs and activities of the institutions, including, without limiting the generality of the foregoing, administrative offices, facilities for business services, auditoriums and concert halls, student services and extension and continuing education services, off-street parking areas and structures incidental to other buildings and facilities which are not primarily for parking purposes, garages, and storage and warehouse facilities, or any combination thereof. See Iowa Code 262A.2
- Buildings and facilities: shall mean buildings to be used primarily for service, clinical instructional and clinical research purposes in the field of medicine with particular emphasis on the family practice of medicine and such other facilities as are deemed necessary by the board to support and carry out the service, instructional, and research objectives of the hospitals, medical clinics, and medical service laboratories of the institution, including, without limiting the generality of the foregoing, hospital buildings, clinic buildings, laboratory buildings, clinical staff facilities, building for housing interns, resident physicians and nurses, and medical record and film storage buildings, or any combination thereof. See Iowa Code 263A.1
- Business: means any trade, occupation, activity, or enterprise engaged in for the purpose of selling or distributing tobacco products in this state. See Iowa Code 453A.42
- Business entity: means a corporation, sole proprietorship, association, partnership, limited liability company, limited liability partnership, or other legal entity, that is formed for the purpose of making a profit. See Iowa Code 321O.1
- Buy: means to purchase, offer to purchase, barter for, trade for, or lease. See Iowa Code 481A.1
- buyer: means a person who buys a motor vehicle from a retail seller. See Iowa Code 322.2
- Campus community: means students, administrators, faculty, and staff at a public institution of higher education and guests invited to a public institution of higher education by the institution's students, administrators, faculty, or staff. See Iowa Code 261H.1
- Capital stock: means common or preferred stock, either voting or nonvoting. See Iowa Code 422.7
- Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
- Cemetery: means a space held for the purpose of permanent burial, entombment, or interment of human remains that is owned or managed by a political subdivision or private entity, or a cemetery regulated pursuant to chapter 523I. See Iowa Code 459.102
- Certificate: means a certificate of title. See Iowa Code 462A.2
- Certificate: means a certificate of public convenience, use and necessity issued pursuant to section 476A. See Iowa Code 476A.1
- Certificate of noncompliance: means a document provided by the unit certifying that the named person has outstanding liability placed with the unit and has not entered into an approved payment plan to pay the liability. See Iowa Code 272D.1
- Charge: means any consideration, the admission price or fee asked in return for invitation or permission to enter or go upon the land. See Iowa Code 461C.2
- Charter: means the form of government selected by a city as provided in chapter 372. See Iowa Code 362.2
- Charter: means a formal document establishing the functions, powers, organization, structure, privileges, rights, and duties of county government not inconsistent with state law. See Iowa Code 331.101
- Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
- Child: includes child by adoption. See Iowa Code 4.1
- Claimant: means any of the following:
(1) A person filing a claim for credit under this subchapter who has attained the age of sixty-five years but who has not attained the age of seventy years on or before December 31 of the base year, a person filing a claim for credit or reimbursement under this subchapter who is totally disabled and was totally disabled on or before December 31 of the base year, or a person filing a claim for reimbursement under this subchapter who has attained the age of sixty-five years on or before December 31 of the base year and who is domiciled in this state at the time the claim is filed or at the time of the person's death in the case of a claim filed by the executor or administrator of the claimant's estate. - Commercial manure service: means a sole proprietor or business association as defined in section 202B. See Iowa Code 459.102

- Community: means a towable recreational vehicle dealer's area of responsibility as stipulated in the manufacturer-dealer agreement. See Iowa Code 322C.2
- Community: means the franchisee's area of responsibility as stipulated in the franchise. See Iowa Code 322A.1
- Company: includes a city that owns or operates a municipal utility providing local exchange services pursuant to chapter 476. See Iowa Code 433.12

- Competitive bidding procedure: means the advertisement for, solicitation of, or the procurement of bids; the manner and condition in which bids are received; and the procedure by which bids are opened, accessed, accepted, rejected, or awarded. See Iowa Code 8A.301

- Confinement site manure applicator: means a person, other than a commercial manure service or a commercial manure service representative, who applies manure on land if the manure originates from a manure storage structure. See Iowa Code 459.102
- Conservation easement: means an easement as defined in section 457A. See Iowa Code 462B.1
- Consumer: means the purchaser or lessee, other than for purposes of lease or resale, of a new or previously untitled motor vehicle, or any other person entitled by the terms of the warranty to enforce the obligations of the warranty during the duration of the lemon law rights period. See Iowa Code 322G.2
- Consumer: means any person who has title to or possession of tobacco products in storage, for use or other consumption in this state. See Iowa Code 453A.42
- Consumer: means the purchaser or lessee, other than for purposes of lease or resale, of a new or previously untitled motor vehicle, or any other person entitled by the terms of the warranty to enforce the obligations of the warranty during the duration of the lemon law rights period. - County special assessment district: means the area of a county outside of cities within boundaries established by the board of supervisors for the purpose of assessment of the cost of a public improvement. See Iowa Code 331.485
- Course of instruction: means a postsecondary educational program that a school offers through in-person instruction, distance delivery, correspondence study methods, or any combination thereof. See Iowa Code 261B.2
- Covered: means organic or inorganic material placed upon an animal feeding operation structure used to store manure as provided by rules adopted by the department after receiving recommendations which shall be submitted to the department by the college of agriculture and life sciences at Iowa state university of science and technology. See Iowa Code 459.102
- Covered institution: includes an authorized agent of the educational institution, including an alumni association, booster club, or other organization directly or indirectly associated with or authorized by the institution or an employee of the institution. See Iowa Code 261F.1
- Covered institution employee: means any employee, agent, contract employee, director, officer, or trustee of a covered institution. See Iowa Code 261F.1
- Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
- cumulative inflation factor: means the product of the annual inflation factor for the 2018 calendar year and all annual inflation factors for subsequent calendar years as determined by section 422. See Iowa Code 422.7
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Days: means calendar days. See Iowa Code 322G.2

- Dealer: means a person who engages in whole or in part in the business of buying, selling, or exchanging vessels either outright or on conditional sale, bailment, lease, security interest, or otherwise, and who has an established place of business for sale, trade, and display of vessels. - dealer: means a person required to be licensed under this chapter who is authorized to sell and service towable recreational vehicles. See Iowa Code 322C.2
- dealership: means a person engaged in the retail sale of equipment. See Iowa Code 322F.1
- Dealership agreement: means an oral or written agreement, either express or implied, between a supplier and a dealer which provides that the dealer is granted the right to sell, distribute, or service the supplier's equipment, regardless of whether the equipment carries a trade name, trademark, service mark, logotype, advertisement, or other commercial symbol, and which provides evidence of a continuing commercial relationship between the supplier and the dealer. See Iowa Code 322F.1
- Debt service: means expenditures for servicing the county's debt. See Iowa Code 331.421
- Debt service levy: means a levy authorized and limited by section 331. See Iowa Code 331.421
- Decedent: A deceased person.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- deed: is a pplied to an instrument conveying lands, but does not imply a sealed instrument; and the words "bond" and "indenture" do not necessarily imply a seal, and the word "undertaking" means a promise or security in any form. See Iowa Code 4.1
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Degree: means a postsecondary credential conferring on the recipient the title of associate, bachelor, master, or doctor, or an equivalent title, signifying educational attainment based on study which may be supplemented by experience or achievement testing. See Iowa Code 261B.2
- Department: means the state department of transportation. See Iowa Code 321H.2
- Department: means the department of natural resources. See Iowa Code 462A.2

- Descendent: One who is directly descended from another such as a child, grandchild, or great grandchild.
- Designated agricultural drainage well area: means an agricultural drainage well area in which there is located an anaerobic lagoon or earthen manure storage basin required to obtain a construction permit by the department of natural resources. See Iowa Code 460.101
- Designated area: means a known sinkhole, a cistern, an abandoned well, an unplugged agricultural drainage well, an agricultural drainage well surface inlet, a drinking water well, a designated wetland, or a water source. See Iowa Code 459.102
- Designated area: means the same as defined in section 459A. See Iowa Code 459B.102
- Designated person: means one of the following:

- Digitized photolicensing equipment: means the machines and related materials, obtained pursuant to contract, the use of which results in the on-site production of driver's licenses and nonoperator's identification cards. See Iowa Code 321M.1
- Direct partner: means a person that holds an interest directly in a partnership or pass-through entity. See Iowa Code 422.25A

- Distributor: means a person, resident or nonresident, who sells or distributes all-terrain vehicles to all-terrain vehicle dealers in this state or who maintains distributor representatives. See Iowa Code 321I.1
- Distributor: means any and each of the following:

- Docket: A log containing brief entries of court proceedings.
- Document: means any form required to be processed by the department under this chapter regulating animal feeding operations, including but not limited to applications or related materials for permits as provided in section 459. See Iowa Code 459.102
- dominant in its field of operation: means having more than twenty full-time equivalent positions and more than three million dollars in annual gross revenues, and "affiliate or subsidiary of a business dominant in its field of operation" means a business which is at least twenty percent owned by a business dominant in its field of operation, or by partners, officers, directors, majority stockholders, or their equivalents, of a business dominant in that field of operation. - Donee: The recipient of a gift.
- Donor: The person who makes a gift.
- Drainage district: means a drainage district established pursuant to chapter 468. See Iowa Code 460.101
- Drainage system: means tile lines, laterals, surface inlets, or other improvements which are constructed to facilitate the drainage of land. See Iowa Code 460.101
- Driver: means a person who operates a motor vehicle for the transportation of railroad workers in the motor vehicle on behalf of a railroad worker transportation company, whether the person is employed by the company for wages or drives for the company as an independent contractor. See Iowa Code 327F.39
- driver: means an individual who does all of the following:
a. See Iowa Code 321N.1- Dry bedded confinement feeding operation: means a confinement feeding operation in which animals are confined to areas which are totally roofed and in which all manure is stored as dry bedded manure. See Iowa Code 459B.102
- Dry bedded confinement feeding operation structure: means a dry bedded manure confinement feeding operation building or a dry bedded manure storage structure. See Iowa Code 459B.102
- Dry bedded manure: means manure from animals that meets all of the following requirements:
a. See Iowa Code 459B.102- Dry bedded manure storage structure: means a covered or uncovered structure, other than a building, used to store dry bedded manure originating from a confinement feeding operation. See Iowa Code 459B.102
- Dry manure: means manure which meets all of the following conditions:
a. See Iowa Code 459.102- Earthen manure storage basin: means an earthen cavity, either covered or uncovered, which, on a regular basis, receives waste discharges from a confinement feeding operation if accumulated wastes from the basin are completely removed at least once each year. See Iowa Code 459.102
- Earthen storage structure: means an earthen cavity, either covered or uncovered, including but not limited to an anaerobic lagoon or earthen manure storage basin which is used to store manure, sewage, wastewater, industrial waste, or other waste as regulated by the department of natural resources, if stored in a liquid or semiliquid state. See Iowa Code 460.101
- Educational institution: means a building in which an organized course of study or training is offered to students enrolled in kindergarten through grade twelve and served by local school districts, accredited or approved nonpublic schools, area education agencies, community colleges, institutions of higher education under the control of the state board of regents, and accredited independent colleges and universities. See Iowa Code 459.102
- Educational institution: means the same as defined in section 459. See Iowa Code 459B.102
- Educational loan: means any loan that is made, insured, or guaranteed under Tit. See Iowa Code 261F.1
- Egg washwater storage structure: means an aerobic or anaerobic structure used to store the wastewater resulting from the washing and in-shell packaging of eggs. See Iowa Code 459.102
- Electric cooperative: means an electric utility provider formed or organized as an electric cooperative under the laws of this state or elsewhere. See Iowa Code 437.1
- Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
- Elementary or secondary school: means all of the following:
(i) An elementary or secondary school in this state which is accredited under section 256. See Iowa Code 422.7- Eligible elector: means the same as it is defined in section 39. See Iowa Code 362.2
- Eligible individual: means an individual who is disabled or who is fifty-five years of age or older at the time the election is made, who no longer materially participates in a farming business at the time the election is made, and who, as an owner-lessor, is party to a farm tenancy agreement. - Eligible postsecondary institution: means an institution of higher learning under the control of the state board of regents, a community college established under chapter 260C, or an accredited private institution as defined in section 256. See Iowa Code 261E.2

- Emergency medical services personnel member: means an emergency medical care provider, as defined in section 147A. See Iowa Code 422.12
- Employee-owner: means an individual who owns capital stock in a qualified corporation for at least ten years, which capital stock was acquired by the individual while employed and on account of employment by such corporation for at least ten cumulative years. See Iowa Code 422.7
- Endangered species: means any species of fish, plant life, or wildlife which is in danger of extinction throughout all or a significant part of its range. See Iowa Code 481B.1
- Engaged in the business: means doing any of the following acts for the purpose of the sale of motor vehicles at retail: acquiring, selling, exchanging, holding, offering, displaying, brokering, accepting on consignment, conducting a retail auction, advertising as being engaged in any of those acts, or acting as an agent for the purpose of doing any of those acts. See Iowa Code 322.2
- Engineering standards: means standards adopted by the American national standards institute, or the institute of electrical and electronics engineers, rural utilities service, or comparable engineering organization or engineering standards adopted by the board. See Iowa Code 476.1A
- Enrolled site: means any property which has been or is suspected to be the site of or affected by a release and which has been enrolled pursuant to this chapter by a participant. See Iowa Code 455H.103
- Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
- Environmental audit: means a voluntary evaluation of a facility or operation, of an activity at a facility or operation, or of an environmental management system at a facility or operation when the facility, operation, or activity is regulated under state or federal environmental laws, rules, or permit conditions, conducted by an owner or operator, an employee of the owner or operator, or an independent contractor retained by the owner or operator that is designed to identify historical or current noncompliance with environmental laws, rules, ordinances, or permit conditions, discover environmental contamination or hazards, remedy noncompliance or improve compliance with environmental laws, or improve an environmental management system. See Iowa Code 455K.2
- environmental audit report: includes supporting information which may include, but is not limited to, the report document itself, observations, samples, analytical results, exhibits, findings, opinions, suggestions, recommendations, conclusions, drafts, memoranda, drawings, photographs, computer-generated or electronically recorded information, maps, charts, graphs, surveys, implementation plans, interviews, discussions, correspondence, and communications related to the environmental audit. See Iowa Code 455K.2
- Environmental claim: means a civil action for damages for environmental harm and includes a civil action under this chapter for recovery of the costs of conducting a response action, but does not include a civil action for damages for a breach of contract or another agreement between persons or for a breach of a warranty that exists pursuant to the Code or common law of this state. See Iowa Code 455H.304
- Environmental covenant: means a servitude arising under an environmental response project that imposes activity and use limitations as defined in section 455I. See Iowa Code 455H.103

- Environmental harm: means injury, death, loss, or threatened loss to a person or property caused by exposure to or the release of a hazardous substance. See Iowa Code 455H.304
- Environmental response project: means a plan or work performed for environmental remediation or flood control affecting real property and conducted under or by one of the following:
a. See Iowa Code 455I.2- Equipment: means agricultural equipment, construction equipment, industrial equipment, utility equipment, or outdoor power equipment. See Iowa Code 322F.1
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. - Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
- Escrow: Money given to a third party to be held for payment until certain conditions are met.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Ex officio: Literally, by virtue of one's office.
- Executor: A male person named in a will to carry out the decedent
- executor: includes administrator, and the term "administrator" includes executor, where the subject matter justifies such use. See Iowa Code 4.1
- Exempt partner: means a partner that is exempt from taxation pursuant to section 422. See Iowa Code 422.25A

- Extension: means a place of business of an authorized vehicle recycler other than the principal place of business within the county of the principal place of business. See Iowa Code 321H.2
- Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
- Facility: means any electric power generating plant or a combination of plants at a single site, owned by any person, with a total capacity of twenty-five megawatts of electricity or more and those associated transmission lines connecting the generating plant to either a power transmission system or an interconnected primary transmission system or both. - Factory branch: means a branch office maintained by a person who manufactures or assembles motor vehicles, for the sale of motor vehicles to distributors, or for the sale of motor vehicles to motor vehicle dealers or for directing or supervising in whole or part, its representatives. See Iowa Code 322.2
- Factory campaign: means an effort by or on behalf of a warrantor to contact towable recreational vehicle dealers or owners to address an equipment or part issue. See Iowa Code 322C.2
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- Family member: means a person related to another person as parent, grandparent, child, grandchild, sibling, or a spouse of such a related person. See Iowa Code 459.102
- Family member: means a spouse, child, grandchild, parent, sibling, niece, or nephew, or the spouse of a child, grandchild, parent, sibling, niece, or nephew. See Iowa Code 322C.2
- Farm deer: means the same as defined in section 170. See Iowa Code 481A.1
- Farm implement: means a machine designed or adapted and used exclusively for agricultural or horticultural operations or livestock raising. See Iowa Code 322D.1
- Farm pond: means a body of water wholly on the lands of a single owner, or a group of joint owners, which does not have any connection with any public waters and which is less than ten surface acres. See Iowa Code 462A.2
- farm tenancy agreement: includes cash leases, crop share leases, or livestock share leases. See Iowa Code 422.7
- Farming business: means the production, care, growing, harvesting, preservation, handling, or storage of crops or forest or fruit trees; the production, care, feeding, management, and housing of livestock; or horticulture, all for intended profit. See Iowa Code 422.7
- Federal adjustments report: means the same as defined in section 422. See Iowa Code 422.25A

- Fiduciary: A trustee, executor, or administrator.
- Field: means the general area underlaid by one or more pools. See Iowa Code 458A.2
- Fifth-wheel travel trailer: includes a toy-hauler fifth-wheel travel trailer. See Iowa Code 322C.2
- Final determination date: means any one of the following dates:
(1) In the case of a federal partnership adjustment that arises from a partnership level audit, the first day on which no federal adjustments arising from that audit remain to be finally determined, whether by internal revenue service decision with respect to which all rights of appeal have been waived or exhausted, by agreement, or, if appealed or contested, by a final decision with respect to which all rights of appeal have been waived or exhausted. - Financial institution: means any bank, trust company, savings association, insurance company or related corporation, partnership, foundation or other institution licensed to do business in the state of Iowa and engaged primarily in lending or investing funds. See Iowa Code 496B.2
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.

- Folding camping trailer: means a vehicle mounted on wheels and constructed with collapsible side walls designed to be folded when towed by a motor vehicle and unfolded to provide temporary living quarters for recreational, camping, or travel use. See Iowa Code 322C.2

- Forbearance: A means of handling a delinquent loan. A

- Formed manure storage structure: means a covered or uncovered impoundment used to store manure from an animal feeding operation, which has walls and a floor constructed of concrete, concrete block, wood, steel, or similar materials. See Iowa Code 459.102
- Franchise: includes a separate written agreement between the franchisee and the franchiser which materially affects the franchise, whether entered into prior to the date of the franchise, contemporaneously with the franchise, or subsequent to the date of the franchise. See Iowa Code 322A.1
- Franchise: means a contract between two or more persons when all of the following conditions are included:
a. See Iowa Code 322D.1- Franchisee: means a person who receives motor vehicles from the franchiser under a franchise and who offers and sells such motor vehicles to the general public. See Iowa Code 322A.1
- Franchisee: means a person who receives farm implements, motorcycles, autocycles, all-terrain vehicles, snowmobiles, or related parts or attachments from the franchiser under a franchise and who offers and sells the farm implements, motorcycles, autocycles, all-terrain vehicles, snowmobiles, or related parts or attachments to the general public. See Iowa Code 322D.1
- Franchiser: means a person who manufactures or distributes motor vehicles and who may enter into a franchise as hereinafter defined. See Iowa Code 322A.1
- Franchiser: means a person who manufactures, wholesales, or distributes farm implements, motorcycles, autocycles, all-terrain vehicles, snowmobiles, or related parts or attachments, and who enters into a franchise. See Iowa Code 322D.1
- Fraud: Intentional deception resulting in injury to another.
- Frog: means a member of the order Anura. See Iowa Code 481A.1
- Frozen ground: means soil that is impenetrable due to frozen soil moisture but does not include soil that is only frozen to a depth of two inches or less. See Iowa Code 459.102
- Fur-bearing animals: means the following which are declared to be fur-bearing animals for the purpose of regulation and protection under the Code: beaver, badger, mink, otter, muskrat, raccoon, skunk, opossum, spotted skunk or civet cat, weasel, coyote, bobcat, wolf, groundhog, red fox, and gray fox. See Iowa Code 481A.1
- Game: means all of the animals specified in this subsection except those designated as not protected, and includes the heads, skins, and any other parts, and the nests and eggs of birds and their plumage. See Iowa Code 481A.1
- Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
- Gas: means and includes all natural gas and all other fluid hydrocarbons which are produced at the wellhead and not defined in this section as oil. See Iowa Code 458A.2
- General county services: means the services which are primarily intended to benefit all residents of a county, including secondary road services, but excluding services financed by other statutory funds. See Iowa Code 331.421
- Germane: On the subject of the pending bill or other business; a strict standard of relevance.
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Gift: includes a gift of services, transportation, lodging, or meals, whether provided in kind, by purchase of a ticket, payment in advance, or reimbursement after the expense has been incurred. See Iowa Code 261F.1
- Good cause: means a condition which occurs under any of the following circumstances:
a. See Iowa Code 322F.1- Governmental body: means the United States of America or an agency thereof, a state, a political subdivision of a state, a school corporation, a public authority, a public district, or any other public body. See Iowa Code 362.2
- Governmental entity: means any unit of government in the executive, legislative, or judicial branch of government; an agency or political subdivision; any unit of another state government, including its political subdivisions; any unit of the United States government; or any association or other organization whose membership consists primarily of one or more of any of the foregoing. See Iowa Code 8A.101
- Governmental subdivision: means a county, city, school district, or combination thereof. See Iowa Code 8A.101
- Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
- Grantor: The person who establishes a trust and places property into it.
- Grantor: means any person with sufficient fee title or other property ownership interests necessary to create a valid environmental covenant under Iowa law. See Iowa Code 455I.2
- Grassed waterway: means the same as defined in section 459A. See Iowa Code 459B.102
- Gross estate: The total fair market value of all property and property interests, real and personal, tangible and intangible, of which a decedent had beneficial ownership at the time of death before subtractions for deductions, debts, administrative expenses, and casualty losses suffered during estate administration.
- Gross rent: means rental paid at arm's length for the right of occupancy of a homestead or manufactured or mobile home, including rent for space occupied by a manufactured or mobile home not to exceed one acre. See Iowa Code 425.17
- Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
- Hazardous liquid: means crude oil, refined petroleum products, liquefied petroleum gases, anhydrous ammonia, liquid fertilizers, liquefied carbon dioxide, alcohols, and coal slurries. See Iowa Code 479B.2
- Hearsay: Statements by a witness who did not see or hear the incident in question but heard about it from someone else. Hearsay is usually not admissible as evidence in court.
- High-quality water resource: means that part of a water source or wetland that the department has designated as any of the following:
a. See Iowa Code 459.102- High-quality water resource: means the same as defined in section 459. See Iowa Code 459B.102
- highway: means the entire width between property lines of every way or place of whatever nature when any part thereof is open to the use of the public, as a matter of right, for purposes of vehicular travel, except in public areas in which the boundary shall be thirty-three feet each side of the center line of the roadway. See Iowa Code 321I.1
- Holder: means the grantee of an environmental covenant as specified in section 455I. See Iowa Code 455I.2
- Holder: means the possessor of a fee interest, a tenant, lessee, occupant or person in control of the premises; provided, however, holder shall not mean the state of Iowa, its political subdivisions, or any public body or any agencies, departments, boards, or commissions thereof. See Iowa Code 461C.2
- Homestead: means the dwelling owned or rented and actually used as a home by the claimant during the period specified in subsection 2, and so much of the land surrounding it including one or more contiguous lots or tracts of land, as is reasonably necessary for use of the dwelling as a home, and may consist of a part of a multidwelling or multipurpose building and a part of the land upon which it is built. See Iowa Code 425.17
- Hospital income: shall mean the income and funds received by the hospitals, medical service clinics, and medical service laboratories of the state university of Iowa, including the proceeds of rates, fees, and charges for services rendered by said hospitals, clinics, and laboratories, but excluding state appropriations to the institution. See Iowa Code 263A.1
- Household: means a claimant and the claimant's spouse if living with the claimant at any time during the base year. See Iowa Code 425.17
- Household income: means all income of the claimant and the claimant's spouse in a household and actual monetary contributions received from any other person living with the claimant during their respective twelve-month income tax accounting periods ending with or during the base year. See Iowa Code 425.17
- human organ: means all or part of a liver, pancreas, kidney, intestine, lung, or bone marrow. See Iowa Code 422.7
- hunt: is a ny pursuing, or any hunting, fishing, killing, trapping, snaring, netting, searching for or shooting at, or stalking or lying in wait for any game, animal, bird, or fish protected by the state laws or rules adopted by the commission whether or not such animal be then subsequently captured, killed, or injured. See Iowa Code 481A.1
- Illegal gas: means gas which has been produced from any well within this state in excess of the quantity permitted by any rule or order of the department. See Iowa Code 458A.2
- Illegal oil: means oil which has been produced from any well within the state in excess of the quantity permitted by any rule or order of the department. See Iowa Code 458A.2
- Illegal product: means any product derived in whole or in part from illegal oil or illegal gas. See Iowa Code 458A.2
- Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
- Import: means to bring into, or introduce into, or attempt to bring into, or attempt to introduce into, any place subject to the jurisdiction of this state. See Iowa Code 481B.1
- Income: means the sum of Iowa net income as defined in section 422. See Iowa Code 425.17
- Incomplete motor vehicle: means an assemblage consisting, at a minimum, of frame and chassis structure, power train, steering system, suspension system, and braking system to the extent that those systems are to be part of a completed motor vehicle, that requires further manufacturing operations, other than the addition of readily attachable components, such as mirrors or tire and rim assemblies, or minor finishing operations such as painting, to become a completed motor vehicle. See Iowa Code 322.2
- Incomplete motor vehicle manufacturer: means a person who manufactures an incomplete motor vehicle by assembling components none of which, taken separately, constitute a completed motor vehicle. See Iowa Code 322.2
- Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
- Indemnity fee: means a fee provided in section 459. See Iowa Code 459.102
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
- Indirect partner: means a partner in a partnership or pass-through entity where such partnership or pass-through entity itself holds an interest directly, or through another indirect partner, in a partnership or pass-through entity. See Iowa Code 422.25A
- Indirect partner: means a partner in a partnership or pass-through entity where such partnership or pass-through entity itself holds an interest directly, or through another indirect partner, in a partnership or pass-through entity. See Iowa Code 422.25A
- Initiative: includes a program, project, practice, strategy, or plan established or administered by an agency that furthers a constitutional purpose as provided in section 461. See Iowa Code 461.2
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Institution: means a school district or eligible postsecondary institution delivering the instruction in a given program as authorized by this chapter. See Iowa Code 261E.2
- Institution: shall mean the state university of Iowa. See Iowa Code 263A.1
- Institutional income: shall mean income received by an institution from sources other than the following:
a. See Iowa Code 262A.2- institutions: shall mean the state university of Iowa, the Iowa state university of science and technology, the university of northern Iowa, and any other institution of higher learning under the jurisdiction of the state board of regents which offers a college program of four years or more, including any such institution the creation of which is hereafter authorized by the general assembly or which is placed under the jurisdiction of said board. See Iowa Code 262A.2
- Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.
- Intellectual disability: means a diagnosis of intellectual disability or intellectual developmental disorder, global developmental delay, or unspecified intellectual disability or intellectual developmental disorder which diagnosis shall be made only when the onset of the person's condition was during the developmental period and based on an assessment of the person's intellectual functioning and level of adaptive skills. See Iowa Code 4.1
- Inter vivos: Transfer of property from one living person to another living person.
- Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
- Internal Revenue Code: means the Internal Revenue Code of 1954, prior to the date of its redesignation as the Internal Revenue Code of 1986 by the Tax Reform Act of 1986, or means the Internal Revenue Code of 1986 as amended and in effect on January 1, 2020. See Iowa Code 422.7
- Internet: means the federated international system that is composed of allied electronic communication networks linked by telecommunication channels, that uses standardized protocols, and that facilitates electronic communication services, including but not limited to use of the world wide web; the transmission of electronic mail or messages; the transfer of files and data or other electronic information; and the transmission of voice, image, and video. See Iowa Code 4.1
- Internet site: means a specific location on the internet that is determined by internet protocol numbers, by a domain name, or by both, including but not limited to domain names that use the designations ". See Iowa Code 4.1
- Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
- Intestate: Dying without leaving a will.
- Iowa affiliated group: means an affiliated group that has made a valid election to file an Iowa consolidated income tax return under section 422. See Iowa Code 422.7
- Issuing county: means a county that is participating in county issuance. See Iowa Code 321M.1
- Joint special assessment district: means a district defined by a county and one or more other counties or one or more cities within the county or within an adjacent county pursuant to an agreement entered into by the county and one or more other counties or cities in accordance with chapter 28E and this part with respect to public improvements which the parties to the agreement determine benefit the property located in the cities and the designated area of the counties outside of cities, which are parties to the agreement. See Iowa Code 331.485
- Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
- Judicial officer: means a supreme court justice, a judge of the court of appeals, a district judge, a district associate judge, an associate juvenile judge, an associate probate judge, or a magistrate. See Iowa Code 4.1
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Juror: A person who is on the jury.
- Karst terrain: means land having karst formations that exhibit surface and subterranean features of a type produced by the dissolution of limestone, dolomite, or other soluble rock and characterized by closed depressions, sinkholes, or caves. See Iowa Code 459.102
- Karst terrain: means the same as defined in section 459. See Iowa Code 459B.102
- Land: means land which is used or which is suitable for use for any purpose, if the land is located within an agricultural drainage well area which includes land used or suitable for use in farming. See Iowa Code 460.101
- Land: includes land that is not open to the general public. See Iowa Code 461C.2
- Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Legacy: A gift of property made by will.
- Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
- Legatee: A beneficiary of a decedent
- Legislature: means the Iowa general assembly. See Iowa Code 462B.1
- Lemon law rights period: means the term of the manufacturer's written warranty, the period ending two years after the date of the original delivery of a motor vehicle to a consumer, or the first twenty-four thousand miles of operation attributable to a consumer, whichever expires first. See Iowa Code 322G.2

- Lender: means a person whose name appears on the records of the museum as the person legally entitled to property held or owing by the museum. See Iowa Code 305B.2
- lending institution: means a creditor as defined in section 103 of the federal Truth in Lending Act, 15 U. See Iowa Code 261F.1
- lessee: means a nonresident alien, foreign business, or foreign government, or an agent, trustee, or fiduciary acting on behalf of the nonresident alien, foreign business, or foreign government, or any other trade or business which is under the lessee's common control as provided in 26 U. See Iowa Code 9I.3
- Lessee: means any consumer who leases a motor vehicle for one year or more pursuant to a written lease agreement which provides that the lessee is responsible for repairs to the motor vehicle. See Iowa Code 322G.2
- Lessee: means any consumer who leases a motor vehicle for one year or more pursuant to a written lease agreement which provides that the lessee is responsible for repairs to the motor vehicle. See Iowa Code 322G.2
- Lessor: means a person who holds the title to a motor vehicle leased to a lessee under a written lease agreement or who holds the lessor's rights under the agreement. See Iowa Code 322G.2

- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- Liability: means a debt or obligation placed with the unit for collection that is greater than one thousand dollars. See Iowa Code 272D.1
- License: includes licenses for hunting and fishing, or other recreational activity. See Iowa Code 272D.1
- Licensee: means a person to whom a license has been issued, or who is seeking the issuance of a license. See Iowa Code 272D.1
- Licensing authority: means the supreme court, or an instrumentality, agency, board, commission, department, officer, organization, or any other entity of the state, which has authority within this state to suspend or revoke a license or to deny the renewal or issuance of a license authorizing a person to engage in a business, occupation, profession, recreation, or industry. See Iowa Code 272D.1
- Lien: A claim against real or personal property in satisfaction of a debt.
- Life cycle cost: means the expected total cost of ownership during the life of a product. See Iowa Code 8A.301
- Life estate: A property interest limited in duration to the life of the individual holding the interest (life tenant).
- Line-make: means a specific series of towable recreational vehicles meeting all of the following criteria:
a. See Iowa Code 322C.2- Lineal descendant: Direct descendant of the same ancestors.
- lineal descendent: means children of the taxpayer, including legally adopted children and biological children, stepchildren, grandchildren, great-grandchildren, and any other lineal descendent of the taxpayer. See Iowa Code 422.7
- Liquid manure: means manure that meets all of the following requirements:
a. See Iowa Code 459.102- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Livestock: means the same as defined in section 717. See Iowa Code 422.7
- Livestock: includes but is not limited to an animal classified as an ostrich, rhea, or emu. See Iowa Code 4.1
- Livestock market: means any place where animals are assembled from two or more sources for public auction, private sale, or on a commission basis, which is under state or federal supervision, including a livestock sale barn or auction market, if such animals are kept for ten days or less. See Iowa Code 459.102
- Living with: refers to domicile and does not include a temporary visit. See Iowa Code 425.17
- Loan: means a deposit of property not accompanied by a transfer of title to the property. See Iowa Code 305B.2
- Loan limit: means , for any member, the maximum amount permitted to be outstanding at any one time on loans made by any such member to a development corporation, as determined herein. See Iowa Code 496B.2
- Local government: means a county, city, township, school district, or any special-purpose district or authority. See Iowa Code 480A.2
- Long-term stockpile location: means an area where a person stockpiles manure for more than six months in any two-year period. See Iowa Code 459.102
- Magistrate: means a judicial officer appointed under chapter 602, article 6, part 4. See Iowa Code 4.1
- Major water source: means a water source that is a lake, reservoir, river, or stream located within the territorial limits of the state, or any marginal river area adjacent to the state, if the water source is capable of supporting a floating vessel capable of carrying one or more persons during a total of a six-month period in one out of ten years, excluding periods of flooding, which has been identified by rules adopted by the commission. See Iowa Code 459.102
- Major water source: means the same as defined in section 459. See Iowa Code 459B.102
- Majority leader: see Floor Leaders
- Management costs: means the reasonable, direct, and fully documented costs a local government actually incurs to manage public rights-of-way. See Iowa Code 480A.2
- Management plan: means the document that states the goals and objectives of a specific protected water area which has been proposed for designation, the specific description of the area to be protected, land use agreements with property owners, the specific management programming considerations for the area, the in-depth project evaluations, analysis, justifications, and cost estimates, the proposed acquisition of fee title and conservation easements and other agreements, and the specific design and layout of facilities. See Iowa Code 462B.1
- manager: is a person who is actively involved in the operation of a commercial manure service and takes an important part in making management decisions substantially contributing to or affecting the success of the commercial manure service. See Iowa Code 459.102
- Manufacturer: means a person engaged in the business of constructing or assembling all-terrain vehicles required to be registered under this chapter and who has an established place of business for that purpose in this state. See Iowa Code 321I.1
- Manufacturer: means a person engaged in the business of manufacturing or importing new and unused vessels, or new and unused outboard motors, for the purpose of sale or trade. See Iowa Code 462A.2
- Manufacturer: means a person who manufactures and sells tobacco products. See Iowa Code 453A.42
- Manufacturer: means a person engaged in the manufacture of towable recreational vehicles. See Iowa Code 322C.2
- Manufacturer: includes a person who uses a completed motor vehicle manufactured by another person to construct a class "B" motor home as defined in section 321. See Iowa Code 322.2
- Manufacturer: means a person engaged in the business of constructing or assembling new motor vehicles or installing on previously assembled vehicle chassis special bodies or equipment which, when installed, form an integral part of the new motor vehicle, or a person engaged in the business of importing new motor vehicles into the United States for the purpose of selling or distributing the new motor vehicles to new motor vehicle dealers. See Iowa Code 322G.2
- Manufacturer-dealer agreement: means a written agreement or contract entered into between a manufacturer or distributor and a towable recreational vehicle dealer that specifies the rights and responsibilities of the parties and authorizes the dealer to sell and service new towable recreational vehicles. See Iowa Code 322C.2
- Manufacturing: means physical or chemical modification of one or more materials to produce packaging or packaging components. See Iowa Code 455D.19
- Manure: means animal excreta or other commonly associated wastes of animals, including but not limited to bedding, litter, or feed losses. See Iowa Code 459.102
- Manure: means the same as defined in section 459. See Iowa Code 459B.102
- Manure storage structure: means a formed manure storage structure or an unformed manure storage structure. See Iowa Code 459.102
- Markup: The process by which congressional committees and subcommittees debate, amend, and rewrite proposed legislation.
- Materially participated: means the same as "material participation" in section 469(h) of the Internal Revenue Code, except that section 469(h)(3) of the Internal Revenue Code shall not apply. See Iowa Code 422.7
- Measure: means an ordinance, amendment, resolution, or motion. See Iowa Code 362.2
- Measure: means an ordinance, amendment, resolution, or motion. See Iowa Code 331.101
- Member: includes any entity included in the consolidated return under section 422. See Iowa Code 422.7
- Member: means any financial institution which shall undertake to lend money to a development corporation upon its call and in accordance with the provision of section 496B. See Iowa Code 496B.2
- Metallic mineral resources: means the valuable minerals of an area containing metals such as, but not restricted to, lead, copper, zinc, and iron that are presently recoverable or may be recoverable in the future. See Iowa Code 458A.2
- Minnows: means chubs, suckers, shiners, dace, stonerollers, mud minnows, redhorse, blunt-nose, and fathead minnows. See Iowa Code 481A.1
- Minority leader: See Floor Leaders
- month: means a calendar month, and the word "year" and the abbreviation "A. See Iowa Code 4.1
- Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
- Mortgagee: The person to whom property is mortgaged and who has loaned the money.
- Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
- motion: means a council statement of policy or a council order for action to be taken, but "motion" does not require a recorded vote. See Iowa Code 362.2
- motion: means a statement of policy or an order for action to be taken. See Iowa Code 331.101
- Motor vehicle: means a self-propelled vehicle purchased or leased in this state, except as provided in section 322G. See Iowa Code 322G.2
- Motor vehicle: means a vehicle which is self-propelled, including but not limited to automobiles, cars, motor trucks, semitrailers, motorcycles, and similar vehicles regulated under chapter 321. See Iowa Code 321M.1
- Motor vehicle: means any self-propelled vehicle subject to registration under chapter 321. See Iowa Code 322.2
- Motor vehicle: means a self-propelled vehicle purchased or leased in this state, except as provided in section 322G. See Iowa Code 322G.2
- Motorboat: means any vessel propelled by an inboard, inboard-outdrive, or outboard engine, whether or not such engine is the principal source of propulsion. See Iowa Code 462A.2
- Motorcycle: means as defined in section 321. See Iowa Code 322.2
- Motorcycle: means a motor vehicle as defined in section 321. See Iowa Code 322D.1
- Municipality: means any city or county in the state. See Iowa Code 461C.2
- Mussels: means the pearly fresh water mussels, clams or naiads, and their shells. See Iowa Code 481A.1
- National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
- Net cost: means the price the franchisee actually paid for the merchandise to the franchiser less any applicable trade, volume, cash or bonus discounts. See Iowa Code 322D.1
- Net cost: means the price the dealer paid to the supplier for the equipment, less applicable discounts. See Iowa Code 322F.1
- net income: means the taxable income as properly computed for federal income tax purposes under section 63 of the Internal Revenue Code, with the following adjustments:
1. See Iowa Code 422.7- Net price: means the price listed in the franchiser's price list in effect at the time the franchise is canceled, less any applicable trade, volume or cash discounts. See Iowa Code 322D.1
- Net price: means the current price listed in the supplier's effective price list or catalog, less any applicable trade or cash discount. See Iowa Code 322F.1
- Net revenues: means gross revenues less operating expenses. See Iowa Code 331.461
- New towable recreational vehicle: means a towable recreational vehicle that has not been sold at retail. See Iowa Code 322C.2
- Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Noncancer health risk: means the potential for adverse systemic or toxic effects caused by exposure to noncarcinogenic hazardous substances expressed as the hazard quotient for a hazardous substance. See Iowa Code 455H.103
- Nonconformity: means a defect, malfunction, or condition in a motor vehicle such that the vehicle fails to conform to the warranty, but does not include a defect, malfunction, or condition that results from an accident, abuse, neglect, modification, or alteration of the motor vehicle by persons other than the manufacturer or its authorized service agent. See Iowa Code 322G.2
- Nonconformity: means a defect, malfunction, or condition in a motor vehicle such that the vehicle fails to conform to the warranty, but does not include a defect, malfunction, or condition that results from an accident, abuse, neglect, modification, or alteration of the motor vehicle by persons other than the manufacturer or its authorized service agent. - Nonresident: means a person who is not a resident of this state. See Iowa Code 321I.1

- Oath: A promise to tell the truth.

- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Obligor: means a person with a liability placed with the unit. See Iowa Code 272D.1
- Officer: means a natural person elected or appointed to a fixed term and exercising some portion of the power of a city. See Iowa Code 362.2
- Oil: means and includes crude petroleum oil and other hydrocarbons regardless of gravity which are produced at the wellhead in liquid form and the liquid hydrocarbons known as distillate or condensate recovered or extracted from gas, other than gas produced in association with oil and commonly known as casinghead gas. See Iowa Code 458A.2
- One hundred year floodplain: means the land adjacent to a major water source, if there is at least a one percent chance that the land will be inundated in any one year, according to calculations adopted by rules adopted pursuant to section 459. See Iowa Code 459.102
- One hundred year floodplain: means the same as defined in section 459. See Iowa Code 459B.102
- Open-end credit: A credit agreement (typically a credit card) that allows a customer to borrow against a preapproved credit line when purchasing goods and services. The borrower is only billed for the amount that is actually borrowed plus any interest due. (Also called a charge account or revolving credit.) Source: OCC
- Operate: means to ride in or on, other than as a passenger, use, or control the operation of an all-terrain vehicle in any manner, whether or not the all-terrain vehicle is moving. See Iowa Code 321I.1
- Operate: means to navigate or otherwise use a vessel or motorboat. See Iowa Code 462A.2
- Operator: means a person who operates or is in actual physical control of an all-terrain vehicle. See Iowa Code 321I.1
- Operator: means a person who operates or is in actual physical control of a vessel. See Iowa Code 462A.2
- Ordinance: means a city law of a general and permanent nature. See Iowa Code 362.2
- Ordinance: means a county law of a general and permanent nature. See Iowa Code 331.101
- Outdoor areas of campus: means the generally accessible outside areas of campus where students, administrators, faculty, and staff at a public institution of higher education are commonly allowed, such as grassy areas, walkways, or other similar common areas and does not include areas outside health care facilities including both stand-alone facilities and mixed-use facilities that are embedded within another facility, veterinary medicine facilities, a facility or outdoor area used by the institution's athletics program or teams, or other outdoor areas where access is restricted to a majority of the campus community. See Iowa Code 261H.1
- Outdoor power equipment: means equipment using small motors or engines, if the equipment is used principally for outside service, including but not limited to aerators, augers, blowers, brush clearers, brush cutters, chain saws, dethatchers, edgers, hedge trimmers, lawn mowers, pole saws, power rakes, snowblowers, and tillers. See Iowa Code 322F.1
- Oversight: Committee review of the activities of a Federal agency or program.
- Owner: means a person, other than a lienholder, having the property right in or title to an all-terrain vehicle. See Iowa Code 321I.1
- Owner: means a person, other than a lienholder, having the property right in or title to a motorboat or vessel. See Iowa Code 462A.2

- Partnership level audit: means an examination by the internal revenue service at the partnership level pursuant to subchapter C of title 26, subtitle F, chapter 63, of the Internal Revenue Code, as enacted by the Bipartisan Budget Act of 2015, Pub. See Iowa Code 422.25A

- Permittee: means a person who, pursuant to section 459. See Iowa Code 459.102
- Person: includes any individual, firm, corporation, partnership, joint adventure, or association, and the plural as well as the singular number. See Iowa Code 321H.2

- Persons with disabilities identification devices: means those devices issued pursuant to chapter 321L. See Iowa Code 321M.1
- persons with mental illness: include persons with psychosis, persons who are severely depressed, and persons with any type of mental disease or mental disorder, except that mental illness does not refer to intellectual disability, or to insanity, diminished responsibility, or mental incompetency as defined and used in the Iowa criminal code or in the rules of criminal procedure, Iowa court rules. See Iowa Code 4.1
- Physical or mental impairment: means any physiological disorder or condition, cosmetic disfigurement, or anatomical loss affecting one or more of the body systems or any mental or psychological disorder, including intellectual disability, organic brain syndrome, emotional or mental illness, and specific learning disabilities. See Iowa Code 422.7
- Pipeline: means a pipe, pipes, or pipelines used for the transportation or transmission of a solid, liquid, or gaseous substance, except water, within or through this state. See Iowa Code 479.2
- Pipeline: means an interstate pipe, pipes, or pipelines used for the transportation or transmission of natural gas within or through this state. See Iowa Code 479A.2
- Pipeline: means an interstate pipe or pipeline and necessary appurtenances used for the transportation or transmission of hazardous liquids. See Iowa Code 479B.2
- Pipeline company: means a person engaged in or organized for the purpose of owning, operating, or controlling pipelines for the transportation or transmission of any solid, liquid, or gaseous substance, except water, within or through this state. See Iowa Code 479.2
- Pipeline company: means a person engaged in or organized for the purpose of owning, operating, or controlling pipelines. See Iowa Code 479A.2
- Pipeline company: means a person engaged in or organized for the purpose of owning, operating, or controlling pipelines for the transportation or transmission of any hazardous liquid or underground storage facilities for the underground storage of any hazardous liquid. See Iowa Code 479B.2
- Place of business: means any place where tobacco products are sold or where tobacco products are manufactured, stored, or kept for the purpose of sale or consumption, including any vessel, vehicle, airplane, train, or vending machine; or for a business within or without the state that conducts delivery sales, any place where alternative nicotine products or vapor products are sold or where alternative nicotine products or vapor products are kept for the purpose of sale, including delivery sales. - Place of business: means a designated location where facilities are maintained for displaying, reconditioning, and repairing either new or used towable recreational vehicles. See Iowa Code 322C.2
- Place of business: means a designated location wherein proper and adequate facilities shall be maintained for displaying, reconditioning, and repairing either new or used cars. See Iowa Code 322.2
- Plaintiff: The person who files the complaint in a civil lawsuit.
- plant life: means any member of the plant kingdom, including seeds, roots, and other parts thereof. See Iowa Code 481B.1
- plat of survey: means the same as defined in section 355. See Iowa Code 331.604
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
- Pledge order: means a promise to pay out of the net revenues of a county enterprise or combined county enterprise, which is delivered to the contractors or other persons in payment of all or part of the cost of the project. See Iowa Code 331.461
- Pool: means an underground reservoir containing a common accumulation of oil or gas or both; each zone of a structure which is completely separated from any other zone in the same structure is a pool, as that term is used in this chapter. See Iowa Code 458A.2
- Postsecondary educational expenses: means any of the expenses that are included as part of a student's cost of attendance as defined in Tit. See Iowa Code 261F.1
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Prearranged ride: means the provision of transportation by a transportation network company driver to a transportation network company rider. See Iowa Code 321N.1
- Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
- Preferred lender arrangement: means an arrangement or agreement between a lender and a covered institution under which the lender provides or otherwise issues educational loans to borrowers and which relates to the covered institution recommending, promoting, or endorsing the educational loan product of the lender. See Iowa Code 261F.1
- Preferred lender list: means a list of at least three recommended or suggested, unaffiliated lending institutions that a covered institution makes available for use, in print or any other medium or form, by borrowers, prospective borrowers, or others. See Iowa Code 261F.1
- Presence: means a location in Iowa at which a student participates in any structured activity related to a school's distance education course of instruction, with the exception of proctored examinations. See Iowa Code 261B.2
- Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
- Printing: means , as used in chapter 7A and this subchapter, the reproduction of an image from a printing surface made generally by a contact impression that causes a transfer of ink, the reproduction of an impression by a photographic process, or the reproduction of an image by electronic means and shall include binding and may include material, processes, or operations necessary to produce a finished printed product, but shall not include binding, rebinding or repairs of books, journals, pamphlets, magazines and literary articles by any library of the state or any of its offices, departments, boards, and commissions held as a part of their library collection. See Iowa Code 8A.301
- Private educational loan: means a private loan provided by a lender that is not made, insured, or guaranteed under Tit. See Iowa Code 261F.1
- Private instruction: means independent private instruction as defined in section 299A. See Iowa Code 422.12
- Privately owned lake: means any lake, located within the boundaries of this state and not subject to federal control covering navigation owned by an individual, group of individuals, or a nonprofit corporation and which is not open to the use of the general public but is used exclusively by the owners and their personal guests. See Iowa Code 462A.2
- Privilege: means the protections provided in regard to an environmental audit report as provided in this chapter. See Iowa Code 455K.2
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Probate: Proving a will
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Product: means any commodity made from oil or gas and includes refined crude oil, crude tops, topped crude, processed crude, processed crude petroleum, residue from crude petroleum, cracking stock, uncracked fuel oil, fuel oil, treated crude oil, residuum, gas oil, casinghead gasoline, natural-gas gasoline, kerosene, benzine, wash oil, waste oil, blended gasoline, lubricating oil, blends or mixtures of oil with one or more liquid products or by-products derived from oil or gas, and blends or mixtures of two or more liquid products or by-products derived from oil or gas, whether hereinabove enumerated or not. See Iowa Code 458A.2
- Professional engineer: means a person engaged in the practice of engineering as defined in section 542B. See Iowa Code 459.102
- Program: means an informal dispute settlement procedure established by a manufacturer which mediates and arbitrates motor vehicle warranty disputes arising in this state. See Iowa Code 322G.2

- Project: means the acquisition, construction, reconstruction, extending, remodeling, improving, repairing, and equipping of all or part of a county enterprise or combined county enterprise within or without the boundaries of the county. See Iowa Code 331.461
- Project: shall mean the acquisition by gift, purchase, lease, or construction of buildings and facilities which are deemed necessary by the board for the proper performance of the instructional, research and service functions of the institutions, and additions to buildings and facilities, the reconstruction, completion, equipment, improvement, repair or remodeling of buildings and facilities, including the demolition of existing buildings and facilities which are to be replaced, the acquisition of air rights and the construction of projects thereon, and the acquisition of property of every kind and description, whether real, personal or mixed, for buildings and facilities by gift, purchase, lease, condemnation or otherwise and the improvement of the same, or any combination of the foregoing. - Project: shall mean the acquisition by gift, purchase, lease, or construction of buildings and facilities and additions to such buildings and facilities, the reconstruction, completion, equipment, improvement, repair, or remodeling of buildings and facilities, including the demolition of existing buildings and facilities which are to be replaced, and the acquisition of property of every kind and description, whether real, personal or mixed, for buildings and facilities by gift, purchase, lease, condemnation, or otherwise and the improvement of the same or any combination of the foregoing. - Property: means a tangible object, animate or inanimate, under a museum's care which has intrinsic historic, artistic, scientific, or cultural value. See Iowa Code 305B.2
- property: includes personal and real property. See Iowa Code 4.1
- property owner: means the contract purchaser if there is one of record, otherwise the record holder of legal title. See Iowa Code 364.12
- Property taxes due: means property taxes including any special assessments, but exclusive of delinquent interest and charges for services, due on a claimant's homestead in this state, but includes only property taxes for which the claimant is liable and which will actually be paid by the claimant. See Iowa Code 425.17
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Protected groundwater source: means a saturated bed, formation, or group of formations which has a hydraulic conductivity of at least forty-four-hundredths meters per day and a total dissolved solids concentration of less than two thousand five hundred milligrams per liter. See Iowa Code 455H.103
- Protected party: means any of the following:

- Public defender: Represent defendants who can't afford an attorney in criminal matters.

- Public right-of-way: means the area on, below, or above a public roadway, highway, street, bridge, cartway, bicycle lane, or public sidewalk in which the local government has an interest, including other dedicated rights-of-way for travel purposes and utility easements. See Iowa Code 480A.2
- Public thoroughfare: means a road, street, or bridge that is constructed or maintained by the state or a political subdivision. See Iowa Code 459.102
- Public use area: means any of the following:

- Qualified education loan repayments: means amounts paid as principal or interest on any qualified education loan of the beneficiary or a sibling of the beneficiary. See Iowa Code 422.7
- Qualified higher education expenses: means the same as defined in section 529(e)(3) of the Internal Revenue Code. See Iowa Code 422.7
- Qualified stockpile cover: means a barrier impermeable to precipitation that is used to protect a stockpile from precipitation. See Iowa Code 459.102
- Qualified stockpile structure: means any of the following:

- Railroad right-of-way: means the full width of property owned, leased, or subject to easement for railroad purposes and is not limited to those areas on which tracks are located. See Iowa Code 321I.1
- Railroad worker transportation company: means a person, other than a railroad corporation, organized for the purpose of or engaged in the business of transporting, for hire, railroad workers to or from their places of employment or in the course of their employment in motor vehicles designed to carry seven or more persons but fewer than sixteen persons including the driver. See Iowa Code 327F.39
- Rates: means rates, fees, tolls, rentals, and charges for the use of or service provided by a county enterprise or combined county enterprise. See Iowa Code 331.461
- Rates: means the same as defined in section 384. See Iowa Code 476.1A
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.

- Recreational purpose: includes the activity of accompanying another person who is engaging in such activities. See Iowa Code 461C.2
- register: include any mode of permanent recording including but not limited to, card files, microfilm or microfiche, electronic records and the like. See Iowa Code 331.101
- Registered voter: means the same as it is defined in section 39. See Iowa Code 362.2
- Regulatory agency: means an agency which issues licenses or permits required for the construction, operation or maintenance of a facility pursuant to statutes or rules in effect on the date on which an application for a certificate is accepted by the utilities board. See Iowa Code 476A.1
- Relative: means a person that satisfies one or more of the following conditions:
(a) The individual is related to the taxpayer by consanguinity or affinity within the second degree as determined by common law. See Iowa Code 422.7- Release: means any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping, or disposing into the environment of a hazardous substance, including the abandonment or discarding of barrels, containers, and other closed receptacles containing any hazardous substance, but excludes all of the following:
a. See Iowa Code 455H.103- Religious institution: means a building in which an active congregation is devoted to worship. See Iowa Code 459.102
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Remand: When an appellate court sends a case back to a lower court for further proceedings.
- remote control or internet hunting: means use of a computer or other electronic device, equipment, or software to remotely control the aiming or discharge of a firearm or other weapon, allowing a person who is not physically present to take a wild animal, a game bird or ungulate kept on a hunting preserve under chapter 484B, or a preserve whitetail kept on a hunting preserve under chapter 484C. See Iowa Code 481A.125A
- Remote sale: includes the delivery of the vehicle to the residence of the buyer or another agreed-to location, if requested by the buyer. See Iowa Code 322.2
- Rent constituting property taxes paid: means twenty-three percent of the gross rent actually paid in cash or its equivalent during the base year by the claimant or the claimant's household solely for the right of occupancy of their homestead in the base year, and which rent constitutes the basis, in the succeeding year, of a claim for reimbursement under this subchapter by the claimant. See Iowa Code 425.17
- Replacement motor vehicle: means a motor vehicle which is identical or reasonably equivalent to the motor vehicle to be replaced, and as the motor vehicle to be replaced would have existed without the nonconformity at the time of original acquisition. See Iowa Code 322G.2

- Reptile: means a member of the class Reptilia. See Iowa Code 481A.1
- Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
- research college: means an accredited public or private college or university, including but not limited to a university under the control of the state board of regents as provided in chapter 262, or a community college under the jurisdiction of a board of directors for a merged area as provided in chapter 260C, if the college or university performs research or experimental activities regarding animal agriculture or agronomy. See Iowa Code 459.318
- Reserve peace officer: means a reserve peace officer as defined in section 80D. See Iowa Code 422.12
- Resident: means as defined in section 483A. See Iowa Code 321I.1
- Resident partner: means any of the following:

- Response action: includes , but is not limited to, investigation, excavation, removal, disposal, cleansing of groundwaters or surface waters, natural biodegradation, institutional controls, technological controls, or site management practices. See Iowa Code 455H.103
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- Restricted spray irrigation equipment: means spray irrigation equipment which disperses manure through an orifice at a maximum pressure of eighty pounds per square inch or more. See Iowa Code 459.102
- Retail installment transaction: means any sale evidenced by a retail installment contract between a retail buyer and a retail seller wherein the retail buyer buys a motor vehicle from a retail seller at a time price payable in one or more installments. See Iowa Code 322.2
- Retailer: means any person engaged in the business of selling tobacco, tobacco products, alternative nicotine products, or vapor products to ultimate consumers. See Iowa Code 453A.42
- Retired farmer: means an individual who is disabled or who is fifty-five years of age or older and who no longer materially participates in a farming business when an exclusion and deduction is claimed under this subsection. See Iowa Code 422.7
- Revenue bond: means a negotiable bond issued by a county and payable from the net revenues of a county enterprise or combined county enterprise. See Iowa Code 331.461
- Revenue sharing arrangement: means an arrangement between a covered institution and a lender in which the lender provides or issues educational loans to persons attending the institution or on behalf of persons attending the institution and the covered institution recommends the lender or the educational loan products of the lender, in exchange for which the lender pays a fee or provides other material benefits, including revenue or profit sharing, to the institution or officers, employees, or agents of the institution. See Iowa Code 261F.1
- Reviewed year: means the taxable year of a partnership that is subject to a partnership level audit from which final federal partnership adjustments arise, or otherwise means the taxable year of the partnership or pass-through entity that is the subject of a state partnership audit. See Iowa Code 422.25A

- rider: means an individual or group of individuals who uses a transportation network company's digital network to connect with a transportation network company driver to request a prearranged ride for the individual or group of individuals, and who receives the prearranged ride in the driver's personal vehicle between locations chosen by the individual or group of individuals. See Iowa Code 321N.1
- Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan. There is no fee to the borrower, who receives a full refund of all fees paid. The right of rescission is guaranteed by the Truth in Lending Act (TILA). Source: OCC
- Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
- road: include public bridges, and may be held equivalent to the words "county way" "county road" "common road" and "state road". See Iowa Code 4.1
- Roadway: means that portion of a highway improved, designed, or ordinarily used for vehicular travel. See Iowa Code 321I.1
- Rule: includes "regulation". See Iowa Code 4.1
- Rural county services: means the services which are primarily intended to benefit those persons residing in the county outside of incorporated city areas, including secondary road services, but excluding services financed by other statutory funds. See Iowa Code 331.421
- Safety standards: means applicable regulations promulgated by the United States occupational safety and health administration and by the labor commissioner under chapter 88. See Iowa Code 476.1A
- Sale: means any transfer, exchange, or barter, in any manner or by any means whatsoever, for a consideration, and includes and means all sales made by any person. See Iowa Code 453A.42
- Sales finance company: means a person engaged, in whole or in part, in the business of purchasing retail installment contracts from one or more retail sellers. See Iowa Code 322.2
- School: means an agency of the state or political subdivision of the state, individual, partnership, company, firm, society, trust, association, corporation, or any combination which meets any of the following criteria:
a. See Iowa Code 261B.2- School board: means the board of directors of a school district or a collaboration of boards of directors of school districts. See Iowa Code 261E.2
- seal: shall include an impression upon the paper alone, or upon wax, a wafer affixed to the paper, or an official stamp of a notarial officer as provided in chapter 9B. See Iowa Code 4.1
- Secondary road services: means the services related to secondary road construction and maintenance, excluding debt service and services financed by other statutory funds. See Iowa Code 331.421
- Sell: includes barter, exchange, and other methods of dealing. See Iowa Code 322C.2
- seller: means a person who sells a motor vehicle to a retail buyer. See Iowa Code 322.2
- Selling: includes bartering, exchanging, or otherwise dealing in. See Iowa Code 321H.2
- Selling: includes bartering, exchanging, delivering, or otherwise dealing in. See Iowa Code 322.2
- Separated location: means a location or object from which a separation distance is required under section 459. See Iowa Code 459.207
- Service of process: The service of writs or summonses to the appropriate party.
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- Sheriff: means the county sheriff or a deputy sheriff designated by the sheriff. See Iowa Code 331.101
- Sibling: means the same as defined in section 12D. See Iowa Code 422.7
- Signature: includes an electronic signature as defined in section 554D. See Iowa Code 4.1
- Small animal feeding operation: means an animal feeding operation which has an animal unit capacity of five hundred or fewer animal units. See Iowa Code 459.102
- Small business: includes an employee-owned business which has been an employee-owned business for less than three years or which meets the conditions of subparagraph division (a), subparagraph subdivisions (i) through (iii). See Iowa Code 422.7
- Snow covered ground: means soil covered by one inch or more of snow or soil covered by one-half inch or more of ice. See Iowa Code 459.102
- Snowmobile: means the same as defined in section 321G. See Iowa Code 321I.1
- Snowmobile: means the same as defined in section 321G. See Iowa Code 322D.1
- Spawn: means any of the eggs of any fish, amphibian, or mussel. See Iowa Code 481A.1
- Special assessment: means an unpaid special assessment certified pursuant to chapter 384, subchapter IV. See Iowa Code 425.17
- Special equipment: means equipment installed on a motor truck which, in combination with the motor truck on which the equipment is installed, constitutes a self-contained unit configured for a specific purpose. See Iowa Code 322.2
- Species: includes any subspecies of fish, plant life, or wildlife and any other group of fish, plants, or wildlife of the same species or smaller taxa in common spatial arrangement that interbreed or cross-pollinate when mature. See Iowa Code 481B.1
- Spray irrigation equipment: means mechanical equipment used for the aerial application of manure, if the equipment receives manure from a manure storage structure during application via a pipe or hose connected to the structure, and includes a type of equipment customarily used for the aerial application of water to aid the growing of general farm crops. See Iowa Code 459.102
- state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
- State agency: means a board, department, commission or authority of or acting on behalf of the state having the power to enter into contracts with or without the approval of the executive council to acquire property in its own name or in the name of the state. See Iowa Code 7D.34
- state agency: means a unit of state government, which is an authority, board, commission, committee, council, department, or independent agency as defined in section 7E. See Iowa Code 8A.101
- State board: means the state board of education. See Iowa Code 261E.2
- State law: includes the Constitution of the State of Iowa and state statutes. See Iowa Code 331.101
- State partnership audit: means an examination by the director at the partnership or pass-through entity level which results in adjustments to partnership or pass-through entity related items or reallocations of income, gains, losses, expenses, credits, and other attributes among such partners for the reviewed year. See Iowa Code 422.25A

- State plan: means a long-range comprehensive document that states the goals and objectives of the protected water area system, establishes the procedure and criteria for prospective protected water area designation, provides the format for prospective area analysis, establishes a priority system for prospective area study, recommends potential areas for inclusion into the system, institutes interagency coordination, and outlines general administrative and management needs to develop and administer this system. See Iowa Code 462B.1
- Statute: A law passed by a legislature.
- Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
- Stockpile: means dry manure originating from a confinement feeding operation that is stored at a particular location outside a manure storage structure. See Iowa Code 459.102
- Stockpile: means to store dry bedded manure outside of a dry bedded manure confinement feeding operation building or a dry bedded manure storage structure. See Iowa Code 459B.102
- Stockpile dry manure: means to create or add to a stockpile. See Iowa Code 459.102
- Storage: means any keeping or retention of tobacco products for use or consumption in this state. See Iowa Code 453A.42
- Student: means a person who enrolls in or seeks to enroll in a course of instruction offered or conducted by a school. See Iowa Code 261B.2
- Student: includes an individual attending an accredited nonpublic school or the Iowa school for the deaf for purposes of sections 261E. See Iowa Code 261E.2
- Student: means an individual who is enrolled on a full-time or part-time basis at a public institution of higher education. See Iowa Code 261H.1
- Student fees and charges: shall mean all tuitions, fees, and charges for general or special purposes levied against and collected from students attending the institutions except rates, fees, rentals, or charges imposed and collected under any of the following provisions:
a. See Iowa Code 262A.2- Student organization: means a group officially recognized at or officially registered by a public institution of higher education, or a group seeking such official recognition or official registration, comprised of students who are admitted and in attendance at the public institution of higher education, and who receive, or are seeking to receive, student organization benefits or privileges through the public institution of higher education. - Subpoena: A command to a witness to appear and give testimony.
- Subpoena duces tecum: A command to a witness to produce documents.
- Substantially detrimental: means that, by a preponderance of the evidence, the market share of the franchiser's motor vehicles in the community will be significantly reduced in comparison to the franchiser's historical market share in the community. See Iowa Code 322A.1
- Substantially impair: means to render the motor vehicle unfit, unreliable, or unsafe for warranted or ordinary use, or to significantly diminish the value of the motor vehicle. See Iowa Code 322G.2

- Supervisor: means a member of the board of supervisors. See Iowa Code 331.101
- Supplemental appropriation: Budget authority provided in an appropriations act in addition to regular or continuing appropriations already provided. Supplemental appropriations generally are made to cover emergencies, such as disaster relief, or other needs deemed too urgent to be postponed until the enactment of next year's regular appropriations act.
- Supplier: means a person engaged in the manufacture of towable recreational vehicle parts, accessories, or components. See Iowa Code 322C.2
- Supplier: means the manufacturer, wholesaler, or distributor of equipment sold by a dealer. See Iowa Code 322F.1
- Surface water: means water occurring on the surface of the ground. See Iowa Code 460.101
- Surface water drain tile intake: means an opening to a drain tile which allows surface water to enter the drain tile without filtration through the soil profile. See Iowa Code 459.102
- Surface water intake: means an artificial opening to a drain tile line which drains into an agricultural drainage well, if the artificial opening allows surface water to enter the drain tile line without filtration through the soil profile. See Iowa Code 460.101
- Swine farrow-to-finish operation: means a confinement feeding operation in which porcine animals are produced and in which a primary portion of the phases of the production cycle are conducted at one confinement feeding operation. See Iowa Code 459.102
- Tenancy in common: A type of property ownership in which two or more individuals have an undivided interest in property. At the death of one tenant in common, his (her) fractional percentage of ownership in the property passes to the decedent
- Termination or noncontinuance: includes a reduction of the geographic area of a community. See Iowa Code 322A.1
- Testator: A male person who leaves a will at death.
- Testify: Answer questions in court.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Textbooks: includes books or materials used for extracurricular activities including sporting events, musical or dramatic events, speech activities, driver's education, or programs of a similar nature. See Iowa Code 422.12
- Threatened species: means any species which is likely to become an endangered species within the foreseeable future throughout all or a significant portion of its range. See Iowa Code 481B.1
- Tiered partner: means any partner that is a partnership or pass-through entity. See Iowa Code 422.25A

- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
- Totally disabled: means the inability to engage in any substantial gainful employment by reason of any medically determinable physical or mental impairment which can be expected to result in death or which has lasted or is reasonably expected to last for a continuous period of not less than twelve months. See Iowa Code 425.17
- Towable recreational vehicle: includes a travel trailer, toy-hauler travel trailer, fifth-wheel travel trailer, toy-hauler fifth-wheel travel trailer, folding camping trailer, truck camper, and park model recreational vehicle. See Iowa Code 322C.2
- Toy-hauler fifth-wheel travel trailer: means a fifth-wheel travel trailer equipped with a back wall capable of being lowered to form a ramp for loading and unloading a specialized rear compartment that can then be resecured for travel. See Iowa Code 322C.2

- Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
- Transient consumer: means a consumer who is temporarily traveling through a towable recreational vehicle dealer's community. See Iowa Code 322C.2
- Transmission lines: means electric lines and associated facilities operating at thirty-four thousand five hundred volts or higher voltage, and substations, transformers, and associated facilities operated at thirty-four thousand five hundred or more volts on the low voltage side. See Iowa Code 437.1
- transportation: is a ll carrying or moving or causing to be carried or moved. See Iowa Code 481A.1
- Travel trailer: includes a toy-hauler travel trailer. See Iowa Code 322C.2
- Treasurer: means the county treasurer or a deputy treasurer or employee designated by the county treasurer. See Iowa Code 331.101
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Trial jury: A group of citizens who hear the evidence presented by both sides at trial and determine the facts in dispute. Federal criminal juries consist of 12 persons. Federal civil juries consist of six persons.
- Truck camper: means a vehicle designed to be placed in the bed of a pickup truck to provide temporary living quarters for recreational, camping, or travel use. See Iowa Code 322C.2
- Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
- Trust fund: means the natural resources and outdoor recreation trust fund created in section 461. See Iowa Code 461.2
- Trust fund moneys: means moneys originating from the natural resources and outdoor recreation trust fund. See Iowa Code 461.2
- Trustee: A person or institution holding and administering property in trust.

- Tuition: includes those expenses which relate to extracurricular activities including sporting events, musical or dramatic events, speech activities, driver's education, or programs of a similar nature. See Iowa Code 422.12
- Turtle: means any member of the order Testudines. See Iowa Code 481A.1
- Underground storage: means storage of gas in a subsurface stratum or formation of the earth. See Iowa Code 479.2
- Underground storage: means the storage of natural gas in a subsurface stratum or formation of the earth by a pipeline company. See Iowa Code 479A.2

- undertaking: means a promise or security in any form. See Iowa Code 4.1
- Unformed manure storage structure: means a covered or uncovered impoundment used to store manure, other than a formed manure storage structure, which includes an anaerobic lagoon, aerobic structure, or earthen manure storage basin. See Iowa Code 459.102
- Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
- Unit: means the centralized collection unit of the department of revenue. See Iowa Code 272D.1

- Use: means to operate, navigate, or employ a vessel. See Iowa Code 462A.2
- Use: means the exercise of any right or power incidental to the ownership of tobacco products. See Iowa Code 453A.42
- Used towable recreational vehicle: means a towable recreational vehicle which has been sold at retail and previously registered in this or any other state. See Iowa Code 322C.2
- User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.

- utility equipment: includes equipment associated with earthmoving, industrial material handling, mining, forestry, highway construction or maintenance, and landscaping. See Iowa Code 322F.1
- Vehicle: means any vehicle as defined in chapter 321. See Iowa Code 321H.2
- Vehicle subject to registration: means any vehicle that is of a type required to be registered under chapter 321 when operated on a public highway, including but not limited to a vehicle that is inoperable, salvage, or rebuilt. See Iowa Code 321H.2
- Venue: The geographical location in which a case is tried.
- Verdict: The decision of a petit jury or a judge.
- Vessel: means every description of watercraft, other than a seaplane, used or capable of being used as a means of transportation on water or ice. See Iowa Code 462A.2
- veteran: means a veteran as defined in section 35. See Iowa Code 331.608
- Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
- Volunteer fire fighter: means an individual that meets both of the following requirements:
(1) The individual is an active member of an organized volunteer fire department in this state or is performing services as a volunteer fire fighter for a municipality, township, or benefited fire district at the request of the chief or other person in command of the fire department of the municipality, township, or benefited fire district, or of any other officer of the municipality, township, or benefited fire district having authority to demand such service. See Iowa Code 422.12- Warrantor: means a person, including a manufacturer, distributor, or supplier, that provides a written warranty to a consumer in connection with a new towable recreational vehicle or any part, accessory, or component of a new towable recreational vehicle. See Iowa Code 322C.2
- Warranty: means any written warranty issued by the manufacturer; or any affirmation of fact or promise made by the manufacturer, excluding statements made by the dealer, in connection with the sale or lease of a motor vehicle to a consumer, which relates to the nature of the material or workmanship and affirms or promises that the material or workmanship is free of defects or will meet a specified level of performance. See Iowa Code 322G.2
- Warranty: means any written warranty issued by the manufacturer; or any affirmation of fact or promise made by the manufacturer, excluding statements made by the dealer, in connection with the sale or lease of a motor vehicle to a consumer, which relates to the nature of the material or workmanship and affirms or promises that the material or workmanship is free of defects or will meet a specified level of performance. See Iowa Code 322G.2
- Waste: means and includes all of the following:
a. See Iowa Code 458A.2- Water area: means a river, lake, wetland, or other body of water and adjacent lands where the use of those lands affects the integrity of the water resource. See Iowa Code 462B.1
- Water of the state: means the same as defined in section 455B. See Iowa Code 459.102
- Water source: means a lake, river, reservoir, creek, stream, ditch, or other body of water or channel having definite banks and a bed with water flow, except lakes or ponds without outlet to which only one landowner is riparian. See Iowa Code 459.102

- Water-related equipment: means a motor vehicle, boat, watercraft, dock, boat lift, raft, vessel, trailer, tool, implement, device, or any other associated equipment or container, including but not limited to portable bait containers, live wells, ballast tanks, bilge areas, and water-hauling equipment that is capable of containing or transporting aquatic invasive species, aquatic plants, or water. See Iowa Code 456A.37
- Watercraft: means any vessel which through the buoyant force of water floats upon the water and is capable of carrying one or more persons. See Iowa Code 462A.2
- week: means seven consecutive days. See Iowa Code 4.1
- Well: means any hole drilled to determine stratigraphic sequence, mineralization, or for the discovery of oil or gas. See Iowa Code 458A.2
- Wetlands: means an area of two or more acres in a natural condition that is mostly under water or waterlogged during the spring growing season and is characterized by vegetation of hydric soils. See Iowa Code 456B.1
- Whitetail: means an animal belonging to the Cervidae family and classified as part of the Virginianus species of the Odocoileus genus, commonly referred to as whitetail. See Iowa Code 481A.1
- wholesaler: means a person, resident or nonresident, who in whole or part, sells or distributes motor vehicles to motor vehicle dealers, or who maintains distributor representatives. See Iowa Code 322.2
- Wild animal: means a wild mammal, bird, fish, amphibian, reptile, or other wildlife found in this state, whether game or nongame, migratory or nonmigratory, the ownership and title to which is claimed by this state. See Iowa Code 481A.1
- Wild mammal: means a member of the class Mammalia. See Iowa Code 481A.1
- Withdrawal of a certificate of noncompliance: means a document provided by the unit certifying that the certificate of noncompliance is withdrawn and that the licensing authority may proceed with issuance, reinstatement, or renewal of the person's license. See Iowa Code 272D.1
- withholding agent: means any individual, fiduciary, estate, trust, corporation, partnership or association in whatever capacity acting and including all officers and employees of the state of Iowa, or any municipal corporation of the state of Iowa and of any school district or school board of the state, or of any political subdivision of the state of Iowa, or any tax-supported unit of government that is obligated to pay or has control of paying or does pay to any resident or nonresident of the state of Iowa or the resident's or nonresident's agent any wages that are subject to the Iowa income tax in the hands of such resident or nonresident, or any of the above-designated entities making payment or having control of making such payment of any taxable Iowa income to any nonresident. See Iowa Code 422.16
- Worker: means an individual employed for any period in work for which the individual is compensated, whether full-time or part-time. See Iowa Code 327F.39
- Writ: A formal written command, issued from the court, requiring the performance of a specific act.
- Writ of certiorari: An order issued by the Supreme Court directing the lower court to transmit records for a case for which it will hear on appeal.
- year: means twelve consecutive months. See Iowa Code 4.1
